Gosh, thanks guys, but I'm so confused!
So, I can file american taxes for 2011, with my canadian income? Doesn't even make sense to me... How?

Is it more profitable to file married joint, or seperate?

What is ITIN?

I do have my SSN already, in my married name.

And can I file my Canadian taxes too? I should be expecting a nice chunk from them, so I REALLY want to file those... Will I have to file it as married?

Sorry, I know this is a lot to ask, but I'm so confused! :wacko:

Oh! And what would happen if we DIDN'T file as married just this year?

First, I would think of the relevance of answering yes to that question. Do you have a criminal background directly linked to having smoked weed? Have you ever been arrested? Have you ever tried to smuggle drugs through the border?
If the answer is no, then I would just ask myself how answering yes would make your case more 'complete' than if you'd say no for something you haven't done in a long time (I presume). The only way they could prove you've smoked before would be to test a strand of your hair. Doubt they'll do that.
It's up to you though, and I'm no expert, this is just what I think..

AP is more common in MENA and Sub Sarahan but it means they are still checking into your background somehow. If you were approved at the interview and in AP there is still a very very very small chance you will be denied, if AP digs up some sort of dirt. The problem is that AP is unpredictable and can take a long time. However for places other than the ones I mentioned it is usually less than a month. It is a braod catagory for any uncleared investigations or document validations that need to clear before they can give a visa.

Alright, so you called DOS? What I would do is call this afternoon to see if you get a different answer. The visa being pending would mean AP (administrative processing). If the person you get next says the same thing, definitely get your congressman involved.
I think it is safe to say that whatever a DOS person tells you, don't blindly believe it. A couple weeks could mean a couple of months, considering they are not the most accurate most of the time...
The faster you get the congressman involved ( I know I'm repeating myself here) the faster you'll have an answer, and hopefully your visa in hand.
Don't stress out too much, even though that's easier said than done, but stay proactive and things will be ok. If you just wait around, that wouldn't be good for your stress level!

To get the congress person involved, you'll have to have your US fiance to call. Usually there will be someone in the office that deals with immigration issues. You fiance might have to mail/fax them a release of info agreement of some sort I think... I know LeslienScott had a similar issue after their interview, as well as Valerie78. You could try contacting them, maybe they'll be of more helps since they've gone through that...
In regards to your flight, unless you have cancellation insurance just reschedule it for maybe another month or so.
But like mentionned above, your first step should be to call DOS...

Well, I would think that if you were either denied or needed to send in more documents that they would have told you at the interview. If the interviewer said 'you're visa is approved', then it should be approved...
What was your shipment method? DHL? Xpresspost? Do you have a tracking number? Did you check online to see what it says?
I know that they have a new thing going with DHL, but when I got my visa, it was with Xpress post, and it took around 10 days to get your visa back...
Have you tried calling DOS to see what they have to say?
It might not be a bad idea to get your congress person involved to get things moving... Your visa could be sitting on someone's desk, or something like that...
Good luck, and try to be proactive with this so you don't go completely insane... Call DOS today, and if the answer is not satisfying, get the congress person involved right away...

CanadaAdjustment of Status Info?

Is this normal? We went to our K1 interview and were approved. The interviewer kept tax returns and w2's from petitioner and co-sponsor. Now that we're adjusting our status, it's again requesting copies of these same forms. We dont' have them, they do!? Did we mess up not asking for them back? I guess we have to ask my accountant, and the co-sponsors accountant for hopefully copies of previous filed tax returns?
Anyone else in this boat?

Yeah, we had copies of everything, and I had brought the originals with me. When I gave the interviewer my papers, I told them they were copies but I had the originals if he wanted to see them...

Can you get the papers again? Maybe make 5 copies, just to be on the safe side :P ... Sucks that you have to go through that though...

9 more days until my interview (Sept 24) Should I assume since I am still scheduled the old way that I still pay & bring my xpress envelope to the interview as previously done? Maybe I should call to be sure? I'm thinking I would of gotten something in the mail if they changed it for me as well, but since they snuck this new process in without warning, you never know!


Just do it the old way, make sure you have your enveloppe and cash. I don't see why all of a sudden they would stop sending the visas, and the cash, well, better safe than sorry!
I guess it'll all become clearer once a couple people go through the interview in October... Good luck by the way, and congratulations on all the dates, this is great!

If I remember correctly, I remember being told by a lady on the phone through DOS that they 'open' dates for interviews a month at a time.
I have no idea if you guys will be able to skip a month, but depending of your situation, I wouldn't want to postpone it any more than that. I mean, most of us have wanted more than necessary to get a date in the first place, I'd go ahead and book it, and work around it...

Eh, but that's just me, and I really have no business in you guys' topic! I'm excited for everyone though, this is really good news!

Hi!
I did my POE at Trudeau, so maybe I can help! My flight was at noon or something, and I got there at 9am. Ended up waiting with nothing to do for almost 2 hours! The POE itself is very smooth and quick. First you'll check in your bags, then you'll go through customs. I had made a detailed list of what was in each suitcase, but was never asked to show it. The guy at customs did a couple things on his computer, asked me a couple questions, took my package from the consulate, and walked with me to secondary. He gave my package to another woman, and she asked me to go and wait. By the way, when you go and wait there will be a section on your right, and a section on your left. The one on the right has ramps for luggages, and the section on the left has offices. I had to wait on the left side. I waited maybe 30 minutes and was asked in an office. The lady wasn't much talkative, but she was nice. She seemed to know what she was doing, and after 10 minutes I was out of there and free to go!

4 hours ahead of time is plenty!

I had my visa sent to me through Xpress post back in August, and I thought the service was pretty reliable. I guess it all depends on when Montreal mails it. But after that, I got it really quick. My interview was on a Monday, the tracking number appeared on Canada Post at like 6:30 pm on Friday, and I had my visa on the following Monday...

As far as I remebered, there was a couple DS forms that I filled and sent, including the confirmation page of one you do online.As far as the checklist goes, I just checked that I had everything required for my case, signed it, and that was it. I brought everything with me at the interview. I think on the cover page it actually tells you not to send anything right now, but to sign it. They probably just want to make sure you are aware of everything you need. This way you can't get to the interview and be like "oh, I didn't know I needed that!"... That's what I think anyways... Open your pictures with paint -the good 'ol version- and then crop it. My passport pictures were on a CD, and they actually were 'glued' together, meaning that the whole picture was my face, twice. I cropped one of my faces out, and bingo, it worked, and the USCIS website said that they were accepted... Worth the try!

Very helpful! I wish someone would have done that when I was at that step (mind you the info was probably on here, I was just too lazy to look it up!)

I don't know if the procedures have changed since last spring, but I think it would be good to note that you don't actually have to send what is requested on the checklist when you send your P3 back. But like I said, it might have changed, I know that on my P3 letter, it was stated not to send anything yet, just to check and sign the checklist...

Yeah, Udella&Wiz, thank you...I had that page printed out from the DMV, but then when I went the first time, the lady gave me a detailed list of what I needed and the 60 days thing wasn't even on there... I'm still gonna try to go tomorrow just because when I went it was mid-october and she didn't mention anything about the new law change... I'm not getting my hopes up but it's worth the try, especially since Chris has to go renew his anyways...

Hey everyone,

I'm running into problems with the evidence for the co-sponsor and I really need you help/advise...
So the co-sponsor is my future mother-in-law. All of her bank accounts and the house are both under her name and her husband. So when we received the letter from the bank today, it was under his name, not hers. What can I do? Can I get another letter from the bank with her name on it? Or at least with both their names?
I'm really starting to stress out now, because my interview is in 17 days, and I'm worried I won't get it all done in time now with this issue...

Any thoughts, suggestions?

There's really no telling with Montreal, and from experience with our batch don't believe everything DOS tells you. They are not telling lies, but I don't think they know exactly what's going on with Montreal either... The interview date will come, it's a matter of time, and don't expect it to be quick. I know this is frustrating, try to stay positive, and it'll all come together! Look at halfnhalf, they've been waiting 60 + days for a date...And some CR-1 people have been waiting 11 weeks for a date too...

I know there is probably 50 posts like this one already, but here I am, asking you guys to look over my documents and evidence for my interview next week! I am so excited but very nervous as well! :wacko: :dance: :wacko:

I also put questions at the end of this, nothing major, but still... Thank you so much everyone for taking the time to reply, you have no idea how reassuring it it! :thumbs:

So here's what's in my filing thingy I'm bringing to the consulate:
- 3 passport pictures (the same used to fill the online form for the P3)
- Every notices received (VSC, NVC, Mtl Consulate)
- Birth certificate, notarized copy, notarized and certified translation
- Police checks, notarized copy for one of them, notarized and certified copy for that same one (the other one, from the
RCMP is in both English and French)
- Letter from Translator with her business card and seal
- Evidence of domicile (copy of passport info, copy of driver's licence, copy of birth certificate, 1 credit card bill)
- Medical enveloppe
- Support form with: Letter from boss, 6 weeks of pay stubs, letters from banks for various accounts, last statement of
these acounts, last 3 years of tax transcripts and W2s
- Letter of intent for each of us
- Copy of P3 and confirmation page
- Co-sponsor documents (will use this only if they say that Chris' income is not sufficient)
- All the originals of the evidence for the support forms
- Copy of I-129F
- Flights info, hotel receipts, car rental receipts, boarding passes for every visit we've made
- Proof of relationship: 6 months worth of phone bills, e-mails, slips for mail sent and/or received and 11 colour photos
- Xpress post enveloppe (the biggest one they had)

Alright, so what do you guys think? Am I missing anything?

And here are some questions:

- In the support form, they ask the petitioner when the visa form was submitted (#10). Should I put down the date we sent the I-129F or the date we received the NOA1?

- When putting down my adress on the X-press post pre-paid enveloppe, do I put down the consulate's adress for sender? If so, do I use the one written on the P4 letter?
