Note,,, I only printed one chat session for every 10 days for the interview... The idea/requirment is to show a continous relationship.
It is Not necessary to show every detail of your daily lives. I had 12 printed sessions for the 4 months we were apart.

As always,,, better to have more then less. But, I tend to lean toward "What is reasonable,,, plus a bit more".

In my opinion, if you follow the guides on this site, there should be no reason to hire an attorney. Hiring a lawyer doesn't make the process move along any faster. Easier perhaps, but not faster. Plenty of folks have gone it on their own, and have had no problems. Yes the wait sucks, but we have all gone through it, even though it can try your patience at times. Also, the average timeline for a CR-1 in Manila is running around 5 months. Good luck on your marriage, and good luck on your visa journey!

I have another question to make sure I understood it. Did you still fill in I-864 besides I-864a for your mom and your dad's I-864?

The accountant told that his wife has to sign too. So, would that mean that in this case we have to submit 3 affidavits, is that right?



That is correct. If your co-sponsor filed a joint return, both individuals on the tax return must submit an affidavit. So, your spouse would fill out I-186, your co-sponsor would fill out I-864, and your co-sponsor's wife, would submit I-864A because they live in the same household.

Correct, and also incorrect. The current year's income is what will be looked at. As long as you meet the poverty level at the time the I-864/I-134 is signed, you will be fine. However, USCIS requires most recent plus 3 years tax returns or transcripts, whether you met the poverty level, or not.

If the current years income is above the level needed, you would need to prove that (letter from employer, similar to the 134 format, paystubs (6 months to be comfortable)) - and the most recent years tax return info.

They will take that in account (new job, making it now).

Add more years, even if they are below the level needed, to show you have a history of income.

No need to go through the rigor of converting assets - as you do not need them (since your current income meets the level at the time of the 864 filing). You could show bank statements with the level of money in savings (letter from the bank should suffice)

Not that I have seen anywhere. Mainly they need your face clear from obstruction, both ears visible, and the only head dress allowed is relious type worn on a daily basis. The bindi is considered religious, yes? Then I would venture a guess that if it is worn on a daily basis it would be allowed. I could be wrong...and would suggest that you call your nearest photo shop who takes US passport photos, and ask the question to them.

2 options here.

1. He should be able to contact the court clerk where the Florida divorce was adjudicated, and request a certified copy. I did this in AZ, I live in South Dakota. Made a phonecall to the County Clerk's office, ordered the decree, gave them bank info, and it was mailed out. I received mine in about a week.

2. He can try to take the decree to his local Courthouse, and have them certify the decree he has in his posession. This too will incur a cost.

at this stage copies of divorce certificates are acceptable. once you get to nvc level you need originals or certified copies.
you can always phone the court house and verify whether its an original or not too.
personally i think you'll be fine. good luck.

How long have you lived in Morrocco? If over six months, you can DCF at the US Embassy in Casablanca. But, for that you would have to show your address in Morrocco. I assumed that you have to have proof of domicile in the US. I am not sure that using a relative's address, and not having a physical address is appropriate. Can someone clarify this? :help: I am just looking out for the OPs safety. I didn't think using someones address in the States, and living abroad is legal for USCIS purposes.

Flight confirmations are one thing, but you have to prove you were physically on the flight. Your passport stamps should cover for this though. :bonk:

How do they decide which service center it goes to? Do you have any ideas? I live in Texas and I was under the impression that it would be sent here to the Texas Center. I have also been told that it could go to the California Center since my fiancee is now in Tijuana. I'm lost when it comes to that.

As far as proving that you are bonafide, what are some of the items that can prove this? I can't give them a lease because we don't live together, and that kind of limits what we can present i would think. I tried adding him to my bank account, and they request that the person be present and in order for that to happen he needs to be here! LOL We do have pictures from when we have met, and emails as well as phone records. I hope these suffice the requirement to prove that we have been in contact since we met. I also know that my passport has been stamped at least 4 times when I have traveled to Mexico to go see him. :blink:

There doesn't seem to be much rhyme to the madness, but I guess they send the packages to Service Centers based on current workloads. Used to be based on where the Petitioner lives. Not anymore....

I think that what you have would work fine. Include your ticket stubs, and boarding passes if you flew. Otherwise, save all your receipts too. I front loaded my package with a ton of pictures. Mostly of me with her family, and her and I together in different spots around Metro Manila, as well as pics from the wedding. I also have a few affidavits from close friends, but haven't needed them yet. But, I know how difficult it can be to add someone to a lease, or bank account. Luckily, I added my wife as the primary bene on my life insurance, AND she has a military dependent ID card too. :dance: You can save up all your proof before they ask for it at NVC though. It'll give you time to build a good proof folder.

Thanks, in regards to q 3 that's exactly what I'm trying to avoid, the infamous lawyer fees! :wacko:

When I went to consult with the lawyer she made it seem that it would be years before we could be together and the only way to do it faster would be to file for the K-3 visa so that at least that time we could be together. Since it looks like you also have some experience with the process, how long is it approximately? I know that the time frames are provided we have all papers sent in with the packets. This is my second marriage, and the first time all we did was file the I-130, but before any other paper work could be done we were already getting divorced, so I really didn't get the chance to know what papers were needed to file.


Average right now is 5-9 months depending on which Service Center they send your package to. My package for my wife flew through the USCIS. It has reached a stand-still at the VSC, but I know it'll happen soon enough. The biggest hurdle for this process is proving you have a bona fide relationship. There is a lot of extraneous paperwork in my opinion. Study up on the IR-1/CR-1 guide, and you should be fine and dandy. Hope this helps. If you have questions once you get your paperwork going, don't hesitate to ask!

Since you are choosing to marry your Fiance in December, your attorney is correct...to a point. She is recommending that you pursue a K-3 visa. However, since the I-130 and the I-129F will be approved at the same time, the I-129F will be administratively closed, and you will be put on a CR-1 course. Save the time, and hassle, and file I-130 when you come back to the States. The wait time for a K-3 and IR-1/CR-1 is the same anyways.

As for Question 2...I wouldn't foresee any problems based on the info you provided.

Question 3. If you feel that you have a complex case, which it doesn't appear to be, hire an attorney. If you follow the guides on this site, you can file yourself, and save those attorney's fees for a honeymoon when your hubby gets here. :dance:

Guys I need your input on this:

I'm an LPR and my wife has an interview date next month(in her home country).I have been unemployed for 2 years now but I have already sent in my I-864 and file is now at the consulate.
Neither the NVC nor the consulate have so far asked for a Co-Sponsor.I assume they will but so far they have not.
Just in case I have the Co-Sponsor's I-864 ready with me and I have sent it to my wife,in case they ask for it.

I am wondering why they have not asked for Co-Sponsor yet.
Any input on that,guys?

Search for some additional info on your consulate. Some consulates will not accept co-spnosors. Mostly for K-1s, but you are filing for IR-1, so I'm not really sure. I would call the Consulate and ask the question. I would think that the interview is a bit late to be dealing with it. Makes you wonder how it made it thru NVC....

You dont pay anything to have an expedited procedure. You have to meet the USCIS criteria to qualify for an expedite.

As far as im aware, you can only pay for an 'expedited procedure' if you are applying for a different type of visa.

You CANNOT pay for a faster process during the immigrant visa application.



You can...it's called Premium Processing. Costs $1225. But you are correct, expedites are fee-free. :thumbs:

You can go to your CFO after your interview. You can go before as well using your interview e-mail as your proof to get in. It's up to you. If you choose to wait until after your interview, and haven't received your passport from the Embassy yet, you can still attend the seminar, and counselling. They will give you your completion certificates. Once you have your passport from the Embassy, take it, and your certificates to the nearest CFO office. They will affix the stamp to your Visa. If I can make a suggestion, use PRISM for your CFO seminar. I have heard they are less stringent than St Mary's. Make sure you bring all of the required documents for the seminar. Most people will just take the same package they had at their interview.

This is incorrect. The CEMAR and NSO certified marriage license are two completely different documents. Your SO will require both at her interview though, unless the ORIGINAL certified copy of the marriage contract was already submitted to the NVC.

The POE will be the first airport he arrives at that has an immigration checkpoint. Since he is coming on a CR-1/IR-1 yes he can work as soon as he gets here. From what I have been told, you can call in with your change of address. Quick and simple. I still think that your interview will be scheduled in Dubai, since that is where you live. I have known people personally in the past, who had their interviews elsewhere. One good friend had hers in Korea, even though she was a Filipina. As I said before, the NVC will assign the case to the appropriate consulate. Once you get your case number, you will know. The first three letters of the number are the consulate where you will interview. If it is MNL, you will interview in Manila. Fill out the forms, answer the questions as asked. Don't read into the questions.

Hello dear VJ Members

Please I need your advice for my situation below.

1.)We got married in Manila, Phils. on Dec. 1, 2010, husband is back in the US and will start to work on I-130 Form, but I’m bit confused here , since I’ve been working in UAE-Dubai for 5 years now , and going home only to the Phils. for annual vacation, not sure which address I should write on the G-325A and I-130 (??) Should it be Dubai address / Or shall I write only Phils. address since that is my permanent address and will go back there for Interview. Or shall I rather get interviewed here in the US-Embassy- Dubai? Is it imperative that beneficiary’s : Consulate(US) must be in the country where Marriage took place for CR/IR1 Visa ? Has anyone had the same experience out there? Please, any light that you can shed on this matter will be greatly appreciated. Thank you in advance.

2.)Can I write my married name on all application forms even though I haven’t changed my passport yet? I’ve enquired with PHils consulate-Dubai but I need to submit Marriage Certificate from NSO which will take a while, as per my hearing maybe 6 mos before it could be released. Follow up question: Anyone has the knowledge how long the NSO can release Certificates after it was submitted by the Local Municipality? If so, Is there any way it can be faster? (note: I am only holding our original Marriage Certificate registered locally)



Well, I can answer your follow-up question. You can obtain a certified xerox copy of the marriage cert from the NSO as soon as the marriage is registered. This copy will be blue in color, and will work for the intial petition. The certified original will be available in about 3 weeks once registered. This will be yellow, or green in color, and is what will be required at your interview.

As to your other questions, when filling out the G-325a, answer the questions as they are asked. Current address = where you are now. Since you have been there 5 years, you should only have to list your Dubai address since it is where you reside and the form states adress for last 5 years.... Vacationing in the PI doesn't count as a permamnent residence. Now, since you are living in Dubai, your hubby should list the US Embassy in Dubai as your consulate. NVC will assign your package to the appropriate embassy anyways. But since your primary residence is in UAE, you SHOULD be interviewed in Dubai.

Your name should reflect what is on your passport, since your passport name is what your visa will be issued to. I think there have been folks here who have changed the name on their passport after submitting their forms. Someone will correct me if I am wrong. :bonk:

2.) Question 11 Enter "intend", and state that you will be financially supporting her when she arrives. If you have been sending money until now, state also that you have provided support on her behalf since XXXdate.
3.) As for evidence, duplicate copies of your last 3 pay statements from your employer will suffice, as well as bank statements from the previous 3 months, and previous year's tax return.

For proof of employment, a letter from your supervisor, or boss on company letterhead with the date you started until the present would suffice. this along with your pay statements will cover the requirement.

I-134 isn't required until the interview. The only forms required to file K-1 petition are the I-129F and G-325a for you and your fiance, passport photos, supporting evidence that you have been together within the past 2 years, your letters of intent to marry, And of course the check for payment.

These all get mailed to the Service Center for the part of the country where you live, which looks like will be the California Service Center in Laguna Niguel.

Ya, I'm thinking that's because they aren't Canadian Citizens and therefore can't prove sufficient ties to Canada or their country of citizenship. As far as I know citizens of Canada and Bermuda can travel to the US for either 3 or 6 months without a visa. Ask someone in Florida have many retired Canadians stay there in the winter....
