K-1 Fiance(e) Visa Process & ProceduresRegarding Travel to after receive K1 visa
Travel outside BEFORE entry to the USA having a K-1 visa has NO effect on the K-1 visa.

The Visa is valid for 6 month after it is issued, and is only activated upon entry to the USA.

QUOTE (pushbrk @ May 15 2008, 02:16 PM) <{POST_SNAPBACK}>
The visa is valid for six months.

The approved petition is valid for four months.

Either you or your lawyer has confused the two. Your I-129F is a petition, not a visa. Consular officers can and routinely do extend the validity of petitions but the six month validity of the actual visa is firm.
Don't you just love confused lawyers?

Yes, USCIS approves the petition and makes NOA2 letter valid for 4 months, consulate can and usually will extend that.

After visa interview at the consulate, the VISA itself is valid for 6 months after the counselor officer interviews and approves the visa.

FAQ: 3. Once you have the K1 Visa it is good for only one entry into the United States within 6 months of the issue date. A K2 Visa holder (child of K1 Visa holder) may enter up to one year after the K1, but a K2 Visa holder may not enter the U.S. prior to the K1.

K-1 Fiance(e) Visa Process & ProceduresEmployment
Can take a job with EAD or Green-card. EAD can take 90 days or more to get.

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

It is possible to get EAD before marriage and filing for AOS, however, (a )(6 ) K-1 EAD costs $340 and results in a 90 day NON-Renewable temp EAD that expires 90 days from entry on the K-1, since it can take up to 90 days for I-765 to be approved, the results is a worthless or denied EAD.

K-1 is best to file for EAD with or after filing I-485 to adjust status using code (c )(9 ) there is no fee for this it is included in the I-485 fee.

guides6ly.gif http://www.visajourn...mp;page=k1k3ead

Also this is not a K-1 visa topic, it is an "Working & Traveling prior to getting a Green Card" topic and should be in that forum.

With I-129F there is a Petitioner and a Beneficiary.

The petitioner is the US citizen who is filling out the I-129F, the Beneficiary is the foreign citizen that will eventually interview for the K-1 visa at the US Consulate.

Both US Citizen and Foreign citizen need to fill out their own 4 page G-325A. In this case both beneficiary and petitioner are applying for the visa.

K-1 Fiance(e) Visa Process & ProceduresA couple of questions
QUOTE (motu @ May 27 2008, 03:31 PM) <{POST_SNAPBACK}>
You can contact the nearest UK embassy in USA (google for it) and apply there when you are ready to get a new passport. You will need a SS number to work even after the authorization, so look for one in your home area and apply about a week after arriving - it may take 2 or 3 weeks to get (If you already have one - then you are good to go). You can apply for AP when you get married and apply for AOS - generally it takes 2 or 3 months, so it all depends. Good Luck
Note: there is only one UK Embassy in the USA that is in the nation's capital, all others are Consulates.

Embassies for any country in any other country are always in national capitals only, all other locations in other cities are consulates.

K-1 Fiance(e) Visa Process & ProceduresA couple of questions
Not a problem, once you are in the USA you can renew your passport through the UK embassy in Washington DC by mail. http://www.britainus...n...i=10080&d=1

The EAD stamp only allows you to work for 90 days after entry, after that and you will need EAD card or Green-card to continue working.

Yes, applying for a travel doc is not hard, just file I-131 along with the rest of the AOS paperwork. AP (I-131) tend to take 90 days or so to get approved.

Just as long as they just wanna see im eligibl. I know im prob worrying about nothing but i wanted to double check that they will just see it as an honest mistake not knowing when visa comes through and trust that we have sorted it out

K-1 Fiance(e) Visa Process & ProceduresAvadavit and another question
I-134 affidavit of support is needed at the visa interview, NOT when filing the I-129F.

Most on K-1 do not have any wedding plans until after getting the visa, that is what the 90 days after entry is for. All you have to do is tell them in your letter of intent that you intend on marriage within 90 days after entry on the K-1. NO set date is required. http://www.visajourn...r_of_Intent.doc

K-1 Fiance(e) Visa Process & ProceduresNon U.S. Fiancee working in U.S. before marriage
Only way for a K-1 visa holder to take a job is if they have EAD stamp in passport, most POE do not issue this stamp because SSA will issue SSN to a K-1 with or without the stamp.

A K-1 can apply for EAD card before marriage and filing AOS, however, this costs $340, and results is a 90 day EAD card that expires 90 days after entry, and since it can take nearly 90 days to get the card, the card will either have expired before it can be issued, or expires shortly after getting it.

QUOTE (Brian_bellingham @ Jun 2 2008, 07:56 PM) <{POST_SNAPBACK}>
Actually K1 is valid for 90 days, but I otherwise agree. Even if she got her nursing license now, she would have to wait until she got permission to work, which will be after you get married and then applied for EAD (Employment Authorization Document, which you get while you are waiting for the Greencard). So when she gets here, she will have time to study up on the NCLEX. There are computer programs or books you can buy on Amazon to help with the NCLEX studies.

One correction, you mentioned getting the nursing license and then taking the NCLEX. Actually you must take the NCLEX first before you get a license, it is a requirement. I know, my wife is an RN. If things change and she is able to get her license in the Phillipines, she may not have to take the NCLEX, as I *think* there is some sort of agreement between the two countries. Anyway, her nursing school there would know that for sure.

Yes, we've met in person twice. This is just his first visit here, our two previous times together were in Canada when I visited him.

It will be his first visit here and it will be our longest time together by far. (Both of my previous trips have been five days long)
I would hold that and provide it later at visa interview as relationship evidence. No sense having an adjudicator at USCIS get confused by the dates of travel on that email being dates after your I-129F filing.

First rule... don't ask, don't tell. Second rule... well, beyond those high ranking officers, how can an American Consulate or FBI access CCP's roaster to find out who is a member and who is not?

The point is the question of party membership is asked on the visa application and although the Consulate and FBI don't have access to a CCP roster, they do know that police officers are most likely party members. Never lie to an immigration official or on an immigration form.
Exactly, if they do catch the lie, like when adjusting status or even years later when applying for citizenship, they can and DO revoke resident status and deport based on misrepresentation.

The best policy is to answer honestly and if requested file the waiver.

K-Visas may get past this at the consulate, but when adjusting status the question comes up again on form I-485.

2) K-Visas are NON-Immigrant, NON-Immigrants do not need to be vaccinated for the visa, they will later need vaccination record when adjusting status in the USA. Vaccinations are required for the green-card, not the K-Visa.

I don't actually live at my parent's house, and I'll only be on my ship until September 2008 this year, so by the time my petition goes through I might have a totally new address. This is a dilemma smile.gif Also, should I have her send me a certified copy of her birth certificate for inclusion with my I-129F petition? or is that not neccessary until she applies for her K-1 Visa?
Your resident address stateside, that is your parent's home, this will ensure that you get correspondence from USCIS.

You do not need her Birth cert at the time of filing, you will need it at the time of visa interview.
