Have tried calling the airline(s) to give you a print-out of your boarding schedules? At least they should give you something that shows you boarding at certain airport & time and your arrival & time? The pictures alone is not enough - you used boarding passes. If you don't these then make clear copies of your arrival and departure stamps in your passport.

A notarized affidavit from your landlord that BOTH of you live at that address or location should help. Also, do have any receipts of you two transferring money to each other? Any gift receipts? Do you receipts of any valuables, example an appliance or furnitures that bear the name of both of you? The more pieces of evidence you provide will go a long way to support your case.

I found a few time stamped photos from 2011 and I have 8 separate stamps of admission but the RFE says all foreign language documents must be submitted with complete word-for-word English translations and then must certify it. Do we have to translate the stamps then? Keep in mind that two of my stamps are not your normal, cross the border stamps. One is a courtesy visa from Peace Corps in Spanish and another is an extension of my tourist visa.

I could potentially do the letter from the landlord but that is just going to delay us more but I also don't want to rush it if that document could really help us. Other people on here, the majority I believe, haven't lived together so part of me just wants to send in my passport stamps (translated if necessary), a certified letter from Peace Corps saying I lived in Guatemala, the one itinerary I can get my hands on and 5 time stamped photos.

You are talking about evidence of meeting in the past 2 years? The passport stamps will be added evidence. Send the pictures and put the date behind and write who is in the pictures and where. What about boarding passes showing that you were there.


Yes, the evidence of meeting. I sent like 10 pictures with the date and where on them when we initially filed the petition. On the RFE it says to send ticket stubs or itineraries if you have them.

Ok, so my fiance and I just received and RFE in the mail that says we need to send more evidence. Here is my problem...I was in the Peace Corps in Guatemala from April of 2010 through March of 2012 then I lived with my fiance from April to September. During my time in Guatemala I flew back and forth three times and I flew there again in November and I am going again next week. The problem is that up until the beginning of last year we hadn't decided what we were going to do in the future so saving my flight itineraries and whatnot had never even cross my mind. Now when I get on Expedia they have all been deleted. I have my info from November and from this coming trip and an email confirmation from a trip I made in April of 2012 but other than those flights I don't have proof of my flights even though I was living there. We have been together for 2.5 years and have plenty of photos but I want to make sure I have a sufficient amount of evidence in for them. Unfortunately we have nothing but photographic proof we even lived together as there really is no such thing as a lease and the power bills were always in our landlord's name. Could getting a certified letter from our landlord in Guatemala saying when we lived there and for how long help us out?

I can get a certification from Peace Corps confirming my time in Guatemala so I know that will help. I am also going to copy my whole passport and all of the stamps but to me that seems really easy to fake since there are no identifying numbers on the stamp pages...I don't understand how that will stand up as proof for them. I copied my front page and some of the stamps when we submitted the petition, will photocopying it all make a difference? I just don't want another RFE so I want to be as thorough as possible. If anyone has any advice about the plane tickets or what else we should send that would be much appreciated!

If you have an I-134 for the tourist visa, and also one for the K-1 visa, this will not affect the K-1 visa. Just that when you do your I-134's, you need to include the person from the other I-134 as a member of your household and have enough money to support for the household size. For example, if you do the I-134 for the K-1 first you obviously will put yourself and your fiance (and anyone else that you provide support to). When you do the tourist visa I-134 second, you will need to include yourself, his mom, AND your fiance (because its on another I-134).

Basically you need to put down everyone you are supporting on the I-134, including people that are on previous I-134's you are still obligated to support. As long as you have enough financial support to support your household size then there will be no problems.

You won't be able to do anything to help with the tourist visa. His mom will have to prove strong ties to her country on her own. The I-134 you do for the K-1 visa will have no effect on his mom obtaining a tourist visa.


If you want to send an offical invite you have to do an I-134 for her too. I have done the tourist visa process already so I know what she will have to prove. I am talking specifically about having two I-134s out at the same time and how that could potentially affect our K-1 visa.

Not sure why you are going for a K1 if that is such a major parameter.


Having his mom at our wedding is the USA would be much easier than having my entire family in Guatemala for a wedding. That is why.

I want to do the official invitation but I dont know how doing two I-134s will affect our current visa. Should we wait on the tourist visa for his mom until our visa is complete?? No question is a ridiculous question!

Since you are the sponsor, use the I-134. The purpose of the forms are below.

I-134: To show that visa applicants have sponsorship and will not become public charges while in the United States. The sponsor must file a separate affidavit for each applicant.

I-864: To show that the applying immigrant has enough financial support to live without concern of becoming reliant on U.S. government welfare.

The link is from USCIS to her and her husband. Is it different for them because they are doing the K3? Our cases are almost 100% the same but they chose to get married right before we left Guatemala. I am sure someone, somewhere on here has been in this predicament or has some suggestions. I am contemplating flying down for our interview on April 11th. Part of my decision involves being able to fly back to the States with my fiance. Obviously this is contingent 1. on him getting visa and 2. the visa being in hand on time.
I don't know how other embassies work but with Guatemala you have to select a cargo express location for them to send your visa to which takes most people about 5-7 days to receive. My issue is this...I am flying in the day of the interview and with my vacation time I will be able to stay Thursday to Thursday. I am going to buy a round trip ticket but I am unsure how to make my fiance's reservation. I don't want to buy a ticket and when it comes down to our flight day his visa still hasn't arrived... Have people purchased refundable tickets in this situation? Or have people purchased insurance for flights and then cancelled them if things didn't go as planned?
I know it is crazy to try and get both the interview and the actual flight out within a week but I really want to see if it is feasible.

My fiance and I received NOA1 on in mid August, however, I cannot recall if he submitted the "Intent to marry within 90days" part. We have yet to receive RFE, I'm just worried. Should we not have received and RFE by now if that were the case?

Hello everyone, i just google on website for an immigration information and found this fabulous website, and yet i still haven't find out the answer, so please please anyone with a useful information really help on my scene here.... thank you for the best of your time and sharing information to help me here. 

 

i'm an us citizen and  i applying for a package of I-129F for my fiance and USCIS have received the package and continue their examine our paper work in Feb, 2013 till now, i just got a notice said needed to update some more proof of our established relationship, during the time my fiance is pregnant and ready to give birth to our first daughter before the time of she received the k1 visa... " i understand that having a child doesn't speed up the processing our visa ", so my point here what should i do? i have gather some information from friends said that i should:

 

1. have a copy of birth certificate of my daughter with both parents name on it. 

2. have a talk with us embassy in vietnam, so they can ask me and my baby have a DNA test 

3. obtain a test result, and bring back to US to apply for US passport for my baby? 

 

please many information sharing would be much much appreciation from our family

For me, my casefile was adudicated at a local office in Irving, TX.

 

I learned that none of the stuff I frontloaded made it over to NVC.  So I sideloaded at NVC, shoving stuff in with the DS-230 submittal for EP.  It took a bit of time to get a case complete, as the NVC folk had to detach my evidence and add it into the SAFEFILE version of the casefile. 

 

If yer casefile isn't yet with NVC, plan ahead, aye?

 

Aye, better to plan ahead then get caught off guard :-) I am also consider getting a lawyer in Guangzhou in case we get a blue slip......... I hope I am not thinking too much............

 

I just sent my stuff in on July 5th, and I received the unofficial NOA1 last Friday. Thank you for letting me know the case file abdication, I will make sure to side load and back load during the phases

Welcome to the forum. I also live on the Eastside.

 

I traveled to Guangzhou to provide encouragement and support for my then-fiance at her K-1 interview, yet was barred from attending the interview (per consulate policy),  I gave her an EOR, inserted lengthwise in my passport, to present to the IO at the start of the interview. The IO took my passport and enclosed letter, glanced over the letter, returned my passport to her, and commented that the USC was in Guangzhou. I don't know if it helped, but I know it certainly didn't hurt our case. Guangzhou is known as a high-fraud consulate, it is my impression anything supplemental data that you can provide to the IO to support your case if a plus.

 

YMMV.

Thank you for the reply, I just completed my EOR letter yesterday, I will turn it in during the nvc and interview phase.

 

I also front loaded my i-130 petition with 5 notarized affidavit letters, tons of communication (QQ, email, and skyp) records, and 16 photos (many included us and family/friends). I will give it to nvc during that phase and another copy to my wife for the interview. Hopefully this will work for me............... keeping my fingers crossed.

You won't find it listed as a requirement from DoS or GUZ IV.

 

However, in blue slips issued at GUZ IV, it was a thing asked for.

 

Rather than be reactionary, many folk have included it with I-130 or I-129F,

then again at NVC (for spousal visas)

then again on interview day at GUZ IV

 

Why all of that, you ask? a relationship grows over time, so an Evolution of Relationship letter would grow over time, as well.

 

Never subitted one prior to interview day?  That's ok - you can still submit one on interview day, in yer lass's hand to the Vice Consul, the first 20 seconds of the interview.

 

It's not a requirement.  If'n you have red flags not addressed in submittals to USCIS (or NVC) then it's best to submit an EOR and address those red flags in the letter, on interview day.

you and Ryan both mentioned red flags. Such as married after first meeting, age difference is too great, set up by a family member, no english lanaguage skills etc...

 

Thank heavens we don't exactly fall in any of those catagories (we were not married after first time we met, our age difference is about 7 years, we were introduced by a mutual family friend and she went to college in the states so english is not a problem).

 

The only red flag I can think of is she was denied entry to United States this May, she was given the option to withdrew the visa. The reason she was denied is because we picked up our marriage certificate in Feb of this year and she can't convenice the CBP officer that she will leave the country.

 

But several ppl on this forum said this is not a big deal since she was not deported with a bann. Should I mention that in the EOR letter?

I just filed my i-130 petition couple of weeks ago, and I received the NOA1 hardcopy early this week. I was wondering, is it smart for me to file a k-3? The reason I am seriously considering k-3 is I see a lot of people waited so long for NOA2 and never get a response, it is free to file, and seems like there is no harm into it, what is your opinion on k-3?
 
Also, if I do decide to file k-3, do I need to file on same evidence level as i-130?

I filed mine K3 about couple months ago. Far as I know, the location of K3 is in Lee's Field, and the location of cr-1 is at everyone's favorite park........

 

I haven't receive any notice regarding changing locations as of today. I certainly hope both of my files are seperate and never join together, but who knows.............

 

 

 

I have seen this year (or late last year) two people went all the way through I-129F off to embassy they were going the K3 route and the embassy closed the I-129F since the I-130 was coming. One couple the I-130 was just at NVC so they were delayed lik.

 

Someone else reported here not to long ago they were asked which route and they chose to stay on the CR1/IR1. It happens we say obsolete because more times than not they are just closed but some do get by. WHY who knows. Is it a country specific thing who knows.

 

Many since this horrible delays have filed I-129F in volume it will be interesting to see what happens. Seems a bigger logjam because USCIS says they will send the I-129F where the I-130 is and they will stay together so now adjudicators have two petitions to go through more delays.

Some possible red flags that I have seen discussed in various forums:

  • Did you marry on the first visit?
  • Were you introduced by a family member?
  • Large age gap?
  • Have you been married before?  If so, how many times?

 

You mentioned you already sent your petition, what kind of evidence did you include with it?

 

 

No one here or anywhere else can guarantee that you will be successful, however, the better prepared you are (no matter how strong your case is), the more likely you are to have a successful outcome.

 

Thank you Ryan, we were not married on the first visit, we were not introduced by a family member but we were introduced by a mutual family friend. I don't believe 7 years apart is a large age gap. And none of us has ever been married or having any kids.

 

The evidence I submitted was the marriage certificate, communication records (emails, qq messages, and skype record), her travel records (3 times) to U.S and my travel records (2 times) to China and travel records within U.S (2 trips to Vegas). Notarized affidavit letters from my mother, 2 of my friends and 2 of her friends, plus 16 pictures, some of the pictures has us plus friends and family members.

 

We don't have any joint assets or bank accounts at this point, we were planning to add those after our wedding ceremony. We only picked up our marriage certificate earlier this year.

However, I have also read that there is a female CO of Middle Eastern descent that usually interviews beneficiaries whose files may have been pegged for denial.

I just received the hard copy of NOA 1 today, and I am little confused by it and hoping if you guys can help me.

 

The notice said my petition has routed to USCIS in Overland park, KS. But I can't find that location anywhere on USCIS website, and can't find the process time for it. In fact the only processing time I can find for I-130 is the office in Vermont.

 

Also, according to the website, it said it is under initial review since July 11th, and mainly it is doing a background on the petitioner. Does that mean it should be done within reasonable period?

 

From my analyst of the timeframe between noa1 and noa2 in this website is anywhere between 21 days to 2 years, and the average is between 4 to 5 months. I seriously doubt my case would take shorterthan the average.
