Hello everyone,

I recently posted updating everyone on my husband's denial of his CR1 Visa. Actually I'm not sure if it was denied because they CO that interviewed him actually told him that she wasn't denying it that she simply had to return the case back to USCIS for further review. Briefly, the other items were: that he answered the questions about my birthdate in the Egyptian format vs. the American format and because the CO states he did not know how long I lived at my current residence, which my husband swears he was never asked that question. Anyway, can anyone here please maybe give me an insight on how long I have to wait for USCIS to give me their final decision? Our case will be at USCIS for a total of 4months on the 13th but one of their reps has told me an answer can be made as early as 120days (the 13th of August). But when I look on the website it only states that an I-130 is currently taking 5months????

Any suggestions? Ideas? Has anyone gone down this path with USCIS, California Service Center and give me a more accurate idea? I am really trying to be patient but I am going crazy without any news or update from USCIS. Everyday I check their website and nothing's changed. I've also signed up with them to alert me via txt/sms message as soon as they reach a decision.

Hi, we went thru all the process with the basic service with "la poste" and it went well, it just took maximum 5 days for each letter that we send. So dont spend a lot of money using chronopost.

The embassy processing is so confusing.  My husband's medical is expiring on December 12th and we have not been contacted for fresh documents.  Yet, I have seen from others here on the forum that they request fresh documents well before the expiration.  What happens if his medical expires?

We have an attorney...the only thing they have helped us with is preparing the forms and letting us know what we needed to make the NVC step shorter.  We are 10 months in AP and celebrated our 2nd wedding anniversary this past Monday.

After several long months our case had a status update on 9/25, the first one since March.  Today I called DOS and asked for a case status...the operator took my information and pulled up my case.  Then something very odd happened...normally I get the "Your case is in AP and you will be contacted when completed", but this time the operator asked me what did I know about the status.  I told him all I knew is that its in AP and he asked me if the embassy contacted me...I said "No, should they have contacted me?"  He then put me on hold for a bit and came back with the standard your case is in AP answer.  He seemed to be willing to answer questions so I asked him what was the status update on the 25th?  He said it was internal processing related to the case.  DOS knows what is going on with the case, they just refuse to say anything and cite confidentiality and privacy issues (of which I do not understand because this is my information).  It's so frustrating, but I have a good feeling that maybe our visa journey is coming to an end soon.  Hoping we get to spend our 2nd anniversary together...

Hello, this is my first post, I have been a silent vistor for quite some time.  My journey started in Dec 2011.  After a 10 month processing period at USCIS and few weeks at NVC, my husband had his interview at the Islamabad embassy on January 23, 2013.  We are now almost 7 months in AP.  I am curious to know if there have been any visa approvals where the petitioner is an American female of non-Pakistani origin and the beneficiary is a Pakistani male.  The couple of cases that I have seen here on VJ have been in AP for years.

Praise Allah!!!!!!!!!!!!!!!!!  My husband was called into the embassy for fingerprint and oath today.  He was called to the window, asked to do the oath and gave his fingerprints.  The woman told him "Congratulations, you are approved.  You will have your visa is 7-10 days.  After 3 years of waiting, our journey is coming to an end and our new life together will begin.  There have been many ups and downs through this whole process and I thank everyone here on this forum for all of your support.  Here are the particulars of our case:

 

  • Married 11/11/2011
  • Filed 12/2011
  • Approved at USCIS 10/2012
  • Interview at embassy 1/2013
  • We saw sporadic updates from 1/2013-1/2014
  • There were several updates in 3/2014, result our case was requested back by USCIS
  • In May 2014 a Homeland Security officer visited my home in the US and interviewed me (wife/petitioner)
  • Returned to the embassy end of June
  • Request in the first week of July for updated documents (DS260, marriage certificate, nikkah nama, birth certificates), passport and medical were not requested at this time
  • About 5-6 updates until August 22nd
  • Congressional inquiry Sept 8th, response - waiting to schedule oath and fingerprints
  • Call from the embassy Sep 18th to schedule the appoiuntment, bring new medical and passport for the 29th

how long time to change to issuse and get pick up my passport lady said will take 5 working days ?

There are no specific reasons for getting in AP, some of the couples here got everything right with no red flags but are still under AP. All you can do is pray you get to be one of the lucky 5% to get out without one.

I recommend asking your congresman/senator to send an inquiry. In my experience they always get a reply.

I have been a silent reader since the past few months, I can feel the pain of everyone who is suffering in this AP process, it is the hardest test of patience I have ever been through, My husband just had his interview at the Islamabad embassy on 09/05/2014. It did not go well at all, as they asked him all sorts of questions. at the end he was given a refusal sheet under 221 g to submit additional items. We have already done that and are waiting for them to get reviewed. I have not seen any update since the day of the interview.

 

The whole process was so smooth throughout the way, all the way up until the day of the actual interview. As if a year is not enough, they make us go through this pain, they should do ALL their administrative work before the actual interview, and the day of the interview just see the person. I do not know why they make their jobs complicated and people suffer from the long distance. 

 

I have read the majority of this thread and glad to see a lot of people have been issued, and best of luck to everyone who is still waiting. I shall update as I go through this step of AP.

 

Does anyone know who I should contact to get information on weather the documents my husband sent after his interview were received? Should I email embassy, call DOS or NVC?

 

I am very sorry for what you are going through. If I'm understanding it correctly you are in AP, that seems to be the norm around in Islamabad. I would recommend giving them about 2 weeks and if you do not see any update on your case after 2 weeks of sending the paperwork then send an email to confirm if they got the papers or not.

Contact the medical center for the appointment and then do your medical. When you get your medical report send it to the Embassy using their recommended courier.

Ah. It doesn't state 'Returned to NVC' so I am assuming it's still in ISL in that case. I just went off the assumption it's taking this long. Just states as 'Adminstrative Processing' with the last update falling on 7th May. Btw, is there any update on your case? Not officially. Just curious as to what is happening with it these days.

 

Our case was sent back to the embassy in May, they asked for additional paperwork and we have seen some updates, but nothing since the protests started.  They still have not asked for his passport or a new medical as those were returned to him when the case was sent back.  This is our 20th month of AP.

Haven't received an update since 07th May. Leads me to believe that they sent my paperwork back here to the States. Haven't heard anything and it's been 7 months of AP. Still holding out.

If they returned your paperwork to the US then your case status would show as "Returned to NVC".  My husband has been in AP since January of 2013 and our case was sent back in March of this year.

Does your joint sponsor make enough without his former wife's income?  If he does, it should be a non-issue as joint sponsor's responsibility is financial and it has nothing to do with with whether or not he is still married.  If he doesn't meet the income requirement on his own then you will need a new joint sponsor.

For those who have had their case statuses flip to "Expiring Soon"...when you contact the embassy to correct it, did the embassy start working on your case?  I'm just wondering why the status flips sometimes.  My husband's medical has expired before and the status never flipped.  Our case was recently returned back to the embassy from USCIS (still don't know why it was requested back) and they called my husband for paperwork (DS 260, marriage/birth certificates, etc) but they did not request a new medical (which was expired) and his passport.  Now we have a status change to "Expiring Soon".

No, you must send originals.  I emailed the embassy when they asked me to send I864 and they said it must be original signature (no scanned copies).  I sent mine via DHL and it arrived in 3 days.

Well there is quite a bit of back story to my case.  I'll try to keep it short.  My case was sent back to USCIS (requested by USCIS), it did not go through the revocation process.  I had a home visit by a Homeland Security Officer because they were concerned that my case was a fraudulent marriage.  Shortly after my home visit the officer sent my case back which NVC took forever to process it and send it back to the embassy.  The embassy received it and asked for:

  • DS 260
  • Original Birth Certificate
  • Nikkah Nama in English and Urdu
  • Passport photos
  • I864
  • Tax returns

When my case was returned to USCIS, the embassy returned everything to my husband.  His last medical expired in June this year.  They specifically told him not to do the medical until he was called.

 

The Summary of my timeline is:

  • Filed Petition Dec 2011, approved Oct 25, 2012
  • 3 weeks at NVC
  • Interview was 1/23/2013

We have been in AP since then so just over 17 months

Has anyone been requested to send DS 260 without sending the medical?  I've noticed that most of the posts here have the embassy asking for both at the same time.

You have to keep dialing over and over until you get through.  The NVC number is always busy...

Now my case is back at the embassy.  It was received today via DHL.  Let's hope they have all they need now...18 months of AP started in June.

Finally my case made it back to NVC.  They said its under "additional processing", so looks like they are going to ask for updated financials.  I just hope it doesn't take weeks for them to do this too...

the embassy isn't trying to break anyone up, the consulate has a job to do. AP cannot be waived or expedited, they have no control over how long background checks take to clear. Record keeping in Pakistan is horrible at best and trying to complete AP is a long, tedious process when record keeping is so bad. The cannot and do not discriminate because of what you call "mixed marriages".  

 

My husband has lived in the same province and the same city since he was a child.  He has never traveled outside of pakistan, not even his province.  Background checks have been completed and my case was sent back to USCIS for whatever reason.  I did not get a NOIR, what I got was an unannouced visit from a Homeland security officer at 9:30 on a Saturday morning.  He interviewed me, inspected my home, bedroom, closet and took pictures.  He told me that they do this because people are known to get paid for visas and they were looking for evidence of another man living with me.  My husband was in AP for 15 months when my case was requested back by USCIS.  They did not find anything on him, so they turned their investigation on to me.  Neither one of us has a criminal record, I have a good job and no financial issues. We are a "mixed marriage", as much as we would like to think that they don't discriminate, they do.   The embassy COs have complete autonomy.

 

The problem is, that there is no transparency into the process.  People could have to hope if they told us that they have to do X Y Z and we are on step Y.  Some people are in AP for months and some for years there is no rhyme or reason as to why they do this.

Yesterday I also picked up my passport, and very very very happy. Every time when I read people status issued I only thought when that day come when I will share that my visa issued. And alhamdulilla that day came.
I also wanna thanks to all members, by reading your experience it help me because all of us can do nothing just share our experience and try to guess next procedure could be this. I dont think the amount of time on AP is what is important, do not minimize my feelings and my hardships base on the time our case has been on AP frankly it is belittling. The amount of time people are apart due to the immigration process is really the hardship, and that is what I am trying to convey. I am well aware that there is no ti,e frame for the AP process, which makes things that much harder. We didnt even know that AP existed. There are things you dont know about how this immigration process has affected us. 

I am not trying to belittle your feelings.  I wish there was someone that would have prepared me in the beginning and told me about the reality of AP.  My attorney had never dealt with this embassy and he did not prepare me for what I was in store for.  The people here have provided me with such hope and support through this horrendous process that I can't thank them enough.
 
My husband and I have been on a five year journey.  Everyone here has hardships of one kind or another.  Who am I to say that anyone has it worse that someone else.  I have seen stories of financial, medical, and emotional hardships of different varieties.
 
The point I was trying to make is that the embassy tests all of us to see if they can break us apart during the wait time.  The embassy doesn't care about your hardships, they only follow their own timelines and procedures.
 
In cases of mixed marriages, they even go as far to deny and send your case back to USCIS for revocation adding a year or more to the process and trust me...no one can prepare you for that.  I wish there was a rhyme or reason for what the embassy does, but there isn't.
 
In the end, all you can do is stay strong for each other.

not long a little over a month but I have been apart from my husband for a year and 7 months, and i think that i will not survive this, that we may not survive this.

 

Wow...you have only been in AP for 1 month?  Many here have been in AP for many months, some even years.  Going through AP at Islamabad is a true test of patience.  Is the beneficiary female?  If so, you may be lucky and your AP will only be a few months.  If the beneficiary is male, then you need to be prepared for a very long AP.  I am not saying that AP times can't be short, but the vast majority on this forum have had long wait times.

 

AP is difficult on relationships, it causes fights and incalculable stress between you and your spouse.  This is your test that Allah has given you and its up to you and your spouse to pass it.  The only thing you can do is be patient, respond to anything the embassy asks for and wait.  Be strong for each other or you will end up going crazy or worse divorced which has happened.


Today i got my passport with visa and packet .Thanks Allah... 

 Thanks To All vj friends who help me in all difficult process....All friends are always in my prayers who are still waiting for visa's ....
