I guess they suggested K-1 for you since you are engaged. If marriage is in your near future, I'd definitley suggest DCF. It's a short, easy process, your spouse will get a gc right away and it will be all taken care of before you even leave the UK.
But: You have to be married.
Also, but I might be wrong, I don't think you need to even deal with co-sponsors. !?


I have a question regarding your dual citizenship: Don't you have to give up one of your citizenships when you are 18? That's what we were told when our son was born who is a dual- us/german citizen

welcome to VJ!
None of the mistakes you said you guys made when you filed for the I-129 sounds like it will make them deny you.
Usually if they need more information about something, they will send you an RFE, a request for more evidence. Maybe they will let it all slide and ask you more question at the interview about places you have been together and how you met and all that.
I wouldn't be to worried at this point. They have accepted your application and now the waiting game is on.
I know it's an exciting and sometimes nervwrecking time and process, but it is all do- able. If you read some more here, you will find many cases a lot more complicated and these guys mostly make it through without major hiccups as well.

Just for the future: Read the guides and instructions on here very carefully and follow them as closely as you can and you will be fine!

If she wants to, she can gather documents like her birthcertificate, write a draft of the letter of intent, start putting together a folder with pictures, letters,...other evidence of your relationship but other than that- not much you can do at this point.

I think that's why teh yneeed it, but the again in the form they ask for last and present address - in my case it's the same address...i di not change my address...it's all correct in our pettition...

the consulate hasn't been assigned yet.. we have not been approved yet! All we wanted was to change Warsaw, Poland to Dublin, Ireland in Q20 in I-129f... will try to call and find sth out today...

Yeah, Maybe you get to talk to a real person who will be able to tell you what you need to do. I suspect there is no special form to request a consulate change so they do it backwards by "changing" your address in the system which would lead automatically to a consulate change!?? But then it's USCIS....that kind of thinking would almost require common sense.

Hi everyone!

Recently I have posted a thread in relation to the email we got from USCIS saying that the status of our case is document/card production...I'm sure you've seen those. Yesterday we got a hard copy document in mail.

when filing I-129f in November our lawyer put Warsaw,Poland in Q20 ( when they ask about the consulate). Although I'm a Polish citizen I reside and work in Dublin, Ireland. Couple of weeks ago we called, since we wanted to have that changed. We really want the interview to be in Dublin since it will save as a lot of money, not mentioning the hustle!

What came in mail was 2 things.

Simply a note that we made the request and that the consulate will be chosen by the State Department when the CSC approve the petition.

BUT

Along with that came a note that they received a changed of address request and want us to fill out a AR-11. Which doesn't make any sense to me... they ask in that form to fill out present and last address...which would be exactly the same in our case! ?They're also asking for Alien number and port of entry details which do not apply to me. Any one has any insight or thoughts to share?

What is more they're telling us in that note to fill out that form (AR-11) and send it to address in London...why London? Does anyone know?

We're getting frustrated...we're almost on our 5 month mark and were hoping for an NOA2 soon... We were hoping to get married on memorial weekend...

How should we proceed with that? I know you'll probably say to call them...which we will...I'm just hoping to get some insight from anyone with proper knowledge and/or experience.



It's London, KY, not London, UK :) Not sure why they want the AR-11 from you but I suspect they need it to change the assigned consulate?

Go to your congresspersons website. Usually they tell you how to contact them and sometimes they have a form you need to fill out that allows them to inquire in your name. I had to write a letter to state this.
But it did help me with my AOS process. It really depends though, what the problem is I think...

I heard that some embassies try to accomdate you with the interview date based on when you want to get married. But I wouldn't say that's a rule and they always do it.
My interview date was 10 days after I submitted all my paperwork and 6 weeks prior to our thought of wedding date (I too just estimated and it worked out like that) but I think they just sscheduled me for the earliest interview date after I had sent in all my documents.

These are questions frequently discussed on VJ- so far, still no definite answers. There are many factors why an application that was submitted later would be approved earlier than others...it could be a pending backgroundcheck that needs more time, laziness of your particular caseworker, expedited application that will take "your" spot" nobody really can't say.

My advice: Don't even get worked up over it. It's pointless. Your time will come, until then, stay patient and go with the flow....unless it's been an extremely long wait, then you should get into 2nd gear and make some calls..lol

We didn't get an RFE, but my fiances name was wrong when we recieved the 1st NOA. He called the custumer service # to get it corrected and they told us, they would send us a corrected one...which never came. Instead, we got the NOA2 already, with his RIGHT name, just misspelled..lol
Now we are working on that one to get it straight...even I don't think, one typo will do anything to the whole process....

So..so far no trouble... :thumbs:

If it comes to Immigration I strongly advise to always stick with the truth. Now there are things you should only say when asked for and not volunteer to share, but that's entirely different than lying about something.

I had my folder with all my documents in a leather bag that I still had from college;-) Since I didn't have any other "stuff" in there, other than my passport, a pen, a book, a snack and tissues, I didn't have a problem with security at all.

They are strict with electronics though. I had to go back to the same consulate two years ago and forgot to take my iPod out of my purse. I was lucky, they had a little storage shelf there where I could leave it until I left again.

Lol..They already took away my green card.....(that was cruel enough already, especially since I paid so much for and waited so long for the card)
By no means are they taking away any my naturalization certificates and/or passports!
They cannot take what does not belong to them, issued from other countries.....
If I want to give up citizenship to any other country..fine, that is of my own choosing...not up to the US government to decide that! It's like another country taking away US-issued documents...
Lol..Let's just say there will be world war III if that happens!
Besides, the USCIS has better things to do and needs to be more competent in other ways....

Doesn't it say they can/will take your US citizenship away if you don't give up any other citizenship within a year of becoming a naturalized US citizen?
Of course they are not taking away your canadian or any other citizenship!

In either event, I have never heard of something like this happening. Kinda funny actually that as a german citizen you have to apply to keep your german citizenship if you become i.e. a US citizen but then the US could take away your US citizenship if you do that.
Why does it have to be so complicated? LOL

Do NOT, under any circumstances serve Jury Duty before you actually ARE a US Citizen. It's absolutley possible that they sent you the letter in error, not knowing about your immigration status.

I'd just reply to them explaining that you are not a Citizen yet and therefore you cannot be on a Jury. It's not a big deal, people get out of JD for all kinds of reasons but your's is not just an excuse, you are just not allowed to, as that is pretending to be a USC which will screw up your entire naturalisation process.

Given your experience at the ROC stage where you almost were deported when USCIS didn't believe your marriage wasn't genuine and took it all the way to the court (which is in your A-file!), it would be Russian Roulette if you now were to pretend again that your marriage is healthy even though you just stated publically that it is not. Even if your wife cooperates now, it still would be fraud and can haunt you for the rest of your life. If your wife wants to hurt you later on, all she has to do is come clean and confess and your naturalization will be declared void, like it never happened. Not worth the risk.

Unless you want to risk immigration suicide, I strongly advise you to wait with the N-400 until you have been a resident for 5 years.

I have a similar problem, I once was pulled over by a military police officer for speeding on base. I only got a warning which I had to give to my husband and he and gave it to his commander. Nothing ever happened after that, it was only a warning.

So, on the application, would I just write "1. speeding citation 2. when 3. where 4. warning- no charges filed" ??

I don't even have that ticket anymore...

It never really made sense to me to buy a ticket in your maiden name since your greencard and all your other documents are in your married name.
Sure, the passport is the main travel document, but even if I showed my marriage certificate..that is signed in my maiden name, so how does that link to my new married name? Just the fact that my husband signed there with his (and now as well mine) name?

I think I will get a new passport as soon as I get my greencard.....lol

Hi all!

So I looked over the instructions to remove conditions and started filling out the I-751.

My family and I are living in Germany right now on my husbands military orders so I have some things I need to do differently I think.
I think I got everything, but I want to make sure I am on the right track, so please comment!!!

1. I still file within the 90 day window prior to my 2 year "gc anniversary"
2. The application goes to the Vermont Service Center since my last of Residence was Louisiana.
3. I need to get my fingerprints done at the nearest US embassy or US military installation and submit them with the application.
Question: Do I still need to pay the $80 biometrics fee?
4. The Instruction on the uscis website says to call the nearest embassy for instructions on the method of payment.
Can't I just submit a check or moneyorder?

5. When the uscis websites talkes about "applicant and dependents" need to submit fingerprints and passportphotos, they mean me and potential K2 children!?
(My 1 year old son is a dual citizen, so I am assuming he does not need to have pictures taken?)
6. Part 5 asks about the immigration status of the children. Should I put "U.S. Citizen/dual citizen" in that field?

Thanks for taking the time to help me out here! It's been so long since I had to deal with this stuff, I am a little out of the loop.....

I'd say, if you are in doubt that you have enough other proof of having a valid marriage, I'd go ahead and add your wife to your excisting accounts.
That's what we did, we didn't open any new accounts, I just got added to my husbands.
It's not a big deal and can give you some peace of mind to have more "proof".

I did that too. Chose the option that I have changed my address and then they connected me to a live person. I then just told them I was not changing my address but had some other questions and that was fine. It's really weird that it has to be so difficult to speak to a live person!!! I was surprised there wasn't an option to do so in the main menu.


Hehe, it wouldn't be good old USCIS if something was easy and made sense...LOL

@v333k: We've been in Germany since June 2008, so I can't see a connection between the EAD update, expiration, anything. Just strange but yeah, I am not worried about it.
I just hope everything goes smoothly with the ROC since I really don't want to go to an interview while I'm here...and we are returning to the US in June of 2011 and I am hoping to have the GC by then.
Will they send another extension letter in case they haven't made a decision yet? How does that work? Can't really go to a local office for a stamp...


@candelari: Yeah, I tried that before I got the NOA but the copy of the check was so bad, I wasn't able to decipher anything on it.

It was last updated on the 23rd, the day after they sent my NOA.

I never checked on my other cases, AOS, EAD, AP, but when I checked today, I had a really strange case update for my EAD. Not just a touch, an actual change.

Does anyone know what this here means:


Post-Decision Activity
On February 26, 2007, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

The change was on Jan 9, 2010, almost a month before I filed ROC and about 3 years after my EAD was approved.
Does that look familiar to anyone???
( I am not worried about it, just curious.)

I recieved my NOA1 today and as I was reading, the application number on it won't be working to check your status online, that I'd have to wait for the biometrics letter.
Since I am filing from overseas, I won't get such letter. I already submitted my fingerprints and my photos.

Does anyone know how I can find out my case number? Call with my A# and hope someone will be able to help me?
Use my old case number from filing for AOS when they are asking for a number until I can explain what I am calling for?

Any ideas or experiences from people in a similar situation?

Hi all, I am a little confused here. I filed for ROC on 2/2/10 and my NOA is dated 2/22.
On friday i got another NOA with date of 2/16. It looks entirely different, different paper, different wording, it looks even like it's been typed with an old typewriter.
Also, on the sencond one they put my german mailing address down but then send it to our military PO box.
The EAC# is different but on the first one it said it's the application number and on the new one it says it's a receipt number.

What should I make out of this? Is the receipt number usually on the biometrics appointment letter and they send me this instead?

I read that, that's why I would say forget about removing conditions and start over.
The only evidence I'd say you should have is for the abuse you had to deal with in case that comes up later on.

Wouldn't it be the easiest for you to marry in Europe? Denmark maybe where the marriage will be legal in Gemany AND the US?
Then you do DCF and get your GC approval before you even return to the US.
If you try to enter on VWP and they smell "wedding", you might be in trouble, but even if that flies, you'd have to still do AOS in the States which is a much lengthier process than DCF.
