K-1 Fiance(e) Visa Process & ProceduresAt what point should I worry?
I gotcha...but my concern is that there have already been a couple of approvals for those that filed way after me, yet I've not heard anything.

Being patient I can generally do, but then there's the worry that something is wrong when mid to late Feb filers are already getting approvals.

K-1 Fiance(e) Visa Process & ProceduresNOA2
Congratulations for you!!!! I know how hard this wait has been for you.

How long can a Vermont filer wait before inquiring as you did? I filed the first week in February and have been seeing people from mid to the end of Feb getting approvals.

K-1 Fiance(e) Visa Process & ProceduresObservation about people getting NOA2's
Tonyeck...perhaps while we're waiting you could put together a graph to either prove or disprove this. I will read both of our tea leaves and consult with a psychic to find out when we will be approved. And Safitu, what do you want to do?

Might keep us busy (but definitely not sane) as we watch those who went after us get approved before!

Thank you both!!!

Safitu, but how did you actually get a live person? Did you go through the RFE prompt? I'm going to call after I walk my poor dog, who has been waiting patiently during my "episode." :)

K-1 Fiance(e) Visa Process & ProceduresFriday Morning Freakout
I know that there is no rhyme or reason to how USCIS processes cases, but I seem to be one of the first February filers from Vermont, and have not yet been approved.

How long do I wait before truly freaking out? There's nothing odd about our case and my fiance has never been to the States, but I just don't know what to think right now.

What do you recommend, other than a prescription of Xanax?

I know that the VJ timeline is ONLY a guideline based on others' experiences, but the date given was March 5:

Based on timeline data, your I129f may be adjudicated as early as March 5, 2007*.

If this date has passed by more than 10 days or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline.

Obviously, the second paragraph is a funny message...the USCIS processing times are in August!!!

There's no reason that I can think of that'd we'd be denied, but I don't know how long to wait before being worried that there's actually a problem

Help!!! I know that there's no specific question here, and I'm soooooo psyched for safitu and tonyeck, but I feel like the cheese right now...the cheese stands alone.

Also, when you turn on email notifications on the USCIS, it doesn't show up that you've actually done that, right? I click it on and click it off when I get all nervous, so I don't know if it's actually on or not.

We're all going through this process for our partners...trust us on this one when we say it's the petitioner. Look at the forms you have to file, with the specific data for the non citizen loved one.

The faxed form is a no-no. Her G-325As have to have her ORIGINAL signature on all four copies.

Just the facts at this point.

You also don't need evidence of a continued relationship at this point....you simply need to prove that you have met in person within the last two years. Evidence of an ongoing relationship is only needed at the interview.

GabachaYucatecaFemaleMexico2007-03-11 13:30:00
K-1 Fiance(e) Visa Process & Proceduresaffidavid but not of support
I was thinking along the same lines, but to bring a letter from my father to the interview. He REALLY wants Edgar here for some reason, and has offered to write a letter.

Might they consider it at the interview, or would it be superfluous?
GabachaYucatecaFemaleMexico2007-03-11 13:18:00
K-1 Fiance(e) Visa Process & ProceduresRFE???
Phila, but you sent in a copy of your passport, right? You should be fine then. I just stuck in my BC as an afterthought, but wouldn't have had my mom not brought it to me just before I sent in the petition.

K-1 Fiance(e) Visa Process & ProceduresG 325A - Attachments
I had to attach an extra sheet to my fiance's G-325A because he's had more jobs than lines on the form. I did this after leaving Mexico, and I signed them myself...he didn't. And we got approved.

The only proof of meeting I sent from the past two years were pictures from Dec 31, 2005 (no dates save for the ones that I put myself) and my return boarding pass from Cancun from my last visit this Xmas. I also sent some more photos, but were dated 2001, 2002, and 2003. Obviously, I was much more interested in documenting the early stages of our relationship, and got lazy after a couple of years. Oh, and a copy of the acknowledgements page from my thesis where I thanked his family.

So basically, I had only one piece of primary evidence of our meeting, and nothing with both our names on it.

So good to hear...I'm glad that you'll have the chance to talk face to face.

I remember reading your initital post and first thinking that you sounded so cold, talking about getting another woman. But I also thought that it was a broken heart talking!

I hope everything works out!

K-1 Fiance(e) Visa Process & ProceduresTranlating documents
No need to find a certified translator. I just did it myself and included the little blurb someone posted here. In fact, I wrote his letter of intent for him in Spanish and English.

And I don't think that the US is as picky about official translations as Mexico is.

I confirm, lucho. :)

My timeline is similar to yours, and I received my hard copy in the mail today, but knew about it on Firday because of my obsessive checking on the USCIS website. Check there first, then hold tight for a couple of days, maybe followup with your lawyer and then call.

K-1 Fiance(e) Visa Process & ProceduresProof of relationship on K1 visa app.
I think the lesson that many of us have learned is that we are no longer operating on our own timelines, but rather the timeline imposed on us by USCIS.

While I miss my guy terribly, I'm not particularly sweating our separation at this point....after all, we'll only be together for the next 60 or 70 years. A couple of months delay won't break us.
GabachaYucatecaFemaleMexico2007-03-19 18:04:00
K-1 Fiance(e) Visa Process & ProceduresWhere to get English translation of Birth Certificate
I don't see why it needs to be certified in the fiance's country of origin since in the States it is not necessary to be certified or licensed in order to provide a certified translation for official use.

That definition of what a certified translation is above sounds funny...there is no such thing as an exact translation...that would be babelfish. Translated documents should have the exact same meaning and tone as the source document, but would never be considered an "exact translation."

K-1 Fiance(e) Visa Process & ProceduresK1 Visa's and marrying outside of the US
No, the IR1/CR1 seems to take longer overall, but you won't have to face the hurdles that us K1ers will face once our SO is in the US. It sounds like doing it that way, you wait much longer to get permission to enter, but will already have work authorication and GC, wheareas K1ers get permission to be in the States much faster, but have a lot more work and waiting once here.

If you really meant it when you said eventually, then it sounds like the IR1/CR1 makes more sense...especially if you weren't planning to live in the States for a few years.

Of course it may come up at the interview, but I'm 5 years older than my Mexican fiance and we were approved no problem.

I wouldn't be too worried.

K-1 Fiance(e) Visa Process & ProceduresI'm freaking out :(
"paycheck english": there's one way of speaking that people use to communicate with friends and family, but they need to know the more standard form of English to be able to get a job, win someone over at an interview, etc.

GrenadaCrix: I LOVE Portland! When I went to college in Maine (Bah Habah) I remember hearing that the state was around 97% Caucasian, but that the three % non-white population lived in Portland. Regardless, I loved it there, and would consider moving to Portland!

Working and living in a highly diverse urban area, I've gotten used to hearing non-standard English from native speakers, and also most people I speak with have highly accented English since there's a large immigrant population. The English I speak is dubbed "paycheck English."

I'm glad you're laughing....I thought I might have actually PO someone!

Only thing regarding that that I'm actually worried about is that he tends to introduce me to people as "his wife." I have always looked askance at him when he does that, but now I REALLY have a reason to scold him for it.

I'm sorry...my attempt at sarcasm fell flat. :( But thank you for being kind enough to answer.

I was just tickled that the OP had the eggs to go off on people for not liking being asked such a fundamental, easy to research question.

Please forgive me for wasting the time it took to post a real response to my fake question!

Quick question...so my K1 just got approved and we have an open appointment for his interview. Is it okay if I just go to Mexico and marry him before the interview? Will that be a problem?

Lawyer will not make any slow down. But most of them are 'reactive' and paper based preference guys. In NVC, online methods are faster than paper methods.

I e-mailed my lawyer, I'm going to talk to them tomorrow. Hopefully they'll give me good news regarding the case!

IR-1 / CR-1 Spouse Visa Process & ProceduresNOA-2 Filers for April

You mentioned you have NOA2 of your I-130, right? If yes, that's the approval. USCIS will forward your case to NVC in 1 to 2 weeks time. You may use the lawyer, if he/she is efficient. Or if you are confident with the NVC shortcut (LingChe) that you can do yourself, you can avoid the lawyer.

NOA2 of I-130 means it is approved and visa# is ready for your beneficiary (you were LPR petitioner).

Loto

Thanks Loto! I really hope this is it!
