I-864a is if your non-household member co-sponsor (your aunt) is married and you need to show that she herself meets the requirements (so, husband would fill out I-864a). Also, this shows that (husband) is willing to accept the risks, since they are married they BOTH assume responsibility.

So, yes. You fill out I-864 and so does your aunt.

Surprisingly, my case got updated in just 14 hours!!!

I spoke with a NVC representative yesterday she told me that I have to wait for certain forms that NVC will email me in a week or two and then only I can send the DS 3032 and I 864.

- Could you kindly let me know what are the documents that I need to gather so that I can work on it proactively.

And I also have a couple of questions regarding my Police Clearance Certificate and choice of representative:

- I am an Indian Passport-holder and currently residing in Toronto. I have a PCC issued by The Indian Consulate, Toronto, Canada in August 2011. But from the last 1.8 years I am living in Canada. Kindly suggest do I need to apply for a Canadian PCC and these PCCs are valid for how many days?

- My second question is in the form 3032 I need to mention the name of a representative. Does this mean if I am mentioning my attorney's name on it then he has to accompany me to the interview? In my case, though my attorney helped me in filling my F2A, he lives in California, USA and my interview will be in Montreal, Canada. It will be very expensive on our part if the same attorney is going to accompany me to the interview. And i would prefer a local attorney who deals with CR 1 Cases in Montreal. Kindly, advise!!! And please, let me know if anybody knows about a good attorney for CR1 visa type in Montreal Canada.

As far as the DS-3032, you need a template (you can search for one here on VJ), make sure you put the case number, petitioner's name and DOB, beneficiary's name and DOB and both of your email addresses.
For the I-864, you need to make sure you qualify for 125% over poverty limit (I-864p). You need the coversheet that you get after you have paid the fee, Fill out I-864, letter of employment, last 6 month's paystubs, past 3 year's taxes (you can get transcripts from the IRS website. They will mail you them for no charge).

Since you are living in Canada, I would also request the PCC forms from Canada and I believe they are good for up to a year (please ask another member going through Canada for this to make sure. I could be wrong).

As far as your attorney goes, you do not need him to be at the interview with you. He just fills out paperwork and is supposed to let you know/follow the laws (IMHO, they're pointless).

Congratulations! What your husband did was correct. Send an e-mail requesting for an upgrade and a copy of his naturalization certificate. He should get a response probably between 5-7 business days saying that he was accepted and your new petition category. Right now, have your husband get all of his I-864 and DS-230 paperwork together. The NVC process can take you a month or less if you guys are productive. Remember he has to pay the $404 and $88, so get that together. You are well on your way to being together! :thumbs:

Im not quite clear on the question you are asking. Is the spouse the sponsor? Or is the sponsor someone else?

I think OP means that if he (and beneficiary) are no longer living in the address that they provided with all of the forms as "permanent address" would it somehow disrupt the process.

The paperwork goes to the address that you provided as "permanent address." You are not obligated to live with your co-sponsor for the rest of your life. I believe there is a form you must fill out to change that permanent address. Someone here will let you know which one it is (as I have no idea).

It's 1 year if you keep in touch with them. It sounds as though you did not do this. In addition to not keeping in touch, you missed your interview without prior notice. I'm sure they would've rescheduled for you. Your best bet is to start the process ALL over again.

Hello my name is Shawnda and I am new and I am trying to get as much information as possible in a row before I even marry my fiance lol!...We have been together for 7 months and I am planning to go to Nigeria to marry him in May 2012. So my first step is trying to decided on a K3 or CR1 route to take...and I have decided based on this site to go the CR1 route. I tell you this journey is not for the light hearted at all but I love my fiance so much he is my very best friend... I know it will all be worth it in the end....so my question is this...

After we get married in May 2012 and I come back to the US and start the CR1 process can I go back to Nigeria to visit him while it is processing? I won't even ask if he can come here I'm sure he could but...it's hard to get a visa in Nigeria....we know he tried to get a B1 visa and was denied just 11/28/11 and he had all that he needed... :( but that is okay we are still on to plan B as we trust God to see us through! :)

Well that's it for now....I know I will have MANY more questions! I am so thankful for this sight! I have no one to ask for help!

You can travel there as much as you'd like. There are no restrictions. In fact, it would probably be better for you to go visit him. It will make the time not seem as long and you can also use that as evidence =)

Considering the fact that Colombia is a high-fraud country, I would personally go with my spouse to a K-1 interview. I have seen a lot of instances where the beneficiary gets denied because the CO cannot prove that it is a bonafide marriage. Please read the Embassy reviews to get a better perspective of the people that have been there and done that. If you do not have enough time off from work to go to interview, wait for visa, and come with her to the U.S.A why don't you let her come on her own? It would be more important that you're there at the interview than at POE. No one can say exactly how long it will take for her to get her visa delivered to her residence, however, the estimate is around 7-10 business days & she would be able to travel to the U.S as soon as she has the stamp on her passport. And also, remember that she is not guaranteed a visa, there may be other things that may happen that wouldn't allow her to come to the U.S quickly. Do not book flights for her yet. Wait until she has her visa in her hands. Most importantly, good luck. :thumbs:

Not at the POE but there is an "airport tax" at El Dorado worth about $50 USD for non-residents.

I'm just putting together my I-751 petition, and one of my letters from an interstate friend isn't "notarized" or "sworn". I know notarization isn't essential, but I believe it should say something on there like "i swear this to be true....."
What do you think, should I include it anyway? Leave it out? (I already have two Affadavits) I could write "I swear this to be true...etc" on the letter myself, but I really don't want to jeopardise this petition in any way.

Appreciate any opinions, thanks.

For example, we stayed at a friend's place for a while when we came back from Japan--no lease.

You say you stayed with a friend for a while? That's who you should ask to write an affadavit for you. That friend can testify that you lived together in their house as a married couple. What about your parents or other relatives? We used Mike's parents - they wrote us a great letter, even though we've only visited twice since we got married.

Have either of you ever regularly picked the other one up after work or met for lunch from work? Have your boss or co-workers write a letter saying this. Do you grocery shop together? Eat regularly at a certain restaurant together? There are so many people who you might see everyday who could attest to your relationship, that you spend time together and "look like a happy couple" (which seems to be what USCIS is looking for!!)

Personally, I thought your evidence list covered all the bases, but I can only guess they're looking for more than one piece of evidence in each category? I'm guessing they're also looking for a body of evidence that wouldn't be easily faked. You say you included wedding photos, what about photos covering the time period since you were married, especially ones in distinct, far-apart geographical locations (we had one by a tower in Massachusetts, one on the golden gate bridge, and one hiking in the grand canyon) Also those with family and friends.

Theyr'e probably also looking at dates. Did you open your joint bank account right after you were married? Ask the bank for a letter saying when it was opened, and back this up with evidence of checks made out to both of you individually, and in both your names, that were deposited into the same account over the 2 year period.

Hope some of my suggestions help.

Over this whole process I always found it very useful to read on VJ the lists of what other people include for evidence. It's given me lots of ideas as to what paperwork to keep, so actually filing the I-751 was quite as easy process.

So for anyone who's interested, here's our list:

REQUIRED
* I-751 Petition
* Additional list of all our addresses since married, as requested on petition form
* Cheque for $275 (yay, we snuck in before the fee skyrockets!)
* Copy of Green Card, front and back

OPTIONAL EVIDENCE
* Passport copy - i saw this mentioned somewhere, and I copied it on the same page as my Green Card. I now read it's not required, but it's in there now and I don't feel like re-copying, so it's staying.
* Affadavits - Three letters written by: 1) Mike's parents 2) a good friend of ours who came to our US wedding reception, and 3) my old boss. The letters say how they know us and talk about times they've seen us together, how we present as a couple, etc. etc. The first two are really lengthy and notarized, the last one is short and to the point, and just signed. If this presents any issues, i'll post it here!
* Photos - 8 photos of us in distinct geographical locations (Walking across the Golden Gate Bridge, Hiking at the Grand Canyon, Arches NP in Utah) or with key family members - there's one of both sides of the family right after our wedding in Australia (where i'm really skinny) and then another a year later, again with both sides of the family, in Connecticut (where i'm obviously larger LOL) (hard to fake the weight gain if we took all the photos in one day!!!!). I also threw in a picture of us and our dog - it doesn't prove anything, but it with the other stuff it paints a nice picture. I know there was some discussion when we were first filing about digital vs. *real* photo prints - I just printed these off on my home printer on ordinary paper, 4 to a page. Again, i'f they balk at this i'll let you guys know.
* Residential Lease Agreements - copies of the front and back pages of our current, and one previous lease
* Renters Insurance - current policy and one previous bill
* Tax Returns - Copy of IRS transcripts showing our 2005 and 2006 joint US tax returns. These are easy to get (call the IRS, they'll get them to you within 2 wks) and prove you filed together, which your copies of the tax return do not.
* Credit Card - Copy of our visa cards and a statement showing a joint account.
* Costco - Copy of our Costco cards on a joint account.
* Banking - We have 2 joint Checking Accounts, so sent one statement and one voided check.
* 401k - Copy of both our 401k policies, showing the designation of each other as beneficiaries.
* Travel - A copy of our airline receipts and itineraries for our trip to Connecticut last September/October, where we had a (belated) US celebration of our marriage, hosted by Mike’s parents, and attended by Rosemary’s parents who traveled from Australia for the event.

That's it. So we'll see how that goes. I feel fairly confident that there's enough different stuff there to show a life togther. And it is nice to know at this stage it's more up to USCIS to prove a fake marriage than the other way around.
