While I certainly understand why it would be much nicer to have the actual 10-year greencard in our hands, I am not going to stress over the waiting time. After all, we are permanent residents, we have the extension letter which is as good as the greencard (as far as rights and permits go) and from what I can see from previos filers- chances of denial are slim!
So really, why stress? We are just going into month 4 now! This is still not terrible, considering that we have 12 months until our NOA expire.
It was a different thing with AOS, I admit I was really a bundle of nerves back then, but right now I don't see why I should stress myself out over the greencard. Unless you have some difficult circumstances to deal with, chances are good that it is just a matter of time until we all hold our little plastic card in our hands.

I hope they won't "forget" or "lose" my application again like it happened with my AOS...lol

For how long were you wanting to travel?
I would say it is safe to travel with the extension letter (NOA1) you will recieve after you filed for ROC or the stamp, specially if you would be flexible with your travel dates.
Maybe check out in other peoples timelines (go to the monthly threats in this forum) to see how long it usually takes from filing to biometrics, so you can better estimate when it is fairly "safe" to travel.

But yeah, have someone check your mail while you are gone and get you any info from USCIS.

If your approval letter says Feb 24 but the greencard has Dec. 20 as expiration date on it, I'd make an infopass appointment...or follow the directions that came with the card for what to do when you find something wrong with the card.

I hope though that we both have not thought of any other explaination of the two different dates that would spare you from having to get a new card. Good luck!

You can file without him present.
My husband was deployed as well when I removed conditions and it was no problem. Plus, we lived overseas.
I wrote "Active Duty Military- Overseas" on the very top of the form. You may want to write "Active Duty Military- Deployed" on the top.

Add his deployment orders and a letter from his commander as to why he won't be able to attend any possible interview or sign forms. (Or have your husband sign the form when he is there in April?)

You might even get around the interview ( I did) or they will just forgive your husbands absence.

I agree, we were in the same situation, my husband had everything regarding the house, cars and utilities in his name, the only thing we had jointly were bank accounts, cellphone and car insurance, life insurance.

I submitted copies of letters/bills to him and/or me that showed the same address and that seemed sufficient.

I have to add though that we also had our military orders and his will with me as the main beneficiary, so that might have mattered a lot as well vs. combined bills....

Why did your wife suggest to bring the kids? To use them as evidence that you are a "real" family?
I honesty don't think that is necesssary. If they feel like they need to see more evidence, they would send you a RFE. If you haven't gotten one of those, you should be fine with what you submitted.

I guess it couldn't hurt to bring more stuff to the interview in case the situation becomes critical regarding the papers you sent in.

I think an experienced and good interviewer will be able to see that you and your wife are in a happy and real marriage.

You can file up to 90 days prior to the expiration date. I'd suggest you do so early on in those 90 days. You should recieve a NOA1 which will extend the current greencard for one year, which would allow your wife to travel in December.
I am assuming you are talking about the 2 year conditional greencard, so I agree with Inky, this is not a regular renewal of the card, you have to remove the condional status on the card/your wifes status.

The list looks good. As mentioned before, you don't need to submit marriage certificate or license, they know by now that you are married;-)
Also, when you submit any joint bills, bank statements,...make sure they cover the entire time you have been married (not every single months but maybe 2 per year per account.

I also heard to go easy on pics, I resized the pictures I wanted to send and printed them all out on one or two pages with captions and dates and that seemed to be ok.

Don't get to worried, ROC is pretty straightforward...

I think what you guys could/should have done is getting a letter from the Army asking to let him file prior and also add a fingerprint card and passport pictures to the application to get around the biometrics appointment.

I don't think writing "active military" on the application without any kind of orders, enlistment papers,...attached to it will do anything.

I filed for ROC from overseas and did that but you have to show why you would not be able to go to a biometrics appointment- so I sent in our orders.
Not sure what will happen with your application, I have never heard that you can just file whenever just because you are in the military. I hope, you will get that sorted out fast!

I guess you can make a difference between not having any income to support the household and having income and chose not to support the household. I still don't think this was THE reason for the denial.
Either the OP hasn't submitted enough other evidence of his bonafide marriage or there were other red flags during a possible interview, IF there was an interview.

Like other said, OP, can you give a list of all the documents you submitted and what exactly does the denial letter say?

Lawyer up before you start the appeal but start gathering EVERY bit of evidence you can find to submit with the appeal. Also, start talking to people (family, friends) and ask them to write affidavits.

That's a messed up situation you are in, I hope your wife can calm down soon so you guys can plan and go the next steps. The journey isn't over yet!!

If you haven't yet..take a look at my timeline. I think my application went through pretty smoothly, no RFE's, no delays, that's how it SHOULD be..lol

Another thing: The longest waiting period is until your petition gets approved.
Once you have the NOA2 (the approvel notice) and the case gets send to NVC and then to the embassy in Germany, things move fast...(depending on how fast he gets his medical exam done and sends the required papers in....with that, you have little influence, how fast you want the process to go once the case is in Germany.

Who did you talk to? a customer service representative or an immigration officer? If you talked to a CSR, I wouldn't really trust anything they say or do.
Do you have a case number? If so, did you give it to the person you talked to and did they look you up in the system?
IF yes, what did they tell you about your status? Did they recieve your application (well, if you have a case number I assume it's from your cashed check wish would mean they recieved it)?

If you know they recieved your application, it is not too unusual that there are no updates or touches online, you have to wait and be patient....now if something went wrong and your application got lost, you should submit a staus inquiry

I am pretty sure mine was closed all the way- I remember because I was trying to take a glimpse inside and there was no way to see anything. What makes you so sure that they all have that?

On another note: I had my envelope in my carry-on bag and nobody even asked me for it when I checked in or went through security nor when I boarded. I only took it out at my POE and once someone saw me with it, I got taken out of the line to get processed.
I guess based on my visa they would have known about me having an envelope but yeah, It didn't even accure to me that someone would want to see it when I left my homecountry but now it seems that's common practice?!?
