When Chris and I got engaged and decided to go through the K-1 route, I had NO IDEA what it required and had never heard of it before, I read the guides, downloaded the exmaples of each form, and everything became clear. Read the guides thoroughly before posting questions that are too vague, you have better chances of getting a clear answer after that. It looks complicated, but it really isn't.

Ok, are you in the US on your K-1 visa? (Sorry not so clear in your post)
Then you filed for AOS, right?

Well, they'll send you a notice of action(NOA) stating they received your file. Did you apply for EAD and AP? If so, these will be teated seperately, and you will most likely get NOAs for those as well. You should also receive a letter giving you an appointment for you biometrics to be taken. Then the wait begins...! Be patient!

Basically what I did was this:
month/year to month/year: Chesterfield, Virginia (if less than months, write the number of days, 180 days, 7 days, start counting on the day you woke up in the Us)

You can also write down the day you entered, 09/15/2008 and say the lenght of trip (15 days) and the destination. They don't want you to write down everything you've seen or where you've been. Just put down your destination...

Well, you could file a sponsor's document, and since you're income is not enough (that's what I figure since you have a co-sponsor) you have a CO-sponsor to show sufficient support...

Well, they will look at previous year's income tax transcripts, but it is the CURRENT year that will determine if it's enough.
Also, remember that if your mother is the co-sponsor, her income needs to meet the requirement for a household of 3, since she is co-sponsoring YOU for your FIANCE. That's 3.
If she has a house, that helps.

Were you requested by the service center to send the I-134? If so, and you did send it in, and you did receive confirmation of reception, then I would think you're ok.
If they didn't ask you for it, you sent it in anyways, and they confirmed receiving it, I guess it'll just go in your file, and there you go. Bear in mind that you probably want to bring an updated version of it to your interview.

Also, don't worry about waiting, I waited 4 months to hear anything from the service center, and it was an approval. Our file was touched once, a week after they had received it, and that was it for 3 months. Welcome to the immigration waiting game!

Hi Steve,
Actually, you will need to do this letter twice, and you do need to include it in the package. The first letter of intent is to mail with the package. You need one from you and your fiance.
Then, when you are going for your interview, you'll need some with a recent date on it to show that you two still intent on marrying.
Make sure they are signed and dated. I wouldn't send my package without it if I were you. Getting a RFE for that would su** big time... And at my interview I was asked for the letters. So they'll actually be wanting that...

You might want to double check with someone that actually is from the Philipines, but I know that I needed his tax transcripts for the last 3 years. A tax transcript needs to be ordered with the IRS, it's not the receipt you get when you file online. I also had his W2s.
I did not get anything notarized, and I made copies of everything. I handed the copies and said that if they wanted to look at the originals that I had them...

I know it's been a while, but when we filed last year, I had a touch like a week after sending the package, and then for almost four months, nothing nada niet. But then it was approved.
Be patient, you also have to remember that pretty much most of the East coast files with Vermont. That's a lot of people, and like mentioned above, we on VJ probably are less than 10% of everyone filing for a visa right now...

When we filed for our K1, we both had gaps in our timeline because I was here for 6 months, and he was up there with me for 7 months. I also was unemployed for a while, and so was he. We went ahead and put it in because it was specified to do so in the guides on here.
I don't know if you'll get a RFE for this, but you have to ask yourself why it's specified in the guide in the first place. Someone else might give you more insight on the RFE part, but if I were you, I'd go ahead and modify the form. It might delay you sending the I-129, but it's better than getting a RFE for something as trivial as this, like you said...

Today was a very stressfull day. The lady who interviewed me did not look at any of the evidence that I had with me. She did not ask to see the pictures, emails , nothing. This lady just saw the forms and had very few questions about how we met and decided to get married.

Some of your questions might be best answered by people who have actually dealt with the embassy in London, but here are some suggestions for you!

- Try to gather evidence of relationship: pictures, telephone bills, e-mails, travel receipts and itineraries, cards received, anything that puts you both at the same place at the same time.

- The medical for a K-1 can be used for the green card process if it's filed within a year of the appointment. I file for my green card in October, and had my medical done in May, so I was all
good on that level. I don't know if the embassy in London is different, but I had to book my own appointment when I figured out when my K-1 interview would be.

- Gather birth certificates, police checks, all that good stuff, and make copies of everything!

Like Kimbear said, it is up to the officer, and each time you/he might have a different experience. If your fiance has no criminal record or pending charges, he can try to cross again bringing ties to Canada with him. If he is denied entry, it has no effect on the K-1 process, just on your travel plans :P

Here are some answers to your questions! Hope I can help!

- For the support form, you do need the tax transcripts for the last 3 years. For yourself and your co-sponsor. You can get those by contacting the IRS by phone or by sending them the completed form (look it up on google). If there is an IRS office close to you, you can also go there and ask them for it.

- As far as pay stubs go, it is better to have them, but Chris' company is old school and still gives out written checks. When it was time for our interview, the secretary printed out the little slip that comes with the check and I brought the photocopies with me. Basically, if you can't provide pay stubs, provide something else that proves the income. Bring your bank statements or something...

- Someone might want to double check this, but I think that if you are using a co-sponsor and that person has assets with her husband/his wife, you need a consent letter from them as well... Like I said, someone needs to confirm this, because I'm not exactly sure...

- As far as the NVC question goes, someone from Italy might want to answer that... Did you try posting this on the Italy forum?

My only 12 year old kid(boy) will go with me,.. i will have to get a passport for him next week. Everyone would always recommend to bring the child if possible. Of course, for the mother's complete happiness :D ,.. My annulment papers states, the custody of the child is mine, so i guess i don't need any letter from my ex husband, i hope so,.

Hi,

I've read an article regarding packet 3, stated that they don't send any packet at all instead they'll notify the beneficiary and petitioner through an email being that packets that were sent before get lost most of the time. I tried looking for that article which I have read but I can't find it anymore. I have scheduled my interview this Feb 20th but I didn't receive any packet nor an email.
What we did was, we called NVC and got our case #... and we went on with the process of paying the fee and calling to schedule for an interview.. This is also the step a lot have taken here in VJ, we just tried it.
I am not an expert or anything but I'm just sharing to you what we have done.

I am planning to take that route too as soon as we receive our NOA2, still waiting though, hope next week, if i'll get an RFE its ok, means they're already reading our petition. If approved,..i will not wait for the packet, soon as we got our MNL Case #, then good to go for visa paying at BPI, then schedule online for interview. At least a little idea on what to do next.

In my culture, we rarely get proposed to. We just talk about it, decide to do it, and the man usually asks the parents' (dad's) permission before or after. During my interview, I was asked that question. And as the CO knew of our culture, I told her that we just talked about it and decided together and she accepted the answer. As long as you tell the truth and you don't create an elaborate false story where you both are saying something different, you should be fine... Just as I say, tell the TRUTH. :thumbs:

He did'nt kneel down, or even asked me about marrying him. But we are discussing a lot for our future, even kids name :yes: . We have this mutual understanding, funny but while i was doing my letter of intent, had a weird feeling ( at least for a Filipina) to say that i will be marrying this guy, who didn't even officially asked me to. But i love the fact and the thought of marrying him. I have no worries for questions at interview, i maybe have no ring but i have the genuine love to support everything. I hope, he will surprise me when i get there, still want to hear those magic words. :yes: To add, we've known each other for more than 8 years now. Had to go through a tough annulment ( took time, big time).

I recently got an RFE and am still waiting for the letter. I just checked my package the 2nd copy i made exactly like the original for my records. Theres 2 things that may be why i was sent an RFE. What do you think? I learned about primary and secondary evidence. Looks like i have no primary Evidence. This is basically what i sent for evidence.

1. 20 photos of us but did no write our names or dates on the back. Honestly i dont know the exact dates of these photos?
2. Facebook and emails 1 page
3. Engagement ring receipt
4 Orbitz travel info receipt

Im thinking maybe that wasnt enough evidence? Also i noticed we both did sign our names on the forms BUT she only signed her first and ONE of her last names.. Example Mary bravo smith. She signed mary smith.
I hope i get this letter soon!

We just received an update on our case status today and we got an RFE. We were expecting this as our lawyer did not included my fiance's Letter of Intent in our packet due to some typo error. My question is when should we expect the hard copy to arrive in the mail? I know RFE could be heart shattering but for me, it's a blessing. This is a good sign that CSC is moving forward with our case. I hope my fellow CSC July Filers will hear good news soon and good luck to all of us waiting for NOA2. When i mailed my docs. to my fiance. I included my passport photos based on US standard passport size, my G325A and intent letters with my signature on it, even my birth certificate( its not actually necessary at this initial filing). I made sure i forwarded several copies not just the exact quantity they required. Service Centers sometimes misplaced our very precious documents, and mailing them take few days, so its better to have spare in case. Goodluck.

I have to say, part of why I don't read or post in the K-1 and CR/IR-1 forums anymore is because there are far less questions relevant to filing, and far more posts that sound like "I mailed off my petition 4 days ago and haven't heard anything, is that normal?" And that irritates me. Americans are so damn impatient. I didn't even realize this until I spent time overseas. My husband was never concerned about waiting, because his country's government takes forever to do anything. They can't even get a government ID the same day it's applied for, and we complain about waiting an hour at the DMV.
I was of the attitude that I wasn't going to whine about waiting. You can do one of three things: 1. ###### and complain, 2. Wait patiently or 3. Get up off your butt and move to your SO's country while you wait. Complaining and calling every day aren't going to get you an approval any faster.

This process is a choice. Our government doesn't owe you a husband/wife. Immigration is not a right. Suck it up and wait your turn. We all had to do it. God forbid some of you get a NOID/NOIR and have to wait possibly years for a chance for rebuttal..


Yeah my love lives in Morocco too, and it is amazing the stories he has told me about the government and how long they take to do something! By the way your baby is cuuuuute ! Im going to go with option 2. I wish it could be there in Morocco when the time comes but not possible :) Oh well, will see what happens!

I married a Filipina in 1975 while on active duty stationed in the Philippines. At that time, the MARRIAGE process was longer than the immigration process. I took her and my stepdaughter to the U.S. when I was transferred in February 1976. She and my, by then, adopted daughter became U.S. citizens in 1979. As I remember the process was pretty painless. Perhaps it was because I was on active duty at the time. Well, here I am again, going through the "process" to bring my wife of 11 years from the Philippines to the States. We have two U.S. citizen daughters, and the waiting seems to be much harder on me now than then. Hopefully the waiting will be over soon. 97 days today since my NOA1 and NO touches.



Hope it goes faster for you, wow.. eleven years! Congratulations :) Here's to many more.
