You can have an "engagement party" before comming to the USA on a fiancee visa, however depending on the laws of foreign country a "Wedding Ceremony" can be considered to be legally binding and if this is the case US recognizes this as being married, and using a K-1 while already married is misrepresentation and can come back to bite you later on.

My fiancé and I are planning to get married this year. He filed for my K-1 visa in December, and as soon as my visa is granted, we will have our wedding. Let's say I have my K-1 visa approved, and I receive it with no setbacks, no problems.

If I get legally married in my country, and then enter the US within the same week, to get legally married where he lives, using the K-1 visa I would already have, am I breaking the law?

My wedding abroad would still not be registered in any official agencies, my marriage certificate would not yet exist, nor would my documents have been changed to my new name. I would still be single, according to my records in the system.

If you have educated input on this, please reply.

Legally married is legally married.

A K-1 is for UN-MARRIED people, if legally married before using it to com to the USA, then you are NO LONGER UN-MARRIED. You WILL be starting over this time with filing an I-130 for a spouse visa.

USCIS tends to not be critical about passport photo.

In our case my wife's photo was 1.5" x 2" and was not an issue.

Get correct photos later for the visa interview, the consulate can be more fussy.

Since then USCIS has simplified the form to just a single page, only one each needed, one from Petitioner, One from benificiary.

There is nothing that the Guangzhou consulate like better to do than to hand out denials like candy to K-1 cases, especially for "Non-Bonafide relationship" Front-loading the petition can mean the difference between Pink, and White at the interview.

If USCIS closed second petition not Revoked it, then I see no reason for a third try. Also if same person I don't think a waiver would be needed either, IMBRA, ahs to do with petitions for several different people over a period of time.

If it were me, I would forget the K-1, go see my fiancee, marry, and then apply for a CR-1 spouse visa, much less cost in fees (~ $800, vs ~1800), and probably a better chance of getting the visa. Also wont be dealing with USCIS to adjust status, CR-1 gets green-card upon arrival to the USA.

Filing I-485, is NOT for becoming a US Citizen, it is for adjusting status from NON-Immigrant to Immigrant, A Green-card holder, or Lawful Permanent Resident.

As for travel visa, can always apply for a B-2 visa after returning home, however being married to a US citizen poses an immigrations intent which needs to be proven otherwise.

If you are a naturalized citizen, then this is a number that is on citizenship certificate. I beleive it is the A# you had before naturalization.

It isn't asking for it. Just write N/A if you were born in the USA. You provide the certificate number only if you check the naturalization box. It's a confusing section.



OP's profile says "Naturilization Approved" as status, makes me believe a naturalized citizen.

Need submit evidence of having actually met in person, Copies of boarding passes, hotel receipts, restaurant receipts. Need evidence of dates and places. This evidence can be up to 2 years old.

Any evidence older that 2 years old can be added to show a long term ongoing retationship.

Photos wont cut it.

The problem is that the consulate that issued the K-1 ultimately handles the K-2 case, they probably will not ship the case to the consulate in different country as follow to join.

You may want to call DOS Visa services in the USA and ask, they may know if can send the follow to join K-2 case to a consulate in different country than handled the K-1. USCIS does NOT issue or handle visas, DOS does. (202) 663-1225

As the other post said, use K-1, marry, then immediately file an I-130 for a CR-2 visa for step child, this may actually save you some $$ avoiding having to adjust status from a K-2 to get green-card, the CR-2 gets card upon entry to the USA, can then get SSN immediately too, which may help enroll in school.

Just the facts.

1) In my case it was like, Met online <date>, Visited in Country <Date>, Engaged <Date>... It really does not need to be a biography, just the relevant facts is all.

2) You could mention that if you like, shows relationship with family

3) I named the site I met my wife on.

4) Just name them, the site I used responded to my email, they too were not considered IMB

5) "NONE" This number would later for your fiancee when adjusting status would be the A# assigned when I-129F is approved.

Having a flag, or even a denied entry to the USA will not affect processing, or approval of a visa. What would cause issues would be accumulated overstays exceeding 180 days.

Nope, prior Non immigrant visa denials and cancellations will not affect a K1 petition unless the prior visa denials had to do with inadmissabilities that would get a K1 also denied. If prior denials had to do with suspected immigrant intent and no evidence showing no intent, then NO it would not cause a problem for K1.

K1 has immigrant intent so is handled by immigrant visa unit, not Non immigrant unit.

That is the correct answer, 6 months, or if something like passport or medical expiration is sooner then the visa is shortened to match.

Thanks so much for all of the replies.
So, maybe to help any other people out there, we called the Dr (in Sao Paulo) responsible for the medical exam for Brazil. He said that Hep B, MMR, Varicella and Tetanus/Diptheria is definitely required. He did not say anything about the others...... ???
However, we do have an answer. I also emailed the Consulate in Rio and will post their response for anyone concerned.

What is required is determined by age and the CDC in the USA.

A K-Visa is a NON-Immigrant visa, like any other non-immigrant visa does not require vaccinations to be done to get the visa. HOWEVER later when adjusting status from NON-Immigrant to IMMIGRANT after marriage, the vaccinations WILL be required.

If doing vaccinations for adjustment of status later, will need to get an I-693 vaccination record done and attached to the adjustment of status paperwork.

Vaccinations is a requirement of immigration.

That box is not a signature box, you can type your name in that box and yes you still fill in those lines.

I would fill the entire form on computer, print out, and sign it using blue ink in the spot where it says Signature of applicant.

"N/A" if it does not apply.

In your case the answer is N/A because a natural born citizen would not have an A#, it does not apply in the case of a natural born citizen.

Thanks all for responding....wonder why USCIS added in a A# when they responded to my congressman that they are still reviewing my petition. Maybe I have a NOA2 and it's a secret, sshhhhhhhhhhhhhhhhhhhhh!

I would suspect, USCIS assignes the number very shortly after receiving the petition, to keep track of the person internal, and the first you the petitioner normally see the number is on the NOA-2.

Does anyone know if this is the case for Latin based alphabets?

I understand that chinese characters are very different. But the Croatian alphabet is very close to the Roman alphabet. I'm just wondering because names such as Jose vs. José or Francois vs. François or Joao vs. João.

I could've sworn I've seen a friend's whose driver license says João instead of Joao. But I'm not entirely sure. I should find their email lol. His would simply be Sr?an vs Srdan/Srdjan.

Seems like a trivial question, but it's important to him...so I'm trying to find him a correct answer.

Driver's licenses are issued by the individual states, so one state may, and another state may not do this.
