She has actually already obtained her police clearances from Dubai from the time that she lived there before.

They are valid only 1 year, so may be out of date by time of visa interview, but again this will not matter.

Just letting you know ahead of time, from time to time I see panicked posts about not being able to get a police cert from Dubai.

Right now she is living in the Philippines with her family and son. She is considering going back to her old job in Dubai. We have not filed the K-1 yet, but I am basically just holding off until I get some advice. If she can go back to Manila when her interview comes up with her son, and it won't cause any problems with her visa approval then that would be best, but I am not familiar with the rules.

Note about Dubai, police certs are only available if actually residing there, cannot get them when not and back in Philippines, so if interviewed in PI then forget about the police certs, and they consulate will not request them because they cannot be got.

Have you filed I-129F yet? What did you indicate as residency address in part 2 of the form, I would use a Philippines address, as residency to ensure K-1 and K-2 interviews happen in came consulate to avoid any confusions.

Thanks for the link YuandDan :thumbs: Do people in the military need to submit additional documents, not included in the list? Would anyone have a knowledge what happens if they are in classified, and superiors will not extend a certificate of employment? This may not be our case, but fiance hasn't talked to the higher ups yet (frankly, i dont even understand who is considered as classified) but he mentioned that there is a possibility that no certificates of such nature may be issued to them. Are there other supporting documents that we may submit in lieu of the above?

I'll be so thankful to other military fiancees who may share experiences and advise. :help:

A letter of employment is only one thing that is used with the I-134 needed at interview time to establish ongoing income, it is NOT a requirement.

Not sure if military issues anything as to how long an enlistment period will last.

Keep in mind it can take 4-5 months to get an work permit after fiancee arrives in the USA, so will continue to be unemployed for some time.

If employment shortly after arrival in the USA is a concern, then the way to go is marry first and apply for a spouse CR-1 visa, this visa gets green-card upon arrival, and can hit the ground running taking a job shortly after arriving in the USA.

It will not affect the processing of the petition.

However at interview it depends on what the interviewing officer feels, for example if you are the type that jumps from job to job, this may make them question your income stability. It can also depend on what you mean by "job" for example a contract IT worker may work at 6-9 month gigs back to back, and if income shown is stable it would not be an issue.

Problem is the passport page and stamp can come from any one's passport there is no proof that it came from your passport. In my case I had a dated visa to the foreign country attached to the page next to the entry and exit stamps, so this was solid proof that it was my passport that the page came from.

You need to attach more than just one piece of evidence that you visited fiancee sometime in past 2 years.

Boarding passes, hotel receipts in country, ATM receipts in country, other receipts from in country, some people take a photo together holding something that will date the photo like a news paper.

1) Can always apply for another B-2, has demonstrated in past that will not overstay, so getting another tends to be fairly simple at most consulates.

2) Get a letter (NOA-2) and/or email, the petition will then be sent to consulate THROUGH the National Visa Center.

3) NVC tends to take about 1 month to process and send to consulate, then perhaps a month of so after that will be an interview. REVIEW the timelines!

4) Again TIMELINES! AOS (Adjustment of Status) tends to take 4-6 months or so to process.

If they do marry their petitioner outside the 90 days, they will have to file both I-130 and I-485 together to adjust status, again this is only marriage to the original fiancee, not someone else.

A quick question based on the number of people that the sponsor is 'responsible' for.

Our co-sponsor (my mum) lives with my dad, making a household of 2. But because they will be co-sponsoring my fiance, does the income need to be above that for a household of 3?

And finally - both my fiance and I live abroad - so does that make the household 4? (mum, dad, fiance, me)?

Joint would be responsible to count only 3 (Sponsor, their spouse, and intending immigrant) The don't count petitioner as member of their household.

The 1-2 year thing has to do with US citizen filing I-129F, not beneficiary receiving one.

You can simply let the K-1 expire, or contact Embassy about turning in the immigrations packet un-opened.

In the future, the Interviewing officer may have questions about your prior K-1 visa, they may question motives about why the two attempts at getting to the USA and your motives, so stronger documentation may be needed for a second visa petition by a different person.

Need to re-read the OP's question, they are asking if after getting the K-1 would it be OK to "Marry" in home country, they did not say that they have the visa yet. They only have NOA-1 letter is all.

I don't see any problem with an informal ceremony, as long as it is not registered in the foreign country. It's just a party, after all, and many people do that anyway, because it's difficult to combine wedding planning and law. As for the formal wedding though, I am afraid it will have to be in the U.S.

If it's important for you to have the actual wedding in Indonesia, I am afraid you'll have to file a K-3 or start the immigration procedures, which will take a little longer and may require longer separation.

You can have an "engagement party" before comming to the USA on a fiancee visa, however depending on the laws of foreign country a "Wedding Ceremony" can be considered to be legally binding and if this is the case US recognizes this as being married, and using a K-1 while already married is misrepresentation and can come back to bite you later on.
