The OP seems to be confused with the fact that if his wife's daughter requires TB treatment, that she will need to go to St Luke's for the injections every day....As for keeping his wife's passport...seems strange because if his daughter is held up for TB treatments, the visa will expire before his wife can use it.

Our overall plan is to start the pig farm now, and within 3 years, we will be retiring to the PI anyways, so at that point, we will oversee the farm. To be honest, my in-laws have never really asked for anything. My wife's one sister is the only one who has really taken advantage of us. Now she has taken advantage of my mother-in-law as well, so I wonder what is going through her head sometimes.... :bonk:

My situation is different, but similar. My wife doesn't work. I chose it to be that way. I support her 100%, so in that regard it's different. My wife is not the eldest sibling, but is still the one her family looks to when they need money. She has a sister who has totally abused the hell out of her over the past year. Her sis wanted to open a clothing boutique, so asked my wife if she would be willing to foot the up front money for the store. After she and I discussed this at length, we decided to go ahead and help out. Well, long story sort-of-short, she and my wife agreed to a payment plan, so that within 6 months, my wife would no longer hold any part of the business. As of now, my sis-in-law owes my wife 20K PhP and has balked on a loan she took out with my mother-in-law. Who gets stuck with the bill? You guessed it...my wife. My mother and father-in-law are tailors, and have had a rough time. They owned a shop in Masbate, and due to crappy politics, lost their shop about 2 years ago. So, they have tried everything to make money for themselves. Right now, they make charcoal...We are looking at starting a piggery, to give them an added way to make money. But, to stay on point, my wife has held the burden every time her family needs monay. With her sister, I talked my wife into completely writing her sister off. Her sis now sends texts about her dying, and blah blah blah...but My wife has finally taken a stand. I'm proud of her. She still sends money to her mom and dad, but they do well with what she sends. Her elder brothers and another sister help out as well...but I think that because my wife is married to a kano, that is the primary reason for her being held responsible...

You have to make sure you read the fine print. Kayak prices do not include tax and airport fees...unless they have changed recently. The usual tax and added fees will take that $840 to around $1100.

^^^ Thank you for the link that verifies the four-month life of a USCIS-approved I-129. :thumbs: It is the first time that I am aware of it. However, I don't think there is anything to worry about in a case like this, where an I-129 is actively working it's way through the process. I have never heard of a case where the USEM adhered to the four-month expiration rule due to the two-month delay caused by the TB culture. As a matter of fact, after the culture comes back negative, St. Lukes will be the one to reschedule the interview. :)

First, contact the National Visa Center at NVCInquiry@state.gov, put the petition number and expiration date in the subject line, and remember to include relevant data in the body of the email, such as applicant's name and date of birth, your (petitioner's) full name and date of birth, and repeat that the K-1 petition validity is expiring on 8/11/2010. However, don't panic: consular officers can revalidate an expired K-1 petition and add a couple of months to the validity period.

From an immigration lawyer FWIW. Petitions DO have an expiration date.

All he needs for his Legal Capacity to Marry is his passport, and divorce decree (if required). Definitely get there early. They will give him the forms to fill out, he will go pay for the service, and have a short interview with the CO.

As for the license, it does vary by Barangay. We married in Quezon City, and we needed my passport, divorce decree, and birth certificate. My wife needed her CENOMAR, birth certificate, passport, and that's about it. Good luck!

You can actually file a K1/I-129F Petition WITHOUT her passport as it's not a requirement in filing the petition.




A passport isn't required for the petition phase, but will be required for the Visa application phase/interview.

We met in Korea in 2005. I had just come out of a terrible relationship with another Filipina whom I had also met in Korea. 2 of my friends hog tied me and "peer pressured" me into going out with them. Alas, my wife was working that night. Neither of us believe in love at first sight, but things were different. She is 13 years younger than I, but is an old soul. She has lived more, and experienced more in her short time on earth, than most people experience in a lifetime. That being the case, I was immediately turned on to her maturity, and her jovial personality. We dated for about 6 months, and decided to take things to the next level. When I was due to leave, her "contract" was almost up, and we discussed where we head from there. She was intending to stay an additional six months in Korea, but I told her I didn't want her to stay. We agreed, and she left for Manila the day before I left for the States. We have had our share of ups and downs in the past 5 years. We filed for a K-1 in 2007, but abandoned it because of my work, and financial difficulties... but glady, on Feb 28 of this year we were married in Quezon City. I have started the CR-1 process, and am looking forward to her being in my arms for good. We share alot of common traits, and our beliefs on just about everything are spot on, so we have been blessed to have met our equals. She is my life, and my soulmate, and I know that the real fun has just begun.

There should be no problem whatsoever. The Embassy doesn't track foreign marriages. What he went to get was his legal capacity to marry, which basically affirms he is not already married. As long as they didn't marry, the worst case would be he wasted the 30 dollars for the affidavit. No problem! Since there is no marriage on file with the NSO all is good. :thumbs:

My wife and I just had this discussion the other night. I was telling her a story of when I lived in Las Vegas. I used to see several couples at a local food court eating lunch every day. Well, the US husbands were eating lunch, while their Filipina wives were shopping, and running up charge cards. All of the gentlemen were in their early to late 60s, and I was expecting their wives to be somewhat close...but alas, they were all in their mid to late 20s. Anywho, they acted as if their ####### didn't stink, and that they were the best thing since Lechon Baboy. My wife's response was "Why would they act like that? They are in America, and don't have anything to be better than, diba?" She said if she had seen them, she would have reminded them of who they are, and where they come from, and that her motto is humble first, boastful last!

"If you had tickets to a sports event, concert, Disneyland, or for an airline flight, and when you got to your assigned seat you found someone else was in that seat, what would you do? You would call for a person in charge of ticket checking and have the person in your seat removed. You would properly be asked to show your ticket, and you would gladly and proudly do so, for you have bought and paid for that seat. The person in your seat would also be asked for a ticket, which they would not be able to produce. They would be called "gate crashers" and they would properly be removed.

Now in this huge stadium called the USA we have had millions of gate crashers. We have been asking security to check for tickets and remove the gate crashers. We have been asking security to have better controls in checking at the door. We have asked security to lock the back doors.
Security has failed us. They are still looking the other way. They are afraid to ask to see the tickets. Many people say there is unlimited seating, and whether there is or not, no one should be allowed in for free while the rest of us pay full price!

The only reason that I can imagine anyone objecting to being asked for their ticket is that they are in favor of gate crashing, and all of the illegal activities that go with it, such as drug smuggling, gang wars, murder, human smuggling for profit, and many more illegal and inhumane acts that we are trying to prevent with our new legislation. Is that what I am hearing from all of the protestors such as Phoenix Mayor Gordon, US Rep. Grijalva, even President Obama? If you are not in favor of showing tickets, (proof of citizenship, passport, green card, or other legal document) when asked, as I would do proudly, then you must be condoning those illegal activities."

I think we need to look at the real circumstances when it comes to pulling out the race card. Arizona has a HUGE problem with illegals. Last I checked, there weren't too many Asians, or African-Americans running across the border. So, to say this law is racist is total BS. If Northern states were to adopt the law, would we have Caucasian Canadians being detained for being here illegally? Or if adopted by Florida, how many Hatians would be "targets"? I dare to bet that the mix of demographics will change from state to state based on where the illegals are coming from. Based on color? Possibly, but ONLY because of where said illegals are coming from. I support this law 100%.

My wife pays 3000PhP a month for her condo in Quezon City. There are about 10 open condos right now. Actual rent is 7,500PhP a month, but if you pay by the 4th of the month, you get a 4500PhP discount. It's approx 300PhP cab ride to the Embassy from where she lives. Not too shabby.

You will need to register your marriage with the NSO. Once complete, you can request your CEMAR. ( Certificate of Marriage) The marriage certificate from the US will not meet this requirement. Why didn't you just file for AOS in the States after you got married? What type of Visa were you in the US on?

My wife has expressed interest that she wants to leave her daughter with her aunt for now and she want's to come over here to the U.S. If that's the case, well have to start the petition process all over again for the child at another date. This is totaly ridiculous that they expect everyone to have treatment at there hospital when some people live hundreds of miles away. But that is the way it is. I can't do anything about. I am not a rich man to keep the child up in Manila so she could have treatments. No, your not being rude, so thanks for the information. btw, I did call St. Lukes and they confirmed everything that you mentioned. I was just not aware of since I was going my wife's information from what she told me.

If I remember your past posts, I can distinctly remember members telling you that your wife's daughter HAS to be treated at St Luke's. If she is treated by a family physician, she will still need to take the entire battery of meds at St Luke's DAILY, which will prolong the entire process an additional 3 to 6 months. I don't mean to sound rude, but you have asked, and many knowledgeable members have told you what your wife's daughter would need. Your wife is good to go. I would make every effort to get her daughter treated properly post haste! If she is beinig treated at St Luke's, I apologize, but from your post, it doesn't look that way.

Back in 2002, my ex-husband did not return our daughter (then 3 years old) after a routine visit. The reason? At the time, I was dating a Brit, and he and his family came to the conclusion that I would leave the country with our daughter in tow. Granted, we had thought about getting married, but back then, the laws were such that I needed to secure an affidavit of consent from my ex...and knowing him, he would not have agreed to it.

It took me almost a year to get her back, and I had to go to court to do so....via Habeas Corpus...since parental abduction is not illegal in the Philippines...talk about a screwed up law. That year was hell...no mother should ever have to go through that.

My ex has never held a job for more than a year, and has been unemployed for the last 7 years. Good luck trying to get child support out of him. I never asked, and nor has he initiated...you would think that someone who "loves his daughter so much" would be man enough to realize that he has responsibilities other than to his drinking buddies...where he has freely spent whatever money he gets his hands on.

Am I happy the law for securing consent changed? Hell yes. My daughter deserves the best life she can possibly have, and we have found it here in our new home, with a truly wonderful person who is the best husband to me and the best father to her.

I would not have it any other way.

I think questions like this all depend on the town you are in.
I am going through the process at this very moment and nothing has happened like what I have read. I have to wait 12 days not 10. I needed a Cenomar for myself. I needed not only the Cenomar, passport, affidavit, but also original copy of birth certificate. Oh, and they wanted 5 copies of everything.
We were supposed to attend an 8 hour class only offered on Tuesdays and Fridays before applying for marriage but the clerk after much begging let us start the 12 day process on condition that we promise to attend the class. Had a brief worry regarding my divorce paperwork. In California you must wait 6 months and 1 day before final dissolution. The judge can sign the papers at any time in that 6 month period. Well this just confused the clerks in Butuan because they wanted the two days to match. They were going to make us wait for the city attorney to review but I finally convinced them to use the final date. Our total marriage application cost 2600 pesos.
The judge is charging us 2000 pesos to preside but I don't know if that is because he is coming to place of our choosing. We also had to pay court 500 pesos. It has been a very difficult process so far.



Wow....All I needed was my birth cert, my passport, and Affidavit in Lieu of Legal Capacity to marry. The Embassy only asked for the copy of my decree....

I'm guessing that part of the problem is that they don't see a lot of foreigners at the Quezon City Hall. I was mean-mugged more in Quezon City than I have anywhere else in the world....And I suppose that I can respect your opinion, because I guess that for most, the overall opinion is that if you are applying for a marriage license in the PI with a foreign hubby, you are either a bar girl, or a mail order bride.

Well, obviously the rules are different for everyone who walks into Quezon City hall. We paid a total of 3000 for the license. And we didn't have to go to any seminars. My wife asked what the heck I was talking about last night, and why we didn't have to...

I should have known something was up when we had to meet the "fixer" off of the City Hall property. He said he didn't want the other clerks in the registry office to see me, because they would harang us for extra money. LOL What a farce. I was uncomfortable, but he kept reassuring me that everything would be legal. I told him the first time we met, that I was concerned about that....because it didn't seem right that we had to fork over 1000 pesos to him every time we met. My wife gets pissed at me because I keep comparing how things are handled in the states, ie, your paperwork gets handled the same, with no hidden fees, and people basically do their job, and don't expect anything extra for it. If they go above and beyond, it's because they want to, not to get paid.

So, I know that I am beating a dead horse. We're married, and everything is legal, so that's all that should matter, but if I can prevent anyone else from doing the same, then I will be the "fixer" posterchild.

I actually take offense to this statement. My wife is NOT a cheap bar girl marrying a foreign national. We have been together for over 5 years. Which is about 5 years longer than most of the guys on this site have known their significant others. I may be uneducated as to the Filipino culture, but all it took was one trip to learn that everything in their government is based on lining someone's pockets with coin.

The reason we went to the guy at city hall was because I was only in the Philippines for 3 weeks, and the normal time it takes to get the license was too long. So basically we paid to expedite the process so we could have time to plan a decent wedding, and enjoy the countryside.

We had a Minister do our wedding, we paid a total to him of 1000php which covered his fee, and the license fees. This was in QC as well. Watch out for the buzzards at City hall though. As soon as they see a foreigner walk in they will try to take your money to process the license faster. We got suckered out of an additional 2500 to the guy at City Hall. Was kind of worth it though to see the mobile courtroom bus out front. :)
