Removing Conditions on Residency General DiscussionTax Return Copy Question
Somewhere on VJ I saw that IRS Transcripts were preferred over your copies of tax returns. Mike called IRS and ordered these over the phone - it's free, and a fully automated system so you don't even have to talk to anyone at IRS. Ours took about a week to arrive.

Removing Conditions on Residency General DiscussionWhich is the correct address?

Hi, everybody! I am having a bit of a last minute freak out. We've assembled the package and are ready to send it in to CSC, but when I compared the address from the instructions of form I-751 to the address given on the CSC homepage for filing the same form they are different! Actually, just the last 4 digits of the zip code are different but I do not want to make a mistake and send it to the wrong place   Can anybody who filed at CSC help me with the right address?

Thanks!!!

I agree - go with what is says in your form instructions. That's where we sent ours. (That said, i'm sure both addresses would work if it's only the last 4 zip code digits that are different)
Good luck!

Removing Conditions on Residency General DiscussionAffidavit Letter
I have no idea which they prefer, however we hedged our bets and included some of each: 1 from hubby's parents, 1 from my old boss who knows us both, and 1 from a mutual friend. We don't see any of these people on a day-to-day basis as we live in different states, however I'm still confident our letters will adequately support our application as each letter included 2-5 examples of times we have seen these people in the 21 months since we got married.

Removing Conditions on Residency General DiscussionBiometrics - a second time????
Maybe it's because some of us doing I-751 never did AOS, so didn't have biometrics done at a USCIS office. I did DCF in Sydney, so had my fingerprints taken by the local police there, so not on file with the USCIS. I believe the fingerprint on my GC was taken at POE LAX???? But yes, I think as they haven't taken enough of MY money yet, they feel they need my contribution to their BBQ fund...

K-1 Fiance(e) Visa Process & ProceduresCan you travel to the US while K1 is processing?
Plus we don't wanna get a letter from her employer because we aren't going to tell them she's leaving until we get the visa. Otherwise she might get laid off =/

OK, but you don't have to tell your employer the whole story, just tell them you're going to the wedding, and will be back to work afterwards (which, if i understand correctly, is true, right?) and you need the letter as you've heard Canadians visiting the US are getting asked for proof of ties to Canada. Your impending K1 doesn't have to enter the picture at all, does it?
Just a thought.
Good luck!

Hi, all.  I was just peeking at a few timelines from earlier-than-us filers to see where we stand (just mailed package this week).  What does "in line" mean for a naturalization filer?  Since it looks like the whole process generally takes less than a year, what anniversarry date are you guys talking about?

IR-1 / CR-1 Spouse Visa Process & Procedureshi am new here
Hi. The "Agent of Choice" form is just to tell them where you want them to send information. It`s usually best to use an address in the US or some other place that has dependable mail service and best to use someone who you don`t expect to move because things can get lost if you change the address. The "Agent" is usually either the petitioner or a lawyer. You can use your spouse`s name and another person`s address (like one of her relatives) if that makes it easier.

On the I-864, someone has to take responsibility for the immigrant. That`s the "sponsor". The idea is to prevent the immigrant from needing financial support from the government later on. Usually the sponsor is the USC or LPR who is bringing the immigrant to the US, but it can be someone else if necessary. On the I-864, the sponsor has to show proof of income (usually tax forms) or assets (stocks, realestate, a big bank account, etc). If one person can`t do it, there is a way to use the income or assets from two or more people, but only one of them will actually be held responsible for the immigrant.

The time it takes and what it costs depends A LOT on your situation- where you are, what visa, using a lawyer or doing it yourself, any legal problems, etc.

That`s what we`re doing- I took a week`s vacation along with a four day weekend. As long as all goes smoothly we`ll go visit family in Chihuahua after the interview. This will be your first appointment, won`t it? Are you expecting clear sailing or planning to file a waiver? Good luck, whichever it is.

Generally speaking, how much notice is given when the interview packet is mailed? 30 days?

Something like that. I don`t remember when our current one arrived, but the postmark says 01/29 (El Paso) and this time we have our interview on 02/28. Other people are getting them with about the same time frame. Don`t forget to arrive a couple days early for the medical- it usually only takes one day, but sometimes you have to go back a second time and they`re closed for a lot of holidays- all US holidays and all Mexican holidays. Also, if you buy plane tickets, be sure to give yourself plenty of time for the interview because that one frequently runs into another day. Last year my wife had to keep going back again and again for a week (I was already back at work by the time they finally finished with her). I`ve never heard of anyone else getting stretched out that long, but it can happen. Two days is fairly common. I think they have a list of holidays posted on a website somewhere but I don`t know where.

Hi, Raymond. Is the 3032 the "Agent of Choice" form? If so, they should sent you the packet at the address you gave them. As far as I know, they don`t send anything to Mexico. What ever they send to me in the US, I just fax coppies of to my wife. Also, I could be wrong, but it seems to me that most people are currently waiting about a year from the time their cases are transfered to CDJ to their appointments. Good luck.

Well, here`s how it actually worked: I went abhead and used her old A-Number on the new DS-203 and it didn`t cause any problems but our GC arrived in the mail last week with a NEW number. I guess the old one was eaten by a washing machine somewhere.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-485 withdrawn- is A-number still active?
I`m not sure where to look for this. We filed an AOS package in `03, then withdrew our I-485 the following Dec. In the mean time, my wife was denied IR for illegal presence and our waiver was recently approved, so we`re back to the paperwork again. When we applied for the waiver, we used her old A-number wherever it was asked for but now I`m thinking that she probably hasn`t really had an A-number since we withdrew the 485. I`m basing this on the fact that the first we saw of this number was on the NOA for her I-485. So is the 485 actually where the A-number comes from? If that`s the case, we ought to be marking N/A when it`s asked for, shouldn`t we? I don`t think it really matters much, but I would sure hate to run into problems for trying to "hide" the fact that she used to have one or for trying to "pretend" that she still does.

K-1 Fiance(e) Visa Process & ProceduresK1 Process, return to foreign country and more
(Reply from 'the fiancee'):

These answers have been helpful so far, and relieved some of our worries about 'proof' and it sounds like London isn't as strict as what we've read about which is good. And we really are trying NOT to get our hopes up, and accept that we'll have to spend (what seems like) an eternity apart at some point. We will definitely look into the CR1 option to see if it's faster, though I've read that the K-1 application has a 95% acceptance rate and some lucky people get it all sorted in a matter of months. The B-2 might still be useful simply for the interim period, whichever route we go, plus it gives us more of a 'six month' mindset. If we know we'll get to be together for at least 6 of the months (out of however many months the process may take) it'll hopefully give us more patience, and it'd just be a bonus if it takes less time. The return ticket thing will have to be done to avoid red flags, and the prices aren't that much different anyway - and I could always use it to visit family in the UK more cheaply if the timing is right.

As for the UK visa running out, we were hoping for some advice on trying to extend it while within the UK, as it ends in June and my Graduation is six weeks later in July, and it'd be a shame for him to miss the day and all the celebrations. But that one might be a question for a different forum, I suppose.

K-1 Fiance(e) Visa Process & ProceduresK1 Process, return to foreign country and more
Me and my fiancee are currently residing in the UK, where she is a resident and I am on a six month tourist visa; we both want to travel to the US in the beginning of August/end of July.

I have a few questions here:

1) Regarding proof of financial support, I work as a computer consultant on an exclusive contract with a company, and therefore for tax purposes I would be self-employed.
However since I have only started with this company late last year (where I did not even make enough money to file a tax return), I don't have any documentation to prove this.
I am sure that my employer (read: exclusive client) can provide a letter stating my salary, but I would not have any W-2 forms to provide alongside with it, since I am not technically an employee. I can provide receipt printouts though. Can/Should I just file an early tax return for 2011?

Additionally, I don't exactly know *when* to actually file the I-134 form.
We are planning to send out the I-129F and associated G-325A forms ASAP, however I am wondering whether I'll need something else along with it (e.g. the I-134 form) as well.

2) We hope to spend as much time together as possible. Initially we were thinking about doing a B2/VWP -> AOS, however my research on this shows that this is both illegal and risks a ban, so this is out of the question.

While a K-1 would require a return to the UK for my fiancee, we were thinking we might be able to spend some time in the US together either on the VWP, or more likely, on a B-2; hoping that she will have had her K-1 approved before the B-2 itself expires.
This means that she would need to go back to the UK for a given period of time and then return to the US on her new K-1.
While this is feasible and allowable legally (or so I have come under that impression), how much time would she actually have to spend in the UK on her return?

Also, regarding the B-2, it would be a waste to purchase a two-way ticket when the date of her return would be unknown - would it be proof enough to show at the POE that we have applied for a K-1 and she plans to return to the UK at some point in the future?

3) How much proof does she need to present at the interview? We live together and are holders of a lease agreement on an apartment, but we don't have much in the way of photos, emails, or letters (the only thing we actually have is a facebook status, which apparently nowadays is quite a statement). Would the fact that we've been living together for a while be good enough?

4) Not really related to K-1, but my visitor visa to the UK will expire in about a month.. any suggestions on how to handle this?

Just an update.. I put my current address (in the I-129F) as a UK one, and then as an attachment to the I-129F form I wrote

Supplement to form I-129F, part A, question 2: address information
ADDRESS FOR CORRESPONDENCE AND PERMANENT RESIDENCE:
Address: 123 Main St.

State: NV
Zip Code: 12345

I am currently residing at the location specified in the form itself, however.

However, I got the NOA-1 today at my UK Address. Luckily enough, I also got the e-notification, but I was expecting them to deliver it to my address in Reno.

Thanks again. Sorry if I might sound like a broken record here, but:

Part of our case of having been together and being in a relationship to marry etc. is the fact of us having lived together in England for close to six months (I will be leaving upon the expiry of my six-month visitor visa, which expires in about a month).

We have a kind of dilemma here. We were planning to provide a lot of evidence of us having met and lived together here, this includes a six-month join tenancy agreement, utility bills and the like pertaining to our current address here inside the UK.

Will this be a problem or a conflict of sorts if I then (don't) say on the G-325A resident history that I am in the UK now? Or do I just put my friend's address above the UK address, etc.?

Maybe I am confusing 'Residence' with 'where I am actually sleeping at the current moment'

you dont have to be in the US, you just have to be a USC and have a US residence. I filed from abroad when I was in Cairo. I put my parents address as my residence and wrote on the cover letter that I was currently abroad and could also be reached at my Egypt address. They still sent all my messages to my parents house.
its totally fine.

Thank you very much. So to get this straight, I entirely omit any reference to my current residence being currently in the UK (on both the I-129F and G-325A) and merely put mention that I live in the UK for the time being?

I'm currently in the UK and I'm just about to send out my I-129F forms and associated documents, but I'm wondering where I should place my current address:
I've been living in the UK for a few months, and am to return back to the USA in about a month or so.
I do not have a place of residence in the US at the moment; however I do retain a State of Nevada ID - also, I have a friend there to which I can have my mail delivered to etc.

My question is whether it would be ideal to place my contact's address in the US, or my temporary address here in the UK (which I would most likely need to change in a few weeks time anyway) -

K-1 Fiance(e) Visa Process & ProceduresTo B2 or not to B2
Hrrm.. so I see that a VWP would be a more certain path;

However, how long are we talking about (on average) until she actually needs to be in the UK for the medical/interview.

Also, will her applying for a B2 (and possibly being denied) cause her to have a red flag or whatever?
foobarbazMaleEngland2011-06-22 21:22:00
K-1 Fiance(e) Visa Process & ProceduresTo B2 or not to B2
She does have numerous family in the UK, and she would be staying with them anyway during the times when she will be unable to actually be in the US. So she can provide proof of the means to support herself, and at least show that she has somewhere to return home to in the UK.

She's just graduated college in the UK, I wonder if that would give her any edge. Maybe applications to universities in the UK?
foobarbazMaleEngland2011-06-22 19:56:00
K-1 Fiance(e) Visa Process & ProceduresTo B2 or not to B2
So I've filed a I-129F last month, got my NOA1 and waiting for more updates.

I want to have my UK fiancee stay with me here in the US starting in the beginning of august until her K1 interview happens.

From what I understand, the K1 process takes about 5-6 months, and by the time she would arrive in the US (beginning of august) it would already be two months into the process.

I'm debating whether she should go under the VWP (no B2 application fees, interview etc.) and stay for three months, at which the K1 process would have entered its fifth month and likely have her interview in the UK anyway, or whether it's worthwhile to go the B2 route.

I've done some googling and I'm kinda scared about the chances of her getting rejected for the B2 etc. are.

PhilippinesTransfer of approved K1 petition from Abu Dhabi to Manila
Hi All VJ Members,

We're hoping that someone could help us on these and wondering if someone has experienced the same.

Our petition was approved last Aug. 13 but it was sent to Abu Dhabi instead of Manila. I used to work in Dubai and was still there when we started the paperwork. We used my Dubai address as my current address to be completely honest with my current location and put on US Embassy in Manila for my interview location. Unfortunately, our papers were still sent to Abu Dhabi. I already got my case number and interview date which was for Dec., but there's no way that I could do it there since I already quit my job and went back to the Philippines. We sent a formal request to Manila to be forwarded to Abu Dhabi. Abu Dhabi confirmed that they have sent the physical file last Sept. 25 by diplomatic pouch and will take about 2-4 weeks before Manila receive it. We're calling USEM twice a week, last Friday we called again but according to them they still don't have the file yet. My fiance and I are really getting nervous about the waiting time since our approved petition is only valid until Dec. 12, 2012 as per the validity date indicated on the NOA2.

Does anyone know if by any chance there's a way to track a diplomatic pouch and how long it really takes before Manila receives it?
If ever, what will happen if the petition reached its validity date and we don't have our file yet? Do we need to file another petition or we could extend the validity date in USEM?
Can I schedule my medical and interview even though Manila doesn’t have my file yet?

Thank you so much in advance :)

K-1 Fiance(e) Visa Process & ProceduresConfirmation Letter Address?
Hi Guys,

Which address does the embassy use to send out the confirmation letter to my fiancee once they get the paperwork from the NVC...the one on the I-129F or her G-325A?

We're about ready to send in our K-1 petition, but have run into a little snag. My fiancee is a Filipina currently living/working in Dubai and after reading about the long wait times for Abu Dhabi, we've decided that going back to Manila for her interview will get her to the US about 4 months sooner. I already have her signed G-325A with her Dubai address on it. Could I just use her mom's Philippines address on the I-129F to make sure she gets the letter, or do we need a new G-325A as well?

Thank you

This is really silly but my husband had his interview today and was approved. Now, we'd signed up for having his visa go to a DHL in Bogota (which is free). He will be going back to bucaramanga tomorrow so we want his visa to go the DHL there instead. Is there a charge? I thought they only charged if they sent it to an address, such as your home but I am not positively sure. Does anyone know?

Hola A todos
Leyendo el “post” de ALT+3 dice claramente que su visa aprobada la entregaron en una oficina de DHL que el mismo selecciono. “ She asked me when i was leaving and gave me a DHL paper with a number to call and set up the visa delivery.
