So I submitted my k-1 application late February and unfortunately I was never advised to submit proof of my relationship (photos, letter of intent, etc). A lot of the case numbers close to mine have been either approved or received a RFE. Should I be proactive and send this information in now, or should I wait until I receive an RFE? Suggestions? My application is at CSC. Does anyone know an address where this information should be sent? And should I attach a copy of the letter I received from them so that they know my case number? Any help would be appreciated.

Depends on the country.  Some consulates encourage the petitioner to come, while others don't even let the petitioner in the building.

So do to my work load I'm kind of caught between going to my fiance's interview in Costa Rica or going to pick her up and flying back to the States together... Don't think I can do both. Any advice since I've heard the embassy in Costa Rica shouldn't be a problem? And I've known beneficiaries doing the interview on their own without any issues? Anyone have any experience with this particular embassy?

My fiancée in Costa Rica is bring her 6 yr. old daughter with her. When she picked up her packet at the consulate, she specifically asked if there was anything additional documents needed (authorization from biological dad, etc) she was told no. Nothing was needed, just her daughters passport. Costa Rican immigration stated the same. No additional "permission" from the biological dad is needed. I was under the impression that a notarized letter or something was needed. Anyone have some insight on this? Is it embassy specific?

I'm a little confused... If the application I-29f does NOT state that a separate letter of intent to marry from both parties is required, why would they not approve the application because of the lack of such letter? It just doesn't make sense. The application also doesn't state that photos, itineraries, or more proof of a relationship is required. Why would it be required to get approved. I was under the impression that those items where needed for the actual interview, not for the application. Am I wrong?

My fiancé sent me the 1-129f replica, 6 months payslips before the interview, 3 years tax transcripts, 2011 w2 and 2011 and 2012 1040 Noa 1 and 2, NVC letter, signed and dated letter of intent, cert of employment signed by the boss, bank statements (optional)...in one package.

He sent it thru usps, about 90 dollars, they have global partnership with fed ex...it arrived in my hometown as guaranteed which is at least 7 days...usps cost less by 100 to 150 US dollars...


Ps...he will scan and email to me his may June payslips, and 2012 tax transcripts end of June.






i have another question. when she goes for the interview when she is finished with it will she findout then if she is approved to come to the USA or does she have to wait and they will send her the information in the mail

All cases are sent to the NVC and will be assigned a case number and sent to the consulate from there. MNL# is your case number. MNL stands for Manila. You can call the NVC and get your MNL#, but I would wait at least a week before calling. ok i have been checking online where to find the trancripts and i have found nothing. everythning will cost me me 57.00 per year. but everyone tells me it is free ..you would not happen to know the site to order the transripts

ok i will check on these things. however i do not understand some of the short hands - like NOA? NVC? Cert of employment is as proof? and do i need to send in just my W-2's for the last 3 years will that be good enough? or do i get all the information from the IRS for 2010-2013 tax trancripts? i have the pay slips for the last 6 months. my cert letter is from the HR dept. of the company i work for. all it says is my job title and how long i have been there plus i am a perm.  but there might be a hickup with that. my company merged with another company and they took the other companys name. so it will show a differant company name on there than the one i used when i sent it in to the USCIS office. will tis be and trouble? also she has a copy of all the stuff i sent in to the USCIS Office. i brought it to her kust three weeks ago. i went and spent 2 weeks there with her .which is the third time in the last 18 months. i went in april of 2012 and in september  and then again in May of 2013. also thank you so much for you help it does mean alot to me that they do have wonderful people out there in the world who care about people they do not know . also today is my birthday .. lol ...42 ..i wish it would 24 ..lol .anyway i can scan these things and email them or i need to mail them to her ?  and once again thank you very much

my Fiance and I have gotten our I-129F approved on June 11th and i now have gotten a letter from the Dept of homeland security. in the letter they said they will be sending the information to the Consulate in Manila. i thought it had to go to the Visa service center first. Also what is a MNL # and on the USCIS site the instructions said when i got this letter it would have instructions on what i needed to do and what she needed to do.  there is no information on anyof this. also does she need to go to embessy for interview and they send her for the medical or can she just go in for the medical then set up her interview at the embessy.

The embassy in Manila, Philippines requires them even if they are not listed as a requirement on the I-134 instructions. They are listed on the Manila embassy instructions. Either tax transcripts from the IRS or your 1040 tax return with W-2s to back them up. You may also be asked for an employer letter stating your job is permanent and a recent paystub indicating your job and pay is current.

Bank statements are only required if you cannot provide proof of current income via paystubs or are using assets in lieu of income.

i do thank you for the info. this is what i have and plan on sending in. do you think it will be good enough . copies of my w2's  2010-2013  copies of my last 10 pay stubs. a letter from my comapny explaining why my company has a differant name from the one i sent in to the name it is now . my company merged with a smaller company and we took there name for tax reasons. and copies of my 1040 plus a statement from my company on what work i do and for how long i have been working there.

Consulates usually ask to see 125% income for the I-134 as well. You can make up the shortfall in assets (so, if you are short $1000, you need 3-5x the amount in assets, i.e. $3000-$5000), which it appears you have. Personally, I think it would be best to keep your job so you can get through the K1 interview and AOS without a co-sponsor.

Recent timelines show AOS is taking anywhere between 6 months to a year.

 

Ok but to file the I-134 I qualify as a family unit of just 1 as I am not married yet correct? So even at 125% I still make the poverty line. But getting married makes my family unit 2, which then makes the poverty line move up, which is where I don't qualify. So then cash can be considered as an asset?

Now that i've looked into the I-864 I'm seeing that it then becomes 125% of the poverty line and I dont think I will make the cut on that as I am just under that number, so at that point I would need a joint sponsor. So under a joint sponsor I would then be able to leave my job? We're close to 50k saved up at this point so really we wouldn't need anyones help money wise, just from a legal stand point.

 

And about how long does it take for the I-864 to be processed/approved? I can't really find a timeline on AOS processes other than what needs to be completed for the packet.

I was wondering, assuming we pass our interview, if someone would be able to tell me how long the petitioner needs to stay at their current job? Would I be able to leave my job as soon as my fiancé is approved? Or after we get married? After her green card is issued?
I was hoping to leave my job in August and maybe take an extra month or two off, we have quite a bit of money saved up so it wouldn't be an issue money wise, but I don't want to just quit my job and it becomes an issue for her being here.

I left to see my fiancee America for 3 months. Although some have negative experiences with that.
They can't refuse entrance based on a K1 process. As the matter of fact I used that fact to get in (why would I pay so much for a K1 just to waste all the money and move in now?) they can however refuse entrance based on their feeling that your visit is not genuine.
Still, I'd say it's worth it. Being 3 months together is a great way to kill time. It took us about 6 months to get our NOA2.

Another thing I did, was spend a lot of time with my friends as I had to say goodbye to them. Volunteering anywhere I could and live as a nomad. It was actually pretty fun but still it didn't numb the anxiety completely.

I am in the same situation and to be honest i have no idea what to do...graduating from the Univ soon and I am a PhD, so yes if i take a job here i dont know how long i will be working...maybe a few months or maybe even a year...who knows. staying home and just waiting for the NOA2 is not an option for me, would drive me crazy and it wont be good for my career. but i am also concerned if anybody will hire me just for few months...with the jobs i would apply for, people expect you to stay longer otherwise it is pointless to hire anybody...i am so depressed...this is OUR life and we have to make the best out of it.... sure the way CSC processes cases now is not helping at all...
just praying for some mirracle to happen...and missing my love so much...


I know, it´s really hard :( But we have to think of ourselves, our sanity and what´s best for our lives and careers. You are a PhD and I am a lawyer, we just can´t afford to mess around with our careers. The professional world is cold and not understanding of a situation like ours. I wouldn´t be upfront in an interview, they will simply not hire you.
It is the uncertainty that makes the wait so terrible. If we knew, ah, CSC is taking 8 months now and it will remain the same, we could plan accordingly. But we simply don´t know whether they will pick up speed again (in that case you as a November filer would be up for a NOA2 pretty soon!) or if it´s only getting worse and we will have to wait up to a year.

Whilst it can be seen that taking on a position with full knowledge that you will resign later is something one might not want to do ... It's important to remember that should your employer's situation change they would can you if it was (for them) the right thing to do. One might not want to do such a thing to a small business or friend - you eventually have to look after no.1 as rarely will anyone else in the employment field do so.

And I speak as someone with their own business who is therefore an employer of people. I am also cognisant of the fact that me leaving may result in collateral damage in my present business.

This is not something any of us is doing lightly (I hope) and as such there are some hard decisions to be made.


It is a large corporation that I applied with. I don´t think it would cause major damage for them if I resigned upon short notice. I guess I have to be selfish here, when it comes down to it, they won´t care about me either. Will you give up your business in the UK? Those are really tough decisions we are forced to make! It´s all for love though. Some people may think we´re crazy, but secretly they admire our courage, I believe :D

I'm not going to make any substantive changes until I at least see a bunch of previous month filers get their NOA2. Business as usual. I'm assuming 60-90 days on the UK side on the final stage anyway. It's especially brave to make big decisions ahead of them picking up your file never mind the risk of RFE's ,further delays , blocked toilets in the consulates blah blah blah blah.

That's not to say I'm not doing anything to get ready. I'm just not doing anything that irreversible. Not that I know what I will do if we are not successful.......

Hi everyone,
I know that a lot of us are waiting... and waiting for our visa. I am having a hard time deciding what to do with the wait time.

Here´s my situation:

I quit my job in October to be with my boyfriend (now fiance) in the US for 3 months to figure out if we want to take the relationship to the next level. He proposed, I returned to Germany, we filed the K1. I thought it would only be a process of 4-6 months and I would be back with him. I thought that was a great time period to get rid of my apartment, my stuff and say good-bye to loved ones. Now I found out that CSC is taking forever to process K1 visas and all in all it will more likely take 9-10 months or God knows how long. Almost 3 months are already over since NOA1. I am in a position now where I have to either find a job and only work for a few months, which doesn´t make a lot of sense if you´re having an actual career in a high-profile field. Also I would have to lie to the potential employer about wanting to stay permanently and then quit spontaneously upon CSC´s notice, which gives me a guilty conscience.
Or I could move in with my family who live near the Frankfurt consulate and just wait for the visa for several months. Sitting around doing nothing I feel lazy, unproductive and useless. I also worry about the huge gap that will appear in my resume and may damage my career. I do have a job interview in a couple of weeks and if they offer me the job, I may accept, but I am not sure yet since I want to be ready to leave my town in Northern Germany to be available for the consulate as soon as I hear from CSC and NVC. If I stay and work, it may delay my departure for the US eventually because I will still have my apartment and all my things that I will have to loose and take care of. That will stress me out immensely.
What would you guys do? Anyone in the same situation?

hi there, we filed in January too, received NOA1 on Jan 9th. We haven´t heard anything nor did we expect it after studying many stats and other couples´ timelines on this website over the past few weeks. there has been one couple that filed in February and they got theirs within 2,3 weeks, but only because they got an expedite for humanitarian reasons since the beneficiary was from Haiti. Looks like we won´t hear anything for at least another 3-6 months :( .

I wonder why they told you that you´ll have at least another 56 days until your NOA2(why such a concrete number now when usually they´re so vague?).
Does that mean they won´t re-shift their focus onto K1s until the 1st of June??? Is that their plan of action?! I was hoping that this long awaited shift of priorities would happen within the next few weeks....

Hi and welcome to the forum! We filed in January with CSC too, also from the greater L.A. area.

Let´s follow each other´s timelines, can you please fill in yours!? It´s quick and easy to do and gives other people an idea as to where you stand in the process. Also that info can be used for stats and estimates. When you go to your profile, there should be given an option somewhere on top "add/edit timeline", just click on it and follow the instructions.

When we filed, we anticipated a 5-6 months waiting period for the WHOLE process (consulate part included) based on how quick CSC was approving in the first half of 2012 (2-3 months). We were shocked to learn that CSC processing times have increased drastically and there seems to be no end in sight. At this point, I hope to be in California with my love by Christmas. We can manually mine some data off of the USCIS website via the receipt numbers. In fact, I was just trying to find the late november-december numbers now, but cant find them.

It would be nice if people could post # near theirs, so we can look some up, get data directly from USCIS, and shove that in the face of the lazy congressmen personnel.

Do you know what number range (ball park) those recently approved December filers could have been? I am a January filer and tried to go back based on my number, but couldn´t really make sense of it. There were mostly (already approved, of course) DACA cases. My receipt number starts with 139. Do the 2012 cases all start with 129?

We are together now for a week and we found out today that we are approved! The timing is perfect!
