However according to the immigration rules if the child is legally adopted by your fiancee BEFORE you start the K1 filing and is listed as a dependent daughter in the initial paperwork and on the I-156K, then she has some time with which to follow later her adopted mother as an automatic k2 visa recipient. Otherwise you have to refile for her later - separate process. But at no point it is longer that two years. K-1 Fiance(e) Visa Process & Procedures	K-1 Interview - Proof of Divorce	I do not have a copy of my divorce decree from my first marriage over thirty years ago. Is this a reason for an RFE? Will copies of both divorce decrees need to be presented for the interview at the embassy or will the most recent one suffice? My first marriage ended in 1970 in a State I have not lived in since 1971. All that was needed - in 2009 when I filed - was a telephone call, a letter, a check and a self addressed envelope and presto, in days I had the document. So long as you know the county and state where the divorce was granted, regardless of the years involved, you can get your documents and YES you must present them. K-1 Fiance(e) Visa Process & Procedures	Hit a major snag... it may be over	You say your Ex is paying the mortgage in lieu of child support and that the provision is voluntary - and therefore you can not claim it. First, if the court ordered Child Support, (and I'll be amazed if they didn't), then you have a court order. You can provide additional documentation about the method of payment, i.e. the mortgage and document that he is meeting his court ordered responsibility in that method. Second, if you don't have court ordered child support, go back and get it. Such things need to be done and the court that failed to provide for it was in error. Third, if the mortgage is in excess of the court ordered amount, ask the court to ammend your divorce agreement to stipulate the payment of the mortgage as the means of support. You are claiming a family of four, but you are not reporting the full income for it because you assume it is not reportable. It is. Just as the support might not continue if your ex dies, loses his income or just gets squirrelly, you might not have a job next year. The USCIS and the State Department are looking BACK, not forward. They know the future can not be perectly guaranted. The look back to get an indication of the future. Fourth, for all those who aren't self employed, it is hard to understand the situation. her actual income was NOT what this person was reporting as her income. The gross business income is not her real income. Her real income is the business net after business expenses and dedcutons, which may account for 100% or more of the gross. In essense, her reporting the gross business income is meaningless. There may be no net, or next to none. If the business is in the negative column, or close to it, close it. The 1600 + the second job ought to get you close and if the first is that much of a money loser, a new primary wage job will plug the hole - meaning a delay but not the end. Our experience was as follows: 08/03/2009 NVC Letter advising the I-129F is approved and will be sent to the embassy. 08/22/2009 Manila time Air21 Delivers the WRONG packet to Fiancee in Manila - left unopened So that was 19 days. We have heard of a number of miss-sends and so I guess if you don't have a letter after 30 days call the call center - not the embassy - and ask regarding the number. US Embassy and Consulate Discussion	K-2 and 157	That is sort of what I assumed... but the USCIS website says nothing in it's new pages about a 157 for K2 dependants - which is a change from when I brought my family to the US from the Philippines. My good friend is now marriying my sister-in-law who lives in the Phillipines and we were researching the changes like 131 turning into 350 when I ran across the lack of info on K2 filing. After I posted this we found the updated Manila Embassy webpage that made it clear the fee was fee each K2 plus the K1. In this case equaling 1050. I did the conversion into php pesos and back for exact amout that will be needed as the system is a scam and always has been. The conversion rate and Banco de Oro is 50 to 1. Hi Stormbringer, one more question! Does my wife have to refile documents that she already filed as part of the K-Visa/AoS/RoC process or can she reference that they are already part of the record? In this regard, I am thinking about divorce decrees, annotated marriage documents from the Philippines, Land Titles, two of the three years of tax returns... et al. For example: I got married July 2009, and got my GC October 2009. So I become eligible to file October 2012. US Citizenship General Discussion	N-400 August 2012 Filers	Hi. By October 26, 2012, I will be 3 years resident here, which in 3 years rule resident and married to USC, I can file for my citizenship. I can file 90 days earlier before my 3rd year of residency, however prior to my filing, I need to be 3 years or more married to my husband. That's why I filed after August 8 which is our third year anniversary but still days earlier from my 3rd year residency. adiiann thanks for the reply. I must admit I am still confused as that is not what the USCIS instructions authorize from that I have read. The document says 3 (three) years after approval of your Adjustment of Status not 3 years after the marriage. Can you point me to a document that advises differently? For that is is worth I married my wife in September 2009 but we got the GC in February 2010. The USCIS documents all say that one cannot apply until the following: [as] a spouse of a US Citizen, you can apply for citizenship 3 (three) years after approval of your Adjustment of Status. (Emphasis and underlining is mine.) But some of you are applying 90 days before that? How? Where is that permitted? Specifically adiiann listed the GC expiration date of the AoS to get the RoC as 10/26/2011. Based on that, from what I read, the N-400 filing should not have gone in until 10/26/2012. US Citizenship General Discussion	N-400 November 2012 Filers	Hi MikeInWyoming ... to find out the places that the ceremony is held in your area, you can ask other members or call the district court (which it seems you have already done).  And yes, I wouldn't wait a month if that means you missing what could be your potential appt. date.   Call back in a week and ask for a tier 2 support caseworker.   We called USCIS again today and got passed to a second tier guy. I had told him I was afraid we would miss the May 13th date and had not gotten the letter.He said he was barred from telling us the date, but as WE had the date, he could confirm that is was nice we knew it.  He would send out an expedited letter and if we didn't get it by the 5th we should call back and they would fax it to us.   So at least now we know and we have a way forward.  I will update the table in a separate post. US Citizenship General Discussion	N-400 November 2012 Filers	It is now fourteen days after we received the email stating that a letter was sent regarding the date for the Oath Ceremony... and we are still WAITING for the letter.   I know that there are Oath Ceremonies scheduled in May and then in July for Federal District Court, but that doesn't tell me which one my wife will be in. We were told to not call back the 800 number until a month after the notification... but that would be May 16th and the next ceremony is May 13th and 125 miles from here. The one after that is on July 8th and 265 miles from here. Do I wait just one more week for the letter and if it doesn't come, call back before the 30 days are up? US Citizenship General Discussion	N-400 November 2012 Filers	We have been missing from this site for a while. My wife interviewed well on 4 March 2013 but was told she needed a couple more statements/bills/accounts with both our names on them, that were dated within the last nine months. We sent them in the next day. On 04 April we got an email putting my wife "in que" [sic] for the oath ceremony. On 16 April we received an email staying that the USCIS "sent a notice providing the date, time, andlocation." We have gotten no notice and , this being eight days following the email, we called the USCIS 800 number. The USCIS call center woman's response was...If you don't get a notice in 30 days, call back. So I asked, does that mean the oath ceremony is not until after May 15th? The woman's answer was, I do not know, I don't have access to those records. So we wait and hope we don't miss it. US Citizenship General Discussion	N-400 November 2012 Filers	Hey MikeInWyoming, Now, my question is: was that 4.5 month a single trip, or multiple trips? Did you both file taxes? If so, you should not have any issues. Bring those documents that I mentioned, and you should be good to go. If you have other questions, feel free to ask Take care. Actually there are two rules: The length of time in each trip AND the total time of all trips combined. Take a look at the N-400 Naturalization Eligibility Worksheet, part of form M-477. Step 4: During the last ?ve years, I have not been out of the United States for 30 months or more. (The rule for 3 years files, my wife, is 18 months.)
