K-1 Fiance(e) Visa Process & ProceduresI-134
You do not need a letter from you bank. It would be a waste of time and effort to go and get one.

Since you yourself are sponsoring, your pay stubs, employer letter and tax transcripts are more than sufficient. You are good to go.

I'm working on the I-134 and I find that the instructions that come with it don't really request a lot of documentation, but many of the posts I've read indicate that I should send much more. My question is: I make sufficient income to sponsor my fiance without a co-sponsor, so do I still need to send bank statements and a letter from my bank? OR....is proof of my income enough? I have a letter from my employer, several pay stubs and the last 3 years of tax transcripts. Do I need anything else?

I read the tips on a guide I found and which says this: "You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form."

In the I-134 instructions, these are the 4 "options" (I will paraphrase them):
A. Statement from your bank
B. Statement from your employer
C. Documents that are required if you are self-employed
D. List of any bonds that you own

I have the letter from my employer. I am not self-employed and I do not own any bonds. As for my bank accounts. I have a small savings account at a local credit union (about $4500). Other than that, my checking account and savings account at my bank are small and fluctuate because I pay my bills out of them.

I just don't want to send what isn't absolutely necessary...especially if it isn't going to benefit us. I know, also, that it appears that requirements vary from embassy to embassy...so I am looking for information specific to the embassy in London. :)

Thanks so much!

K-1 Fiance(e) Visa Process & ProceduresWhen will I get my NOA2?
Are you filing for your K1? Your timeline says naturalisation.

If it's a K1, prepare for around a 6 mo. wait...

I have sent all the documents along with the K1 form back in January 2, 2011. I got my NOA on January 25, 2011. When should I expect to receive the NOA2? Upon receiving the NOA2, when should i expect NVC to receive all the documents?

K-1 Fiance(e) Visa Process & ProceduresI-129F payment abroad
I had my mum write a cheque and post it to us in the UK.. it was just easier!!

With regards to communications and everything, filled out everything with my UK address but for reasons involving the unrealiability with Royal Mail (at least for me!) and the ease of getting paperwork quicker, I had asked, when sending in our 129-F, that they use my parents US address for posting everything.

I have heard of people that use their foreign address, and I am sure it will be no problem :)

Hey! our situations sound really similar! And its so great to hear that it is working out for you!! This def seemed like the best option for us as well!

Could u explain the process that you used? SO you got your mom to send a check to you in the UK and then you sent it to the Visa lockbox in the states? DId they send all the notifications and stuff to your address in the UK?

Def need all the guidance you can give :) thanks so much! xxx

K-1 Fiance(e) Visa Process & ProceduresI-129F payment abroad
Hey there -

I applied from the UK, too - as I was living and working abroad for three years.

I've just now moved back to the US.. it means us being a part for the next four months, but it's SO much easier when it comes to the I-134 to be here....!!!

Thanks you guys!

I am in the country on a post study work visa, as I graduated from a UK university and am currently in the middle of my masters.

OK so Im going to need to send the full 340$ payment along with my I-129F petition? correct?

Have any of you applied for this from outside your country of residence?

xx

Oh - and what I did for the bankers draft - I just had my mum get one for me and she posted it to us in the UK! We gave her the money for it.. but it was just easier, at the time.

hey everyone i need your help!

I live in the UK and have for the past 3 years on a working visa.
Met my boyfriend 4 years ago when I studied abroad.
We are engaged and I want to get him into the country on a K1 visa so we can have a big wedding with my family.

My Problem............ I dont know if I need to included a check in my I-129F petition??
It says on the form instructions if you live abroad to contact the embassy for method of payment.....but they were completely unhelpful!

Help anyone??

Can I pay over the phone? Do I have to send a check? If so Im going to have to send it to my parents and get them to attach a check as I no longer have a US bank account....

Help ASAP please! I want to send the form out as soon as possible! xx

K-1 Fiance(e) Visa Process & ProceduresIndex number for UK birth certificate????
Yes - that is the information you need.

I've just logged into the GRO site again:
Reference information from GRO Index Year1985 District name* Volume Number* Page Number* Reg (month and year of registration, mm/yy)*

Sorry about the slightly ugly paste... ;-)

Make sense...?

He did one of those sites and it just gives him this number he claims is the volume number and page number.

K-1 Fiance(e) Visa Process & ProceduresIndex number for UK birth certificate????
There are sites where you can look this information up - I think they are all pay-for sites. We used ancestry.co.uk. But there's a ton of them out there...

Hi

My fiance is requesting his birth certificate and he needs something called an index number to request his birth certificate. Did everyone have to get theirs? Did they have to pay?

K-1 Fiance(e) Visa Process & ProceduresShould We Wait to Apply?
We used my parents address as our mailing address and had no problem with everything. I used my address on all the forms, etc. but affixed a note saying to please use my parents address for all correspondence.

Thank you, but would his change of address be a problem? As obviously being in the military he tends to be all over the place - and of course when he leaves we don't intend on living on a military base! I'm not sure if he'd need to be living in his own house already - the same place where we would eventually live together? Alternatively his parents do not mind us having documents sent there, but I'm really unsure of what we can do there.

K-1 Fiance(e) Visa Process & ProceduresApplying for K1- we both live overseas: Help!
You can do that, if you can show proof of both of your returns to the UK. You will have to settle in the UK for a while though before trying to move to the US, I reckon.

I could ask my friend what their lawyer advised, if you're really curious.

If you want to marry and settle in the US, do you have any remaining friends that could co-sponsor your I-134?

You could always fly to the US together, get married here (which is perfectly legal so long as you have no immigration intent), and then go back to the UK as a married couple. I'm almost positive that the UK recognizes US marriage certificates so long as they are officiated properly.

That way you wouldn't have to worry about dealing with a UK marriage, but you would still be considered married, and therefore qualified to apply for a US spousal visa.

K-1 Fiance(e) Visa Process & ProceduresWhen should I file the I-29F (petition for alien fiance)?
My other half is planning to come in June (of this year), and our wedding is in August (of this year) - we applied early September 2010..

Our timeframes are similar to yours - just this year :)

See our timeline below.. we've been a bit slow with something (e.g. returning packet 3) on purpose...

I'd say get all your ducks in a row and get everything kicked off, but perhaps submit your application in June-ish/July-ish? You never know if they're going to slow thigns down or turn around and become super-speedy all of a sudden...

My fiancee will be moving here from the UK at the end of July (2012), and we plan on having a wedding in August (2012). I've read that the visa takes about 7 months to obtain, but once it's approved, how long will it be good for? In other words, how long does he have to come to the US once he's approved? I'd like to know so I can figure out when to apply for the visa. Thanks!

K-1 Fiance(e) Visa Process & ProceduresHow did you get your NOA-2?
Hmm.. I was living in the UK at the time.... but I got our NOA2 email around 5:30 a.m. GMT... :) It was a lovely wake up call!

Just curious what times everyone got the e-mail or text from USCIS notifying of NOA-2? Anyone not get anything until the actual letter?

Also, on a lighter note, I would love to hear y'alls stories of where you were and how you reacted to the GREAT news??? I am anxiously awaiting mine and would love to get pumped for the excitement. Story time please...

K-1 Fiance(e) Visa Process & ProceduresWaiting...
I'm American and my other half is English.. the 8 hr time difference makes it tough but we Skype on the weekends and exchange emails during the week.

Knowing the end is in sight keeps us going :)

And I know you're not supposed to plan for a big wedding - but we are - and that's something that keeps us motivated and happy - being able to put things together for it :)

Male/British half: Get skype, microphone and webcam on both sides - it helps a lot, and the skype video calls and voice calls are free. Plan for a rough time, and have patience with your other half, relationships are never easy, long distance is harder still, and with the stress of the visa processes it's going to be an uphill battle. But if you're signing up for that, you believe it's worth the effort. Keep this in mind when you're feeling down - it's a temporary stress/unhappiness, but you will be happy afterwards when it's all over.

Find things to do together and to talk about ( I suggest online gaming, but that's just my addiction ), and try to get as many visits as you can reasonably afford.

Use recent pay stubs instead?

Howdy,

since I'm feeling pretty good about our NOA 2 happening pretty soon, I am scrounging up all the stuff my fiance will need for the P3.

I was looking at my company's intranet, and the only way they offer employment verification is via an online service, http://www.theworknumber.com. There is no way to get a paper letter.

Do we have to get a letter on paper?

K-1 Fiance(e) Visa Process & ProceduresHow long
My fiance and I met in Nov 2006, and got engaged in Feb 2009. We were a bit different in that we were living together from Nov 2007 - Feb 2011. Filed in September 2010.

(Yes, I know we could have gotten married abroad where we were living - as I did meet the residency requirements for the UK - but we really wanted a big US wedding and to settle here straight after) ;-)

I was just wondering how long everyone knew there fiance before filing for the K1 visa? I was going to post this as a response to another post, but I just thought it was an interesting question.

I just find it interesting the different lengths of time it took for people to file. I a sure for various reasons. I am thinking that it did not take long for people to wait in countries that were far away from one another and took a great expense to travel to, like the U.S. and China. On the other hand I would think that people from places where traveling to see them might not be as difficult, like the U.S. and Canada, might take longer. I hope that made sense. Probably not.

I think this info is in some peoples time lines but not in every ones.

My fiance and I met online and knew each other 8 months before I filed for the K1.

K-1 Fiance(e) Visa Process & ProceduresThoughts on the 90 day ceremony deadline
We're just doing one big ceremony... we've been engaged for ages (Feb 2009 - but mind you, we were living in the same place until Feb 2011).... wanted a summer wedding and the number '27' is quite significant in our relationship, so settled on August 27th 2011 and worked backwards from there... filed everything in September 2010 so all set and good to go for August :)

Hey fellow VJ members. I am wanting to get some feedback on how others have or will be handling the 90 limit for the ceremony. My fiancee and I are considering having a very basic ceremony during the 90 time frame. We are then thinking of planning out a much bigger wedding since we would not be under a time frame restriction. Does anyone know if it is indeed legal to have 2 seperate ceremonies? Understandably my fiancee wants her family and close friends to be at our wedding. It would be hard to plan out all the details of a large wedding with visa and travel issues to consider in 90 days. I am just curious how others are going about planning for this.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa procedures
I'll jump in about the addresses bit...

I was living abroad in the UK at the time of filing. On all my documents, I wrote the address I was living at in the UK, but affixed a supplement form starting that I wished to use my US address for all correspondence (it's my parents house).Worked brilliantly, no problems.

Hello, hello, hello,

I'm wondering if anyone out there sees any potential complications with my process. I am getting ready to send my I-129F petition from Thailand (I have been here two months and will be here another four before I return to the US). I think it goes without saying that I will be back in the United States before the whole process is completed. On the I-129F form should I put my permanent address in the United States as my mailing address as opposed to my current address in Thailand? As well, my fiance will be moving to another location in Thailand when I leave for the United States. Should she also use a permanent mailing address in Thailand? Will it look odd if we are using different mailing addresses instead of our current address? Also, the check which I will be using to pay the petition fee will have a different address than my permanent address as it was my address before I came to Thailand. Any problems?

...and a question about Service Centers. In the fiance 'letter of intent' template in the Visa Journey K-1 guide it gives a space to put the address of your service center. Do I know this yet? I live in California. Is it safe to assume this will be the service center reviewing my petition?

...also, in the Visa Journey K-1 guide for sending off the I-129F packet it says that I should include a G-325A Biographic information form for both myself and the beneficiary. Do I send one for myself at this time as well or only for the beneficiary. I saw somewhere elso that I submit the petitioner biographic info. at a later date. Can anyone lend any clarity to this issue.

Thanks everyone,

Eric

K-1 Fiance(e) Visa Process & ProceduresI-134 Question
In England you take the I-134 to the interview...

If you have time between now and your interview, I would have a spare, correct copy w/ no white out, just in case.

If you've already mailed it in, then there isn't really anything you can do. If they want any further information from you, you'll get an RFE. But, I would doubt it's going to be a problem.

If you haven't mailed it yet, you could always do another I-134 without the white-out.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresA good Visa company or Law Firm recommendations
VisaJourney was the best asset!!!

There are some very intelligent and very experienced individuals on here who are gracious enough to answer all sorts of questions. The amount of knowledge on these forums is tremendous.

Don't bother with a lawyer. The I-129F is very straightforward, if you do all the reading on this site. And hey, if you still have questions afterwards, I am sure there are several voices on here who are willing to help.

Because I'm trying to finish up the I-129F quickly (within the next two weeks, and so far so good about collecting documents and preparing translations with an official company), I would like to have a lawyer or some firm assist to make sure we have everything we need and everything is in order. Can anyone recommend some law firms or otherwise online immigration visa help sites that were very good in helping you prepare for the Visa process?

Some of our new friends from this site mentioned they had good luck with www.amerilawgroup.com. Is there any other good immigration lawyer firms that any of you would recommend that are specifically familiar with the Vermont Service Center?

Thank you kindly
David and Irina

Anything they might keep = copies.

You never know where originals might get lost.

Later on - when you have your interview, etc. - bring the originals and copies for them to keep...

when sending all the proof of relationship, ongoing relationship, birth certificates, cenomar (singleness) does it have to be original or just a photo copy of everything? thanks in advance, god speed!

K-1 Fiance(e) Visa Process & ProceduresMisery loves company
I hope you get a job soon.. I know how frustrauted you must be. My mum was meant to be our co-sponsor but she lost her job earlier this year, and I was SO worried that we weren't going to be able to find one. (I was living abroad and had foreign income, so couldn't do it at the time.)

Is there really no friend or anyone at all who would be able to co-sponsor? I am sure you have really tried everyone you know... :-/ but it's so hard being away! :(

I really dislike airing my dirty laundry, but I need to just put this out there. I wonder if there is anyone else out there in the same boat.

Our K-1 Visa is being held up by the fact that I can not find a job. There...I said it. He is going for his medical in two weeks. This is excessively stressful on me at the moment. I was laid off last June due to my Grant-funded job being cut at state level. There is no one on my side who can be a co-sponsor. I just have to get a job!

Now, it is getting ridiculous...I have a Master's Degree, and have never been out of work in my life. I went down to the state unemployment office to see if they could offer any help and when they asked me how long I have been out of work, their reply was "that's not so bad!" Can you believe?!!!

The situation just looks so bleak. I wonder if I will ever be able to fill out the I-134 at this point. I try not to get down, and get up every morning and make an effort of showering and dressing as if I had a job, but, this is getting more and more difficult. I put out at least 30 applications/resumes in the last couple of weeks alone.

If it is this bad for me, I only wonder what difficulties he will entail when he starts looking for work once here.

Any support or advice is welcomed. Thanks for letting me vent.

K-1 Fiance(e) Visa Process & Proceduresbeneficiary documents required on I-129F
My finace had a name change, too...w/ the initial I-129F we sent:
1) his long-form birth certificate (which had his old name on it)
2) a copy of the signed name change decree that has his old and new names on it

No problems, anywhere. (At our interview, they did ask him to see the original copy of the name change decree)

Hello again...

My fiance changed her first (given) name (cultural, social reasons) when she was about 15. Does she need to declare this and send appropriate documentation of this on question 7 of the I-129F Petition? Her passport will have her current name on it. Does she need to send a copy of her passport with the I-129F petition? I guess I am confused by the instructions for the I-129F (#6,C). It says:

"If either you or the person you are filing for is using a name other that that shown on the 'relevant documents,' you must give UCSIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order."

I am confused by the 'relevant documents' part. At this point what are the 'relevant documents?' Again, her current passport and Thailand ID card have her current name on them. Do I still need to send legal proof of name change when I send off the I-129F Petition. This will not be a problem, just wondering?

'relevant documents'???????

Thank you!

Eric

K-1 Fiance(e) Visa Process & ProceduresRequest for expedite # 2 still denied?????
Best of luck in the future... I am sure that another job offer will come up. Perhaps this one just wasn't meant to be!

(My friend who isn't on this community but has also gone through this process had a similar situation - her finace had a job offer here but they were kind enough to hold if for him 'til he arrives in June now; they wanted him back in December - but there was no way that could happen)

Just to clarify. The wedding stuff was in addition to the business expedite and job offer here. We originally submitted the expedite with both as evidence and it was denied. So my congressman resubmitted one based on the business alone. The thing that is the issue is that if he sells it now and waits he will need to get another job as supplemental income until the time he can come here. It is better for him financially to hold onto the business now but will probably have to dump the price to get it sold quickly. Also, his job offer needs him here in the summer to get trained and such but now we have to let it go too.

I understand about my lawyer and I am incredibly disappointed with him. I wish I would have found this site too. Fortunately, it was a base price and I am not getting charged more for the expedite. This whole situation sucks and I wish CSC would just get the things done. The thing that bothers me is that they don't give us a reason. If they did we could possible come up with more evidence to support it if needed.

K-1 Fiance(e) Visa Process & ProceduresExpedite Approved
Congrats on your expedite being approved, and all the best with the rest of your journey!

I just wanted to address a couple of responses regarding expedite I have seen on this site.

We, my US fiancee and I, from the UK, filed the I-129f on January 22, 2011 through the VSC, NOA1 issued January 24, 2011. At the time we didnt think we could expedite but we decided to give it a go, so on Feb 22 we called USCIS, and requested to expedited based on my US fiancee's medical and severe financial need. The next day they emailed us asking for evidence. We mailed it to them and this was recieved Feb 25. Yesterday we received a letter from them confirming the expedite was approved, the letter was dated March 24, 2011. This was after we called twice, spoke to a tier 2 operative, who told us to email and fax them to ask where their response was. We sent the fax and email on March 14, 2011.

So since expedite approved, and VSC sent letter and email stating approved, we are now waiting for the petition to be approved or get an RFE.

K-1 Fiance(e) Visa Process & ProceduresMedical in London..malaria
I think you need to be honest w/ whatever you answer... if they ever find out that you lied, that could be even more severe.

There is a place for you to explain your answers.. so if you had it - explain!

I was just thinking, i was looking at the questionaire on the medical at Knightsbridge and i see it asks if you have ever had malaria...does that mean if you answer yes, then you will be barred or denied?

Also the I-134 form says "with mortgage and other encumbrances thereon amounting to"...does that mean you put how much your bills are per year or per month?

thanks

K-1 Fiance(e) Visa Process & ProceduresMedical interview questions
My friend's fiance had something similar happen.. he did have a criminal record (1 assult, alcohol-related.. it was in a pub). He wasn't asked anything at the medical about it. He did give up drinking for a month before the interview, based on his lawyer's recommendation (not sure the full story there...) But all went fine for him in the end - he's got his visa in hand and will be in the US in 2 weeks!

My fiance had his medical interview in London last week, where I attended as well. Nick has two minor past crimes on his record, one involving simple assault. The medical interviewer was questioning him heavily on if this was an alcohol-related offence of not. He answered truthfully that it was not. His court records do not have toxicology reports on them, but he wasn't drunk at the time and the court records do not mention anything regarding that. The interviewer asked about how often he drinks now and he answered about 5 beers a week, which is truthful. He has never had an alcohol-related problem. 5 beers a week is clearly not a drinking problem, but he wanted to be honest instead of saying he never drinks, which would have been a lie. My question is if anyone has had experience with this? The interviewer seemed satisfied that he had answered all questions in the positive. We aren't expecting any problems, but I wanted to see what everyone thought. Thank you!

K-1 Fiance(e) Visa Process & ProceduresG-325A question
We did the same, Oiraesesse. In the blank we wrote 'See supplement sheet' and then had a supplement sheet titled G-325A Supplement, Question XX... and then listed the full address.

We had lots of stuff that wouldn't fit in - silly UK towns and addresses :)

You can type it on a separate sheet of paper too, and then sign and date it. If I remember correctly that's what the form instructions say to do, and that's how we did it. We had no problems.

K-1 Fiance(e) Visa Process & ProceduresDoes credit score affect K1?
Fortunately, credit does not matter :-)

As long as when it comes time for you I-134, you can show that you meet the income requirements, etc. you are good to go!

So, just wondering, do they check your credit in your background check?? My credit is on the mend from my college days - and I was just wondering if this would have an affect on our visa? Financially I am set now, meet the requirements of the income guidelines, my credit score is is on the high-average side but not stellar. I'm just worried past choices might have a negative affect on this....

Trying to figure out if getting a second job to pay off all of my debt in the next few months, and breaking my back to do so, is worth it???? (our NOA1 came today - so would it even matter if I did it now?) Or, should I just keep making my regular payments?

Why would you need a letter from your parents? Unless you need one later on in India, it's not required for the initial I-129F

K-1 Fiance(e) Visa Process & ProceduresPolice Certificate Question
Police certificate still required. Unfortunately, they don't care who you are!

My fiance's in the army and works alongside the Queen, and he still needed one.

Sorry if this is not the right board to post this on (I'm never quite sure!)

My Fiance has a very high level of security clearance for his past job (this clearance is good for some time)...apparently this security clearance involved a very in-depth check - including looking into all police records - and was issued from the UK.

For some reason, he thinks if he brings proof of this clearance - it will suffice in place of a police certificate from the UK...it is a topic we discuss A LOT as I just want him to follow the rules and get a police certificate. I'm not fighting it too much right now as we just received our NOA1 - but, I want to be ready to persuade him if need be! Lol Do you think proof of this high level of security clearance is enough okay - or should he also get a police certificate?

I just don't want him to be denied at the interview b/c he did not have the police certificate...

K-1 Fiance(e) Visa Process & ProceduresFiling fiancee petition
Yes - defintiely. We filed from abroad.

Be mindful that he will need to show that he will need to show that he can support you, etc. when it comes to the I-134 stage. No problem with filing abroad though.

Hi,may i ask if the US CITIZEN can file a petition even if he is not in his country?like,he is a US CITIZEN but he is in the philippines now and wants to file a fiancee visa from here.

K-1 Fiance(e) Visa Process & ProceduresLAX's POE
POE reviews for LAX here... http://www.visajourn.../poereviews.php

I'm also curious to learn more about LAX; my other half will be coming through there in June.

Hello all. My non-English speaking fiance will be arriving alone at Los Angeles on her K-1 visa. What can she expect to happen? I am worried about the language barrier if an issue arise since I am not accompanying her on trip here.

K-1 Fiance(e) Visa Process & ProceduresFilling day till NOA1
Also - it will likley be 6 -7 months at best. Processing times can slow down considerably... luckily CSC is moving quickly right now, but that could change. So do be prepared for a bit of a wait, and don't be surprised if it takes longer than that... (not to be the bearer of bad news) :)

And also - if you use the resources here on VJ, no need for a lawyer! Save your $$!

Gosh so many things we dnt know abt the processs....thanks for enlightening us.

K-1 Fiance(e) Visa Process & Proceduresaffidavit of support - required before interview?
Wouldn't prepare it quite yet.. you want it to be dated somewhat near you interview.. if you send it now, it could be several months old by the time your interview comes.

Thanks very much to the both of you.
