I just took at look at my timeline and the projected time for adjudication is now june-july. It used to show aug-sept. This looks like a good sign! We are both anxious for the wait to be over. Good luck to everyone, on a speedy result!!!

Went to USCIS website to check our case status yesterday, as I have done for quite a few months, and this time I see status changed to approved ! Our NOA1 date was September 21. Just like a bolt of lightning it came ! The process is not over, but at least we have made it through the longest wait. To others still waiting, I hope for a speedy approval for you.

Hi everyone,

I know there has been a lot going around about extremely long processing times for K1 but I have never seen anyone waiting a year!!! We have filed 23/july 2012 and have just received an RFE which turns out might have just been a computer glitch according to our lawyer???? The lawyer now says to us that she doesn't expect us to have an interview until June/July 2013 which would make it a year???? I saw a popular post the other day about a long account of steps with which someone succeeded in speeding up this process but I cannot find it anymore and don't remember the title :-( We have written to all congressmen/women we can think of, white house, have several service requests opened.... nothing. Does anybody have any advice at all? THANK YOU!


Hi Janette,
I think July for the interview sounds realistic if your RFE is a minor one and can be resolved quickly.

Once you sent in the requested documents, you should have your NOA2 within a few weeks.

I don´t think there is any use contacting any congressmen at this point. The major wait is over and was only due to the delays at California Service Center (which you won´t have to deal with anymore once you received the NOA2).

Luckily, Frankfurt is supposed to be one of the quicker consulates compared to other countries. That part should be done within 6-8 weeks upon receipt of your case.

There was no highlighted part that said Referral for Evidence, so I'm hoping for the best! I'm slowly letting my guard down, and hoping and praying that we do have our NOA2! Woohoo!



is is just a standard phrase that they put in EVERY notice, approved or denied.
In your case, it says explicitely "approved", so STOP WORRYING, you have been approved! :lol:

So I called, and transferred to a tier 2 rep and it turns out my petition was definitely approved!! :)

I asked her what was up with the website, and she says that it does weird things sometimes. She has no idea why it's saying my address changed, but that everything is good with my case and I should be receiving my notification in the mail shortly.

Good luck to everyone!! I think what finally made mine go through was a call to USCIS on Monday. I called to check status, and they said they were working on July petitions. I was super nice to her and told her that my fiance put in a 6 month notice to his job in Germany in October, thinking that it was enough time to process the visa. Obviously that was not a good decision, and he is soon to be jobless which will put us in a tough situation. She said she would place a service ticket, and that they have 30 days to address the ticket. The very next day my case was approved. So I would say it's definitely worth calling!

Thank you everyone for your advice. I am a silent member on here, but have used the forums and timelines extensively and you are all so very helpful!

I would get a letter from the employer stating that he makes $xx,xxx a year based on his current salary and schedule.

That could work in our case.

Unlike you, Lynkali, my fiance is not completely out of his job during the summer. He is not a teacher, he is a program manager for educational programs and there is a little bit of admin work to do during the summer, so he remains officially employed.

I´ll have him ask for that type of statement, doesn´t hurt to try.

My situation is somewhat similar.  I teach as adjunct faculty at two community colleges, and usually don't teach at all from June-September (no paychecks for 3 months).  Bearing in mind that I haven't gotten NOA2 yet and we're still in the preparing stage for the interview, here's what I'm doing to show income and assets.

 

First off, my income has fluctuated wildly in the last three years: from under poverty level in 2011 to way above (45K) in 2012 and now for 2013 it will be around 22K (comfortable but like you said, no paychecks during the summer to PROVE my income is ongoing).  So I have letters from both colleges stating that my employment is "semester to semester" but "currently still employed", and stating my current salary.  I also have paychecks up until the summer starts (we hope to have our interview in July so hopefully a June paycheck won't be missed.)  I also am planning to print out the college schedule to show that I am the instructor of record for the coming fall semester at both colleges.  If the colleges have generated their employment contracts by the interview, I will definitely include those, but they usually aren't available before the end of July.

 

Finally because I feel shaky about the whole PROVING aspect -- yes, I know what my income is and it's above 125% poverty level but I cannot prove that once the summer starts and I stop getting paychecks! -- I am backing everything up with ASSETS.  Investment accounts, savings, checking and retirement accounts totaling nearly 200K all in my name -- I can't believe they would find any fault with a marginal income and that amount of assets, and yet I'm still nervous.  So as a final absolute third backup, we have a cosponsor who is filling out all the support documents as well, and if at the interview the officer has any problem with my solo support, then we will submit the co-sponsor as well.  Finally, I plan to have a notarized letter explaining my financial situation in plain English, so there's a quick summary before the consular officer gets overwhelmed by bank statements and paychecks.

 

Maybe I'm being overcautious, but I've always been a "what-if" person, and I want those safety nets -- as part-time educators, we're in a unique situation and I am not sure if the consulate will understand that.  Therefore, assets and co-sponsor.  That's my suggestion anyway!

 

 

I think with your vast amount of assets you should be fine, but like you said, it´s better to be safe because you don´t know how understanding of our situation they will be. 

Great advice, I´ll check with my fiance what assets he has. A co-sponsor he really doesn´t want if not absolutely necessary (male pride, I guesstongue.png ).

Hi everyone, 

 

just preparing myself for the steps to come after NOA2. I have a question regarding the affidavit of support (I-134). Hopefully someone can help.

 

I know the evidence that is required with the form, such as recent pay stubs, tax returns, bank statements.

 

How do they determine if one is above the poverty guidelines if one earns a different amount each month?

Do they actually just look at the past 12 months, add the incomes of each individual month and see if the sum is above the guideline number? Is it that simple? Or do they look at the current pay stubs and multiply them times 12 to make an estimate of what he may earn in the future?

 

The reason I am wondering is this: My fiance works in education and up until recently he had 2 jobs with different employers. Now he is down to one job and the summer is coming up, which means in his field of work, less work and a lower income for a few months.

Unfortunately it looks like my interview will most likely take place in the summer or fall and his last pay stubs (the ones that we will have to provide as evidence) will show an income that would not suffice if that´s what he made every single month of the year. Work will pick up in the fall again though. But the consular officer won´t know that. 

 

I am concerned they may look at those pay stubs and assume that he won´t be able to support me in the future based on the current income. Do we need to worry?

Is there a way to let them know that a "slow summer" is typical in his field of work? Maybe add a statement from the employer?

We have been lucky in that I went to see him in July 2011, he to me in october 2011, april 2012, oct 2012 and feb 2013. Quite a financial strain. Due to work on the ranch he will not be back out here untill september/october if we are still waiting. I won't even try to go visit incase we get turned back. Four tickets at over 1500 dollars each in the summer is a lot to lose. We both would rather spent all our hours together, that's why we went the K1 route, so that I would not have to come back to england once we are married. That for us was important.


I agree! Being married and still having to be separated living on different continents would be even worse than this entire K1 waiting process. But if for whatever insane reason our K1 is denied, the spousal visa would have to be plan B. Pushing away the thought, positive thinking! Good luck for you guys

We spent 6 months apart at the start of our relationship. After that we didn't want to be apart any longer :blush: so we both got visas for Australia and worked there for a year, then travelled Asia. We then went to the US for 90 days and filed for the K1. She has been in the UK for the last 6 months waiting for me to get my visa. :) It's worked out perfect.

ummmmmm, :huh: I am sure most of us do visit their loved ones. But a visit every few months or once, twice a year is not enough to keep you from missing them inbetween visits?!? Maybe there lies an ocean and a whole continent between the 2 of them, everybody has their lives with responsibilities, a job they can´t just up and leave anytime they miss their partner, they possibly have children to take care of, a roundtrip costs $ 1500 or more so you can´t afford it all the time. In many cases it´s visa issues, that won´t allow them to travel to their loved one´s country and/ or stay there until the K1-process is over....so there are plenty of reasons. I don´t think anyone of us CHOOSES not to see their significant other.

I am glad you finally heard from them, Arinlars! It´s been a month since your case left NVC, wow!

 

A&P, were you refering to Arinlars when you said that there is someone else who is in the same situation or is it someone else? That would make us 4.

 

Frankfurt is probably just slow at the moment for some reason and they don´t want to disclose that to the public, so they pretend they haven´t received the files when they are actually somewhere in the building, but maybe no one has picked up these files yet and entered them into the system, like a previous poster suggested. 

 

There may also be a problem with NVC being delayed since CSC picked up pace enormously and NVC must be flooded with new cases to process. Just some ideas, but I have no clue eitherdry.png

 

I hope we´ll find out soon. I was confident that things would go fast with the consulate like it used to. I was hoping to be in the US on Bry´s birthday, which is also our anniversary.

Don´t think that´s going to happen if NVC lost my case and Frankfurt takes a month just to mail package 3. ...

It has been 3 weeks since my petition's hard copy has been mailed from NVC to the Frankfurt consulate. However, up to last Friday DOS and the consulate both have said they do not have the hard copy yet.

 

Here is the kicker.. with the DHL tracking trick.. I saw my package leave NVC and arrive at the consulate 5/22. ranting33va.gif

 

Now I have asked both NVC and DOS if they can track the package and they claim they have no such ability and I should just wait... and I know Frankfurt is not this slow.. usually they process Packet 3 in <1 week. 

 

 

Any ideas what I should do.. I am afraid it was misplaced or lost in the consulate? There is also one other member on the forum in the same boat.

 

I get the feeling Frankfurt is not as quick as they used to be!

 

How does the DHL tracking trick work?? 

 

I am waiting to hear from Frankfurt, too, but I am not sure whether they have received my case at all. 

The CEAC website says it´s still at NVC (since at least May 28!). That is awfully long. NVC does not answer my emails. So I am not sure whether this info is true at all (maybe the website just didn´t get updated) or if it has been sent to Frankfurt yet and they are just being slow. In my case it´s early though, I could possibly hear from them next week or so. If they received it at all...

That sure had me grinding my teeth. And I was just as upset with him. But now that we're approved I can smile about it. But I'm not gonna take a chance with the pack 3 papers!

same thing here.....I suggested my fiance to mail the I134 stuff with UPS or FedEx, it costs $44 and is guaranteed in 2 days. He refused to do so too and I was actually kind of upset with him... but he (we) got superlucky. He used USPS (the regular US postal service), paid only $ 7 and the package was here in only 4 days!!! I was actually on skype complaining to him about mailing it with USPS when the doorbell rang and the mailman handed me the package!!! Couldn´t believe it. So you guys may get lucky as well biggrin.png

The visa process was so stressful for us, and has at times made our relationship feel as if it were strained due to work and other pressures. To see so many people being approved makes me wonder if it could be us quicker than I imagined. I almost can't imagine finally getting our NOA 2, because its caused so many hard time in our relationship that it almost felt like something that would never end and be a happy reality for us. I offer sincere congratulations to everyone, and am keeping up the faith that somehow it could soon be us. I haven't had good things happen to me recently, so to get the NOA 2 almost feels impossible. I want it though, and I will try to pray even though my faith seems lower than it's been in awhile due to stress and strain. I am THRILLED for everyone! congratulations smile.png some of you I was following in timelines, and woke up today seeing timeline changes and then saw the amazing Igor's list updates. Have an amazing day to everyone that got their NOA 2, and to the rest of us lets hang in there! I need all the support I can get.

 

I hope we get our NOA 2 this week, or even today and that the others waiting here do as well. *crosses fingers*

 

Layla, I know how you feel. It felt like NOA2 would never come or at least I could not grasp how and when and what it would be like. 

 

Honestly, that NOA2 came right in time for us because the past few weeks have been extremely hard and emotionally exhausting. I felt that something would have to happen soon, he would either have to fly out here or that approval would have to come...or else I would go crazy and become seriously depressed, .....and here it is, completely unexpected!

No, i dont expect to get NOA2 at all at this point. But i would wish that at least one with NOA1 from the beginning of january would get answer so we would know that 2013 filers are not just put on hold until all 2012's are finished up....


I agree, that would be a great relief.
I hope they won´t skip several months (including ours) like they did when they started approving Dec filers. That would create another "black hole".
I am hopeful though that they won´t let such a backlog occur again right after they put so much effort into clearing the recent one.

No offense, we´re all in the same boat, but I think you are setting yourself up for disappointment.

Do you seriously expect to get your NOA2 now, taken into account you´re an end of January filer?

They´re working on September and October right now.

I think us January filers still have a couple of months ahead of us. And that´s only if CSC is keeping up its current pace. If not, who knows... :(

if it´s true, it must be an expedite. From what I´ve seen (and I am observing closely) they haven´t approved anyone past December except a few expedites.
Looks like they´re working on September and October for the most part. I´ve only seen one more December filer a few days ago.

It is really hard and frustrating.... Just thinking what if we will also have to wait more than 5 months at CSC... I really pray that they will start on 2013 applications soon, and not let us wait. Those who filed in beginning of January are reaching their 5th month (which originally was supposed to be a MAXIMUM processing time), but I still havent seen anyone being processed. Im afraid they wont start on us before everyone from 2012 has been adjucated....

So when people say, "you will just have to wait for your turn in the line, its only fair that people before you get processed first"... Well, I already waited 8 months before I could FILE the petition (first had to become citizen) and now God knows how long the process will be.......... Just sayin', living like this for one year now is hard... :clock: :cry:

All I can add to this is I pray nobody has to be delayed in the way some of us have been. I can not tell you the pain that it causes to have to wait beyond eight months when I initially expected a 5 month wait.

I do not mind when you filed, I just pray that every single person gets processed in a TIMELY manner and CSC never comes to a halt like it did again.

You guys have been so patient and your relationships must be very strong to have endured this ongoing state of uncertainty.

For a long time, it was completely unknown when they would start working on K1s in larger amounts again. It could have gone on and on like this.

And now they are! Don´t you stop, CSC!

I hope CSC will never let this backlog and lethargy of the past 8 months happen again!

On April 19th user Alema_2011 claimed twice that they were January 2013 filers and had been approved on April 19th. However that user has no timeline so I am a little suspicious that either they were joking or they were January 2012 filers. But there have been a few late December approvals so we may see a few coming through now and then. Everyone assumes this is a first-come, first-served process but it appears to in reality be a bit more of a bell curve with a few lucky people being approved earlier than expected and a few unlucky ones being approved later than expected.

Someone else claimed that according to Sen Boxer's office the CSC expects to process all filers before September by the end of April (seems optimistic I know) and all Sept/Oct filers by the end of May. With a good percentage of November and December already processed that means January petitions will likely be approved in late June or thereabouts. Nerve-wracking I know but that would be 6 months for us and at this point I can live with that.

Unfortunately the approvals of these December filers got January filers´ hopes up. Mine too, since I didn´t see too many January WAC numbers before mine on the USCIS site. So that means as soon as they start working on January, I should be up next.

But now they´ve returned to working on the old 2012 cases, which I think is absolutely fine since it is only fair.

People get kind of greedy and want their NOA2 NOW although some are only February filers and have only waited 2 months. I want to be with my fiance too, badly!
But I think we have to be a little more humble and realistic, and like you, I´d be superhappy to get mine in late June/July, which would make it 5.5 /6 months.

That is far sooner than what I expected up until CSC started cranking them out like they did last week.

Let´s just be happy and excited that they are indeed working their butts off and let´s hope they continue that way!

yes, 2 couples were approved after 4months only. It´s great news, but I am not holding my breath.
I think every once in a while CSC randomly picks out a few cases and processes them before due time in order to decrease the estimated processing time. When the majority is processed in 8-9 months and a few are in 4 months or so...voilà...that´s 7.5 months on average.
What I am trying to say is that very few of us may get lucky and hear back from them early, but most of us will still have to wait longer.

Also, maybe it´s just a coincidence, but I have never seen anyone getting approved early when the benificiary was from a Western country. Maybe they think it´s not that "urgent" for us to come to the US as it may be for people from more troubled countries.

not anymore im afraid my friend look up daca it is taking up most of the time for filling and is really hurting k1 process trust me i feel your pain there are many links on VJ to have a look about it all some people have been waiting over 9 months so january fillers expect maybe christmas of next year sad but true .............. keep the faith though it might pick up again and lets do all this together :)


Christmas of NEXT year??? NO NO NO, Chris, don´t say that, you´re scaring people! That would be almost 2 years until NOA2. AS slow as CSC may be, this is unrealistic and will not happen! Let´s stay somewhere inbetween optimism and realism :yes:
