Feeling sad as they seem to have just forgotten my file.  Everything/everyone transferred in same batch as me to CSC seems to have been worked on (RFE/Approval)...  Mine sees no action... oh well.

I heard the samething regarding coupling of k3 and i-130 at VJ as well. I sent mine k3 in couple weeks ago, and it is in MO NBC. I haven't seen any updates on the location of my i-130 at this point, hopefully it will not be joined up because it might slow the entire process...........

I filed I-130 (PD 07/17/2013) and then I filed I-129F (K3, NOA1 on 07/26/2013). I called USCIS yesterday and was told that both applications are at the MO NBC. They also told me that I-129F processing time is about 6 months.

But from I reaqd in here, I guess both applications are coupled and processing will happen at teh same time following I-130 processing time.

I still have hope I-129F will be approved soon, I'm on the 4th month of the presumed 6, we'll keep you posted

Hello everyone!
I called uscis today because I never recieved my noa1 in the mail. I am living overseas with my husband (thankfully we arent apart through this horrible process). The gentleman told me that they do not send letters overseas... Go figure. I would have just let it go but I am considering filing for the K-3... I had him send it to my parents house.
Think it is worth it? Guess it cant hurt!?

Just got off the phone with an agent from USCIS national customer service, he said at this point they don't know how long its going to take for applications that is in the NBC. The NBC has not informed them anything at this point, and nobody would know the information.

 

I did a quick google search and I can't find the phone # of the uscis overland park. I was wondering, if some how we can find their phone # and ask for division 8 may be we can get some actual information instead of routine scripts from the agents..... Thoughts?

From what I read so far, only ppl that are getting NOA2s from Overland park KS are expedited requests.

I am a little late in the game posting here, but I have been lurking for a while.

 

We filed I-130 and I-485 concurrently at NBC on 7-24-2013.  We recevied a NOA last week and had our inteview scheduled for 10-8-2013 in San Francisco, we are nervous this seems to be moving faster than others. 

 

Partner is here on an F-1, we were married shortly after same sex marriage resumed in California and the Windsor decision became effective/implemented.

 

3-31-2010 Met while partner was here in US visitng family and looking at schools

1-20-2011 He entered on a F-1 Student Visa

7-5-2013   We were married at our home in California

MSC, or Missouri Service Center, is another name for the NBC. So if your I-130 is routed to NBC from the lockbox location, then your USCIS receipt number will have the MSC code.

 

I think the common wisdom is that petitions that are routed to NBC will eventually be transferred to USCIS local field offices in the cities where the petitioners live, or to other service centers. However, there are instances where the NBC actually processes some stand-alone I-130s. In fact, USCIS opened another NBC location in Kansas with the purpose of handling/processing stand-alone I-130s. But many VJ members have noted that their I-130s were still being transferred even though theirs were initially at the new NBC office as late as Dec 2012. 

 

As for locating your I-130, I think the only way to do it is to call the National Customer Service Center (1-800-375-5283) and ask to speak with a tier 2 officer. You should only do this maybe after 60 days from the notice date on your NOA1 because chances are, if it is less than 60 days, then your I-130 probably has not been "touched".

 

Lets hope our petition in landed in Kansas will be processed in a timely manner............. good luck to all of us!!!

Hello,

 

I knew I should have ask earlier, but I just filed my petition last Friday, the following are the evidence I included:

 

 

marriage certificate

communication records (emails, qq messages, and skype record)

her travel records (3 times) to U.S

my travel records (2 times) to China 

travel records within U.S (2 trips to Vegas)

Notarized affidavit letters from my mother, 2 of my friends and 2 of her friends,

16 pictures, some of the pictures has us with friends and family members.

 

we were not married on the first visit, we were not introduced by a family member but we were introduced by a mutual family friend. I don't believe 7 years apart is a large age gap. And none of us has ever been married or having any kids.

 

We don't have any joint assets or bank accounts at this point, we were planning to add those after our wedding ceremony. We only picked up our marriage certificate earlier this year in Seattle area. 

 

Is this enough information to pass the first hurdle?

My wife studied in United States, what kind of police clearance I need for her? Do I need it from state's level or FBI level? I am still between noa1 and noa2 phase, the reason I ask now is, it could take 12 weeks for FBI clearance, and I need to obtain her finger prints. I am already waiting for noa2, mind just wait for police records at the same time :-)

The problem in proving her ties to China is that she is married to a resident or LPR of the USA. USCIS feels her ties change to that person once she enters the USA. That is exactly what they told me. I was denied 3 times. I was also told they would not let me enter if I did somehow reach a POE.

You indicate she was already denied entry once and lost her tourist visa. She will be denied if she attempts to obtain another one.

None of that will have any affect on her future immigrant visa actions.

 

I am a United States citizen, does that makes a difference on visitor visa?

Hello all,
 
Hopefully this is the right forum to ask this question. I am in i-130 petition process to get my wife back to the states and I understand according to U.S. law, she is allowed to coming as a visitor (in theory) as long she can prove that she has strong connection back home and she will leave the country within the date of her visitor visa.
 
Here is my question, she was sent back to China and volunterliy withdrew her visitor visa by CBP officer in May because she couldn't provide strong connection back home. I understand if she go for a visitor visa again, the chance of her getting one is not with her. But will the visitor visa rejection affect the i-130 process and consulate interview later on?

I'm from Canada.

No visa is needed.

We just go back.

We also haven't had our interview yet and I would never anticipate a hard time being given as being denied was not a big deal.

Other canadians have been denied lots of times and were never even remotely questioned at interview.


I expect denial after marriage is fairly common.

It's a pretty big red flag if you don't supply enough evidence of return so I really wouldn't think so much into it.

Don't let it keep you up at night, it's really not a big deal.


 

Thank you for your reply, it is much appreciated. I hope U.S consulate in China would be this thoughtful, I guess since visa was not needed for Canandians thus there wouldn't be a record of it. Anyways, I just completed my i-130 petition and will sent it out first thing tomorrow morning, I won't worry about it until it is actual DS-230 time :-)

You do NOT need an I-130 to gain entry.

They probably just mentioned something about it because they thought she was trying to immigrate.

Like niki said, did she provide ties to her country such as a lease, bank statements, employment letter, etc etc.

You really need to carry these things to prove you'll be returning to your country when visiting somewhere where you have a spouse as that can often be viewed as a huge red flag.

 

Don't think much of it.

The way you answered the question is definitely incorrect though as her denial was NOT due to having no I-130 filed.

My husband was denied 5+ times entry into the US.

I have a question regarding ds-230 part II question 42(Have you ever been refused admission to the United States at a port-of-entry? (if answer is yes, please explain)) 
 
My wife was denied entry at port of Seattle in May, because she and I were married in U.S in Feb. 2013. She was given the option to withdrawl of the tourist visa and was sent back to China. I will sent out my i-130 petition soon, and I was researching how this process works and I found out on DS-230 form question 42, they ask that, what is the best possible way to answer this question?
 
My answer would be: 
 
42. Have you ever been refused admission to the United States at a port-of-entry? (if answer is yes, please explain)
 
Yes: We didn't realize i-130 petition was needed to gain entry, we thought all we need is B2 visa and adjust her status when she arrive.
 
According to my lawyer, she said this is not a big deal as long we answered truthfully. The answer I give above is the truth, is there a better way to articulate the answer?

I've been waiting on my NOA2 for the I-130 for 6 months now and my hubby and I just decided to file the I-129f this month.  A user on another topic, who has also been waiting 6 months was actually called into the office by her lawyer who advised her to file this I-129f now.  Another person also had a similar experience.  We think the Immi. lawyers have come to know something which has prompted them to suggestion their I-130 clients now file for the K-3 path as well.  

 

I mean, once upon a time the K-3 was originally put in place for this exact scenario...where the wait times for I-130 are ungodly long.  Then things started getting processed faster and thats when the K-3 became obsolete...I-130s were getting processed well before I-129fs, so no point in bothering.  But NOW, its back to moving at a snail's pace with a massive backlog, so it would make sense if they are starting to process the K-3s again.  

 

The general theory I've uncovered from reading millions of posts is that during this waiting period, wherever your I-130 is sitting, filing the I-129f means they have to locate your I-130 to confirm that it exists and check its status.  the K-3 is supposed to be processed while the I-130 is pending, but I think the actually operating procedure is that they just grab the I-130, while they're checking it exists, and processing that instead of the I-129f.  Then you get notification that the I-129f is dropped and that your I-130 is advanced to the next step.  Seems awfully coincidental that it happens in that manner more times than not.  (Which is dumb because if they were smart they'd go ahead with approving the K-3 since that would actually get them more money in the long run).

 

So even if the K3 is dropped, if it means getting hands and eyes on the I-130 then whats the harm?  There is no cost to send the I-129f and it will either help or it won't.  You either move forward or you stay where you are.  No loss.  And it least you take a shot at it.  "You miss 100% of the shots you don't take" so I would say go for it.

What i have read from others is since you do have a I-130 on file the I-129F will be sent also to NBC (I had thought it was going to TSC with the other I-129F) but nope.They will marry up your two petitions so they can sit and marinate together. but hey like darnell said if you are waiting all this time why not. lets hear a successful story about a k3. It's been ages since we have. Go for it.

IMO, currently, filing an I-129F SEEMS to get the I-130 yanked to another office altogether, 

and both are adjudicated at the same time. 

 

IMO, if it seems useful, this casefile pulling, then I say go for it.  Ya, I usually don't say this, but if yer gonna wait regardless, a casefile yank seems useful.

I think it might be worth it to file for K-3 visa at this point and time, I sent out my petition during July. I contacted a person in the liaison department and he said I still have at least 6 months of waiting.

 

From other ppl in VJ, they said the wait time should be around 11 to 17 months. I just hope the request doesn't land itself to overland park. Any suggestions? I understand K-3 is obsolete, but it might bring my wife and I together quicker.......

I called them and was able to speak with a Tier 2 agent, she told me to ignore both emails and keep on waiting, since the address was not changed............ Hopefully there will be light in the other end of tunnel, and hopefully that light didn't turn out to be a train.............

 

Progress.  They probably didn't actually change the address.  Call and make sure the correct address is currently on file.

I Just received back to back emails from USCIS, one stating the alien number has changed, another stating the address has been changed........... Here is the kicker, I didn't change the mailing address, do you have any idea what just happened here? 

 

If you were able to obtain a police certificate, then apparently they are available, though the State Dept.'s page that would contain the instructions for obtaining them, doesn't mention them at all.  Strange and unique relationship the US has with Palau.

May be I should ask the Palau police for some information, I do have the police clearance from them for my wife very quickly from last year. But I am not sure if they would let me know if they caused the delay.

 

 

Could very well be the Palau connection is the cause of the delay.  No mention is made of any police report being available OR unavailable.

I think you are right, my wife did went to high school and college in the states or U.S territories (Palau). I guess it will take a while for the wonderful people in Palau to get her background........... 

 

 

The letter does not indicate whether the background check issue relates to the USC or the foreign spouse, but it does seem more likely to be the foreign spouse, in your case.  If you also immigrated previously, especially through marriage to a USC, they it could be both.  Without knowing more about your circumstances it's difficult to say.  However, if there's something specific that worries you, that probably IS the issue.

I am in the middle of i-130 process, and this is the respond i got today from my senator:

 

According to USCIS records, your constituent's I-130 case received an initial review by an officer at the Nebraska Service Center (NSC).  However, a background check process was subsequently initiated in his I-130 case; and it is not yet complete.  USCIS electronic records indicate that this case is currently pending background check clearance.

 

Please note that a small percentage of immigration applications and petitions have unresolved background check issues that can delay adjudication.  Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to determine when the background check process will be completed in your constituent's I-130 case.  If a background check reveals an issue that may impact eligibility for a requested immigration benefit, further inquiry is needed.  The inquiry may include an interview and/or contact with another agency or USCIS office for updates or more comprehensive information.  Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.  If your constituent does not receive a decision or other notice of action within 60 days, please contact us for an update.

 

Something I don't understand, what triggers the background check? I understand my spouse has stayed in the U.S for 7 years as a high school/college student and she does have an alien # and SSN. Is that the reason? Also, how long does background check takes anyway?
