Was your fiance born in another country, by any chance? Even if she has UK citizenship but was born elsewhere, this could sometimes cause the person to go into AP.

I am a U.S citizen and got engaged to my fiance who lives in London UK. I applied for her K1 Fiance Visa in Summer of 2010. She finally got her interview on June 16 2011. I went thru a good lawyer in Atlanta. After her interview she was told that they need more time "ADMINISTRATIVE PROCESS". Its October 15, I have emailed the U.S Embassy in London few times via phone and email. We keep getting same reply back that it will just take time. I have moved here in London and our "patience" is so so running out. Does anyone know how long can Administrative Process take?? Is there anything we can do to expeditaite? Please Please help!! Thanks.

I greatly dislike United, but usually found good deals directly from them. If you catch them at a good time - which is rare - Air New Zealand can have some good ones.

Are there any good websites or good low airfares to travel to the UK? I will buy my ticket as soon as I find it! Want to leave soon!

You likely won't have any problems since it's only 2 years. You were married within the 90 days and that's what counts.



Submit your AOS as soon as possible. I **THINK** if you file after 3 years there is an additional form that you need to fill out.. not 100% sure though.



I came up with k1 visa after we were married one month after my arrival, my husband lost his job, and can not send the AOS,
this week he will send...

I need some advice regarding my fiance's employment status. He found a new job and been working for a month now. Now my question is, Is it really a requirement for a petitioner to work as a REGULAR FULL-TIME employee inorder to meet the requirements for the affidavit of support? He is working Fulltime now but he is not Regular, Is that a problem? I am just scared that it would be the reason to get denied.

Yeah 1099. I know i've only been working here about a month, but can I say I've been working for a year and pay the extra tax? When you say the poverty line, is that for the entire U.S. or the state in which I live in? So if I meet the 125% I should be ok? or would I need more than 1 year of tax return history. (It probably won't be until next summer/spring until I start the paper work) Also, I've read something about having medical insurance? How does that work?

The dog bite wasn't too bad, he got me in my behind. I actually didn't even feel it when it happened haha

Yes, we went overboard. Especially for London.



India is very much different than Canada. They look for different things at the interviews. Very often i have seen that in India they request many many many photos and special photos of things that the culture does before weddings etc. some countrys need to front load with more than others do.


I would say Yes add photos but keep the book for the interview (you may or may not get the book back). Make some scans of the photos 2 to a page or something like that and sent a few pages of copys of the photos. write dates/places/names on the photos. If you have more than 1 book and you want to send the book go ahead.

If your income exceeds the amount, then no need for a co-sponsor, if you qualify.

They are only looking at what you are making and not at your debts. As long as you make over 125% of poverty guidelines you should be fine. If not you will need a co-sponsor.

After you apply for your AOS, EAD and AP, your card should arrive in 2-3 months, biometrics needs to be completed. They got ours done fast. AOS slow.

Better to be over-prepared than underprepared, so if it's not too much to get tax transcripts or W2s/1040s from your co-sponsor... try to.



As for you, surely on your paystubs it shows that taxes are coming out, yes?

you need to post this in the UK forum as you might get completely different answers to those above. London does allow co-sponsors but a lot of people have said that they wont ask you for one even though you dont meat the requirements yourself. they have also said that a letter of employment and recent pay stubs are all that is required

Hi everyone...

this is my first post. I got engaged in Pakistan on march 23rd after a two year relationship. I just sent in my petition on April 26th, and they received it on April 28th. Now I've been looking through the posts on VJ and I have realized that there is a potential threat of something called Administrative Processing happening to my case. I'm very worried about this as my fiance is a male from Pakistan and I was wondering if anyone has any suggestions as to how to avoid falling into a black hole of delays? I was hoping to get this visa within 7-8 months...that is the timeframe I was aiming at.

Also, I think I may have overshot it a "bit" in filing my petition. :blush: i thought that i had to prove an ongoing relationship as well and i included emails, chats, phone records, engagement ring receipts...and it ended up being somewhere between 200-300 pages. Does anyone think that will end up being an issue?

Sorry, but having a child will have no effect on your visa - approval or denial.

Did they state why you were denied in the letter?

I think you will have to try to appeal; I don't believe you will be able to re-file... but I am NOT positive about this.


Hello everyone,

I am new to VJ.

We really need help. My fiance who is petitioning me just received a denial notice on September 15, 2011 saying that we lack evidence and that we can appeal. They did send him RFE notice and has sent more evidence on July and have received it for review but didn't state we are having a baby. We Sent the I-129f package with evidence of relationship on March 2011 and on April we found out that we are having a baby and will be due on December 10, 2011. I was there while we were getting the I-129f form ready and we didn't put on the form that we are going to have a baby because we have already sent the form. Sorry if I am not making any sense here. My questions are:

  • Should we appeal or refile for a K-1 fiance visa?
  • If we do refile do we need to state that we got denied the first time?
  • What is the best choice refile or appeal, which will take longer?
  • Can I refile after receiving denial notice?

If anyone can help me with this question I much appreciate it.
Sorry for so many questions.

We just really need help with baby coming on the way. We just want to be together and get our family going for the sake of the baby.

I would remove the pregnancy statement and just leave it as an intent to marry.

Credit, no... but as the other person said, there are legal obligations if you become a public charge.

I thought we were going to need a cosponsor and my uncle was going to do it; however, he's a lawyer - read the paperwork - and then said "no way!"

So the long and the short is that my wife currently isn't making enough money to meet the poverty line to make our Affidavit of Support "good enough".

My brother in law is more then willing to do one for us, however he was told that it could in the future effect his credit and could in the future cause him issues.

I wasn't aware if this is the case but does someone filling out an Affidavit of Support for my Green card papers effect them as far as credit score or hold them to any obligations in that way?

Double check with consulate - very few (if any?) require your to have six - seven different forms of income!

Note that also - if your income is fine - you don't need to prove assets, real estate, etc. That's only if your income falls short and you CAN make up the difference with assets.

sorry I am not using a co sponsor and in my case is only my fiance and myself so I dont exactly know what would it be like for you.

what I do know is that the minimun annual income required for 2 people is around 18k per year. So I would assume that for 4 has to be over 30k.

the form does not have to be notarized ....and besides the I 134 your sponsor needs to provide either pay stubs, letter from his/her current job stating how much he earns a year and wether the job is temporary or permanent), bank statements, real state documents if he ows a house...everything that you can think of! Is better to bring everything just in case! good luck!

The co-sponsor needs to make the same as a sponsor would in this situation. The guidelines are here: http://www.uscis.gov...form/i-864p.pdf

Since there are four of you, he needs to make $27,937.

You need the same type of documents as you would if he were the sponsors: copies of recent pay stubs / letter from employer / tax returns or transcripts, etc. Depending on your consulate - you will likely need only two of those things.

Nothing needs to be notarised. All the best!


Hello people. Since we recently got our NOA2, we´re preparing for the next step, and we have some questions about the I-134.
(Since my fiance (Petitioner) does not meet the income requirements, someone is cosponsoring for us).

Question #1: How much does co-sponsor need to make? (He will be co-sponsoring me and my daughter, and he has a son of his own).
Question #2: Besides the I-134 form, what else is required to submit if only the Co-Sponsor´s income will be use?
Question #3: Forms need to be notarized?

London does not require proof of engagement, or continued letters of intent to marry (unless you're outside your validity date)

Send ALL the forms listed in the post once they are completed and you have your police certificate. You will bring the I-134 from your fiance/finacee to the interview, along with your birth certificate, divorce decree, etc. TO THE INTERVIEW. Despite what the form says, do not send them. London works differently.


Schedule your medical as soon as you have your police certificate AND London has logged your case.


It's fairly straightforward; the example forms on here are great.

That is fine, so long as you fiance still meets the income requirement.

His W2/1040s can be used, but also a letter from his new employer confirming his employment, salary, etc. or paystubs are required. He will write his current income on the I-134.

Congrats in your NOA2 :yes: Yes, I know the most important is NOA2 but like someone told me Why to take risks and don't use a few minutes of your day and call? What happen if they wrote the wrong country and you never know it until NOA2? Some countries take a long time to get an interview than others. I don't know if that happens, could affect my case in some way delaying the process. So, I never know what to expect dealing with USCIS. :unsure: That convinced me to call and ask for the hardcopy. Also, if I had not called, I wouldn't know they had the wrong address, maybe I wouldn't receive NOA2, neither. So, I think the call was the best thing I did, to avoid possible future problems in that matter. :) NOA1 hardcopy shows more information (as names and country of the beneficiary) than a simple text message. By text message I got the receipt number, call me old fashioned, but a "real" notice in where I can check that information is right, give me a sense of comfort and security. :blush:

Just curious.. but on the form, you did specify something like 'Please see supplement sheet' so they would know to look for it, right? You didn't just complete the form and disregard a mention of the sheet? If you did the latter, that might be why they didn't give it attention.

Hi everyone. :)

I decided to call USCIS customer services (1-800-375-5283) because I haven’t received my I-797 notification (NOA1 hardcopy). First, a guy asked me what type of application was and if I had the receipt number, if I was the petitioner or beneficiary, and which is my service office. After answering, he notified me that my status was on "initial review" and I should wait until arrive in the mail any notice. I told him my situation that I had not received I-797 (NOA1 hardcopy) and I wanted to check why. The guy informed me that he going to put me to another officer who could help me. I waited a few seconds and a woman answered, asking my name, receipt number and my alien number. I told her I don’t have any and she said "Fine ". Also, asked for my fianceé's name and date of birth. She told me that my status was in "initial review"... (same as the first guy) and if I have any questions. I told her I had not received my I-797 hardcopy. Immediately, she checked and asked my address. By telling my address, she replied me that it was not. Then, I said my residential address and she said that was correct and that they sent my notification in that address. I told her that I typed on a separate sheet and even use post it! the explanation that my home address is NOT the same as the mailing address. She gave me no excuse, just said the same thing and add to not be worry that they gonna re send it in my "new " direction. :rofl: :wacko:
She asked me if I had another question and I told her that I would like to corroborate that information was correct in the I-797 (names and beneficiary’s country). Kindly she gave me the information and everything was OK thanks to God. She even asked if I had more questions and told me if I do not get the NOA1 harcopy in two weeks to call back. :thumbs:

I wrote this first experience calling USCIS, for two reasons. First, for those who are in a situation like mine, I recommend to CALL. No reason to take so long to receive NOA1 harcopy and Yes they CAN reissued. :dance:
Second, I wonder why the forms are asked to add an explanatory sheet with extra information (if required) if they do not read it? :bonk:
I noted with this that they go directly to the forms and do not verify the extra information added (at least in my case). Thanks to everyone for this wonderful site and my advice is to call for any doubt, even when here is provided valuable information. Not everything here is said and each case is unique. Thanks a lot. Silly bank holidays.... love them normally, but not when you want to do visa stuff :)

I rang ACPO today and they said they have a backlog and haven't logged applications from a week ago yet. However, he said whether they've logged it or not doesn't make any difference for how long it takes: they're still working to 10 working days from receipt.

Because of the bank holiday coming up I'm going to have to change mine to the premium service to make sure I get it back in time!

Maybe you should expect to receive it around Wednesday 8th June?

Ours took 11 working days, so one more than they say it should.

Ours would have taken 10, but we accidently had checked that we wanted it to be signed for... so we had to go to the post office to collect it the following day, as we were both at work when they tried to deliver.

My fiancé sent off for his ACPO last Friday (20/5/11). We did regular service not the expedited one. I was wondering what other people's experiences has been on regards to how long it took to get yours back. Thanks in advance :)

We're using a lawyer (unfortunately ;-P) and the lawyer filled out the co-sponsors I-134a very sparsely. In fact he only filled out the co-sponsors income information. She makes a lot of money, which I'm assuming is why the lawyer didn't see it necessary to fill out the other sections about stocks and bonds, life insurance, bank balances, etc.

I'm wondering if the lawyer is correct in this or if we should fill out the rest of the information as well.

Does anyone know if since the co-sponsors income is well over the poverty line (more than 100k) if it's necessary or not?

You can obtain a long form of your birth certificate that has your parents' names on it...


Hope someone from Mexico can provide you an exact answer; for the UK you needed the long form with parents' names. (We had to contact an approved organisation and re-order, as certificates in the '80s didn't have that information on them automatically)


That's correct, they are not listed on it..
But should that matter considering that i am over 21 years of age ?

No, it doesn't matter if you visit whilst your petition is being processed. There is nothing against it, if that's what you're asking.

Hello Folks,
After reading so many topics, about visits before starting the K1 process!
One question is min my head: How many visits are seen by the Councilor at the interview but after starting the process!
Cause if i understand what some wrote here: that the Co study our file, and they usually already have a judgemental idea about the visa: approval or denial!
in my case: i meet my fiance in USA in holidays 2009, than met in europe in 2010, than he came to Algeria in 2010! after this first visit , we got engaged and launched the process, but he came in DEcjan2010§2011 we were in Algeria and tunisia, than in may 2011, and we plan to meet again in July in Morroco..cause my interview will not be until OCTOBER!..
Im wondering what u guys wi : think about this ?...
will the Co ask me if i saw him since we launched teh process? ... i mean would she mind? or she will just care about whats on the file transfered by NVC?

For the UK, ACRO certificates are what are used and accepted.

I have a question I'm hoping someone can help me with.

I'm currently living in Australia and I'm currently organising my Packet3 Documents for my K-1 VISA application.

The US Consulate in Sydney has sent me my instruction email for police clearance forms.

It states that all police clearance forms must be based on fingerprints and not just on name.

Now I'm born and bred in Australia, but I lived in the UK from December 2003 to June 2006 (I have dual citizenship as my father is British), therefore I need to obtain a UK certificate also.

Not a problem, I found the ACRO Website (which I found also from this forum), but I can't seem to find ANY information on how to get a certificate based on fingerprints from the UK?

I am going on Tuesday to the Australian Federal Police office in Perth to get my prints taken for my AFP Clearance, that is not a problem. I just don't know how to get a UK certificate based on fingerprints.

Can anyone shed some light on this one? Perhaps the UK doesn't offer this service?

Would this police certificate be accepted by the US Consulate in Sydney?

I have sent emails to the US Consulate in Sydney and to ACRO, but two days laters I'm still waiting for a reply!
