Waivers (I-601 and I-212) and Administrative Processes (221g)New Islamabad AP-Tracker, Part II

I have been to Pakistan 3 times starting in 2011 and I am going again in April.  I am a USC female traveling alone and I have never had any problems visiting PK.  Granted there are some dangerous areas, but I travel to Lahore.  I would say the most dangerous thing is getting my luggage off the belt at the airport...but I usually hire a porter.

I forgot to post the congressional response here in this thread:

I received a response from the Embassy, but I have not yet received one from the CSC.  Here is what the Embassy said:

Thank you for contacting the Immigrant Visa Unit.  We received word from the National Visa Center on March 5th that USCIS was requesting the file be returned to them.  We will be sending the file back to NVC through the diplomatic pouch in the next few days and any original documents or passports in the file will be returned to the applicant through the Embassy?s courier service. Alas, we have no information as to why USCIS requested the file be returned to them.

So USCIS said they don't request files back, the embassy said they do not know why the file was requested back.  Is this a mistake?  Did they request the wrong file?  I have no idea what is going on here.

If your case send back for revocation then now its a long process and you have to wait for the next step that when your file send back to USCIS . It may be take 3 months or may be year depend when they send your file back , then they send you the notice what they ask want you as evidence.

Aisha...I see in your timeline says at the time of interview your visa was denied.  Have you been reaffirmed and had a second interview?  What is your current status?

Hi Janetusman,

Sorry to know that your case if sent back for revocation, did the embassy tell you about this?

No, there has been no notification from the embassy.  I called NVC and they said USCIS requested my case back.  I am waiting to hear from my congressman.  There was another status update today so I am hoping they answered her inquiry.  I am praying this is all just a terrible mistake.

I just called NVC this morning to find out what the status update on my case was and NVC said that USCIS has REQUESTED the case back.  Has anyone experienced this?  I asked them if it was sent back for revocation and they said no, it was USCIS that requested the case back.

Haha just reading all of the posts!
My husband's case was updated on February 24, after I sent an email to the Islamabad Embassy. Here is what they sent me:

Thank you for your email.

As per our available record, this visa case is part of an integral administrative processing, that can neither be waived nor expedited. Though, we certainly understand the importance of family reunion, and also aware about the frustration often caused by the delay.

However, ultimately the completion of such process, depends on the Department of State in U.S. Therefore, unfortunately, we are unable to predict the amount of time this process will require.

Consequently, It is imperative to mention that as soon as this process is concluded, we will move forwad regarding this case, and will make contact accordingly.

Sincerely,

IV Unit, Consular Section,

U.S. Embassy, Islamabad.

KA02

How funny...you ask the embassy and they point to DOS and if you ask DOS they point their finger at the embassy.  Many times I have called DOS and they say it's at the embassy awaiting consular decision.

hi LAgirl29

Our marriage is for more than 2 years and 8 months and we spent 9 month together...first three months we spent in dubai while I was working there as HR manager at time of our marriage and then I came to pakistan in 2012 and my wife came second time from US and spent 3 months together but unfortunately had to leave for bad circumstances of politics here in pakistan as well as bad threats and risks for US citizens and now she came in Nov. 2013 and till today we are together...so it is our 10 month going on and I beleive our marriage is not for US immigration...it is to live together forever no matter it's US, UAE or Pakistan. So I get suprised some times when people tell they spent only few days or months together after marriage and I find it so strange how come people have such patience.

i am in AP for last 7 months and 8th is going on but as soon as we got to know that AP may take longer time and realized this we decided to be together and hence I called my wife back to Pakistan immediately and now we are together for last 4 months. it's her 2nd visit to Pakistan and 3rd visit at all. we celebrated our birthdays together, new year together, valentines together, 2 Eids together, 2 Ramadan months together...I have written this all for all the married people to decide better for themselves and stop waiting impatiently for visa. Our marriages are to live for our spouses not for visa and this is my advise to all if you START thinking like us your visa tensions will be over...thanks and regards ALI & SANDRA

I have to say, this post makes me quite angry as it comes across as very judgemental.  While I am happy for you that you are blessed to be able to spend so much time with your wife while you are in this AP hell, there are many of us that cannot take off from our lives here in the US for months at a time.  Many of us (if not all) have jobs and some of us have other obligations (children and family) that we cannot put on hold.  If I had the opportunity to work from PK or live in another country with my husband while we wait it out I would do so in a heartbeat.  I try to be positive everyday, but there are times where the stress of the seperation gets to us.  My husband and I met in 2010 and married in 2011, it is now 2014 and we are still waiting...

Ahmed flew from Pakistan to Abu Dabi to Chicago then on to our home in Michigan. There was a US immigration office in Abu Dabi where they took his visa packet. They were very kind and he didn't have any problems. When he got to Chicago he just showed his passport and visa and they let him through.

Was this immigration office in the Dubai airport in the airport in Abu Dhabi?  When they took his packet, did they stamp his passport there?  How long did this process take?

Carolyn...what was the date of your husband's last interview?

Has the DOS stopped dealing with the 'administrative processing' cases and moved that whole thing to the NVC?

and congratulations once again Carolyn! Wishing you and your husband all the best!

Yes, DOS will no longer answer questions about immigrant visa status

we want to write to the senator for help....please can someone help me with a sample letter, what should we write? thanks

Your senator most likely has an online form to fill out to request assistance.  It will be under Request Assistance from a Federal Agency.  Then they will send you a form to sign so they can submit a request on your behalf.

I think the point is Aisha is that we are all in the same situation. My husband has been in AP for over a year, our journey started in 2011 and EVERYONE has personal situations that are difficult.  The negativity is so counter productive and just brings everyone down, try being positive and find hope in Carolyn's issuance.

I called NVC today after I called DOS...NVC states they do not see anything until the embassy sends it back to them.  So they only saw my husband's interview date from last year and none of the subsequent updates.  They told me that if I want a case status I have to contact the embassy.  Well, we all know how that goes...

I would wait to buy a ticket until you actually have your visa in hand.  There are a couple of people on the ISL tracker that were called in for oath and fingerprints who were put back into AP.

I am so glad it all worked out for you. Question, why did your case go to the field office and not back to the service center it originated from ?

Are you sure the USCIS asked for it back or did the embassy initiate it and was unclear and had a chit chat with USCIS and then USCIS

decided to request it back ? I am just curious why it went to the field office for further questioning rather than a NOID via the service center.

No one could give me a clear answer on why my case went back.  The embassy said they did not send it back and USCIS said they did not request it back.  Obviously, someone was not telling the truth.

According to NVC, it was requested back by the San Francisco field office (not where I live) and was transferred to the local field office.  When I went in for my appointment with the local field office, they said that my case had not been denied.  Although it seems like it was going through the NOIR process.

Curious... What did you do with the congressman? I have heard that they help, but don't know the necessary steps to get the help since I'm sure they are busy with other agendas.

When my case was sent back, my congressman was able to follow the case all the way back to the field office in my town.  Once it made it here, she contacted the local office where they instructed me to come in.  That was where it all started to go better for us.
