Is anybody a Cape Verdean Creole speaker or filing for someone from Cape Verde? If so, I have like two lines that I need translated for a sympathy card for the parents of one of my clients. If not, I can find someone to help me who speaks/writes Portuguese.

Everyone around here (mostly first generation kids) write how it sounds phonetically, so that's way too informal for a card.

I remember that when I was looking to file the K1 from Cancun that there was space on the forms to indicate that your mailing address was different from your physical address. This was especially important because the USCIS won't mail paperwork abroad that they typically mail domestically. I was just going to use my mother's address and have her FedEx me stuff.

You're getting a lot of confusing information on here, and info not pertinent to someone who EWIed.

Get in touch with lucksprite and she can send you to a forum with mostly waiver cases from Mexico for your friend.

Yes, his visa will be denied, but provided the case iswaiverable, with the Waiver Pilot Program, he would be able to submit the waiver a day or two after his visa interview. Provided the case is clearly approvable (they'll need to research this and write the most compelling letter possible with documentation), they can approve the waiver that same day and the non-USC will only have to spend that time in Juarez outside of US. If it's not clearly approvable, it's sent to the backlog and then looked over by someone else. This could take up to a year, sometimes more, and during this time the non-USC will have to remain in Mexico.

This is for the most straightforward cases...it gets more complicated if he has any arrests or convictions, if he EWIed more than once, etc.

As far as the lawyer goes, it's all straightforward up until the filing of the I601. However, I know many people who have written their own waivers and been approved. It just depends on whether they are willing and able to take on the work needed to research and write the letter themselves.

It's the weekenz guys, it's almost time for interview scheduling again im gonna start calling repeatedly on Wednesday since it's the beginning of December. They should start again around that time even though they say second week of the month.


Posted Image Philippines didn't start giving out interview dates until the 3rd week of November. Hopefully they'll start earlier this month. Although, I know most countries start the 1st week of the month.

My opinion probably doesn't matter, but you can be a May-June filer if you want.


I welcome any opinion or advice one would wish to offer edp333. :) In truth, I was actually being sarcastic to another member named G&A about the dates. I think they actually have the account processed just mearly waiting for the I-130 authorization. At least, thats what I'm hoping and praying for ;) :innocent:

I don't believe you would still be considered as a May filer. Your NOA1 will have a date from June. Also, I could be wrong, please don't quote me on this. I don't think you should have mailed the same check back to them. You are supposed to write a new one. Let me tell you why I think that. I mailed in my petition in Sept. 06 and it was sent back, saying I used out dated forms and they sent back my money order as well and it was stamped deposited. There was a letter saying bring this money order back to the bank and ask for a new one. That they can't use it again, as they already stamped deposited on it.
So when I sent back my new petiton, that was in October. I got the NOA1 in Oct. and that meant I was an Oct. filer now, not Sept.

Thank you akim oda, I will bear that in mind. Unfortunately I did send it with the same check because the notice I recieved only requested that I sign the form and send it back. I would think that if they didn't wish for me to send them the same check back they would have said so. But then again, I could also be wrong. ;) I don't see why they can't use it, as it was never cleared through the bank. They need only cash it. There was a blue notice. "Once the form is correctly signed, place this blue notice on top for speedier response time" I'm just doing exactly what it told me to per the notice. I hope they don't want me to re-write and resign every single document all over again. :( But again I would have thought if they had, they would have told me in the notice as a disclaimer. Am I giving them too much credit? :innocent:

I too just recieved a package from the VSC. Unfortunately it was not an NOA1. They rejected my petition! :crying:
In my haste, I had forgotten to sign the actual I-130. (I swore I checked it 5x) *bangs head repeatedly against the wall* I sent it back today. Oddly enough, I noticed my check was attached with stamp that said deposited. Also there was a sticker that was on my I-130 petition that began with EAC. G&A, am I still considered a May filer even though I had to refile again today? ;) I'll keep you all updated.

I don't know if this helps but you might be better off just clicking on the link above the conversation window in MSN Messenger. The one that says, "View your entire conversation history with this contact" It SHOULD open a list of all the conversations with a date and time stamp on them. Maximize the window (click the square in between the dash and the x on the top right hand corner) and press CTRL (control) P for print. Voila! You will now have a neat printed copy of all the conversations you and your beloved had. smile.gif Let me know if this helps you guys out good.gif

As Deb said, it's hard (if not impossible) to understand what USCIS really meant; if indeed what the officer told me will actually happen; or if my case and your case will have the same treatment.

Let me give you more details on how my conversation went with the officer. First thing she asked me was if I paid anything for my I-129F. I sent it in August, so the answer is no, I did not paid anything for my I-129F. Then the officer answered "your I-129F is going through an administrative cancellation. When I-130s were taking too long to get processed, I-129Fs made sense, but now since our times have improved (yeah, right), why would you want to have a K3 when you can have the I-130 approved? Your I-130 is in the queue for approval, may happen tomorrow, the day after, blah blah".

I was left with the impression that if I had paid for my I-129F, it would get processed. But since I didn't pay for it, my only option is to wait for the I-130. Go figure. Yesterday, after discussing this with my wife, I came to the conclussion that I could spend nights and nights trying to make sense of this whole process, and still be left with more questions than answers. So I will simply wait, Amoro. Wait for an RFE (I haven't got one yet), wait for I-130 approval, or maybe even I-129F approval. I will call USCIS around Feb 15th, if nothing happens before.

Please let me know if your case changes. Your case has been the closest to mine that I've found. Good luck, my friend.

Juan, that's exactly what they said to me in November. I was told by the person on the phone and their supervisor the same thing. They said it's their "policy" to terminate the I129F and I didn't really "need" it. They said i'd be better off in the long run but they didnt take into consideration that it takes a lot longer to get an interview for a CR1 then for a K3 so I was crushed.

I asked my senators to try to stop them from terminating it. They couldn't do anything.

I called them repeatedly only to be told the same thing over and over again. So i pursued the CR1. I made ALL the payments.. grand total $830. I now have one final set of documents to send them to complete the CR1 at the NVC and suddenly on 1/24 (after 4 months of inactivity.. 7 months after filing) my I129F was suddenly approved. Their "policies" are not policies. Their rules are only rules to some.

My advice, pursue the CR1 just in case they actually do terminate your I129F then you won't kick yourself later for wasting time but don't forget about that K3. The adjudicators clearly aren't let in on the policies of the USCIS and it might just be approved. Mine was not the only one that got approved suddenly.. asmo and davejaz had the same thing happen. Asmo and Davejaz were smart enough to pursue the CR1 from the beginning.. i didn't. I held out hope for that K3. In the end I got lucky. We may not all be so lucky.

Still waiting on Dept of State. I believe our I-130 and I129F will be the first to reach USEM because they sent me a checklist for our CR1. Apparently the website they directed us to for all the info to be sent did not clarify which police clearance was needed. (We sent local police clearance) They needed National (NBI which is FBI for us in the states) So after my wife mailed the copies we needed I forwarded it over to the Dept of State. They sent my a letter telling me that within a week our other petition would be on its way to the Embassy. *shrugs* I couldn't have guessed this would happen if I tried:P Just an update since I've been immensely quiet with the holidays and school and such. smile.gif

I am going to post our review as soon as possible
It was a kind of opperation to go to the interview as we live 6 hours far from the American Embasy in Rio de Janeiro.
My husband had to work on line from there then no time to enjoy the beauty of the city.
We are back home now and very happy for being APPROVED.

Congratulations davejaz!!! good.gif good.gif kicking.gif kicking.gif ! Still waiting on my RFE. Probably won't reach here until Monday. We are going to be buried in snow by this time tomorrow. We have a huge snow storm headed our way. It is supposed to start sometime after midnight and snow until Sunday morning. Maybe 6+ inches. Doubt I will see anything from USCIS until next week.

I must admit, they have me scratching my head. I didn't think they would approve the I129F after so long. I fully expected to have them give me the same story they gave kathryn (divinemercy) sad.gif *that still really really sux kathryn* Now I wonder which will get to USEM first, my original K3 petition or my newly submitted CR1 biggrin.gif

Dave, your wrong in that Kathryn has now joined you on the CR1 track as of yesterday.
Her situation is very similar to yours, I130 approved long ago, still waiting for the I129F. She had decided to wait for the K3 because of the shorter wait for interview at Lagos while you decided to pursue the CR1. Yesterday, she called VSC and found out that because she no longer has an underlying I130 pending, they were canceling her I129F. So no K3 for Kathryn, CR1 all the way. good.gif

Oops, sorry guys I didn't see that previous post. I wouldn't be surprised if they did the same to me but there doesn't appear to be any mention of it as of late. I'm currently just waiting for my packet with the DS230. I think they sent it by pony express tongue.gif I'm giving them the benefit of the doubt with the past holidays but seriously past two weeks to go from New Hampshire to Rhode Island?? I can walk there and pick up the paperwork faster wink.gif

Ok, the consulate would only have the K3 now even if the I130 was sent to NVC. NVC takes 2-6 months to process an I130 for CR1/IR1. Did you get anything from NVC for the I130? You can call NVC and use the automated system to see if your WAC (or EAC # for VSCers) is in their system for the I130. There is the DS3032 (choice of agent) that goes out to you and your spouse. There is the 2 fee bills (affidativ of support and iv fee) that you would get after that.

iv bill? when my I-130 was sent to NVC .. about a month later I got the following in the mail:

Affidavit of Support Fee Bill
Information about Agent of Choice Letter (ACL) DS-3032 form
DS-3032 Form itself
cover letter
letter with contact info for the NVC

That's it.



G&A looks like u can use a new color maybe. Probably black. You could black out my I-129F section for dead, terminated, murdered. It's up to you. Hopefully I'll be the only black spot on the chart.

The IV Bill only applies if you are going for the CR1 or IR1 (if you're married longer than 2 years *I think*) I got it because I'm on that track. You are still applying for K3 Non-Immigrant visa so you should not receive that bill. You just have to pay for AOS (Adjustment of Status) once your husband gets there. Its all water under the bridge really once he's here. Anyone please correct me if I'm wrong;)
