K-1 Fiance(e) Visa Process & ProceduresQuestions about Form I-134 Affidavit of Support
3. Friend

7. Your current income is what matters

11. N/A - see the example form

Good luck,
Kristin

K-1 Visa

I am filling out the Form I-134.

On Question 3, "Relationship to Sponsor", if my friend is my co-sponsor, what should my friend put when he fills out the Form I-134 for my fiance?

On Question7, " I driven the annual income of $_____", do I put my last year's annual income? because I make different income every year.

On Question 11, should I check " intend" or "do not intend"?

Thank you very much for everyone's answers :)

K-1 Fiance(e) Visa Process & ProceduresDo I really need a changed of name of my mom for the interview?
No, you wouldn't need anything for your mum.

Packet 3 for London and next steps (medical, police certificate info, etc.) can be found here: http://london.usembassy.gov/iv_15.html

Hi there, I'm not quite sure if I need a changed of name of my mom for the interview in London, please help thank you. And what should I do after NOA 2? How long does it take to interview after your NOA 2 thank you ever so much.

K-1 Fiance(e) Visa Process & ProceduresI-134 signature not current enough?
Better to be over-prepared though, right?

Probably what I will do! Only problem is no DHL office within hundreds of miles. UPS ships there but only to businesses and at a cost of around $150.00! Was hoping I would get some definitive information that it wasn't necessary.

K-1 Fiance(e) Visa Process & ProceduresI-134 signature not current enough?
That could be tough.. documents are usually considered 'valid' for 6 months.

Any chance you could pop a new one in the post? Should get there in 2 weeks - I hope!

Olya has her interview in Moscow in 15 days. In looking through our papers she realized that the I-134 I sent her is dated October 2010. I sent her 2 weeks ago all my latest w-2's, 2010 tax return, current bank statements and pay stubs but forgot to send a new I-134 form along with them. Is the one I signed and took to her last October adequate or do I need to express mail her (for a small fortune!) a newly signed I-134? Thanks for any advice/experience you have with this!

K-1 Fiance(e) Visa Process & ProceduresTax return, affidavit, evidence of engage
You can pay for your interview in advance by ringing up; either you OR your fiance can pay. They will email a receipt of payment, that your fiance will need to bring to the interview.

Alternatively, your finance can pay ON the day of the interview. Note - they do NOT accept Visa Electron cards.. there may be other types they don't accept, but as we had a normal Visa card and paid in advance - it was fine.

For London, evidence of engagement isn't mandatory. Neither is an updated letter from your fiance.

US Embassy London web site is quite helpful - http://london.usembassy.gov/iv_15.html

Also, for the I-134, two methods of 'support' will be fine - e.g. letter from your employer and tax transcripts. Tax transcripts are free to order, so order them as soon as.

Good luck!

Hi there again,
I have just received my NOA 2 yesterday. I'm not sure what to do now. Please guide me. I couldn't find where it says they need to see my fiance tax return, when do I need this, and how far do they need? Do they need to see mine as well? What else should I get my fiance to send me apart from affidavit, bank statement, a letter of employment (he's in military), intend to marry letter. We do not have any engagement ceremony, and obviously we don't have any evidence, what should I do? Can my fiance pay for my visa in the state instead of paying in London embassy? And how do I do that? Argggggggggggg............I'm getting stress now please help me

K-1 Fiance(e) Visa Process & ProceduresI29F Fee and it is texas right? just about to send mine off
Yes - initial application w/ the relevant supporting documents (proof of having met, copy of the USC passport/birth certificate, etc.)

ok so i checked the uscis website and the filing fee says 340 and i'm going to send it to the dallas lockbox facility i'm just sending in the inital application, is this all correct? i remember hearing a while back that they would send back the application cause the amount on the check was incorrect like they were not aware that the fees are less than what they used to be, I live in california so do they transfer it to california service center after that or is it just wherever they decide?thanks

K-1 Fiance(e) Visa Process & ProceduresNVC inquiry
EVERYONE goes through the NVC = yes

NOT everyone goes through Additional Processing.

Good luck.

Thanks...I just called them and they said this is standard procedure and EVERYONE goes through it. For some it takes a few days and some a few more. Basically, what it means is that it is in between the stage of being received (it has a case number) but has not been sent out to the embassy yet, i.e. it's being processed.

K-1 Fiance(e) Visa Process & ProceduresScheduling the Medical Exam...how many days out?
We were given a medical appointment about a week after we called up; that was the earliest available.

I can imagine they might be a bit backlogged with all the bank holidays at the moment... I'm assuming they're closed on them.

Hi all,

My fiance is posting the forms to get his police records on Wednesday. We are not opting for the more expensive expedited delivery, instead he should get it back in 10-11 days.

My question is...we were going to go ahead and book the medical when he sent off the police certificate. If we scheduled the medical when he sends the request off...will he have the certificate in time.

What is the wait time for the medicals in London?

Should we book it when he send the police paperwork off or should we wait till its in hand?

Thanks everyone! :luv:

K-1 Fiance(e) Visa Process & ProceduresTax Forms -- originals or photocopies?
You could also provide COPIES of W2s and 1040s in lieu of tax transcripts.

Thank you for the tip, Dave. My interview is on the 17th. We may not have enough time, but will ask just the same. :)

How bout for the other tax forms, the 1040 and 1041, if we cannot get the tax transcript in time for the interview, may he send notarized or certified true copies in lieu of the tax transcript or original? All help will be much appreciated.

K-1 Fiance(e) Visa Process & ProceduresNOA2 approval status
VSC is taking over 5 months right now... timelines look to be 6 - 7 months.

Good luck!

I can't believe I didn't know about this website until today. It's great to find so many helpful tips and advises from so many different people.

I hope someone can help me or point me to the right direction.

I filed for my fiancé at VSC on December 1st last year and got the NOA 1 with receipt date of 12/03/2010. Since then I haven't heard from USCIS. My case status update on USCIS website and call to 1-800 automated system hasn't changed since 12/03 as well. It will be exactly 5 months on 05/02 since the time I received first NOA. I and my fiancé have started to get frustrated with the wait and little worried now. Does someone else also have the same timeline? I saw some members on the forum with filing that after me at VSC has got their approval. Though I am happy for those people, but just don't know what's going on at USCIS.

Is it time for me to call the senator? Does someone know how to get to the live person on USCIS numbers to get the status? May be there is a way and I am just not seeing it due to all the anxiety and frustration. Any help will be greatly appreciated.

Love and peace….thanks.

K-1 Fiance(e) Visa Process & ProceduresOh so many questions!
SSN = need to wait about 3 - 4 weeks 'til you're in the system.. so unfortunately, can't do it straight away!

The main downside of the CR-1 is that it will take longer than the K1. That's the only real downside. It used to be *significantly* longer, but due to increasing delays in the K1 visa processing the gap has narrowed considerably so that it is now on the order of a couple of months. Also, a lot of people don't want to go the CR-1 route because they don't like the idea of not seeing their spouse for 9 months.

I live in California too. You can't get a California's driver's license right away. You need to get a SSN number first. From what I hear that will take about a months from the time of your fiance's arrival. As you know in the US a lot of stuff is dependent on having a SSN, so it is advisable to get that taken care of ASAP. Once your fiance has a SSN, then all he needs to have is his passport and I-94 form that he will get on entry and then he should be good to go for getting a driver's license.

K-1 Fiance(e) Visa Process & ProceduresOh so many questions!
Medical in the UK right now is £210... fee just rose on 1st May by 10 quid.

As you are obviously trying to get a view of the big picture and plan for your AOS already (a good idea!), do some research on the DS-3025 from the overseas medical exam. The instructions on the form say that the applicant should receive a copy, but that's not always the case. Make sure the Panel Physician provides you with a copy. It will save you frustration and money later on. It's something I wish I had known about earlier.

K-1 Fiance(e) Visa Process & Procedurespolice report/records
It depends on the specific country.

I am sure someone on here has experience w/ SA and Panama... and their specific rules.

I was told that i CANNOT get a police record until they ask for it!? is this true?.how come "grandacel" got them in 1 day and it took you(snikerz) 1 month?..

My fiancee has lived in South africa only for more then 6 mos. and ever since been in panama...

K-1 Fiance(e) Visa Process & Procedureswhats next ??
It should technically take only 10 working days - that's the 'timeline' on the standard service. I think ours took like 11 or something like that...

You might have more luck posting in the UK forum with regard to an immunisation record. Wish I could help - my other half was in the British Army - so his gathering of them was a bit different (and VERY easy!!!)

Okay, we have his police records on the way, they said it takes up to 4 weeks to get them. He went to his general practioner and asked for his medical records and they said they didnt know what he was talking about. But, doesnt he need his medical shot records for the medical exam? where would he go to get those and what are they called in th UK ?

Book your medical as soon as your case is logged (note: you should have already ordered your police certificates, you need them for this)

Get cracking on Packet 3, which can be downloaded online.

I just got our LND number today, what should I do next?

K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions
FYI - London doesn't require an updated letter of intent; they won't even look at it.

Also yes you can add info for any question that doesn't have enough space on the attachment. You need to identify the question number you are attaching info for. Also identify the page with A#, Name or something (I forget exactly its on the instructions) so they know which and whose document the attachment is for.

K-1 Fiance(e) Visa Process & Proceduresneed to resubmit documents in color for fiance petition?
Everything except the copy of our passport was in b&w. Passports were in colour - I just thought it would be easier for them to read, etc.

This is the first I have heard on this and am now terribly worried. We submitted B&W photocopies of passports and all the rest were B&W

I would hate it if, it came back just for everything to be re-done in colour.

I am not a K1 filer but a CR1 but its a similar document.

Anyone shed some light on if they submitted everything in B&W and it was ok or asked to resubmit in colour.

SLCPLP, you will need to find out about this missing NOA2 at some point...

In the meantime, I'm curious if you were to call the DOS if they would have and LND number for you...

Ok - so I just got off the phone with USCIS to request a copy of my NOA2 for our interview only to be told that me might NOT be approved bc their system does not show it as being approved.....ummmmmmmm #######???!!!! We got our letter from Department of State on April 22 and my fiance' got his packet from the Embassy on April 26th! What do you mean we might not be approved????

Has this happened to anyone else?????

K-1 Fiance(e) Visa Process & ProceduresHow long of work history do I need for K-1 Application?
You don't need to have worked for certain amount of time, but you need to provide info on what you've done for the last 5 years.

E.g. I only have 4 years of employment history; I was in uni before that. So therefore, I have 4 years of employment.

My fiance has only ever had one job, which he's been in for the last 6 years - so that's his employment history sorted.

Hello,

I'm applying for the K-1 fiancee visa. I was told (my gf read on Chinese site) that I need to show proof over work for 1 year+ in order to apply, but I can't seem to find any relevant information. Is there a strict time we have to have worked to apply for the K-1 visa?

Thanks in advance!

Correct - 7 years is 'nothing' :) And the UK is pretty friendly on that.

All the best and hope you two can be together soon!

Thanks for you kind wishes. Our age difference is only 7 years so this should not be a problem.

K-1 Fiance(e) Visa Process & ProceduresSending in my I-129F
Ours was about 4 inches thick (I went a bit overboard and sent the relationship evidence w/ the package.. oops) - bubble envelope was great!

I don't reckon there would be anything wrong with a box, but it might be a bit strange.... (I just think of like terrorists and suspicious packages, but maybe that's just me being a bit over paranoid :) )

Hi, I'm ready to send in my I-129F package. It'll be almost 3" thick due to all the evidence from 4 trips and some front-loading. I'm hoping you guys can help with some questions.

What is the best method to use to send it in? Could/should it be sent signature required?

Can it be sent in a box?

Should I use FedEx, UPS or USPS Expres Mail?

And to confirm, this is the only address to send it to, correct?

USCIS
Attn: I-129F
2501 South State Highway 121 Business
Suite 400
Lewisville, TX 75067

Sorry, the nerves are catching up to me. Thanks in advance.

K-1 Fiance(e) Visa Process & ProceduresProving US Residence
Correct - as long as you have your parents for the I-134, you are fine. You are still a citizen :) No residency requirement!

We do have my parents as financial sponsors for the I-134, so thats not a problem.. I was just worried when my lawyer said I needed to prove that I was still a resident of the US. I guess legally I still am but I have no job or anything there right now.. I freaked out for a second, but it seems now like it was just a mistake .. I'm calm again lol

K-1 Fiance(e) Visa Process & ProceduresProving US Residence
I'm not 100% sure how things work for Mexico, so please bear that in mind ;-) You will need some sort of affadavit of support for the K1 (I-134 for the UK and most other countries). You cannot use foreign income on that. So as long as you have someone else lined up in the US who can do that for you, then you should be in good shape.

I was like you - living abroad with my other half - but moved back a few months ago and got a job, etc. just to make things hopefully easier in the long run ;-) All then best!

THANK you. This makes perfect sense and I just double checked it on the embassy website and the travel.state.gov site and they both clearly state that the I-864 is not needed until after entry into the US I didn't think I needed to prove domicile right now. You know we hired a lawyer because we thought the process might be a little more complicated due to the fact that I'm here in Mexico with my fiance .. but up until now the only complications have been because of the lawyer lol.

K-1 Fiance(e) Visa Process & ProceduresSo confused by this...
Only Sydney does interviews and processing...

I received my NOA1 about 3 weeks ago. The paper stated that the visa will be processed in Melbourne, Australia. I just got another letter in the mail stating that my Fiance will receive his paperwork in the mail very soon, BUT, now it says that it will be processed in Sydney, Australia. I called the Vermont Service Center & they told me Melbourne. I called the National Visa Center & they (rudely, I might add) said Sydney... So, what the ****? Has this happened to anyone else?

Now neither me nor my Fiance know where his interview will take place. Will it say on the package he will receive soon? I gave him the number to the Embassy in Sydney (he hasn't called yet, asleep at the moment... yes, I'm impatient). But, he needs his interview to be in Melbourne. Would it take long to have it changed if it's in Sydney instead?

I'm extremely irritated by this. On the NOA1 it said Melbourne & that if that needs to be changed, to call & do so. Now I have two different places giving me two different cities!!! :ranting:

Did she get the student visa and overstay or something?

If everything is all in line - then no - no problem at all!

My fiancee applied for a student visa in June of 2010 and now we are applying for the K1 will this be a problem at her interview?

All opinions will help...

Thank you!!

Removing Conditions on Residency General DiscussionI-751 December 2013 Filers

Here's to speedy processing - fingers crossed! We'll be popping our file out hopefully in tomorrow's post - just finishing things up today!

Hello all,

I'd like to join the exclusive December 2013 i751 filers club. My wife recently filed for RoC- her 2 year visa expires at the end of January 2014.

Just sent the package to CSC today (12/4) via 1-day priority mail. Hopefully everything goes smoothly as my wife has a trip booked to Korea for a friend's wedding in January. Having the NOA in hand before departing would be a relief. Also hoping we get the biometric appointment letter quickly so we can do a walk-in before her trip.

PhilippinesWhat does the visa look like?
The actual visa is in your fiancee's passport.

Looking at your timeline, it doesn't look like your finacee has had her interview yet? If she hasn't had her interview, etc. then she won't have her visa. Updated timelines are great :)

Hi,

Just wondering what the visa looks like. My fiancee received the packet today but isnt sure where the visa is or what its supposed to look like. I instructed her not to open the packet and that it needs to keep sealed until she arrives here, then the immigration here will open it. And where is it located at?

Do we have some sort of chart for Sept 2010 CSC Filers? I notice the Vermont Service Centre has one...

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow is your NOA2 waiting time?
A May wedding eh?

I'm worried about ours in August!

We'll hit 5 months at the end of January. Starting to worry about rescheduling our May wedding. :(

What's really annoying is we scheduled a meeting at our local branch and asked very specifically when we should file if we want to marry in May. They said OCTOBER. Good thing we didn't listen to them, or we'd really be screwed.

K-1 Fiance(e) Visa Case Filing and Progress ReportsYES NOA2!!!
So happy for you!! xx

So I woke up this morning, checked my emails which I always do first thing (have been slightly obsessive about it recently..!), and there were the words I having been hoping to see for the past 5 months "your I129F petition for fiancee visa has been approved" or words to that effect :D
I screamed so loud my mum ran up the stairs thinking I'd had a heart attack...!!

Thank goodness for this forum, that's all I can say.
I'm sure I'm going to have a lot of questions in the run up to the interview in London...lol!

The last few days in particular have been a real struggle, was feeling really despondent, but now the worse is over, and the best is yet to come :-)

One step closer to marrying the love of my life
