K-1 Fiance(e) Visa Process & ProceduresUK Fingerprint Police Certificate?
For the UK, ACRO certificates are what are used and accepted.

Hi there again good people of VisaJourney!

I have a question I'm hoping someone can help me with.

I'm currently living in Australia and I'm currently organising my Packet3 Documents for my K-1 VISA application.

The US Consulate in Sydney has sent me my instruction email for police clearance forms.

It states that all police clearance forms must be based on fingerprints and not just on name.

Now I'm born and bred in Australia, but I lived in the UK from December 2003 to June 2006 (I have dual citizenship as my father is British), therefore I need to obtain a UK certificate also.

Not a problem, I found the ACRO Website (which I found also from this forum), but I can't seem to find ANY information on how to get a certificate based on fingerprints from the UK?

I am going on Tuesday to the Australian Federal Police office in Perth to get my prints taken for my AFP Clearance, that is not a problem. I just don't know how to get a UK certificate based on fingerprints.

I am planning on applying for this;
http://www.acpo.poli...rtificates.aspx

Can anyone shed some light on this one? Perhaps the UK doesn't offer this service?

Would this police certificate be accepted by the US Consulate in Sydney?

I have sent emails to the US Consulate in Sydney and to ACRO, but two days laters I'm still waiting for a reply!

Thanks in advance, I really appreciate your help!

GrayL

K-1 Fiance(e) Visa Process & ProceduresEmployment on a K1 Visa
I can only say what I know was given to my friend (who just went though this w/ her laywer)

You can work for your FOREIGN employer still. I know he is still paid in GBP into his British bank account.

Once he gets his EAD, he is legally allowed to work for the company here in the US and be paid in USD.

Hi everyone! I was just wondering...
I passed my interview yesterday, and THIS HAS TOTALLY BEEN THE BEST THING!

On to the bonuses... Today, I asked permission from the company that I will be leaving soon, June 14, and they were okay with me, not rendering 30-day notice as long as our client ~ US Company - is okay.. This US company is on the same location as my fiance - and is actually the company that my fiance is working for, LOL, that's how we met :D

Just had the meeting tonight, our client still WANTS me to work for them, and I informed them of the limitation for the K-1 visa  Looks like they think I'm an asset, hihihi  Our management here and client's upper management are trying to come up with an arrangement for that, and I am sure that it's okay that as long as I am technically working for my company here (local) until such time that I will be allowed to work for a US company, that will be okay, but I wanted to post here too.

Is this okay? Or would this be any violation? :star:

Hope to hear from anyone soon, and thanks for your responses :)
God speed everyone.

K-1 Fiance(e) Visa Process & ProceduresI-129F- Birth Certificate
Photocopy is sufficient.

The K1 package asks for a copy of a birth certificate. Does a photo copy suffice, or do they require an original birth certificate? Kind of confusing. Thanks in advance for your help.

@foobarbax,

Did you only state in the title of the supplement about using that are your correspondence address?

I read your note just now - but bypassed the supplement title - and I had no idea what you were referring to... UNTIL I went back up and read that in the supplement titled you mentioned 'Correspondence Address.'

On the actual FORM, did you say, 'Please see supplement entitled 'CORRESPONDENCE ADDRESS...' etc.?

Just an update.. I put my current address (in the I-129F) as a UK one, and then as an attachment to the I-129F form I wrote

However, I got the NOA-1 today at my UK Address. Luckily enough, I also got the e-notification, but I was expecting them to deliver it to my address in Reno.

Yep - listed all addresses - which was 3 UK addresses and 2 US addresses.

What about for the G325a? For Last 5 years did you list your UK address? or did you only list that in address abroad?

Sorry...I'm in the same spot I have a permanent US address but live in Mauritius with my husband and son.

These address questions drive me crazy !!

K-1 Fiance(e) Visa Process & ProceduresPetitioner residing abroad
FYI - we had a very similar situation. I was living in England with my fiance for 3 years before we filed. What I did was wrote our UK address on the I-129F and listed everything in that address; however, I attached a supplement form to the I-129F stating that I wished to use my parents address in the US for correspondence, due to the fact that I would be shortly leaving the UK to take up new employment in the US.

As you can see from our timeline, everything worked fine, encountered no problems, no RFEs, no questions, etc.

Thanks again. Sorry if I might sound like a broken record here, but:

Part of our case of having been together and being in a relationship to marry etc. is the fact of us having lived together in England for close to six months (I will be leaving upon the expiry of my six-month visitor visa, which expires in about a month).

We have a kind of dilemma here. We were planning to provide a lot of evidence of us having met and lived together here, this includes a six-month join tenancy agreement, utility bills and the like pertaining to our current address here inside the UK.

Will this be a problem or a conflict of sorts if I then (don't) say on the G-325A resident history that I am in the UK now? Or do I just put my friend's address above the UK address, etc.?

Maybe I am confusing 'Residence' with 'where I am actually sleeping at the current moment'

K-1 Fiance(e) Visa Process & ProceduresHelp! UK Embassy Interview Question
Make copies. They will take the copy.

If you don't have a copy, then I suppose they would take the original. But you don't want them to do that :)

I took copies of everything for the interview and asked them if they would keep the originals. They told me because I made copies they would take them and not keep the originals. However, I have heard of other people who didn't get to keep the original...not sure if it depends on the person you get?

K-1 Fiance(e) Visa Process & ProceduresWhere is our file???????????
Try calling the DOS directly. They are usually pretty good about telling you where it may be, what's going on, etc.

Received our NOA2 on 24th March and it stated our file had been passed thru to the relative consulate, we know this to be incorrect as the files must first pass through NVC. As we have not heard anything we called NVC today and they say they do not have it, also called the London Embassy and it is not there either. NVC requested we e-mail them with a copy of the NOA2 in order they can follow the matter up with USCIS Vermont. I would not have thought it would take over 2 weeks for USCIS to send off our file. Has anyone else had this problem any advice would be greatly appreciated. Thanks.

K-1 Fiance(e) Visa Process & Proceduresco-sponsor procedures
Kels, you cannot count foreign income...

Best to have your stepdad handle the I-134.

Note: I do not know for Chile persay; however, some embassies do require the petitioner to fill out an I-134 too, even if the petitioner cannot meet the income levels. Even though you cannot sponsor because you earn foreign income, might be best to have one completed anyway? You don't want any hiccups.

Thanks so much for your clear response! We could do it one of two ways then, could you tell me what you think would be best??

1. I work in Chile for about 1,000 US dollars a month. And I have a money market account valued around 35,000 US dollars.

2. My Stepdad alone fulfills the requirements of being a sponsor.

So, if we go with the second option, that my stepdad is the cosponsor, do I myself still fill out the affidavit of support and provide documents??

Thanks again!

K-1 Fiance(e) Visa Process & ProceduresAffidavit Support
Depending on which embassy you're dealing with, you usually need to two different 'things' to show incomes. E.g. tax transcipts and letter from your employer OR recent pay stubs

But the form instructions for the I-134 only mention tax returns if you're self employed. Is this just a bonus if you're not, or will my petition be rejected if they don't have them?

K-1 Fiance(e) Visa Process & ProceduresK1 visa..???
It would be a good idea to start with this: http://www.visajourn...content/k1guide

You'll find a lot of your answers there about the initial filing, what you need to gather, etc. You shouldn't be worried about the DS-156, etc. at this stage. What you need to look at are the I-129F and the G-325a at this moment. All the rest will come later.

You will also find instructions in the guide above about where to file - you will send your petition to Texas and it will be transfered based upon your fiance's address (depending what state he lives in); unfortunately - you can't pick where it goes.

Ok..My partner and I are trying to finally be together permenatly and legally... I have some questions, there is a lot I dont understand so any help would be greatly appreciated. Thanks in advance.

If my future father in law provides the affidavit of support, how long is he legally responsible for me?

On the download forms for K-1 visa it says the forms, DS-156k, DS-156 and DS-230 are provides by the embassy, what do i do about these?

If my fiance and I will be living in California do we have to file through the California service centre, I seen in another post that Vermont is the best??

The G-325A that I need to provide for the petition, do I sign it then mail it to my fiance before he files?

Do I need another G-325A form for the K-1 visa?

Is there an actual K-1 Visa form or is that jst the name of the visa recieved?

What forms are required by the embassy before the interview? and during the interview?

I know I know a lot to ask but we are so confused.

Thank you so much.

K-1 Fiance(e) Visa Process & ProceduresI-134
@TYJEN - Depending on your Embassy, you will likely need only two things that state your ability to support.

E.g. Tax transcripts OR W2s/1040s AND recent pay stubs OR letter from employer

You mean in terms of financial documents? You also need:
1) 2010 tax return
2) 2010 W2 copy
3) Latest pay stab which has indication of your YTD income
4) Letter from your employer stating your dates of employment, annual salary, employment prospects.

K-1 Fiance(e) Visa Process & ProceduresCan visa photo be printed?
That's absolutely absurd. There is no way that Royal Mail will take that long.

It takes abot 5 - 6 day for something to get from the UK to California. Did your fiancee send it recorded delivery? Check online to see its status. Always always always send so it can be tracked.

Perhaps send them again?

Hi all,

Quick question: my fiancee is in UK and when she tried to send me her passport photo/forms for the I129-F petition, they told her it takes over a month to mail it to me. She tried rush delivery, which was supposed to be 4 days and it's been 2 weeks and now they told her it will take 1-month+.

In any case, I have all of her documents electronically, so I was wondering if I could just print out her passport photo and cut it into the right size and submit that in my packet? Or must the passport photo be the "developed" type.

No, it's not typical.... if you are from certain high risk countries (which Canada is NOT), have a certain name, or have a certain degree, there is a great likelihood that you will be placed in AP. But in short - no - it's not typical.

So is it typical to be under admin review/processing after the Visa interview? I find it so strange for this to happen, especially when I was told to expect the visa within a week. Has anyone else gone through admin review at the Vancouver consulate in Canada?

If you want to hire a lawyer, hire a lawyer; however, this process can easily (well - maybe that's not the right word) be done yourself. VisaJourney is a great resource.

With a little bit of reading and research on this web site, you will be fine.

I have last question i have all the documents ready does i need to hire attorney or lawyer for file the petition because i am scared to file the petition by my self.

K-1 Fiance(e) Visa Process & ProceduresPlane tickets to US
As long as you remember to cancel the return, you'll be fine. (Or use it for a later trip, after you have AP, etc....)

Just don't 'not' show up for the return flight.

It's common to purchase return tickets due to the high cost of a one-way.

Hello folks,

I decided to buy my plane tickets to US already, even b4 my interview. The prices are WAAAAY too much and I wont be able to afford it If I wait until the interview date or so.

The round trip tickets were cheaper than one way tickets, so I bought the round trip tickets and then I'll cancel my return ticket once Im there (i read this somewhere b4 and loved the idea).

Did any of u do the same? Will this give me a hard time when I pass through immigration?

My only reason for buying a round trip ticket is because of the price, which was cheaper than the one way tickets.
Please help.

Thanks very much.

K-1 Fiance(e) Visa Process & ProceduresBe Warned about your cover letter with Packet 3
So sorry to hear that... I'm not sure why that happened. In ours, which we sent in March, we started our wedding was in August and that was no issue. We had an appointment scheduled less than a month away.

I would say keep trying to get it bumped up; maybe there will be cancellations?

Be warned about the cover letter you send with your Packet 3 to the London Embassy. We sent ours and as per instructions to state when medical is as well as intended WEDDING date for November. They sent us back saying that the forms were fine but they will not schedule his interview until closer to his intended arrival date. WE NEVER SAID NOVEMBER WAS THE DAY HE WAS COMING. They assumed it was and now we can't get our interview. We have 90 days to get married when he arrives so they should not assume this and if so they should say for us to tell them when he plans on coming over. Also, We never did receive the packet 3 either!

They took over a week to respond to our email too to find out this information. He is planning on coming in August and now we might not get his interview in time. GRGH! They also stated that we need to make his medical appointment in October. He has it scheduled for next week and this was stated in the cover letter. It makes no sense for them to assume that. We send in the DS-2001 to say we are ready for the interview and that means we want it now otherwise we would have sent it later.

Just wanted to share with you this experience. I was hoping to be there for his interview when I visit in July but now that probably won't happen.

Are you saying that you sent your original birth certificate when you mailed your original I-129F?

Hello,

I am the US citizen who petitioned for my Thai fiancée to come to the states. As part of the paper work I had to send my original birth certificate. I wanted to get that back and trying to fill out a G-884. In Part 2 the form asks for some info that don't apply to me so I just put NA in all the boxes (questions about certificate of naturalization, certificate of citizenship, and naturalization court etc....)
Am I filling out the correct form to get that document back?
Where do I sent the form to? I filed through the california service center, is that where I have to sent the form to? Or maybe I have to send it to the embassy in Bangkok?

Thanks in advance for the help.

K-1 Fiance(e) Visa Process & ProceduresEvidence of meeting
Looks like you have other strong evidence so you will be all right.

Include the hotel receipt anyway - can't hurt!

Just a quick question while we agonise over our I-129F package over and over.

We have put together documentary evidence of our meeting within the last two years, including scans of passport pages and boarding cards (we've made one visit each way), five colour photographs showing us both, as well as incidental bits and pieces such as hotel bills.

However, I've noticed that the hotel bills from here in the UK don't show both of our names. It's not generally how it's done here - the person who pays (this time, me with my card) has their name on the bill and not the person they're staying with. They clearly show that it was a double room, two occupants, and the dates tie in with the air travel evidence and photos, but without her name are we wasting our time including them? We don't have any hotel bills from the US because we stayed at her parents' house.

Apart from that, we've put in photocopies of letters and packages sent via snail-mail to one another, clearly showing postage date on the postmark, and my international phone bill showing, er, numerous calls to her. One thing we haven't bothered to include are any internet-related items - emails, Skype logs, Google Talk IM logs, and so on. These would run to literally reams of paper, and the general opinion of people who've been through London is that they generally aren't seen as necessary.

But my main question is about the hotel bills - I only just realised that they don't actually say who I was staying with! Is that going to be a problem?

Is there a Snappy Snaps near where your finace is? I believe they are a fairly large chain - my finace got his done there.

Yes, apparently there are a few pharmacies nearby that do it, but he is several hours from London. So he can't exactly pop down for a day just to get those photos. We thought he could just do it the day of his medical exam or interview since he'll be in London anyway, but in that case, how would he get them signed? I'm confused about it because we don't have to get passport photos signed in America, it's a new concept to me!

K-1 Fiance(e) Visa Process & ProceduresUnemployed and Co-Sponsor
Your unemployement won't have an affect on getting approved - as you will have your co-sponsor who has sufficient income. The U.S. just wants to be sure - whether it is you or someone else can support the person you're bringing over.

All the best,

Hello all... hopefully you can assist me, provide advice, perspective, or something on this question.

Okay... so I was laid off from my work in May. Due to this factor, I know that I will need to get a joint sponsor for support since I am still unemployed. To my understanding, I will still need to provide my last years tax return/transcript, my last few pay stubs, and bank statements. I'm assuming I will need to provide the same information for my joint sponsor. This of course in addition to filling out the I-134 form. Please correct me if any of the above is incorrect.

My question is about the fact that I am unemployed. My interview will be in the next few months and there is no guarantee that I will have work by then. However, the I-134 ask for position/place of employment and asks for your annual income. What would I put in these spaces? I am currently enrolled in school full time, but due to my unemployment I have been using my savings and its slowly dwindling. So providing my back statement isnt going to do much for me. My cosponsor does meet the 125% guideline for support of us and their household, but I'm wondering if my unemployment may get me a visa denial?

Any suggestions? Anyone had a approval while they were unemployed with support based mostly on joint sponsor? HELP please. :help:

I don't have enough assets alone to qualify. My savings is just 6 months living expenses, and my house's mortgage is underwater. There is no chance in a million years that I can get a co-sponsor... my relatives are not happy enough with what I'm doing to ever be willing to co-sponsor.

Photo copy of paystubs are fine. I'd assume that your US fiancee would want to keep the originals.

With regard to tax transcripts.... I'm honestly not sure if they would ask to see the originals! :-/

Would that be ok to use a photo scan copy of paystubs and tax transcript? I'm worried that I might not have enough time if my fiance mail the original to me.

K-1 Fiance(e) Visa Process & Proceduresshould I worried about the interview in London
Do note that London won't require proof of ongoing relationship. They are most concerned with the I-134 and supporting documents, as well as your documents (birth certificate, etc.) Make sure you have the US passport sized photos that are required.

Ensure you have copies and the originals for your documents. They will ask to see the original and then keep a copy. You need to have the copies handy; they won't make them for you.

London is quite easy - hope all goes well!

nutchaya, other things to bring is proof of ongoing relationship. Also you say divorce paper, if it is the USC's divorce make sure you know all about the exwife because they can ask about that.

I am curious how hard it was for you to get your police records from Thailand.

Chok dee(good luck) with your upcoming interview!

Besides finding out if the embassy has received your medical results (they usually do within 3 - 4 days), what is it you're trying to find out...? Or is it just for your own personal knowledge that you're curious?

The last 3 people I have spoken to at DOS have told me they are unable to see if the results of the medical have arrived at the embassy. Can they usually see it or do I need to call the embassy itself?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresCustoms at LAX
My fiance came through customs in early June... and he had to go through the slow line due to a misunderstanding.

He flew on American - so landed in the American terminal...and honestly - he was through in about 20 minutes. That is - from getting off the plane, immigration officers, bags, customs - all of it. Couldn't have asked for a better experience!

Oh wow, that's a long wait. I don't want to get there late either, just in case for some reason he breezes right through (wishful thinking). What is LE? Will I wait at baggage claim or is there a better place to wait for him? Thanks!

K-1 Fiance(e) Visa Process & ProceduresK1 London Interview
If you look in my signature, we have our interview and POE (LAX) reviews. Interview was in March and POE was in June, so both are fairly current.

You can take a book with you and a hotel key - no problem. I'm honestly not sure about beverages, but I can't imagine water being denied? (well, you can never tell!)

My fiance received his passport back in 3 days, but I see some people lately having it take just over a full week or so.

POE for my fiance at LAX was 20 minutes. This is rare and was amazing! (20 minutes from getting off the plane, going through the immigration officers getting bags and customs. VERY EFFICIENT!)

Hi, my interview is in London on the 13th July and I am now really nervous. I have looked over the link they sent me and I just wanted to make sure I hvae everything and if someone who has been for the interview had posted a checklist of everything to have. Also my interview is at 9am, what time should I get there? I assume I will have to queue to get in and through security so should I get there at about 8? is that early enough or too early? Also i know I can't take in electrical items and key fobs. I just wanted to check am I okay with a purse with cards and a hotel key card? Also could I take a book and maybe a small drink? How long are you usually there? My fiance is back in the US now so sadly he can't go with me.

Another question is how long does it usually take to get your passport back from them, is there anyway to pay extra to get it back quicker? Also can this fee be paid by card or does it have to be cash?

Lastly I think I noticed someone said clearing immigration at the POE it took around 4 hours. Does it usually take so long? and which is generallyt eh best POE. I usually fly into O'hare but I could possibly do somewhere else. Oh and while you are waiting for your information to be processed what happens to your suitcases. I get so paranoid about my cases I would hate for them to be sitting there alone for so long. I know no one will take it but I alway have that fear.

Thank you for any help and answers, I really appreciate them.
