I would not get too upset. So far, no one else has posted similar information.

Moreover, in thinking about things, the information the rep gave me does not necessarily conflict with the five-month goal. In fact, if other information on the VJ site is accurate, the rep's information would be consistent with saying (this is not what she actually said), "Don't expect your NOA2 early; it's going to take the full five months."

To provide a little more detail about this, in other posts on VJ, some people have described that the CSC staff really needs only about 15 minutes with each I-129F file to make a decision. I don't know if this is true, but considering the number of applications sitting at CSC, it certainly seems possible. Anyway, if sufficient information is submitted (and if these people are correct), supposedly the CSC staff needs very little time to review a single application; under this theory, most of the delay is just waiting for the CSC to get through the files ahead of you. If so and if CSC starts processing September 2010 applications in February 2011, most of those applications could be approved right away in February 2011--but still barely within the five-month goal.

So maybe the NCSC rep chose her words poorly. Maybe someone else will post something about better information than (or information that corrects) what I received. That is the potential benefit of the VJ community.

The visa was approved on 20th, the flight was the 28th morning and the UPS courier delivered the package about 12 hrs before the flight. It was nerve wrecking but we made it !!!!!!!!

Hey guys, So Im new to the forum, and new to allllll this, It takes some getting your head around for sure.

My fiance is American, and I am English, my main question is, what way do you suggest is best going with this? My fiance is hopefully going to be visiting in the new year once her work commitments are done, and we plan on probably marrying here in the UK. Which is where all my questions are, Namely, Is this the best thing to do? Ive read about a hundred different visas and processes, as we have decided that we can have a better life together in California.

Is it best to get married here in England?
Best to be married and apply for the CR-1 visa, or to go to the US on a K visa and marry there?

The way I see it is that I have to go through the visa process nomatter what, but if I have a K visa we need to go through the process twice, to change to permenant resedency, and this will all take ages! Or will it? Is there much difference between these processing times for non immigraant and immigrant visas? Is it not therefore best to go straight through the permenant visa process?

I am aware the process can be taken in the uk if my fiance is here, would that help us as far as time is concerned? or are the papers still sent to go through the lengthy months long process in america?

As far as the process in england goes, I know the 130 forms CAN be submitted in england as I said, does my fiance have to live here to do that? could she not submit these forms in the uk and if necessary return home while the process happens, or must she be living here?

And lastly I have read about my spouse having to proove she earns enough money to support me, although il be getting a job once we move. What forms are these, and is that necessary as I do not see that step in any of the CR-1/IR-1 tutorals i have read.

Thanks for helping us, we are a young couple and its all a little overwhelming. Is paying a lawyer worth it, or can we really manage this?

I'm looking for advice and I know that there is somebody out there who has been in my situation before. I guess I should start with a brief history. I'm from the United States and moved to Scotland last year to study for my Master's degree. While I was there I met my husband, who is a British citizen. After a year and a half of dating, I graduated and had to move back to the United States. We did the whole long distance thing and then he came out to visit me. While he was here he proposed and us being us, decided to go and elope. After we eloped, he had to go back to the UK and we are now starting our visa process. We have decided to forego the K3 visa and apply for the CR1 visa because we would rather get all of the legal stuff taken care of at once. The only thing that I am worried about is the I-864 Affidavit of Support. After moving back to the states I was hired for a position making $28,000 per year. Therefore, according to immigration laws, I am financially able to support my husband. The problem here is that I haven't been making this amount of money for longer than three months, so any tax returns that I submit will show my measly student wages, which were drastically lower than what I am making now. Because of this, should I find a cosponsor to ensure that my husband's visa is approved or should I just use my current income and request a letter from my employer to help explain my current position and income? I'm really at a loss right now and any assistance will be much appreciated!

My fiance and i were going to apply for a k1 visa but then decided that it wasn't the best choice for us because of some of the restrictions it had on working in the US. So we furthered our research and came across the CR1 visa and it caught our eye, but when reading over the process we got a little confused on the "evidence of a bonifide marriage" part. we were thinking that my fiance could come down to Argentina and get married but we don't know how to prove that its real even though it is.

I am concerned about the timing considering that it takes one month for the Police Certificate and our NVC stage is hopefully coming soon. With regard to the I-864, it needs to be the original (as it's signed). Photocopies of her mum's tax returns are acceptable; don't send the oriignals. You'll want to hang on to those.



I had my visa interview today in Dublin and was very disapointed when told my wife's wages couldn't be used for our affidavit of support. I was told by the NVC that this would be fine but the consular officer wouldn't accept it as my wife has been in her job for less than a year. She was previously a student so hadn't any tax returns. This is not a huge problem as her mam is willing to be a joint sponsor. My questions are:
-do I need the original I864 and tax returns or can she print these out, sign them, scan them and email them to me so I can post them from here?
-Will I need to do a second interview or will they continue processing once they recieve the affidavit of support?
-How long will this whole process take?
-The consular officer kept my passport, is this normal procedure?

My wife and I are leaving outside of US currently. She is a USA citizen. We plan to move to US to reside and she will be sponsoring me for the IR-1 application. My concern is on Affidavit of Support. My wife is a full time housewife taking care of our 2 children. Obviously she has no income at this time. I will need to quit my job when the IR-1 is approved and after we arrived in US. That means we will have no income until one of us find a job in US. In this case, how can i meet the income requirement stated in Affidavit of Support? We have some cash savings, stock and a house we plan to sell when we move to US. Can these be used to meet the income requirement?

Does anyone face the same problem or have answer to these questions?

Can't do a DCF for a K-1 - it is only for the spouse of a US citizen, not a fiance(e). You would either need to get married (probably fastest option) and file DCF or use a US permanent address (parents, etc) and file a K-1 based on that if you are really wanting to get married in the US (though you could both visit the US, get married here while on vacation from jobs, etc and then go back to the UK and apply for DCF.)

Even if you could file DCF, I've never heard of anyone marrying, applying, interviewing and being granted a visa within a one week time frame. This process takes months no matter which way you go.



Speaking of filing DCF... I've been searching the Forum (just found out about it - it's great) to try to figure out how to file for our K1... I'm American but have been living and working in London permanently since 2007. Fiance is British. Can we file DCF.. or...? Consulate website has been less than helpful thus far.. :-/

We currently live abroad in the UK.... and realise we need to file the I-134 - the affidavit of support. As a US citizen, am I meant to fill this out? Even though when we relocate I too will have no job and no house as we're picking up everything and going. Or shall a family member of mine fill this out on my fiance's behalf...?

No, you don't have to remain in the UK for the entire process. In fact, it is assumed you will return to the US to re-establish domicile. As long as you meet the requirements when you file, you should be fine

With regard to taxes in the UK - I was told it depends on your income in pounds. You only need to file if you make over a certain amount...

I am new at this and would like it if someone could help. My Fiance proposed to me on Saturday, he was visiting here in South Africa and has now returned to America. We are wanting to start the I-129F process ASAP. I was looking at the forms that we can fill out and print, on the top right hand corner they have a expiry date and all the forms have dates that are in the past, where would I be able to find forms that have expiry dates that are current?

This may be a "odd" question but just thought I would check this before we fill out the forms and print them and they end up not being valid.

A quick question based on the number of people that the sponsor is 'responsible' for.

Our co-sponsor (my mum) lives with my dad, making a household of 2. But because they will be co-sponsoring my fiance, does the income need to be above that for a household of 3?

And finally - both my fiance and I live abroad - so does that make the household 4? (mum, dad, fiance, me)?

Based on the sponsors income, you will be fine. Though does the sponsor have anyone else living in their home?

From what you gave, the sponsor would be responsible for 3 people (you, fiancee, him/herself). If there is anyone else in the home such as children, wife etc add that to the "# of people count" to get an accurate amount needed by the sponsor.

For example, can the co-sponsor live in a different state..? Or do they need to be in the same state?

I am happy to inform you all, that we got our NOA2 approved on Jan 5th after 163 days of receiving our NOA-1. So all of you who've been waiting, just be patient. It should be coming anytime.

I am from India, and my fiance is an American Citizen. Being a full time student, she doesn't make enough so we have her mom, who is helping us in getting together being a co-sponsor. I need to know how this works, what all documents do I need from her, that I should take with me at the interview. At the same time, what questions should I be expecting at the interview related to having a co-sponser.

Sooo frustrated with ourselves... I was just looking over the packet of paperwork we sent a few months ago, and on my fiance's G-325A form for former addresses, I noticed there is an overlapping date.

Address 1: May 2008 - August 2008
Address 2: May 2008 - January 2010


What's the likelihood we'll get an RFE for this?


(so frustrated 'cos, I guess, at the time - we were too close to the information and had spent just SO long staring at it!!)

it's better to get tax transcripts from the IRS you don't need the w2 call the irs 1-800-908-9946 or 1-800-829-1040, you need 2008- 2009 2010 you can't get now until after april 18,2011 they know that, if your sending your file after april 18 then you need the 2010 tax

You have the added advantage of being a British beneficiary. From what I have read, the interviews at the London consulate are super easy, quick affairs where the petitioner does not have to be present. Luckily, for you and your fiancee, you are coming from that part of the world. I think it is us, people with loved ones in 3rd world high fraud countries, the ones that need to worry about crossing every "t" and dotting every "i" for the consul at the time of interview...

Sorry if this is in the wrong forum, I'm not very good at them! Please move it if there's a better suited place for it.

I changed my name years ago when my parents got divorced, and all my documents have my 'new' name on them except for my birth certificate. The guide for filing the initial petition says we must post evidence of name change if the name is different to that on the relevant documents. None of the relevant documents at this early stage would have my old name on them, but there is a section on the I-129f that asks for any other names used. Does this need to be proved right away?

So, does this mean my US fiance needs the original copy of my name change deed poll, or will I only have to present this at my interview along with my birth certificate?

Sorry to jump in... but I've a quick question about an address change, too.

I've been living in the UK on a Tier 1 but am moving back to California in February to begin to set up life for us there, get a job, settle back in, etc. Because I've been using my parents address as the mailing address (though I did state I lived in the UK when filling out the I-129F) - do I need to inform them of my relocation back to the US?

Since the mail's been going to my parents (and that's where I'm moving, initially) - I don't believe I would need to?

Just want to make sure we're not going to get a slap on the wrist or anything.

Just going to double check i have this right:

1. NOA2 goes to my finace's house in the US.
2. I Call DOS after NOA2 to find out my LND case number so I can make a medical appointment.
3. Make and attend a medical appointment.
4. Then I call DOS weekly until they tell me that London has issued my "packet 3".
5. Only then should I send in forms: DS-230 Part 1, DS 2001, Form DS-156, Form DS-157, Form DS-156-K.
6. After my forms have been sent to London I should start calling DOS again to find out if my interview has been scheduled just in case they don't get the address right.

I did ask the question under a different post yesterday, but no one's answered it yet..

OK... I only found the AR-11 and then this one for change of address: http://www.ilw.com/f...865fillable.pdf <<< and that I see expired in 2008,was for the sponsor who is required to submit change of address after filing an I-864 Affidavit of Support.

** I'll look more into this and if somebody can further assist Michael's request... please help.
