This is not complicated at all. But I may not know the entire investigation process and what are grounds for denial. You need to think like an attorney (which I am, but not an immigration attorney). The fact is you are divorced, so the K-1 is proper. My barely educated understanding (since I'm just learning about the process myself) is you must show you are free to marry and since you are divorced, then you are free to marry. So show your divorce decrees. I am unaware of you having to show marriage licenses so they will not see you had a marriage overlap (but I may be wrong). Most government agencies are too busy to report what they think is a crime to another and even if they did, then a District Attorney would have to feel they wanted to prosecute through their busy schedule, etc. So that is probably not an issue. But my understanding of the facts are that your latest divorce decree will show that you were married to your current fiancee. I cannot comment on whether this would be questioned as looking like a sham - trying to get someone in the country that you already decided you wanted to divorce. But the reality is people do divorce and then later remarry that same person. All you can do is try. However one comment I read here did cause some concern and that was whether you being in the US was proper since you were married when you came here. I have no knowledge of this topic and hopefully you can clarify this and then others can comment on it. If fraud was committed during that process you could have a serious problem for yourself.


I wanted to add the following too. First I was just informed that you need to disclose your marriages on the g-325a (like I said I am still learning myself), so that will look very funny and that you don't take the marriage process seriously ... but that is more of an opinion than an analysis. The other issue it raises is that the K-1 and K-3 process is for U.S. citizens to get married, and you may have to show that you were married prior to being a citizen (the possible problem above), that you then divorced, and now that you are a citizen you want to bring her over using the K-1 process (that you could not have done with a K-3 since you were not a citizen when you married). This too will look suspicious probably. This is worth a consultation with at least one attorney that knows all the ins and outs as well as possibly a second opinion.

I know some of you might have seen me around here for a while, ever since i've been planning to bring my (girl), fiancee to the US...but..i really have something bothering me a little bit, so i thought that i might post it here as well, maybe you guys can give me some of your best ideas, thoughts and opinions...

I am gonna start with a question that i've asked in a lawyer's forum before, and trust me "It's Complicated" but not hard to analyze...

"Is it illegal to get marry in the US while being marry in another country?

I immigrate to the US from Brazil, i was separated from my wife but not divorced, I got marry here, it didn't work, so i got divorced, now i am a US citizen, and by the way I did not obtained any immigration status from that marriage, i came legally under a family petition made by my father! I went back to Brazil and found the person that is actually married to me, we are back together! But a few month ago we filed for divorce, so we can get marry again in the US, since i am trying to bring her as my fiancee, with a fiancee visa. My I-129F was approved and it's already in the US consulate waiting for "that day"

Dear all,

Earlier today I was reading through the forums and saw people talk about getting a K1 case expedited. My girlfriend was diagnosed with skincancer in June 2010. Because I was spending my sabbatical year with her in the US, I was able to help her get through the toughest part of the battle meaning the surgeries and beginning of the treatments. We left the US towards the end of 2010 thinking it would be no problem for her to receive her medicine while being in Europe. This has not been the case and it´s important for her to now return to the US if she wants to keep receiving her medicine. (The farmacy does not want to send it straight to Europe because of potential stability issues with the medicine) She is currently still in Europe with me but I feel she should return to get the medical attention required and get tested for her progress. Her insurance does not cover her while she is in Europe so getting tested over here is not an option and the medicine is upwards of 2000$ per month so incredibly expensive.

Could we get our K1 case expedited based on my gf undergoing treatments in the US and needing me to be there? The treatments have many side effects including depression so it´s both her physical and mental health that are in jeopardy if I cannot be with her during these tough months. Her treatments are going to continue until september/october 2011.

Do you know of any cases where the US Citizen has medical reasons like this to get the case expedited?
What do you advise us to do? We intend on calling USCIS later today and can provide proof immediately if needed.

On the site of my consulate it says I need to provide police certificates of all places I have lived at since age 16. I spent a year in the US as an exchange student, but as far as I know my official residence did not change. I was just wondering whether I need to get in touch with the police department of the place I stayed at when I was in the US or if it´s not required as it was not my official address.

Hi,I married my wife on Feb 21,2012 in a court and also we had a traditional wedding the next day.I have been talking to her since December 2009 and she was introduced to me by her mum whom i met through my junior brother.The problem is we had never met in person until she came to Ghana with her son in February 2012 for the marriage.Like i just mentioned, we have been talking for a while and we all realized we had a lot in common and fell in love which her mother approved.she also has a son whom i have developed a very loving relationship with.my problem is she has a very low paying job and a very demanding which is makes it very difficult for us to communicate often like i had wanted.our primary form of communication now is the phone and we do send love cards and gifts once in a while.Like any august filer,we are also still waiting for a response from USCIS and we expect to hear from them any time soon.As far as evidence for the embassy is concerned, i have the marriage certificate,pictures of both the court and traditional marriages,copy of her flight itinerary to Ghana,receipts of expenses we had when she came,phone records,love cards and postal letters she sent to me.Please do you think this is enough to convince the consulate?will the fact that we met only once affect chances of the petition been approved and visa granted?My worry is,i have turn down a couple of job offers since i graduated college last year in hopes of moving to the US to be with my wife and step son, and i don't want to have that ruined.Please help me.....

Please i have a serious issue.......Our case got approved in January and we were directed to continue the process with NVC, which we are doing at the moment.We are are at the stage of submitting the affidavit of support but the problem is that, my wife lost her job in march and can't solely sponsor me. Yeah, sorry but you getting the tourist visa are slim to none. You basically have to be very, very wealthy with a high paying job to be issued that visa, me and my fiance learned that the hard way... hardly anyone gets them :( Sorry again. Can she come see you? There is literally no one you can ask to be the joint-sponsor? They can live anywhere in the US and be a citizen or LPR...

At last i got approved!!! I called early this morning, still with no result(the guy told me to call tomorrow, heck no, tagal na kaya) then i tried calling in the afternoon persistently, then there, Clark (window G) finally told me that I passed the psyche exam and be prepared to go to SLEC for my vaccines. So without having second thoughts, i rushed to SLEC with my mom smile.gif I gave my receipt and waited for 4 hungering hours, then at long last my name was called!!! Had my vaccines taken then they rescheduled my interview to July 28 (SONA day) kicking.gif

My fiance's a Filipino too, he moved to Michigan but now stays in Las Vegas and is now working under National Guard Nevada.

Suzy will stay in Malate so we just planned on meeting around 530 for breakfast before our (yipee!!!) interview smile.gif Suzy like I said is a very transparent person so it was really so easy to be nice to her hehehe.

It's just going to be another day before our interview so keep on praying innocent.gif

July 10th: Rescheduled Psych exam. Everything goes well. Says results in 2-3 days.
July 14th-18th: Dr. at convention.
July 21st: Request results. Told to return on July 23rd. to see Dr. again.

I am about to explode but I know there is nothing to be gained.

jtrims56!! I think i've chatted with your fiancee today at SLEC, we really have the same case and I felt sorry for her coz she waited for almost 5 hours with no food :) We exchanged numbers tho so we'll get in touch...we have the same interview date :)

At last i got approved!!! I called early this morning, still with no result(the guy told me to call tomorrow, heck no, tagal na kaya) then i tried calling in the afternoon persistently, then there, Clark (window G) finally told me that I passed the psyche exam and be prepared to go to SLEC for my vaccines. So without having second thoughts, i rushed to SLEC with my mom :) I gave my receipt and waited for 4 hungering hours, then at long last my name was called!!! Had my vaccines taken then they rescheduled my interview to July 28 (SONA day) :dance:

Yes! you talked with my fiance Suzy at Slec. Small world huh? She is approved also and has the same interview date as you. Contrats to you! We are very happy to have Slec behind us.
Suzy said she had a nice talk with you and how you recognized her timeline from my post. She says to say hi, that you are a nice person.

Suzette is so nice too, she's so transparent and i enjoyed talking to her :) we laugh as we share our experiences!!! she's so funny too :) I'm asking her to stay here at our house maybe on Sunday so we can go together on Monday for our interview, since our house is near the embassy and my mom can take us there. It's really really great to have SLEC behind us now, and finally we can be with our partners soon. Congrats too and hopefully we can get our visas in a week's time. Take care and God bless Jon!!!
