Ya, I'm thinking that's because they aren't Canadian Citizens and therefore can't prove sufficient ties to Canada or their country of citizenship. As far as I know citizens of Canada and Bermuda can travel to the US for either 3 or 6 months without a visa. Ask someone in Florida have many retired Canadians stay there in the winter....

Thanks so much!!!! I spent about two hours trying to research the answer to this last night, and just had everything cleared up in about five minutes. :D
I'll click no and sign and date my forms before I come visit, and have him sign and date the forms for when he submits everything after I've left, and then we should be good to go.

We just thought it would be easiest to assemble everything together while I'm there, without me having to mail stuff to him from earlier visits, and my bank statements, etc, teamwork makes it less hectic. : )

It doesn't really matter because you can fill the forms out whenever you want. But I see your point. Fill out your G-325A now, and sign it along with your letter of intent. Thank you! I was thinking the same thing....I've read on another post that if someone is in the states at the time it's sent, even if it's just a short trip, then they do click yes. It's all relevant to the day it's sent..

So if I click No, and we sign and date everything one week after I've returned, and not submit it until after I've left, then I'm ok.

Which also makes me think that the officer will wonder, "how would they be able to sign and date all of the documents together on the same day if she wasn't there?"
And then we would have to get into signing things on different dates....and making up things...

So I just thought if i clicked yes and figured out how to answer those questions....then maybe that is the best way.

Is that question only relevant to a person who requires a Visa to be there?

Canadians don't require visas to visit. We also don't have to fill out an arrival/departure record. The question is asking if they are living in the US on some other visa.

Since you don't require a visa to visit the States from Canada, I would just click no. Save yourself the anxiety, and confusion.


My bad. I got a little ahead of myself. I would wait til you get home and click no just to save the confusion. BUT if you want to file while you're hear, the dates they need will be on the entry/return form you fill out when you clear US Customs. I was unaware that visas are required to visit between Canada and the US now. Things have changed since I moved from New York. :)

I did read the guide actually before posting, it had three items as a guideline. I have proof of passport stamps of visiting her city but we didn't take any photos together. Are photo together a requirement for K-1 and CR-1? That was the question I was trying to ask.

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum, but the more you can provide the less likely you are that you will receive an RFE. Additionally, please note that providing proof of your ongoing and genuine relationship in this package may benefit you by allowing the consulate to have access to this information prior to them formally contacting the non US Citizen fiance. Many high risk consulates approach cases with a skeptical eye and providing this information early on in the original I-129F package will help them in their preliminary review of your case.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.

2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.

3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

They are not a written requirement, but go a long way in showing proof.

For a K-1 you need proof of meeting within 2 years of the date you file.

Average timeline for a K-1 looks like about 6 months....

Average time for a CR-1 is about 5 months, but both of these times vary based on your case, and nothing gets held up for an RFE, or AP.

A question here. In my country when we usually file for some documents and they need a birth certificate they ask not to be older than 6 months(i don't know why is it like this).

The only thing I know of that has a time restraint is the CENOMAR. It is required to be less than 6 months old....

thats easy...just email the consulate and tell them you want to delete your petition. they will stop the process and you have to mail them a letter personally signed and that will take care of it!



Thanks, I don't think I can e-mail the Manila embassy though...I'll check. I planned on sending a letter. How long does it take to get updated in the system? And I am assuming that if the petition is deleted, you should be able to file a new one immediately....

You can get her a visa if you live in Japan. Since you are in the military, you are considered domiciled in the States. Use your home of record as the address on your petition. I know plenty of folks who brought fiances to Japan/Okinawa, and such. Go onto the USCIS webpage, they have a special link for military members.

It may work out better for you to go to the PI and get married. When you get back to Oki, you can apply for a SOFA card for your then WIFE, and she will not require a visa to join you. She will be a dependent ID card carrying wife...At that point you can direct file her spouse visa paperwork at the US consulate on the mainland, which will allow her to enter the States when you come back, or to travel...just a thought.

Hi,

I need some advice regarding a "Initial Evidence Request" for my petition for alien fiance. Immigration is asking for evidence regarding our "Intent to Marry". The letter says we "must express (our) intent to marry each other within 90 days after the arrival of (of my fiance)". Per the instructions of the petition on I-129F, it says:

"Provide original statements from you and your fiance whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutal intent ... "

My fiance and I provided original statments of our intent to marry. So I'm confused on what else immigration wants. When I called the customer service number on uscis.gov yesterday, the guy I was talking to recommended that I fill out a marriage license. Unfortunately, here in Alaska, both the bride and the groom need to be present to fill out the license and be sworn under oath before signing.

I called uscis.gov this morning to see if I could confirm the answer I got yesterday. This time, the lady I talked to at uscis recommended that my fiance and I re-write the letters of intent, but this time have them notarized. I mentioned to the person this morning the answer I got yesterday from uscis, and this person said "your best course of action is to get the letters notarized".

I'm seeking the help of anyone who has received an "initial evidence request" regarding the "intent to marry" and what they provided to prove their intent. Apparently, it is more than just providing original statements ...

That's a new one. My wife and I filed I-129 in 07. We supplied original un-notarized letters, and the proof of meeting w/in 2 years and afew pictures.... That was it for evidence. We had our petition approved without an RFE....

I am under the impression that in Mexico, even if you have been married in a religious ceremony, you would still have to have a separate civil marriage before the Mexican government would recognize you as "legally" married, and that they are two distinct processes there. If this is correct, then if you ONLY had a religious ceremony you are not "legally" married in Mexico, and can still apply for a K-1. Can anyone with more information shed any light on this? Obviously, as has been said before, if you do determine that they are separate processes, I would still not include or mention your religious ceremony anywhere, as it may be confused with a legal marriage.



Well said. I know that religious ceremonies in other countries such as India are not considered legal because of the 2 part process. Any evidence from the religious ceremony should be left out, and the OP should press on with the K-1 process. Looks like he would have plenty of proof of ongoing relationship, and proof of being together within the 2 year timeframe....

Are you speaking of a catholic ceremony? If so, it would be recognized here. Any ceremony considered legal by the foreign nation is recognized as legal in the States. Also, since the K-3 is administratively dead, go the CR-1 route. Look at the I-130 guides on this site for help.

I know I have not been waiting for long, but it does not give a sense of relief to know that there are unapproved petitions dating back to March of this year (perhaps some people have been waiting even longer than that!). At the same time, it puzzles me to see in some members' timelines that their petitions were approved in less than a month. How does that make sense? :unsure:


Well, alot of it depends on how well folks are frontloading their petitions. RFEs will lengthen petition times as well. If I remember correctly, when I filed at the CSC in June of 07, our petition was sent to Manila in early August. I used this site to prepare my package, and frontloaded the bajeebers out of it so there was nothing that could be questioned, or doubted. I did the same thing with my I-130 this year. I too am in lala land waiting at NVC now. I am not saying I am dissatisfied with processing times, but I am a realist. I expect it to take as long as the processing times on the website, and might be pleasantly surprised to find out it takes less...or longer. I just know that my wife will be with me eventually. I like eveyone else would prefer a pink slip in no time...but knowing that probably won't happen, have faith that my package is filed properly, and that it will be approved with no problems. Well, time of year might make a difference, but when it comes down to it. They have other visa types to process as well. If they begin to get backlogged on those types, they will start processing those to clear the queue. I know that a while back it was slow...then they were processing K-1s like crazy, and all of a sudden stopped. I think that this is one of those times when they are processing other visa types.

Everyone needs to realize that if the CSC was only processing 100 or so packages a month it would make one wonder why it takes so long. BUT they are handling thousands of petitions every month. I abandoned my wife's K-1, and we married instead in the Philippines. So, this is technically my second trip through the Visa Journey. It was even slower back in 07-08. The CSC processing times have sped up quite a bit....

Understood. I was mainly addressing the suggestion of using the EXIF information from the photo as evidence of when the photo was taken. I was making the point that the EXIF information was less reliable than the photo image itself because it's easier to edit. I also explained that USCIS will tend to believe your secondary evidence if you provide believable primary evidence, and disregard your secondary evidence if you don't have the primary evidence.



In the days of PhotoShop and photo-realistic computer graphics, there will never be any guarantee that a photo has not been fabricated or doctored to appear to show something that isn't real. If you have primary evidence that strongly indicates that the photo could be real, then the adjudicator is not likely to question it.

Hello everyone,
I am currently depolyed far east until mid March. I have sent the I-129F package back in August and still have not recieved the notice of action the second time. I have called the military help line and requested a priority look. They were suppposed to send me an email yesterday to give me there decision on that but I never recieved one. My question is if in fact I do get the speedy look or what have you, will it be possible for my finace to recieve her Visa to enter the U.S. by Mid March when I return. Obviously that has been the plan all along but I am starting to realize we are running out of time very quickly and as you can imagine I dont have a whole lot of time to dedicate to this. Would it help if I were to call again? What do you think I should do? Thank you kindly, your help is much appreicated.


Did you know you were deploying when you applied? You could have filed for an emergency expedite based on your deployment. You should still be able to expedite, but it's not guaranteed because you are already deployed. Most expedite requests for military are approved due to imminent deployment. To expedite, you have to request it in writing, and provide justification as such. Your deployment orders may suffice...but expediting at this stage just to have her here when you return may not work.

SOME RESTRICTIONS ON THE RIGHT TO TRAVEL OF FILIPINOS

I. Minority- for the travel of unaccompanied minors, a Travel Clearance must be issued by the Department of Social Welfare and Development (DSWD) and presented to the Immigration Officer prior to departure.

A travel clearance is required and shall be secured from the DSWD by the following Filipino citizens:

1. A minor traveling alone to a foreign country;

2. A minor traveling to a foreign country accompanied by a person other than his/her parents.

3. A minor who is the subject of ongoing custody battle between parents will not be issued a travel clearance unless a Court Order is issued to allow the child to travel abroad with either one of his/her parents or authorized guardian.


E X C E P T I O N S:

1. Under special circumstances where a minor whose parents are in the Foreign Service or living abroad as immigrants provided he/she possesses a proof that he/she is living with parents abroad and their travel does not constitute child trafficking.

2. A minor traveling to a foreign country with both or either parents or with his/her legal guardian. Solo parenthood or legal guardianship may be proved by:


A photocopy of the solo parent identification card from the Municipal Social Welfare and Development Office; or
A photocopy of a certification from the local Social Welfare and Development Office of being a solo parent or Tallaq or Fasakh certification from the Shariah court or any Muslim barangay or religious leader; or
In the case of an illegitimate child, a certificate of no marriage from the local civil registrar; or
In the case of a deceased parent, a photocopy of the death certificate; and
In the case of legal guardianship, a certificate of legal guardianship issued by the court.

3. In cases of illegitimate children, if they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD. If they are traveling with person other than the mother, they must secure a travel clearance.


Since the mother has the absolute parental authority over her illegitimate children the father need to secure a Court Order giving him the parental authority over the illegitimate children. If the parental authority has been granted, he is not required to secure a travel clearance. If the minor will travel alone or with someone other than the father, he/she is required to secure a travel clearance.


4. DSWD travel clearance is valid for a period of 1 year from date of issuance and shall be valid for multiple travels within the validity period PROVIDED THAT the conditions under which the travel clearance was issued have not changed. If a change in condition occurs (ex. A change in traveling companion), a new travel clearance must be obtained.


The application for travel clearance together with the supporting documents shall be submitted by the parent or legal guardian or duly authorized representative at ANY DSWD field office. The application form can be downloaded from the DSWD website www.dswd.gov.ph.
The travel clearance may be obtained within 3 working days from the DSWD office where it was submitted provided all the requirements have been fulfilled. (Administrative Order no.14 series of 2005 as amended by Administrative Order no.2 series of 2008, Amendments to Omnibus Guidelines for Minors Traveling Abroad).
