Good morning Fellow April filers.  2 Months down...Hopefully not too many more to go.  I am trying so hard to be patient but knowing my fiance likely won't be able to come to visit due to finances has made it tough.  We talk on skype every night, even if it is only for 15 minutes.  I would so love to have things in place to get an October Interview, even though I know that is pushing it.  how is everyone else doing?

 

It's going good for me.  I get to visit my man in 17 days (16 1/2 now lol).  I was denied entry last September so I'm praying and hoping for good luck that there won't be any problems at the border this time around.  I need to see him so bad.  But good vibes!  Plus, it's been 2 months, they transferred those 2 months of filers out of our way to texas...it can only be good news.  I am very excited about that.  I feel like within a week or 2 we are going to be seeing Feb filers getting approved.  At least this is what I'm really hoping for.  So I'm optimistic that April filers will start to be approved in August.  Too optimistic? Maybe but a girl can dream.

I am almost at 2 months waiting (on the 3rd) and I get to see my fiance in 23 1/2 days (fingers crossed that I don't have problems at the border).  Send good thoughts my way please smile.png. I've been so happy to see Vermont transferred those files.  It's really looking like we will be processed in their timeline now.  Yahoooooo!

Hey fellow April Filers!  Anyone else super excited that December and January filers at Vermont have been transferred out of there?  I am!  Means we are back, baby! (that's 2 months of people OUT of our way) Our processing time should be at 5 months now.  We might actually get approved by September??  OR they could be focusing on other types of visa's but hey, I'm going to look at the positive and maybe just maybe start hoping for an approval by September.  Either way, I was planning to hear something by October so a month won't make much of a difference (but we all know waiting sucks and one month is one month dancin5hr.gif )  Good luck to us all!

Hi everyone,

This is day 10 since we received the NOA1.

My fiancé, the petitioner, doesn't want to research anything off the internet so I'm the only one who actually has an idea of how long we'll more or less have to wait.

He has persuaded himself that I will have the visa by July... no matter what I say, this is his belief. It breaks my heart every time we Skype because I know it's going to take longer, and I can't tell him because he doesn't want to hear any info that I read on forums.

I'm having a hard time coping with it all.. especially the look on his face when I imply I may not be with him before the fall. I just want to cry! crying.gif

I wish he or I won the lottery (I actually do play every week) because being apart is so difficult... and we can't afford to visit eachother.

I know I'm not the only one, we're all on the same boat, but it's precisely because you know what I'm going through that I'm sharing this with you. 

You guys can empathise.

We have to be strong!

I know it's difficult but when you come to terms that you aren't going to even get your NOA2 til at least November IF you don't have any RFE's THEN you have to wait for your interview (you are looking at December at the earliest), it's only going to make it all the worse waiting.  Just take ONE day at a time.  Plan your day, fill the void.  One thing my fiance will not let me do under any circumstance is complain about the wait.  All you can do is be happy you are one day closer.  Believe us, we know it's hard but if we dwell on it, it only makes it worse.  I have in my heart that I won't have my visa til February.  If I get it before that, I'll be ecstatic.  IF it goes longer, then I can start to worry and be sad.

I get the same thing, but it's usually when they ask how long we've been together. It'll be 7 years in July. Honestly though, with the crazy both of us have had to deal with the past couple of years, it wouldn't have been cost effective to do immigration at anytime before now. But now that we are actually doing it, we get the added questions of "are you sure you can live together, you only spend a couple of weeks together a year." Frustrating to no end. Lol. Of course I'm sure, we talk about it all the time, what we each expect, what we are going to do, etc.
 
Well after reading some of the rfes that have come through, I'm now expecting one. I sent in a photocopy of his divorce certificate instead of the actual one, so now I'm having him go and get 3 more from the court since I'm sure we'll need more. And also on the photos, I only put month/year with names and places instead of month/date/year. The other primary evidence should be good though, as well as the forms. I'm wondering if I should wait for a potential rfe or if I should be proactive and send it now. Thoughts, advice?

As for the next steps, we haven't started packet 3/4 yet, but I've already given him a list of things to do and when to do them lol. He's going to try to start tracking down his vaccination records now, and order his long form birth certificate in a couple of days. Then in October, he'll get the police certificate.

And about importing the car, anyone know the details for Chevy so that we can go ahead and start on that? Do we go through a dealer or the Chevy itself?

And as for the visiting other countries, he's only come here and on 2 cruises with me, so I have all the dates when it comes time for that.







Same, same!  "But how do you really know him??"  I think I know him way better than I would if I had met someone in town.  We text constantly.  We know each others schedules.  There is complete trust.  I'm getting the RFE because he sent in the wrong paper to his divorce certificate.  Your copy should be fine.  They don't take the originals, you bring the originals to your interview.  Not sure about the photo's-some get an RFE, some don't.  We sent in the proper divorce certificate but there's been no update to the file and it's been a month.  So I'm assuming we will have to wait on the RFE but for piece of mind, just send it in. Being proactive helps:  I needed to get the stupid Hepatitis shots done.  I have round 2 on Friday and boy that needle hurts! lol!  Police certificate is done (it's good for a year, it was also free when you tell them it's for immigration purposes-in Canada anyways)  If you do a quick search for importing cars, you'll get a ton of links.  Here's one:  http://www.nhtsa.gov...ada01192007.htm (not sure if you are in Canada, I didn't look before I started replying to this lol)  One thing I noticed is the long form birth certificate needed to be sent with your I129-F.  So make sure you have that ready for an RFE as well.   Good luck with everything!

Well, I swore I wouldn't obsess over this process until October, I did enough just preparing the forms and such lol. But here I am again after explaing the process/timeline to family and friends for the millionth time. I feel like printing the flow chart on business cards and just passing them out whenever people ask.

Please tell me I'm not the only one going through this with friends and family. It's like they can't comprehend the time it takes. Me and B have already come to terms with it, so it's things as usual for us, texts most days then Skype 2 or 3 nights a week (3 hr time difference and he works nights).

On the plus side, I finally have a viable job opportunity that will be stable and consistent. The interview is later today. It would be a welcome change to the contract work I do now, and allow me to get to where I want to be for when he does finally get the visa and make the move. The downside will be me not being able to visit again before the interview. Even though we have a relatively easy consulate (Vancouver) it will put my mind at ease to be there. We may be able to swing one more visit for him to come here though, but we are not sure when.

Oh and I read through some of the earlier posts. To update what shows on the forum (what shows under your avatar) go to your profile, click "edit my profile" and scroll down to the bottom. That's where you can select the visa, service center and a few more things. smile.png





This made me laugh.  I don't have any family.  (that's a long story-but basically I'm disowned).  So haven't talked to them in over a year. But every day I work, I get the exact same question from everyone: So how much longer? (I tell them), next day, same thing.  It's annoying but at least they're interested lol!  And just when you start accepting that it's going to take a LONG time and you're ok with it, then someone says in a negative way: Awww that's so long, I couldn't do it.  Then it's depressing lol!

 

I also get alot of people asking if we have heard anything.  I am content to wait till at least October before i start really wondering.  We are also through Vancouver and my Fiance would love to be there for the interview but traveling back and forth just isn't cost effective when he doesn't get paid vacation.  I could go down but we are saving up for the move and everything else.  We will try and get at least one more visit in before the interview to add to the proof on ongoing relationship for the interview along with skype records.  lol  Is anyone else as bad as me and already have the forms for the packet three and 4 ready to go?

I have all the papers started.  I've run into the problem of being on 3 cruises over the last 10 years and it wants to know the dates I was in different countries.  I've called the cruise line and they don't have the info so gulp.  I need to write up a bunch of secondary forms to go along with the primary ones.  It can be overwhelming.  so much to do!  I think tomorrow I'm going to work on getting the letter from the car dealership saying it's approved to bring to the usa.

Hey April peeps!!!  How are awe holding up?  Just think,  One month down for some of us already!!!  Lets hope the next 5-9 months go quickly!!

Yes, we hit our first month, woohoo!  Wouldn't it be wonderful if Vermont hit their goal and CSC hit their target?  We'd all be approved by Sept 1.  But I know I'm getting an RFE.  My fiance didn't send in the proper divorce certificate.  Even though we mailed it to VSC, there's no guarantees whatsoever it will get with the file.  So it SUCKS but at least we know it's coming and have added an extra month to our wait.  Sigh... :(

No problem.  I pretty much "live" on this site now.  I know I have a whole lot more time to wait but I'm always hoping and watching to see approvals go through.  You'll notice there is a constant debate about which service center is faster/slower.  If you keep it in your head that you are going to be waiting a LONG time (at least 7 months before approval) then you won't be disappointed after reading the uscis site says they process in 5 months.

Which centre are you at? Vermont or California? Please update your timeline. "alien # changed" just means your file has been logged lol, we all wish it meant more :)

Well it's finally official. We are April filers. I got the noa1 text and email today, and it happens to be my birthday. So yay! Now its time to sit back, relax and wait 6-8 months. Lol.


At least you are going through Vancouver. That is at least a month less in your wait than mine as I have to go to Montreal. Such a long wait there! Oh well, nothing I can do but keep busy til then.

I think we should be the first group to try and not complain about the rate both centers are moving at! We all know we have to wait. It's so discouraging coming on here and half the posts are people whining about lack of movement. If you tell yourself it's going to take 8 months, your brain will accept it and if the approval comes sooner than you have extra reason to be happy.

I know not to get my hopes up as I think this is the new standard. My case has been updated: "On April 11, 2013, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E)." I have read a bunch of posts to see if this is good news or not. And the answers are about 80% this is standard and the other 20% say I could be getting an NOA2 soon. Please let me know if my fellow April filers received this notice.

I feel like I've already done the bulk of my waiting. I was waiting 8 months for my divorce certificate. For a very long time I was misled as to when I'd be receiving that document. So since I have on average 9 more months to go through, (please, please, please be less!) it's not so bad. It sucks on every level this wait but I feel like true love gets tested. This is a difficult ordeal being away from your loved one. But it's all working out. Got that stupid divorce certificate and here we go...the countdown has been going for awhile so when I read posts of the waits, I think "well, I've already done that length and my character has gotten stronger because of it"! So everyone, it's not so bad. (Chocolate, wine and some good Netflix helps pass the time :P )

Hi Hannah,

I am interviewing in Vancouver, so I think the wait is slightly less, from what I have seen anyway. I am not expecting anything before December. And given it looks like my kids are all leaning towards staying with their father (thats a whole other issue), I will likely not go down till after Christmas anyway. Although I would love to get married this year, I think it will be a new years wedding. Where are you seeing the average time between NVC and Interview date?

My NOA1 date is two after yours, I will be watching and waiting with you, every second of every day...


Someone had posted it is usually only a couple weeks for NVC to forward your case to your local embassy. Mine will be sent to Montreal. And the Montreal embassy's average is 3 months to get an interview. You are very lucky you are in Vancouver where your time frame is much shorter.

So what are everyone's realistic "wish times"? I'm hoping this will all be completed in 9 months from NOA1 to visa in hand. If it's sooner, I'll be very thankful! (and secretly wishing this every day lol!) From approval at NVC to my interview is a few months...I'm hoping if I refresh every second of every day, my interview date will be sooner than the average of 3 month wait!

Hi Hannah,
My application just got received in Texas today, April 3, 2013. I was wondering how you know your application will be forwarded to the Vermont center for processing? Is there any place for me to check to know where my application will be sent?


Just from researching it, my fiance lives in Virginia and Vermont is the closest centre. Texas takes the money and forwards it. If you live closer to the California one, the it will get forwarded there. (to the best of my knowledge)

My mistake was not addressing it properly in the original K-1 petition, I thought it was best he explain his life himself, but that was wrong. My mistake for having to much faith in the interview process and not knowing the proper way to address that red flag. It's going to be OK though.

I am sorry that it was not clear. I was legally married when we met. I have been divorced officially since 2011.  I was separated in 2009 but in Virginia you must wait a year before you can start divorce proceedings. Hicham and I are both free to Marry.  I filed our K-1 in Nov. 2013.

Oh wow, I am so sorry some of you guys have to go through that:( that is just so sad.

 

On a positive side, you will appreciate the relationship you have even more when you are together as you went through really touch times and maybe toughest time in your life. A lot of people who just met their significant other at work, school, or any other places from the same town, will not know this feelings and to my opinion it is harder for them to maintain and value their relationship.

 

What I don't get is how USCIS approves it without any questions and then only on interview there are Red Flags come up. you would think that USCIS would help you and get any explanations before they hand it to the embassy to help us Americans be prepared:(

 

I thought the most difficult thing was USCIS and 129f approval and was excited that I am done with the process. Now i am very scared and will be bugging my fianceee a lot to go over any freaking possible details about my life and her life:( I would not survive 4-5 years without her. I would end up moving somewhere else but USA. I love USA to death and probably would regret that desicion for the rest of my life, but I can not waste so many happy years of my life. My case is easier tho. we are younger, no kids etc.

Oh my, don't even want to think about denial:(

You would think that they would be more helpful too, saying hey this is suspect, so before we send it to the consulate do you want to explain more? 

 

But it is a game, without published rules. A gauntlet.

Marry and CR1?

Yes, but I would like to at least consider the options that are possibly available with this petition and how I might approach a refiling of a K-1. So many changes are happening right now with school, possibly a change in jobs, and things happening with my children, and of course the cost,  it may be until spring 2015 that I can even consider making another trip to Morocco. I thought I might be able to do it between semesters but if I start a new job, I probably won't be able to take the time. So complicated.... :/

I did mention her and that he was upfront about his relationship, as was I ( since I was still legally married , waiting for my year of separation) but I did not go into details, so I didn't say I knew about the previous petition. UGH! :(  Mine was done at the Texas service center. And Just today I did get this email from USCIS:

I know I may get a letter saying that it has expired and at that point, my only option is to re-file. But are there other routes that may be possible? Thanks for any advice.

Or maybe she never actually withdrew the petition and he got one of those automatic fraud markers talked about on Marc Ellis blog? One of the things he told me about her and a point of contention between them was that she was not on top of the process once it was in AP, as she was not the kind of person "who liked to talk on the phone". We all know you can't sit out this process and not call /write / harass to make sure it is moving.

@destiny64 this is possible and i definitely never ruled it out. In fact it's not like she had nice things to say about him when I indirectly contacted her myself. But she never said anything that he didn't already tell me himself, never has he lied or been sketchy. I just feel in cases like this, especially with the time and money and lives invested, it should be more comprehensive of an interview / process once it reaches the Consulate. But whatever, let the games continue!

Yes Thank God for people here, and in the Visa Journey group on Facebook, and my lovely friends who I have met who have gone through this process already to get real information from. Otherwise, Good Grief! I was thinking to myself, I can't believe I know more about this process than this guy on the phone. I'll give it to him though he genuinely seemed to care , and was concerned enough and tried to be encouraging. He was nice, but for sure he was just reading off the computer.

You mentioned in an earlier post that he had been refused under 221 g.

 

Most likely the petition will be returned and expire.

 

 

And it is sad that I could not even get this straight answer today from USCIS , the guy on the phone was SURE that everything was going to be fine. lol.   

 

He told me that they will definitely send me a list of reasons so that I can reply to it. I know that is not true. 

 

Our goal is for me to go back to Morocco and get married there officially! It is just having the ability to make that happen that is getting in the way. It was not as easy as it was before. I can not walk away from my business without someone to take over, and right now there is nobody to take over, plus working around my, and my girls school schedules. 

 

Thanks for this info, I know that this is the REAL truth!

@ Destiny64  I never thought of that point , thank you for explaining that to me. I swear, it feels like a game, and you don't have all the rules. I just wish that the process was more comprehensive, especially with cases like ours that do require a little more time to understand. I completely and totally get that in black and white, it looks bad. I am not that person. I know that they have a hard job, I just expected more from the process, and my country, especially since they know all the years and time, and my live and money and my children's time that has been invested in this and that I MYSELF did not take this lightly and I really hoped that they would have treated him differently in the interview, and especially involved me more. I feel that if the time was taken, and he was given the proper opportunity to answer questions, she would have understood a little better. And also the way things go after the interview, is really not fair for the USC. Let's say she does know something that I don't know, ( even though I know it is what I have mentioned) I feel that it should be prudent for them to inform USC's of the information they are using to deny, because we are the ones that have to continue the relationship with the beneficiaries and make the decision on what to do next. Seeing that I have invested  4 and a half years of my life into this, can you please let a girl know whats up?  The man has never been to the US to commit visa fraud and again, he didn't get the code for all the real reasons why he should not be here.  

 

They wanna talk about fraud? My ex husband lied to me about his religion (among a lot of other things)  to be with me, we get pregnant and I live a life with a man who is pretending to be someone he is not. He even practices my religion with me, and 7 years later he resents me for his lie, and needs to go back to being who he truly is in his old life, with his old girlfriend. That is fraud, and he was born and raised right here in Virginia.

Yes he was married to a USC before, and they broke up, it was the right choice for both of them. You don't move to a new country when your relationship is rocky and that is the only person you will know. He had to get his divorce paper from Morocco (we already had the US paper that I obtained copies of) so that we could marry there. As you know in Morocco, you can go to an office and get told one thing and then go back and get told another. He should have had the final paper he needed by the time I was there, but getting the run around as they do, they said it would be another 21 days for it to be finalized.  In Morocco you can get around the rules sometimes with a little hand to hand encouragement. He never takes that route and I stand by his convictions. Although now I am regretting this because from what I see lately, some KNOWN slimeballs are getting through with K-1s even though they are shady.  I knew this was going to be an issue, and my mistake in my petition was not addressing it enough, because I thought it was best for them to hear from him not me, when they asked the questions, but I chose wrongly. I should have elaborated more that I knew about all of the things, because every question she asked him, she cut him off before he could explain properly. I knew from practically day one, did my own digging and my own research and the man has NEVER lied to me about anything. We believe they were in AP for a long time, and neither one of us have any idea what happened with that petition exactly, whether it was just left in la la land or if she called to withdraw it. He did inquire about it when we first met , because I was curious about his legal standings ( of course!) as I started to get involved with him beyond friendship, and I encouraged him to find out what he could.  The CO even asked about this inquiry and I think of course she thinks badly of it, and it sounds like she did not believe him when he told her I asked him to do it,  because he emailed to check the status of his previous case, a few months after we met.  It is a GRAY situation that was handled in a black and white kind of way. If the CO believed that I didn't know about a previous case, why not call me and ask me? Hicham is a very honest person, and I know they have no REAL reason to deny him entry, because there is a code for all of that....  She just was "not convinced".  So we just have to keep trying to convince them.  I did get a letter back from the senator and he was told by Casablanca in an email that our petition was sent back for "further review of the relationship."  Now what? I call USCIS and the guy tried to tell me that everything is fine and that this is part of the normal process.... WOW...
