If I were to mail him a letter or vice verse, with the mail system in Mexico, it's entirely possible that he's living and working in the States before it arrives in Mexico.

Thanks, Detty. You're definitely right about the money issue. And hopefully my passport stamps are clear (haven't checked for fear that they aren't) but I''ve made three trips down in the past year.

I'm definitely above the poverty guidelines, it's just that the nature of my job is such that I can't prove a steady, fulltime income 12 months of the year. At any rate, just to be on the safe side, I'd like to get my parents as cosponsors. Just don't know if that'll necessitate an affadavit of support or a letter.

I'm looking at flights, and they look dismal, price wise.

Guess I'll have to use my cell phone bill, and see if homeboy can't get an email account and hope for the best. I don't think I'll be able to afford to go down there.

It looks like our case will be fairly straightforward (fingers crossed)! But I was reading about what to do in between receipt of the NOA2 and the interview and have a couple of questions:

1)I've got two jobs, one is as an Adult Ed teacher so I'm not salaried, rather I have no income during the summer from that job. But I've planned for this. My other job is grant-funded and contingent upon receiving continued federal funding. It's sort of up in the air right now, but I feel fairly confident that I'll continue working there. It's not that hard for me to find a job around here that pays enough to eat and pay rent, but there may be a point where I can't reasonably sign an affadavit of support. Would it be wise to get my parents involved in this whole support question? If so, would they have to fill out their own affadavit? I've read elsewhere about cosponsors, but can't find the details.

2) ongoing relationship after the receipt of NOA2: I wasn't planning on going down to visit until we could meet up in Juarez, unless it seems that there is a hold up in the paperwork and the process isn't going as smoothly. So if things go well, would my phone bills (showing a zillion text messages a month and a phone call or two a week) suffice as proof? We don't communicate via email because he's hopeless at it. Would it be the safest route (although not the cheapest) if I planned a quick trip down there to visit? Of course, it'd probably be wise to save the money for later, but if another visit would strengthen our case and avoid not being able to prove an ongoing relationship, well, I suppose that I could get down there to hang for a few days. :)

Thanks for the answer, but I do know that this won't be needed until the interview! As you can see, I'm already getting worked up about something months down the line! The letter from my employer, recent pay stubs, bank statements and two years of tax forms won't be a problem, but I read elsewhere that they also require you to go back three years, which will be the problem.

I promised myself I;d stop reading this forum while waiting for my NOA1, but I can't help myself. I keep reading and finding requirememts that may prove problematic down the road.

Now I've read that for the affadavit of support, he must provide three years of my tax returns and W2s...but I've only been in the States for a year and a half and didn't file returns for the previous years ecause what I earned in Mexico was not enough to file. Will they automatically deny his visa because he won't have all the asked for documents? My income is high enough, but I won't have some of what they ask for...at least not as far back as they want it.

I'm going to stop reading these posts so I don't give myself an ulcer....just, you know, after I read the responses to this one. :P

My mother said that she and my stepfather would be pleased with filling out the affadavit of support for me...but from what I understand, they wouldn't fill it out as a couple. They're both retired, but while working, my stepfather had the larger income. They share all assets and investments and everything they have is in both of their names.

Does it matter which of them puts their name on the form?

i'm colored. usually pinkish, but then in the sun i'm colored in a different way. it's more like a fire coral. and my fiance is colored as well. but he's more like brownish colored. then in the sun, i'd say he becomes burnt-umber colored.

I remember that this question was covered, but I can't find the post.

I see that the I864 has a box to check saying, "I filed taxes for the last three years, but am only including my tax return from the most current year."

I only filed this year and last because the year before that I was living in Mexico and my income didn't require me to file. I don't have any record of this though. Do I leave that box unchecked?

My mother will be the co-sponsor. It would be much easier if she were to just submit a copy of her return rather than getting it from the IRS. They ask for the W2s and 1099s if this is submitted, but she's retired.

I'm looking over the I-134 to give to my mother since she'll be providing documentation as a co-sponsor. I know that Juarez doesn't require this form but just the documentation and that people use this form just to stay orgranized.

But the language in the form is specific to someone petitioning for another, which she isn't doing. Is that okay to still use?

And it also asks about specific contributions to the beneficiary. Could she write something along the lines of: in the event that my daughter is unable to provide for the beneficiary, I will make contributions toward the extra cost incurred by his presence in the US? is that too vague?

And what is her relationship to him: future MIL pending visa approval? mother of petitioner for the K1? the poor sap who was cajoled into being co-sponsor?

Yodrak...I'm a bit confused. :) When you say past income, you mean for the prior year, yes?

So if I made enough $ to be a sponsor for the past three years and this appears on my tax returns, that's not sufficient? Oh...wait...do you mean because the tax returns should be accompanied by a current letter from the emplyer, thus documenting that the past income has been sufficient and that the present income will also be (as evidenced in the letter from the employer). So in her case, the quarterly statements on their holding accounts in conjunction with a letter from the VP of USB...or UBS...or whatever, could take the place of a letter from an employer, which obviously she no longer has?

There definitely would be, but in the interest of not having to provide stuff from all their accounts, just using the quarterly reports. This is just extra stuff anyway, as she fulfills the 125% of poverty guideline with just her income tax forms.

My mother is also a retired teacher, and I am going to use her tax returns which show income from her pension. She also gets something similar to a W2, which I will include. Her investement broker provided a letter with the requested accounts information and she included the last few statements from their accounts.

I'm guessing she's in Mexico. If so, she doesn't even need the fiance invitation letter as you will receive one yourself in the States. That's the only thing they'd send to her in Mexico. Most people don't receive it any way.

If she has a contract, tell her to report the landlord to PROFECO. That should clear things up ASAP.

There's a great taxi driver that advertises on a few boards and who I used when in Juarez. He would be a great addition to your plan!

I do think that many prefer to stay near the consulate, if not because of safety, but because of access. I know that personally, no matter how nice and economical a hotel is, and no matter that I had transportation from the hotel to the clinic and consulate, nothing beats being two blocks away and being able to jump back and forth easily.

I think it would definitely be an interesting package for people wanting to discover Juarez for Juarez's sake, but most people dealing with the consulate both a)want to get in and get out of there ASAP b)don't have the money to take advantage of Juarez's charms.

Just my two cents. :)

Well, I almost always agree with telling the truth to immigration, is it a good idea to do so if it'll surely result in a visa denial?

Do you drink alcohol? and Do you or have you used drugs? are typical medical exam questions (at least in Mexico), and an affirmative answer to the latter will result in a denial, based on the conditions I mentioned above. And they DO profile, at least in Mexico. Men with tattoos and piercings are sometimes much more closely scrutinized and drilled with these questions.

Unfortunately, I know several people who have been denied a family-based visa for admitting to having smoked pot.

If they have admitted to smoking WITHIN the last three years, they will be denied and banned for three years from applying for a visa. If the person says that they smoked a couple of times, even years ago, they are considered a "drug addict." Three year ban.

There is a clause for ONE TIME experimentation that will supposedly not result in a denial.

One friend's husband was denied because he admitted to smoking over ten years ago, and then their explanation when she spoke with an IO was the his bloodwork showed up positive for use of marijuana in the past three years. despite this being a medical impossibility his visa was denied.

One would think that what Kez said would hold true, but unfortunately not when it comes to medicals for visas to the US.

I hate to say this, but yes, you should be worried. I truly hope that everything works out.

You can still file a waiver even as a fiance. But you must prove that, for you, moving to Panama would be an unendurable hardship for you.
