It depends on whether or not you hire a lawyer. For us, a lawyer was too expensive and really not necessary. Unless you're terribly busy or you've got an unusal case, I would skip the lawyer. Mind you, some folks really do need one, but I would try to go without if you can.

As for how much it costs to bring your honey to the US, I would expect a you can safely bet on involving a couple grand when you look at the big picture. For example, I went to Morocco twice and each set of tickets was about $900. Add on meals, hotels, etc. and I'd say we spent a good $1500 on each trip total. Then you've got things like overseas calls. We spent a good $100 a month on long-distance calls (this is good for proof of relationship, to provide call logs). There's all the photographs you take, all the letters and packages you send, etc. Of course these things are dual purpose, they are important to keep your relationship going and keep you from going nuts from separation. But they also provide your proof of an ongoing relationship, which you will be asked to prove at least once. Then you've got the filing fees for K-1, the medical exam, and then the actual wedding, the marriage license, AOS fees, etc. It varies from person to person as to how much you're going to spend, but you can see what to expect.

Some folks have spent more than most, and its not like you have to have all this money up front, we certainly didnt. It just builds over time. Might I suggest you take out a small loan to help you? I took out a 6-month shot-term loan to cover the cost of my first trip to Morocco and it worked out quite well. Might not be your thing, but its an idea.

The size of the picture isnt really important, Im sure what you've done will be just fine. Be careful about overloading your petition with too much evidence. The goal of the I-129F is to petition - get your foot in the door. Save the majority of your evidence for the interview. Put in enough to prove you've met in the last two years, but dont worry about trying to fit a ton of photos into it. So dont stress about trying to make them all fit on one page. Just make sure your evidence is neat, clean, clear and concise. Make sure the person working your petition can clearly identify what the pictures or envelopes depict, and you'll be fine. :) Good luck for a speedy approval!

It all depends on why she was denied before. Its always a good idea to bring up red flags early in your application process and diffuse them as completely as possible. Lay all your cards on the table. You've got the right idea by providing solid evidence. If your fiancee didnt do anything to merit the denials in the past, then I wouldnt worry too much about it. In the visa application process, you will be asked (or she will) if a visa has ever been denied in the past. Be forthcoming and present solid evidence to proove your case, you should be fine. If on the other hand, the denials do have some standing, you might want to consult a lawyer before filing. Again, its dependent on why she was denied.

Go ahead and make a fresh one, sign it, and have it ready. You can wait and see if you get an RFE for it, or you can go ahead and send it in once you know your case#. Dont fret too much, we've all done something silly at least once in the process. And lets be honest, USCIS does all kinds of silly thing that make the rest of us look pretty darn good compared to them :)

Id like to think we are all as good, and in most cases better than, any lawyer :) Ive heard too many bad stories about lawyers screwing up the case to have much faith in them. I can understand using one if youve gots lots of money, but no time to spend on the process. VJ has so much knowledge and experience to share, its much easier not to have worry about getting a lawyer if you do your homework.

Id say you've probably got enough to prove your case. I think you're quite right to be upfront with USCIS about the expired work visa. Although they are normally concerned with just visas in and out of the US, its always a good policy to be forthcoming and get rid of possible problems now before they bite you in the butt. It looks like you've given this a great deal of thought and provided everything you can, and that should make a good impression on the person reviewing your evidence. People comitting fraud dont work so hard to cough up evidence, so dont worry yourself too much. Best of luck to you :)

Just include a few things. Enough to prove you've met in person and have known each other for a little while. Save the massive piles for the interview. I sent copies of luggage tags, boarding passes, photos, emails, chat logs, phone records, copies of rcpts for things I bought in Morocco, copies of passport stamps, etc. You are just trying to place yourself in the same place with him at the same time. You only need a few pieces of evidence to get the job done.

Now my question is this for the ones who went thru K-1 before. My fiance is in Egypt. We meet in 2001, but it's only now that we want to marry, low and behold we can't legal marry there. We have never met and will meet for the first time in person on July30 2007. Can I send the I-129F forms say 31 July 2007? This was actually suppose to be our wedding date, but since we can't legal get married now I have to fill the k-1 visa. Would it be a problem for me to send the forms from Cairo on the 31July 2007? I mean we would've met in person "within" two years right?

Also, if I was unemployed due to illness, and now able to go back to work how will I prove the financial stuff. I mean, people will get ill or lose jobs and it's not their own fault. Can I get a friend to sponsor him if I'm not working full time? what if I'm working for temporary agencies but full time? Is this considered good enough for INS? Anyone dealing with SSI and a co-sponsor?

On your MO, you can try taking it back to the place where you purchased it and see if they will refund it. We had a similar problem filing for AOS where the money order was for too much. No one would cash it because it was already made out to USCIS. And as mentioned above, a personal check is a great way to track your money/case.

As far as filing, I personally think you're pushing things a bit. I can completely understand your desire to get things underway ASAP, but cutting things so close may invite and RFE and delay your case. It is possible for you to meet face-to-face on the 30th and file the petition on the 31st, but it may not be all that easy. You will only have one day's worth of evidence to provide as proof of meeting and the person who winds up working your case may not find it sufficient. And if your only evidence shows you meeting one day and filing the next, it may look like fraud to an adjudicator. Mind you, the purpose of the petition is to get your foot in the door and get an interviewed scheduled, leaving the major evidence piles for the interview itself. But if it were me, Id try to build a little stronger case for myself before sending it off to be reviewed by USCIS. As mentioned above, a photo showing both of you and a dated English newspaper is a great way of placing you together at a certain time. Try to include some other evidence spanning the months up to your meeting, like personal snail mail correspondence, emails, internet chat logs, and phone records. I would also include a short statement about how you have been corresponding for several years prior to meeting, to help build your case as well. Have absolutely all your paperwork, with the exception of the evidence you will aquire upon meeting him, ready to go in the envelope before you leave for Egypt because you may not be able to fix it if you get there and realize you've forgotten something.

On the income issue, as long as someone is willing to sign the affidavit and say they make 125% of the poverty level and will take financial responsibility for the K-1 beneficiary, you're fine. It doesnt matter if you work full or part time, if you have 1 sponsor or 3, as long as you can prove that your fiance will not become a charge of the state. If you aquire a better income by interview time, you can drop your co-sponsors and do it all on your own.

*on the I-129f,it asks for name of former spouse..my ex-wife just recently got remarried last month for the 3rd time,do i use her new last name?


*on the g-325a..it asks about employment for the last 5 years.I been at the same place full-time for at least 15.however, i work part-time now as well,sometimes as little as 1 day a week.should i even include that and i did work part-time last year with much more hours until that place closed.so, what do i do here?


*for putting together my evidence of meeting within the last 2 years..can i tape all my airline tickets,etc. onto blank white paper and write something under it and then photocopy them?

On the I-129F, you should probably use the name you knew her as when you became divorced so it will match the court documents.

On the G-325A, list the job you've had for 15 years as your most current. Put your part time job on the next line including your start date and list the end date as 'present'.

Photocopying your evidence should work fine. I did that with all my boarding passes, luggage tags, receipts, etc. I pasted them neatly on a blank page and made a copy. I then wrote any important notes in the margins around the pictures.

It actually would have been harder for us to file the K-3. And if you dont believe the K-1 cant be done, look at how Luis and Laura ripped through theirs, that ought to be proof enough for anyone :)

Do your best with the information you have. Enter the information as accurately as you can with the info you have. You may wish to attach a supplement sheet with an explanation on the lack of details. Its better to just lay all your cards on the table and say 'hey look we admit she was here in the past, but it was long ago, she didnt break any laws, and we've lost all the important papers'. If they have a question, they'll ask at the interview and it can be explained in person as well.

The picture that is on our profile here is actually the only picture of us together in the last 7 years as well....by the way, this picture of us was taken this May. For some reason, we didn't really think of taking more pictures of us together. Anyway, I did send this picture in with our petition....

Is it bad that this is the only one?

Pictures are just part of the evidence you can provide for proof of meeting. If you have other things like boarding passes, receipts, etc that put you both in the same place at the same time (within the last 2 years), then I wouldnt fret too much. I would, however, try to generate some more photos before the interview. That's when you really need to cough up evidence. And as you mentioned, there is little you can do, aside from taking another trip to take more pictures. Dont fret too much, whats done is done. Cross your fingers for no RFE :)

The K-1 petition is to 'get your foot in the door'. There's no need to load the adjudicator down with a bunch of evidence. Your goal on the I-129F is to show that you and your fiance were in the same place at the same time within the last 2 years. I would advise 3-6 of each type of evidence (photos, chats, phone logs, snail mail, boarding passes, etc.) Save the big guns for the interview.

On the passport photo, I doubt you have anything to worry about. The restrictions on passport photos pertain to large objects or clothing that obscure the face and make it more difficult to recognize.

I can certainly understand your impatience :). We've all been there, but just chill for a little while. Every step of the way, it has taken forever for each NOA to get in my mailbox. It can be due to a number of factors. If you wrote a personal check you can see if it has cleared your bank and possibly get the case number off the back of it. That's what we did while waiting for NOA1. You can look up your case number on the USCIS website.

I would hazard a guess that you are stuck in the crowd at the moment. It took 2 weeks for us to get each of our NOA's for AOS because everybody and their dog tried to get in before the filing fees went up. I wouldnt sweat it right now. There isnt a whole lot you can accomplish by calling USCIS, but you can try. If Im not mistaken, you can get through the automated system and talk to a rep if you dont have a case number yet, but it takes a few tries in my experience. Give it another week or so, I imagine your check will clear soon and you can get the case number from it and also request another copy of your NOA from USCIS. Best of luck :)

I have a co-worker who was in a similar situation. She married her boyfriend who was here on a student visa for several years. So far they havent had any problems, other than coming up with the fees for AOS, but I cant say everyone would have such a smooth ride. I think most of her success was due to the fact that he had already been here for several years. I wouldnt recommend automatically getting married now, and circumventing the K-visas altogether, because you can be nailed for fraud. You have several options, which are all laid out in the Guides section above. Best advice is for your honey to go back home before his visa expires. It can reflect very badly on him in the future if he overstays his visa and tries to file for another one (of any kind). Best of luck to you :)

The processing dates they post on the website never seem to have any rhyme or reason. My best advice for tracking is to look at the timelines for others who filed at or around the same time you did. For the I-129F alone you should be fine. You meet the requirements and that's all the adjudicator is looking for. Depending on what consulate you have to deal with, you may want to get a co-sponsor down the line. You may wish to ask others going through the same consulate when you get to the interview stage, whether or not you should pick up a co-sponsor to help cushion things.

I listened to the OMbudsman teleconfrence today and they are aware that it is taking longer than normal to get checks cashed because of the rcpt'ing delay. They are supposed to have all rcpts current (i.e. checks cashed and NOA's printing) by the end of October. They also mentioned that they will not reject a case if your bank rejects the check because it has been held for over 90 days. Not that I think your check will be held that long. But they are trying to rectify the delay.

Once you are divorced from her, it should be no issue. They will ask about it at the interview and on the filing forms. But as long as proper documentation is provided, there should be no problem. It is not always necessary to engage a lawyer to file.

I would expect you to have your NOA1 at least by the end of October. Per the USCIS Ombudsman confrence call this last week, they took on extra staff and are working overtime to make sure everyone's petitions are rcpt'd by the end of October. If you do no have a rcpt by the end of October, they reccomend you call USCIS to complain. Im not sure how much good it will do, but that's what they said. Hopefully you wont have to wait very long, I know it must be frustrating. Best of luck for a speedy approval!

I suppose it would depend on why you did not file taxes in 2006. Were you a student? Were you unemployed? Were you self employed? As far as Ive seen, the tax records are more of a big deal on the I-864 down the road.

Some consulates allow you to accompany your fiance(e) to the interview, some do not. I would ask some of the other VJ'ers who dealt with the same consulate if they were allowed to attend with their SO.

Processing times vary greatly from one country to another and other assorted problems that pop up at USCIS throughout the year. There is no perfect timeline to judge by, but you can get a pretty good idea of what sort of wait is ahead of you by checking out the timelines above or conferring with others in the regional forum http://www.visajourn...p?showforum=129 . Those that have already dealt with your consulate will be better able to guide you and help you make an informed choice. Keep in mind that just because you are already married to someone does not mean USCIS is going to reunite you with them faster. USCIS has no feelings, sorry to say. I loaded my husband down with piles of evidence. I submitted at least 2 copies of emails and chat logs for each month of our relationship to show the date span, all our phone logs, all boarding passes, all my ticket stubs, all my financial recipts to show I was in Morocco blah blah, every single photo of us together, all original snail mail correspondence (cancelled envelopes) so on and so forth. The whole package wound up being about 2 inches thick. At the time, our consulate was notorious for denying people based on lack of evidence. I wasnt about to send him in there with anything less than overkill. IMO, the inteview is your chance to prove your relationship, knock 'em dead. I would draw the line at bringing a whole file cabinet (i.e. dont make the pile so huge your fiance' cant lug it around easily). Just my $.02

When the application is successful, he would move to the US and they would apply for the Green Card stuff.

Is this possible? Does the US recognize the marriage in the UK? Does the process take longer or shorter than the 'normal' fiance visa route?

The other visa they speak of is also a marrige-based visa, called a K-3. It is not necessarily faster because you are already married. That being said, the regional forum for the UK http://www.visajourn...hp?showforum=99 may be able to give you more informed and precise answers on what it's like to deal with the UK consulate, etc. and their experiences on processing times.

What more can an immigration lawyer do for you, honestly? They are basically paid proof readers. When I contacted the one we were going to hire, he just wanted us to get together all the paperwork and evidence and send it to him. We still had to do the work. He just put it all together for us at the cost of 1800 bucks!

Maybe someone else has a different opinion but I think that you should still try it on your own....just be honest in your petition and I'm sure you'll be ok.

Is there a reason to wait once i am divorced. Wont it take at least 6 months before i have my interview at the London Embassy. The main reasons i feel i need for a lawyer is that .....1- Ive been married to a US citzen before.....2- Stupidly married while i was on the VWP......and 3 i overstayed less than 2 months


Unless Im reading this wrong, you need to be divorced before another visa can be petitioned for. (But if Ive got the wrong impression, I apologize).

And I coudnt find the documentation on the I-134 (which is where I thought it was supposed to be), but it is on the I-864 that you only need meet 100% of the poverty line to sponsor if you are on active duty.

I believe that, yes, you do qualify under hardship or expedite criteria. I think you are also off the hook with the 125% of the poverty line income requirement (only need 100% for military, methinks). Ill see if I can find the links for you.

I think what made me think of this was that I am constantly asked if I am inquiring on an expedite request based on military employment or some such stuff whenever I call USCIS.

I also went by the VJ guides and made a packet bound by ACCO (those big black metal clip) fastners and 2-hole punched at the top. I put the table of contents on the top so it would be easy to thumb through and find the appropriate documents. I also used plastic sleeves for all the smaller or loose bits that didnt fit right in the 8 1/2 x 11 frame. Sorry that I dont have any photo, per se, to show, but I did scan the entire thing into my computer as image files. It is adviseable to at least copy the whole mess a couple of times (you're going to need another copy later). But having it in the computer has been extremely helpful to me down the road.

My husband and I also wanted to start our family before the visa was issued, but its a really good thing we didnt. I would have spent the entire pregnancy alone and apart from him, gave birth without him, etc. That would have been emotionally unbearable for me. This visa process is already hard enough on the heart strings, and I wouldnt add anything else to the list if I could prevent it. Now Im glad we waited. It didnt take long to get 'a bun in the oven' after he arrived here. And its soooo much nicer when you can share it. Im wishing you the best of luck for a speedy approval and a bundle of joy when you're ready smile.gif
