had  my interview last oct 24 unfortuately my case still under administrative processing. I already sent the lacking documents back to the usembassy and recieved last oct 30. But now I dont know what gona happen still waiting from the USEM. I will be glad hearing some advice fro anyone here. thaks

hello i had my interview last Oct. 17 and i had no problem with my papers...since then my visa status was "READY"  just today Nov. 4 changed to AP...hope it will change to "ISSUED" tomorrow... so don't be stressed mine took 11 business days from my interview to update...let's just wait and pray...God bless us!!!

Somehow I just happened to stumble on this thread and I am a little bit curious, because I am learning a 2nd language ( arabic), and as I learn to write it, I also am reading it, and learning to speak I am not sure I understand how one can write in English very well but not be able to talk on the phone or in person on even remotely the same level? To me this is a huge Red Flag for the CO, and your gut is telling you the same since you asked for it. How do you guys work out your future plans? Is she using a translating system to write to you? I really am just confused and wonder how that all works really for any couple with such big language barriers. Just being in Morocco and trying to talk to those around me with my small amount of Arabic was hard enough asking for a glass of water.. I am lucky that Hicham speaks English well and was able to translate things between his family and I. But if he and I had such a language barrier I just don't know how we would genuinely hash out some of the
major topics we discuss as a couple. I am just trying to get a better understanding of this problem and how couples like you deal with that :)

This is a terrible story and no one deserves to go through this pain. It sounds like you gave yourself fully and whole in this relationship. If he truly loved you he could have just gone back to Egypt and started the process correctly right? It seems like a desperate attempt to get him citizenship somewhere like the USA or Canada. Yes we are a great country, but great country or not love conquers all. Just remember though this is not the end of your story.. this is a piece not the whole movie. Have faith and know that as long as you don't shut the door , good will most certainly come. Keep hope and faith alive in your heart. God bless you and I am so sorry to hear about this.

I'm not doing nothing based on the fact that it's an uphill battle. I've already made it very clear that I am taking action, and I know what I am up against. If anyone wants more details AND you think you might be able to help me, pm. I'm not putting all my information up here just for people to tell me what i SHOULD have done, or what i CANNOT do. Misrep was Material Misrepresentation under INA 212(a)(6)©(i)

Yeah, the officer told my mother to file an I-601 to refute the charge of misrep. We do have an attorney. I'm not just going to accept that this is an uphill battle, and therefore just sit back and do nothing.

I guess I should have phrased my question this way:

 

Has anyone who is reading this submitted a 601? If so, how did you organize your waiver, knowing that an officer would only spend 15 minutes, tops, looking at it? I see how some people used tabs, and labels, etc. I was just wondering if this was necessary. I don't want this waiver to look like a 2nd grade art project.

I understand that. My mother does not have a spouse or parent to submit the waiver for her. It is an arbitrary decision that only a spouse of parent can file a 601 in the case of misrep. Therefore, our lawyer had suggested we file the waiver and explain what our situation is, and explain in great detail how the officer made a serious mistake when he denied my mother. I have spent enough time thinking about this and talking to professionals (including the higher tiers of USCIS). For the sake of this post, please assume that I have the right to submit this waiver. How should I organize this, and how can i make it so that I have the best chance of getting approved?

That is nay saying and I don't need comments like that. While I understand you think you are being helpful by telling me that, you are not and I clearly stated why I asked my question and what sort of response I am looking for. I need someone who can help me with the organization of my waiver. Also, you should have known it was a child who was acting as the qualifying relative by the repeated use of the word "mother". For future comments, please help me with the format and organization of my waiver, and what arguments you think I am missing. Thank you.

Hello, everyone!

 

I am writing a 601 for my mother to join me in the US from Jordan. Long story short, she was told that she had misrepresented herself during an interview and they determined she was permanently inadmissible to the US. This was an erroneous decision. Our only choice is to send an I-601, as noted on her rejection letter from the US Consulate in Jordan. At the advice of attorneys, I have decided to begin my 601 by explaining why a waiver is not necessary and that she should have a new interview with the Consulate without the charge of misrepresentation (a de novo  interview, if you will). I am following this basic outline (below). I have also written it in third person to make it seem more official. If anyone has tips, or anything to tell me about how i should format everything, please tell me. So far, I only have this typed up on my computer. I need to get my exhibits together, print it, and send it in. Should I put it in a folder? and how should I organize it? Does it need to be a new page per section? Please tell me how to edit this so that an adjudicator can see how important this is to me, and how much time and effort I put into this. Please only constructive comments. I don't need people who don't know me or my situation second guessing what I think is the best move. I just need people to tell me how to format this 601, and tell me if I've forgotten anything. Yeah... SO obviously the people who handle our lives at the USCIS don't read everything you send them, and don't connect the big red dots that explain people's address information. They just can't get it straight that you, the US Citizen, have moved back to the USA which is where your entire filing was SENT FROM according to the big fat RETURN ADDRESS that you put on the envelope, as well as stated on several documents including the cover letter. I'm not sure what kind of people are handling these cases which affect our lives in such a major way, but they are obviously not that bright. They sent the NOA1 along with an RFE to the address where my HUSBAND, the beneficiary, lives, instead of MY address which is in the US. And now I don't know how to change it so they don't make this stupid mistake again. Any advice, info, or ideas? I tried to do it online and it only gives the option to change the address from one US location to another, nothing outside the country which is in my opinion, idiotic considering how many people come back to the US before and after filing. Anyway, I'm gonna try calling them directly and seeing if they can fix this but other than that idk what else to do...
