Hey guys My name is tony and im new to this site. I had a few questions my fiancée and I have just started filling out our forms. For the Letter of intent form and for the 325 A forms I was told that her signature cannot be zeroxed. I emailed her the form and she printed it out to sign her name in pen then send me a copy. Will that be a problem?

the I-134 only allows for one co-sponsor per intending immigrant. so either your fiance's sister or her sister's husband will submit the form. their income has to qualify for their household size (the co-sponsor, their spouse, any minor child, anyone they claim on their taxes, and the intending immigrant). you will also have to submit an I-134 as her primary sponsor, even if your income does not qualify on its own.

any US citizen or LPR can be a co-sponsor. some consulates will more readily accept a joint sponsor who is closely related than one who is not. you will have to look up your consulate requirements to see how lenient they are with co-sponsors.

Hello Kitthekat, Thank you very much for your response. My fiancées sister and her sisters husband will be helping to sponsor her. At first I wasn't sure if they could do it being they are not my family but thanks for clearing that up.

Hi all,
Thank you for replying to my freakout of earlier. So here's the deal:
I will be leaving tomorrow, on day 181, arriving in Canada at 7pm.
I drove here on May 23rd, and am flying back.
I have the original flight that I had made for November 22nd, thinking it was 6 months, not 180 days.

What do you think? Will this ruin the whole K-1 application, if I can show that we changed planned as soon as we found out to comply with the law? Also, it's not really a full day, it's less than 24 hours more...

Leave your insights, it's greatly appreciated.
Oh and yeah, if this were to be a big deal, when would I find out? While trying to cross the border again with the approved visa?

Hi all!

Well, I made it back home on day 181. Flew home as soon as humanly possible. For those who were new on the topic, here`s what happened:
- Drove down to the U.S on May 23rd with my boyfriend to visit (he`s the one from there).
- Got engaged in September.
- Made plans for the visa
- Thought it was allowed for me to be there for 6 months, planned trip back home for the 22nd of November (used the U.S. embassy site as a reference, and they stated 6 months for Canadians - no words about 180 days)
- Browsed this site on November 18th, the 180th day, and saw in the gallery a form of refusal from the governement where the 180 days policy is stated
- Started freaking out, no possibility of leaving that day - fiance at work, can`t drive me to airport. Can`t drive myself back to Canada (from Virginia, we're talking a 12 hour drive, and I found out about the 180 days at 1pm).
- Made flight arrangement for the following day, day 181.
- Made it home

My fiance and I are going to gather the following documents to explain the overstay:
- Original flight information
- New flight information
- Webpage of the U.S. ambassy stating the 6 months law, not 180 days.
- Letter from employer stating that on November 18th, my fiance was working and would not be leaving work in time to drive me to the airport.


Most of the people I spoke to agreed that even though it is not an ideal situation, it should not be enough to refuse the visa. Does anyone know if travaling days (days that you fly or drive) count in the 180 days/6 months? Because technically, I was back in Canada on the 181 days. Really, it is an overstay of half a day.

Yes. I copy of the G-325A as the new version is only one page and the previous was four.

ALSO, the previous form stated you needed to submit all four copies, yet the new form had this information removed. I also double and triple checked all instructions and there is no reference to four copies anymore so one copy it is :) Plus I honestly don't think you'll get an RFE for only including one copy, they can photocopy it or on the interview instructions ask me to bring more copies. An RFE is "request for further EVIDENCE" and you've already submitted one copy as EVIDENCE so yeah.. that's what i think anyway



What me and Chris did was to fill in one original, with original signature. I attached my picture in a bag to a sheet on which I had photocopied my passport. From reading all these posts I am both worried that we will get an RFE, but now I realize that the people that did get an RFE filled their papers in 2004. Hopefully, now that they only ask for 1, they will be smart enough to just throw our other copies out, with or without original signature... :wacko:

You're more than likely being paranoid which is expected as most of us were LOL!

as for the meeting..all you had to do was prove you met in person. pics passport stamps etc. relationship evidence is not needed at the initial stage with the i-129f application. I submitted a two line sentance with 3 pics and it was good enough.

Ok, so here I am waiting and expecting our NOA2, since fellow Vermont Center/November filers have started to receive theirs, and I'm wondering if I should actually be expecting an RFE instead...
Here's why I'm a little paranoid: on the I-129F question "How we met", we did have to include a page-long attachement to explain how we had met in the last two years and how we maintained our relationship in the last two years. However, I'm wondering if they wanted a detailed explanation of that. I mean, we stated that we met in Quebec, and blah blah blah, but I'm scared they will request further evidence... We explained how he stayed in Quebec with him and visited, and how we drove together back to the U.S so that I can spent time there and visit. I also included e-mails, 1 flight info for me going back (car was out of order at that point), 5 pictures of us...Did you guys go into extreme details on that one?

How about those of you who have recently received their NOA2, especially November filers in Vermont? Do you think I'm just freaking out - yeah I know I haven't included a lot of info here - but help, I'm afraid I'll fail my medical for being psychotic!

Hello everyone!
I was looking at the embassy info on here, and was a little freaked to find out the waiting time at the Montreal embassy for an interview.
I was wondering if any of you knew if one can change the embassy they will be dealing with. I live right in the middle of Quebec city and Montreal, and if I can spare some waiting time, I would rather go through the Quebec consulate.
Also, if anyone is dealing with the Montreal consulate right now, is the waiting time THAT long?

What Kizza said is correct. When i called NVC they always asked me out date of births as well. some times it is hard to get through to NVC, just keep trying, i went though an entire week of busy signals lol in fact we had a thread about how no one could get through! so just keep trying.

also you can ask teh specific date of when they received it, when they sent it to Montreal as well. Helps with the vj timeline. once that has happend you can start calling DOS and harassing them every week :P

Make sure you have a variety of evidence: pictures, e-mails, slip from postal services of items sent/received, flight information, boarding passes, hotel reservations, etc...

You should be ok with 5 pictures as long as you can provide other evidence as well.

One more thing...
I just ordered my long birth certificate online. However, I never saw an option to have it made in English. I will call them tomorrow to see if that can be done. If not, this is what I'm going to do:
- my translator will translate it for me and sign and date a paper that states "I certify that the present document is an exact translation from French to English and that I have the competencies to perform such a translation".
- I will have it notarized
(I also did this with my criminal background check)

Is this going to be ok?

I don't know if this will help, it seems you already had your answer, but I would try to get my medical before the interview and make two trips. You never know what might happen and you might not get the results in time for your interview. You would hate yourself for that forever if for SOME reason they weren't ready, you know? I've seen people on here getting their medical a month prior to their interview. Since there seems to be a good 3-6 months wait for the consulate in Montreal, you have time to plan it out.

Sounds about right! Provide the documents as soon as possible! If they asked you to mail it, get a service that will request a signature, this way you'll know it got there. Also, call a couple days after to see if they updated your case and try to get an answer.

I can't seem to get a clear and definite answer on these two, please enlight me! :wacko:
A)
First, I am getting my birth certificate and my criminal background check translated by a retired translator. He signed, for both documents, a paper that state :" I, ___________________________, certify that this document is a translation from French to English, and that I have the skills required to do this translation. Signed on ______________ in Trois-Rivières, Qc, Canada". AND, I'm getting those two documents certified by a notary.Will this be ok with the consulate?

B)
Second, on a question in one of the forms to fill in for the P3 (sorry I have neither the form nor the question close by) they ask for the dates of any previous trips to the U.S. About 6 years ago, I went to Michigan twice for a short time in the span of 6 months. I drove there once and flew the other time and didn't have a passport since it was not required for Canadians at the time. I have ABSOLUTELY no idea of the exact dates I went there, and have ABSOLUTELY no proof or receipts. I can say it was around September-October the first time, and late December early January the second time. What do you suggest I write down? An attachment explaining my situation?

Hi VJ Community!

I am currently filling out the DS-156form for packet 3 of my K-1 visa and got stuck on question 30 where it asks if I've ever been issued a visa. The short story is that my parents applied for a F4 Green Card (PR through a family member, specifially my uncle) for me when I was a minor which expired years ago and therefore I am now applying for K-1.

My first question is that before I was given my green card would I have received an immigrant visa and what type of visa was it? (It was over 10 years ago and my memory is hazy. I just remember getting a temporary Green Card at the border control) I was not able to find the appropriate visa in the scroll down menu on the eform.

My second question is should I type in that I recieved a green card at some point in time in the 'Enter Additional Visa Issuances Here'?

Any comments and advice would be greatly appreciated as I obviously can't sleep judging by the time of this post!

No, you don't need 4 copies. You need 2 of each for the beneficiary and the petitioner. Only the petitioner's birth cert or full US passport copy needs to be provided with the petition. All the beneficiary's documents are provided later, after the petition is approved, during the visa application process (usually at interview).


Sundrop is right, the USCIS does not require 4 copies anymore, even though the guidelines on here say so. If you want to be on the safe side, go ahead, but when my fiance and I filled, we had one original and 3 extra copies. We were freaking out thinking we were gonna get an RFE, but that never happened. We were approved regardless of the extra copies.

I am engaged to my south African boyfriend and he was very forthcoming about his criminal past. I was wondering what the likely hood of him getting the k-1 visa issued because of this charge.

here are the details...

he was charged with possession of 1 gram of cocaine. He was not fined and had a suspended sentence of 3 years of which he has served just over half of that....he never needed to serve any jail time.
this is his only offense on his record.

we plan to be honest about it and we are also prepared to file the waiver of ineligibility. but i would like to know if this is possible...

Well... This might be a big deal actually. The USCIS is not going to like it at all. They might request evidence that he's been clean in the last two years, or something like that. But the elligibility criteria are pretty clear. You should be honest about it though, that's for sure. Find all written evidence that he has not been convicted and so forth, and send that with your package. I know this is not fun to hear, but the U.S governement will not usually let someone that has a criminal background in the country, especially one related to drug offenses.
You can also try contacting a lawyer through justanswer.com, and find out what the deal is exactly.

Sorry if this is a little negative, and remember that you guys are absolutely right: being honest is the best way to get an approval!

Wow, I feel for you!
You could use an online tool such as ancestry.com, and since not much will pop up as you mentionned, you could use that as a way of showing them that what they're asking is impossible. The idea of having a family member sign a family tree is not a bad idea either, especially if you get it certified by a notary. Also, you can go on justanswer.com and ask an expert their opinion for 20$.

I hope this helps and my thought are with you on what is turning out to be a difficult visa journey for you...

The backgorund check is valid for one year from the date it was issued, regardless of what it may say on the certificate itself.

Incidentally, your K-1 is not approved. You have not even applied for a K-1 visa yet. Your US citizen petitioner's petition is approved. They are not the same and an approved petition does NOT mean an approved visa. Your preparation and interview will determine that.

When Chris and I got engaged and decided to go through the K-1 route, I had NO IDEA what it required and had never heard of it before, I read the guides, downloaded the exmaples of each form, and everything became clear. Read the guides thoroughly before posting questions that are too vague, you have better chances of getting a clear answer after that. It looks complicated, but it really isn't.
