Read something on here that has me worried.

I read on here that when you submit your 129F.. you need to submit both primary and secondary evidence. of proof of having met more than twice in the last two years... and that photos are considered secondary evidence. And with only submitting secondary evidence, you can expect an RFE..

I'm worried because that is exactly what I did.

On my application I said we met online on such and such a date and have been dating IN PERSON ever since because we live less than 50 minutes apart.

Since i live on the border... and from what I had read about what was required. I got the impression somehow that sending off 5 photos with the date and place on the back etc would be enough.

I am not worried that it will just end up as an RFE because I didn't send receipts etc. I just didn't think to do that because we are so close... so I don't have airline tickets etc..

Does anyone have any personal experience with this?

Did yours result in an RFE?

A little follow up- Even though I doubt anyone is still reading this.

BUT - I emailed the Montreal Consulate.. a few months ago.. Telling them the situation and asking if they had anything about me in their system.

I got a response a week ago- saying there was nothing under my first and last name.. but to send my FULL name and DOB.. as well as the case number ( which I don't have).. I replied with that info.. and got a response a few days ago saying.. they have absolutely nothing under any of the info.

I'm taking this as a positive... but I'm going to still print off these emails to bring to my actual interview.. as well as the messages between my ex and I where I attempted to get him to cancel the app.

Anyone know if of the 129F form - when it asks what consulate you will be going through..

We put Ottawa.. since that is closest to me.. but come to find out Ottawa doesn't do K1s... only Montreal does.. is that RFE worthy.. or will they just switch it?

I just know people have had difficulty when they have another pending application in the system still.

Even someone who had a pending application from 8 years ago had it come up in the interview.

Sigh- hoping I have some good karma coming my way.

I would believe 2 years ago that visa would be expired by now. Even if it got approved its only good for like 3 or 4 months. So that's long behind you in my opinion. If it was an issue I don't think NVC would have sent you a "GO" on this K1 visa.

I would try to get in touch with the base's JAG/Legal services unit - possibly his commanding officer if you can figure that out. Hopefully someone there will be able to lean on him to get him to do the right thing.

working on that- trying to figure out his chain of comms difficult because he doesn't have much info on his page regarding his position etc.

And the info I have found for the military.. I'm not sure where to go from there.

get the his commanding officer involved thru the proper military channel. Hopefully they can help him to do the correct thing.

I can't text him because he is in Afghanistan..

But I did have a facebook conversation with him begging him to do what I asked..

That's what I'm going to print off and bring to the interview.

How long ago was u and your ex's thing? are we taking like a year or 2 ago? I believe that the 1st one is good for only a few months anyways. As far as I am aware the K 1 visa expires and then I don't see any legalities.

well we filed our 129f march 2012. So almost two years..

And then we did nothing else with it..

We never got a receipt number or anything

Thank you everyone for your words of encouragement. I can't tell you how much it means to me.

I really am hoping that this doesn't completely ruin things for us as far as me immigrating.

If you find out anything new.. please let me know.

In the mean time I am going to send addtional letters to USCIS and The Consulate to further express my desire to withdraw from the previous application.

I don't have a receipt number but... I just want to do anything i can do to make sure I did my due dilegence.

Just ignored that user. Probably is a troll to get attention just like some other new users on VJ. Don't feed the troll. I am wondering if he/she really read your post carefully and still don't understand that or pretending don't get it at all. If he/she accepted when his/her fiance cheated and beat him/her a lot and still wants to go to the US, I am highly suspicious he/she just wanted a green card.

By any chance did you write a cover letter with your petition to withdraw the previous petition (just so that it's in their file). I wouldn't worry about it. I think you are find Canada is a pretty forgiving place ya know.

Just be ready at interview to explain good your have screen shoyts of conversation.

I think that's fair grounds to decide not to marry someone.

Having a previous petition could obviously be a red flag, but so long as the relationship evidence is good, it should all work out in the end. Good luck.

Consular officer from US embassy that will going to interview you for K-1 visa. Yes, I am sure if you have good explanation to them about your situation and give them a proof, they can't stop you from obtain your K-1 visa just because your former fiance refused to do so. I wish could find you the thread on VJ that was talking about pending several petitions. I will let you know when I found it.

There are some VJers here had same problem with yours. Some of them could passed the interview even though they had several petitions still active. Some others, unfortunately, could not go through.

I know nothing about this but probably is better showing to CO the proof that you already asked your former fiance to cancel active petition but he refused it and you can't do anything or pushed him to do what you've asked for. I hope you still have all papers from your previous I-129F in case you need those. Good luck!

Hi- had a previous post that it looks like people have stopped replying to and i am not panicking about this whole thing.

I have an ex bf who is in the military, while he was deployed a few years ago, we found out he was going to be transferred to Kentucky when he returned so, in fear of having to break up due to the distance ... I got everything ready for the k1 fiance visa application and we mailed it off as soon as he returned home.

But quickly after, I saw he had severe ptsd and he refused to get treatment. After he cheated on me and smashed up my car, and still wouldn't get help.. I ended the relationship. It was not an amicable break up. He still hates me for ending things.

We filed two years ago- he's american .. I'm Canadian..

He moved right after- he never got the NOA1.. his mail was never forwarded to Kentucky when he moved.

So we have no receipt number nothing.

Right after I emailed the USCIS 2-3 times asking to have it cancelled- I got no response.

March of this year I started dating an amazing guy.. I'm super happy. We decided to start this process for us to get married.

So this obviously came back into my mind.

I called USCIS - they told me my ex has to cancel it.

I ask my ex.. he says he will but he is deployed and in love with me.

I ask him again- He says he doesn't care to help me at all.. and will not help me..

I'm getting some answers saying that as long as I am honest in the interview stage I will be fine- others say my new application will automatically be declined.

We just got our NOA1..

I'm so nervous that it is all going to be for nothing.

my ex will not help me.. I've tried multiple ways.

I'm so upset. Please help.

Ya- we are all the same in the eyes of immigration when it comes to money etc..

Just make sure you have everything you need everything.. TRIPLE CHECK... photo copy the whole package a few times and send it off with a read receipt.

Can girlfriend come here then file?

Honestly.. I think the thought crosses a lot of minsd when they first start this process (it crossed mine :/)

But the risk isn't worth it... she can't come here "visiting" with the intent to immigrate...

If she is caught... you suffer pretty much her not being able to come down here at all..

You two sound like great people.. and like you are in love.. I am in the same boat... plus I HATE my job... I literally tear up everytime I live My guy's house because the thought of coming back here... and leaving again is overwhelming sometimes.

As far as how long it takes... it is really hard to say... to give you an example... We filed at the beginning of December and have received our NOA1... but nothing else yet... ... So almost 4 months and we aren't even at the second step yet.. Sigh

Denied - Need Advice

The OP stated earlier that her fiance was questioned at his interview at the consulate and told them his real birth place.

As you explained before, if his mother used a false name and other man is on his bc venezuelan, and the dominican bc has the right name of his mother and his right father.
how did the consulate find that he was born in venezuela?
you said that in the original bc he has diferents last names.
so the two bc are from diferents persons.
The only way that the consulate can find that is if someone that know his history maybe called to the consulate.

Right now the update is that the lawyer has contacted the embassy but they said they didn't receive the form yet which says they are representing me (sent last week) so the lawyer is calling daily.. Tomorrow senator Cardin (or someone in his office) will call the consulate for an inquiry.. The status of the case on ceac is still 'ready' so a denial has not been processed yet.. The interviewer told him to bring back his Venezuelan bc which he has found (original really tore up) as well as his original passport from Venezuela which also has a lot of damage. He is planning to take those documents back on Thursday depending on what data the senator and lawyer get tomorrow.

Obviously this problem is too deep for you to handle if you feel that it is necessary to be so rude and negative.This is someone's life and happiness we are talking about. You should be more considerate. These people probably want to be together as desperately as the next. When you throw such negative responses out like that.. it can be devastating to read for the person who is actually going through the situation.. You make the whole situation sound Earth shattering. My response to this post is.. look.. you made a mistake. It is a little complicated for you to get a direct answer on this type of forum. I think you should do exactly what the consolute asked you to do and go from there. If at the point it gets complicated.. you need lawyers etc.. Then go for it. But it isn't the end of the world. Where there is a will there is a way.. You just have to be willing to put in the work. And even though most of us haven't heard much about this type of scenario... I'm sure it isn't the first time the consulate has come across it. Hope for the best but expect the worst my friend. Just do what they ask and hopefully it all works out. GOOD LUCK.

This problem is way too deep for me to handle. He has a FAKE birth certificate. Due to his fake birth certificate he also has a FAKE PASSPORT, and what else? His entire life is a lie. He will have to start in Venezuela and he will have to prove he was born there. How is he gonna prove that? They are going to say he's a liar because he was born in DR. You are screwed...you need probably three attorneys, one in Venezuela, one in Dr and one in US. Be prepared to spend a ton of money and there are no guarantees that he will ever be allowed into the US. I hate to sound so negative but put yourself into the shoes of the CO and what would you think? Fraud is the first word that comes to mind. No wonder they are not sure about your relationship. If you are supporting this guy you better take a few steps back and talk to some close frineds and ask them to look at this picture and see if you are being taken advantage of. "Packet 4" isn't really anything besides the consulate providing the link to book the interview and approved doctors for the medical. I think the medicals out east take a lot more time to put the package together so make sure you look into booking the medical asap.

I am a Canadian who lives about.. 30 minutes from the US border.. and my boyfriend lives about 20 minutes from there.

Luckily for us.. we get to see eachother pretty regularily through this process...

My questions is- I thought that send 5 photos for proof of meeting in the last 5 years..was going to be sufficient since we live so close together...

My Dad taught me to pay my debt.. I've never missed a payment on a single thing.

But sometimes life happens.. and it's a decision that makes the most sense for your situation.

So be honest with yourself.. look at the big picture... research.. and whatever the best option is.. do it..

And don't feel guilty if its the crappy option.

Oh no I would never run away from any payments! That's why the past year has been such a struggle, not being able to work. Before when I worked, I still had all the debt, but I made all my payments on time and had good credit. We never had plans to stay in the US until DOMA was passed, or else I would have dealt with this before I left for sure, or tried to. Now my wife is using her paychecks to pay off my bills and honestly it makes me feel like total garbage. I know she says she doesn't mind and we share our finances etc but it still makes me feel bad, especially right now when I can't contribute and haven't been able to for 8 months+. That's the only reason I was even looking into it, to take some stress off her.

My student loan is: 9K (But it's under repayment assistance, so I don't have to make payments for now if they keep approving me.)

My student line of credit is: 15K

One credit card is: 2.5K

Another credit card is 3K

and then on top of all our other US expenses.

To me, right now, in my current situation, I guess those numbers seem really scary and depressing. I don't think I'd ever buy a 24K car, to be honest

Yeah, I should do that. My wife just got an increase in her job, and we just had to finance a new car because her SUV crapped out and it wasn't worth putting more money into it. Plus we needed a reliable car to travel to Atlanta for our interview, and move to Portland hopefully in a few months.

I'm going to re-create our budget and see what I can do. I'm wondering if there is a trustee where I am in the US that knows more about the Canadian credit system.

Why don't you just have a consultation with a bankruptcy trustee (it's free).. and ask them straight up about the re-assuming thing?

That was told to me by the BKO trustee.. but who knows.. maybe that was them just trying to sell me on doing it when i did.. ?

I'm going through something very similar.. and had a hard time researching this online.

I however.. and not yet in the US.. I just filed my K1 back in December..

I asked a bakruptcy trustee some of the things you are asking.

1. Can I file from the US? - Yes you can

2. Would it affect my US credit in the future?- Yes.. a lot of creditors in the US.. still have the ability to pull your canadian file. Not all do.

3. Would it affect my AOS process? - No- it has no impact on immigration what so ever. Only impacts your creditors. It is your fiance who would need to prove they are financially stable etc.. not you.

4. How long does the bankruptcy remain on your credit history? Um.. well filing for BKO in Canada.. it stays on your credit for about 7 years.. 9 months to be discharged if it's your first bankruptcy.. and then for 6 years after that. So just about 7.. then it takes time to re-establish your credit etc. However.. I have heard that if you file BKO in Canada... while living in a different country.. that as soon as you re-enter Canada.. you re-assume that debt. That was told to me by the trustee.

5. My uncle co-signed on one of my student loans for me, would filing bankruptcy affect his credit or only if I abandoned my debt? Yes it would. Unfortunately he took on responsibiliy for that debt when he signed onto it. So really.. your creditor could go after him for that money... I'm pretty sure the bad debt will report on his credit bureau if you file as well.

I know how frustrating this is.. I thought of this now.. I have thought about filing for a long time.. And once i realized that I wasn't going to be able to work for quite a while after coming down there..My fiance and I talked about it in depth over like.. a month or two.. and I just signed the papers on Wednesday to have it done. I'm not marrying a millionaire.. and I want to start the next chapter of my life without all this baggage and we don't need the added stress of me finally getting down there.. and then barely being able to make ends meet if he pays my debt. He offed to sell his truck etc.. broke my heart.. I'd never let him pay a dime... Mine wasn't even from school.. it was from Life... Shitty Life.. lol So I really feel for you.. I know how stressful this is.
