K-1 Fiance(e) Visa Process & ProceduresCivilly registered Long-form certificate (birth certificate)
Moving this to the K-1 forum, it sounds like you are dealing with an RFE for the I-129F petition.

A US citizen can use, Birth Cert, or Complete copy of US passport as proof of citizenship. Beneficiary's birth cert is need at the time of visa interview. Also beneficiary's passport should not be needed for filing an I-129F petition, they are probably asking for a full copy of petitioner's passport as alternate proof of US Citizenship.

K-1 Fiance(e) Visa Process & ProceduresDulles Point of Entry
When I traveled home with my wife, she had K-1, I simply got in her line, the immigrations people helping people waiting in line had no problem with my being in line with her. Some POE will direct you both to US Citizen/Resident line, but that is up to the person directing traffic. Best to go through the line for visitors/immigrants unless directed otherwise.

K-1 Fiance(e) Visa Process & Proceduresquestions about K-1 visa in China
A few things, K-1 is a non-immigrant visa with immigrant intent, so the immigrant visa unit at the consulate in the foreign country handles them like immigrant visas, the exceptions are that they use DS-156, and I-134.

In China the only consulate that has an IV unit is Guangzhou so there is where the K-1, K-3, CR-1, and IR-1 visas are handled and interviews are held.

You must indicate Guangzhou on the I-129F.

Lastly,

Since you are starting out, I HIGHLY recommend that you visit and Join "A Candle for Love" that site covers all the pitfalls, and immigrations process through that consulate, as well as many other things involving American/Chinese relationship wise, customs, ect.. Their FAQ section is the most complete on the web, covering everything from start to end, interview questions, There is even a person employed at the consulate that regularly answers questions on that site.

K-1 Fiance(e) Visa Process & ProceduresTranslating papers for K-1 Visa (Russian)
Any documents submitted to USCIS need translating.

However if this is correspondence items like emails letters or chats used as evidence of communications, this does not need to be translated.

As for translations..

(a) Document Translations .

All documents submitted in support of an application or petition must include complete translation into English. In addition, there must be a certification from the translator indicating that the translation is complete and accurate and attesting to his or her competence as a translator. See 8 CFR 103.2(b)(3) .

http://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-2061/0-0-0-2253.html

Translator need not be a professional, just someone conversant in English and the foreign language, that will "certify" it by noting that they are conversant, and stating it is an accurate translation and signing their translation.

K-1 Fiance(e) Visa Process & ProceduresI-134 question
No, there is no specific form, the one you sent will be fine. Packet 3 contains one as a standard item, telling beneficiary that one is needed from petitioner, you are ahead of the curve, and are fine.

K-1 Fiance(e) Visa Process & ProceduresPersonal payment check K1 visa
Are we talking I-129F Petition sent to USCIS, OR the Visa application fee paid to the US Consulate or Embassy overseas?

If I-129F petition, Check is attached to the petition when sending to Dallas TX.

If $350 fee to consulate, most want CASH.

K-1 Fiance(e) Visa Process & Proceduresi-134 or i-864?
I-134 is for K-Visas and is used by the consulate.

I-864 is used when adjusting status in the USA, since you called USCIS the operator assumed you were asking about green-card and adjusting status. When asking questions about a VISA you need to contact Department of State.

DOS:
QUOTE
Other Immigrant Categories - When an I-134 May be Needed

Do applicants who are applying for an immigrant visa in a visa category that does not require the I-864 Affidavit of Support, such as the diversity immigrant visa, need to meet the public charge provisions of Section 213A of the INA?

Consular officers will review immigrant visa applicants whose visa categories do not require the I-864 under the public charge guidelines in Section 212(a)(4) of the Immigration and Nationality Act. The applicants must show that they will not become a public charge. A consular officer may ask for an Affidavit of Support, Form I-134 and supporting documents. The sponsor will need to show income at 100 percent of the federal poverty guidelines for household size, not the 125 percent required under Section 213A of the INA.

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

K-1 Fiance(e) Visa Process & ProceduresQuestion Regarding Bar Code
You are doing K-1, bar-codes have to do with NVC process for CR-1 and IR-1 spouse immigrant visas.

Only bar code I know of used in K-1 cases is the special one generated by the online DS-156 that will be used at the time paperwork gets turned in at the consulate in Guangzhou.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa package HELP!
I'm going to mail out my petition this week. I'm 18 and I did this all on my own so I'm terrified that I'm doing something wrong.
This is what I included in my package:

- Cover letter
- Money order for $340
- I-129F
- I-129F Question 18, explanation of meeting in person
- G-325A and passport style photo of myself
- G-325A and passport style photo of my fiancé
- Copy of my birth certificate
- Letter of intent to marry from me and my fiancé
- A copy of all of our boarding passes and passport stamps held with a paper clip and an envelope including 12 photos.
- Another envelope containing a picture of my ring and facebook conversations over the past two years.

I was wondering if anyone else did anything different or if you have any other recommendations of other stuff I should include. I'm probably way over-thinking this, but I wanna know what should be attached to what and what I should use to attach it. For now I just have everything being held together with paper clips. Also, EXACTLY what should be written on the envelope when I mail it out? If anyone has MSN and is willing to talk me through this a bit more, please leave your screen name in a comment.

Thank you!

K-1 Fiance(e) Visa Process & ProceduresI need I-134 help!
It's not like we just met each other a couple months ago and made an immature decision to rush into things. Yeah I know I'm young, but we've talked it over for over a year now and we know its the right thing to do. We both won't be truly happy until we're together without having to worry about another airport goodbye.

Thank you all a ton for your information. I feel much better about this.

K-1 Fiance(e) Visa Process & ProceduresI need I-134 help!
Okay, I'm 18 years old and started my first job about a month and a half ago. I sent out the I-129F in April, got the first NOA and expecting the second one at the end of this month/early next month so I'm starting to try and figure out this form. Everything's fine except question 7. I do not have an annual income because I'm part time (in college also) and I don't make a set amount. Not only that, but I haven't worked a full year. And I definitely do not make 125% of the guidelines. What do I put on that line? And what do I do about not having any tax returns since I've never had to file for taxes?

I plan on having one (or both) of my parents co sponsor for me, so I'm taking they need to fill out a form also. What do they put on the line where you say who you're filling it out for, me or my fiance? And if it is him, what is the relationship?

I feel so stupid. D:

K-1 Fiance(e) Visa Process & ProceduresOriginal birth certificate?
When I sent the I-129F, I sent a copy (front and back) of my original birth certificate. I know I'm supposed to be sending the original to my fiance for his interview, but I misplaced it since I made a copy and I can't find it anywhere. At all. I tore my house apart. How important is it that I send the original one? I have another copy that I'm gonna have to send, but will it be a big deal?

K-1 Fiance(e) Visa Process & ProceduresCase received by embassy?
I got the NVC letter about a week ago, and I wanted to know what number I can call to know if the US embassy in London has received our case or not. I looked on the website but I could only find UK numbers.

Secondly, can my fiance schedule his medical now, before he gets the letter to get a head start?

And for those of you who have already got your K1 visa, how long did it take you from when the embassy received your case, to when the foreign fiance entered the U.S? I'm really hoping we have Christmas together, but I don't want to get excited about it just yet. What do you think the chances of that are?
Alyssa MarieFemaleUnited Kingdom2011-09-09 21:31:00
K-1 Fiance(e) Visa Process & ProceduresFiance lost passport.
My fiance recently lost his passport, and the day after he just got the letter from the embassy saying they received our case. On some forms, he needs to write his passport ID number, and it will be different from the one on previous forms if he does end up getting a new one. Also, in the one he lost, he has stamps from the U.S. that he got when he was here. Our question is, will this effect our process at all? And will these stamps transfer to his passport if he gets a new one?

K-1 Fiance(e) Visa Process & ProceduresPacket 3 question.

Are you sure they sent him forms? London quit mailing out forms around January 2009. His instructions start here http://london.usembassy.gov/iv_15.html

Read the page carefully. Always look in the right side pane to see if there is a link to more information. Go to all links. Read the links on the left about Medicsl, Police Certificate, Fees, Interview, Courier, etc. It's all there if you read and click links---every single one of them.

They sent a list, and he printed out all the forms on the list and filled them out. Do we have to send some back before scheduling a medical?
Alyssa MarieFemaleUnited Kingdom2011-10-11 23:14:00
K-1 Fiance(e) Visa Process & ProceduresPacket 3 question.
My fiance got his 5 forms in the mail. Does he fill them out, send them to the embassy, then in return they will send the medical information so he can schedule one? Probably a stupid question, but I just want to double check.

K-1 Fiance(e) Visa Process & ProceduresMajor questions concerning packet 3.
So my fiance got his checklist in the mail stating what forms he needs to have ready, but not where they are sent or taken. He's filled them all out, but what does he need to sent back to the London embassy and what does he need to keep in hand for his interview? Also, regarding the things I need to send him such as the financial support, does he bring that to the interview or does he send that in with the DS-156k?

They need to start wording their papers more clearly because we thought we had it all figured out and there's clearly a ton of confusion. :/

K-1 Fiance(e) Visa Process & ProceduresLetter of employment for I-134 question.
I know I need a letter of employment as support for the I-134, but I've been having a lot of trouble getting my hands on it. My employer can't write one up at the location I work at, and the number my boss gave me said they don't support the company I work for, so I'm kind of stuck here. :help: I'm not too sure what to do about it, because I have everything else I need. K-1 Fiance(e) Visa Process & ProceduresHow till the visa is in hand?
My fiance has scheduled an interview in the London U.S. Embassy, and he'd like to know when he'd have his visa in hand so he can start planning out plane tickets (in hopes that he's approved). I know some embassy's you get it the same day, and others you have to wait a week or so to get it in the mail.

Did anyone buy their plane ticket before the interview? Or did you wait after? The prices are probably unbelievable.

Alyssa MarieFemaleUnited Kingdom2012-02-10 21:34:00
K-1 Fiance(e) Visa Process & ProceduresEvidence for Interview
Along with our I-129F packet, we sent a huge packet of evidence that proves we met each other and have a genuine relationship. His interview is a week from Tuesday at the US embassy in London, and he was wondering whether or not he needs to being the same stuff we already submitted in the petition. We haven't visited each other since we sent it, so we have no new evidence besides chat logs. We talk on webcam everyday so we never use phone calls, and sadly there is no proof of that. So should he bring the original proof we submitted, or will they already have access to it during his interview?

Any other suggestions on what else to bring?

Also! Will he need to show his bank information, or will most of it be about MY bank information and not his?

Thank you!

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
Received RFE back in October, because I had not seen my fiance in the last two years. The kicker was that I was 3 days outside of two years.
I actually talked to an Officer at VSC and she recommended go to Ethiopia within two weeks or they would cancel my Petition. So I bought
a ticket and went. My fiance was thrilled. We took pictures, made copies of the tickets, my Ethio Visa and sent them to VSC. I have had two touches
on the 21st and 22nd of December and nothing since. I don't understand why it would take so long. The letter they sent to me said they would
make a decision within 60 days. That will be Sunday 01/09/10. Do you guys have any ideas?

If unemployed, then write "Unemployed" and the period from to in the dates.

Just go back 5 years, and any period of unemployment gets a line.

if nothing for third fourth, fifth, and would be before 5 years ago then leave blank.

A person could be employed for 10 years, and use just the top line, leaving others blank.

I-134 is brought to visa interview, it is not sent with I-129F

List looks good, Birth cert is used to prove US Citizenship, so is only needed from US citizen

K-1 also needs evidence of having been together within 2 years before filing the I-129F, so things like photo copies of passport pages showing entry/exit stamps, airline tickets, hotel bills in country when visiting, ATM receipts, etc...

K-1 Fiance(e) Visa Process & ProceduresTourist Visa while waiting
I would save the $$ and wait for the K-1, a citizen with no ties needs to PROVE no immigrations intent, having a K-1 visa petition in the works only goes to prove there there IS immigrations intent.

Also a person who is a citizen of a country that has HIGH immigrations fraud gets even MORE scrutiny when applying for a tourist visa.

Oh! I guess I can kiss my wish for a honeymoon in Acapulco buh-bye.

Thanks for the reply, YuandDan. Best of luck in your journey :)

Essentially yes prior NON-Immigrant visa is considered null once you have a K-1
YuAndDanMaleChina2011-01-04 13:31:00
K-1 Fiance(e) Visa Process & ProceduresDoes K1 visa cancel an existing tourist visa
Yes, When entering the USA on a K-1, the K-1 is then VOID, and must marry within 90 days and then adjust status.

And YES MUST have AP document IN-Hand before traveling while AOS is being processed, the tourist visa DOES NOT protect the pending AOS, traveling without AP even with a multi-entry visa other than (H1,K3,V1,L1) in passport WILL get the AOS canceled.

Can take a few weeks or a month or so if they reject it.

You need to wait for the center to decide what to do about it, they may do one of three things:
  • Forward it to correct center
  • send it back to petitioner
  • OR process it and send on to NVC for interview.
If Vermont decides to process it, it can take up to 5 months as per Vermont's processing time.
