You are required to have scheduled a visa appointment with USEM. You will be required to present your appointment letter sent by the National Visa Center or an e-mail confirmation from the Visa Information and Appointment Service or you may print off a copy of your appointment confirmation page after you have scheduled your appointment online to begin your medical exam.

 

You have the appointment confirmation page so you are good to go.

If you send the ROM application to the LA Phil Consulate, it will take 3-4 months before it is registered with NSO in the Phil. Does that allow enough time for you? If not then you should visit the consul their in LA if possible to complete this in person, otherwise attend an outreach in your area. You have to make your passport changes in person (either at an outreach or at the Phil consul) but the ROM can be completed by mail. See the website and follow their instructions.

Then, I think it is best that we wait till after AOS to do the name change. We received the endorsement back from the PI Embassy in DC for ROM. But, we have not completed the AOS and such so I think we will not attend the outreach to change her passport till all is complete and she has received her GC. Then, change the passport as the passport will not be needed, unless of course there is an emergency whereas she needs to return to PI. Thanks Hank_

Aren't you required to have your passport for your AOS interview. If the passport is being renewed/name change and sent off to Manila then what will she have for identity?  I'm asking because we will go to an outreach to have her passport changed but she has no other id for AOS interview, driver license and other entities who require identification while the passport is in Manila for 4-6 weeks.

Just like with the NOA2, there is some degree of randomness to this, but luckily this one is measured in days, not weeks.  The average seems to be 5 days,but it can be as little as 2 days and as much as 3 weeks..

 

The good news is that unlike with the NOA2, you don't have to sit down and shut up.  You can track it this time, first on the CEAC website until it goes out the USEM door, and then on the 2Go website.

That's not unusual. They are moving your case to another processing center to "lighten the load" at the current center.  Ours did the same and there were no delays. Actually it sped up the process a little.

My friend went to for her interview last May 2nd, 2014. They CO says it's approved and wait for 2 or 5 working days. It supposed to be the day for her to ended up her waiting. But when she check her Visa online, it says "Administered Processing"

She's worried what to do. His Fiance is a retired and did submit 1099 for his Tax Return. Is there anything to worry about?
Usually who are these people receives this type of Visa Status?
And for how long it will takes?
Does this always happened?

I will appreciate all the advises.






 

What your friend is experiencing is normal. No on can can tell when she will get her visa. Everyone is different. You have to have patience. Calling the embassy this earlier will not change their status.

 

Just relax take a deep breath and be patient. They are almost there.

As an adult you will complete an x-ray for TB. Your child will have the skin test. Remember the skin test takes three days to complete so don't plan on a Thurs. or Friday exam as you will not be able to complete the skin test and you will be required to return thus extending your testing.

 

There is no exemption or getting around the test.

 

If you feel that you are clear then you possibly will pass the test with no concern. Relax.... you will do find.

If they kept your passport and you hand no problems during your interview that would cause them to generate a 221(g) (a letter that would indicate they need more information) then yes you are approved.

 

BUT, don't buy your airline ticket just yet till you have your visa in hand thus avoiding the changing of ticket dates and flights which can cost you $$$$. greensmilies-017.gif

A number of us here on VJ attended the interview with our Filipino fiancés and found the experience to be very enlightening. The benefit was the number of questions that were asked went down significantly by us being present at the interview.  For my personal experience, the CO thanked me and stated that he appreciated that I was there. He then asked me to have a seat and if needed he would call me up. The interview lasted less then 5 min. tops. But the answer is YES you will need your visa and passport with your CFO certificate to get your CFO sticker applied. You can use any CFO location; Cebu, Manila or NIAI airport to have your CFO sticker applied to your passport.

You can do CFO before or after receiving your visa, you choice.  Doing it before you have to go back once you have the visa to get the CFO sticker affixed, doing it after it is all done in one day.

If you get in and complete your CFO session prior to May 15th you will not need your visa. After May 15th a new registration system is in placed and you are required to provide your passport and visa number in order to complete the registration process that is required online.

 

So it's up to you Before or After May 15th will effect your process.

Remember, NO CRIMINAL RECORD and NO CASE PENDING could mean you are in the NBI's database for a past offense, minor as it may be.

If your form says something like NO RECORD ON FILE or NO DEROGATORY RECORD then you have nothing to worry about. Present that clearance to the CO at your USEM interview.

 

The Green NBI is the document needed for your interview.

The OP is no longer participating in the discussion. I hope they are doing their research as they will find that the consensus is to contact USEM and determine what the necessary steps are. It would be a waste of time and money if they choose the wrong avenue to travel down.

 

@PhiLandShiR I agree with you. I have read over and over and have talked to others in the same "boat" as the OP and they were able to prove the correct linage of their baby/child by DNA.

Will try to find a site to explain it better but it would require testing of a lot of people and very specific testing (read very expensive) for DNA to prove the child is her biological child and not her sister or half-sister (assume grandma might of had an affair).

 

 

That's why we are recommending that she contact the Embassy to determine what is an acceptable test to prove that the daughter is her bio-daughter. Nothing more and nothing less.

 

Hank has done some research which is a good starting. The common thread here is that they first should contact the Embassy and determine if a DNA testing is viable to appeal their case. If it is, is there a certain test that must be completed. What are the instructions and steps they must follow. To do this on their own with a second I-130 can cause them extra time and expense if they fail to provide the correct testing and do it on their controls. Again, anything can be documented if you have the right amount of money in the Phil so contact the Embassy and follow their instructions to the letter. That is the majority of the groups recommendation. If you see it different please explain.

2025.gif Can I suggest that you take a minute and think what it feels like to walk in the USCIS/USEM shoes.  They see cases, upon cases similar to yours that are fraudulent. So they review yours and you have the same documents and "story" as the others. But yours (according to you, and I am not doubting you but follow me on this) maybe is legit. 

 

Keep in mind that many before you have tired and failed because theirs was fraudulent. I'll give you a personal experience.  I was with my wife during her interview at USEM. I could hear the CO questioning a applicant for a visa at another window. The CO was asking where the proof was that the boy was biologically hers [younger sister] and not her older sister who was petitioning them together.  The CO saw right through what they were trying to pass over the CO. The older sister petitioned the younger sister and her own bio son [bio son of the older sister], but the younger sister had to convince the CO that the "son" was hers. The CO saw straight through the scam and disapproved the visa. In fact the sister and the "son" will not be eligible for a visa for years if not at all, because they lied about the relationship.

 

Any document can be "bought" for any amount of money in the Philippines. That's the elephant in the room. And the CO knows this hence the dismissal of your claim.  2028.gif

 

IMHO, I would contact the Embassy and appeal the petition. Ask what is needed and provide the document or test (which I think will be the DNA test). The DNA test will show a closer match to you then to your mother hence this should be enough to satisfy the CO.

 

Your test MUST be completed with an authorized DNA testing center or USEM will not except your DNA results putting you back to square one. So ask USEM for a list of qualified DNA testing centers. (I gave you one that was located in the USA but it's your choice)

 

Starting a new I-130 only puts you into the financial roller coaster that you want to avoid if I understand your original post. Why pay extra when the USEM states that you can appeal their original findings at NO CHARGE. Am I missing something here!!!!  You want to do this cheap but you are starting from the beginning and enduring the extra expense. 2020.gif

It?s unusual to get a letter from USEM declining your visa application without an explanation. The only thing that I can gather from what you have said is that you must prove that your daughter is your biological daughter and with DNA testing you will be able to do that. I'm thinking  that when a BC is recorded a year or more after birth, a DNA test will be required almost 100% of the time.

 

A friend of mine went through the process for a CRBA for a child and I thought I would share the steps he took thinking that this might be a good step in the right direction for you. Of course, the good news this procedure you can do on your own and not involve a lawyer, thus saving you some costs.

 

It begins:  The US Embassy ACS Section via email sent us the procedures on what we needed to do and a copy of the memo from the Examiner indicating that we needed DNA Testing.  They also provided a list of AABB Labs Accredited International DNA Center in the US that we can contact.

 

On 20 Oct 2013 we contacted DDC DNA Diagnostic Center Baltimore MD for Paternity Testing at http://local.dnacent...ltimore MD.html and the cost for the DNA Kit was $449.  It includes three DNA Kits, cost of shipping and handling both ways (kit from USA to USEM Phil and samples from Phil SLEC back to USA DDC DNA and results to USEM from DDC DNA) and processing fee for the DNA Result.

 

On 25 Oct 2013 the US Embassy ACS Section received the DNA Kits from DDC DNA Diagnostic Center Baltimore MD.  According to the instruction memo from the ACS Section once they receive the DNA Kits they will contact St Luke?s Extension Clinic and set-up an appointment.

 

On 11 November 2013 we got an email from St Luke?s Extension Clinic indicating that our appointment was set for 5 December 2013 at 10:30AM and another appointment on the same day at US Embassy ACS Section at 12:30PM.

 

On 5 December 2013 at 10:30AM we went to St Luke?s Extension Clinic to register and pay the fee of 1,500.00 peso.  You can go there earlier which we did at 9:30AM instead of 10:30AM since it is just for registration and payment.  First you will proceed to the 4th floor and register.  Once you are done on the 4th floor you will proceed to the 5th floor and pay the fee then back to the 1st floor to fill out some forms, get digital photo and finger printed for their files.  Then you will proceed back to the 4th floor for final instructions for you next appointment at the US Embassy ACS Section.  We had to bring the following:

 

·         Your US passport or valid ID

·         Child?s NSO certified birth certificate (original or photocopy)

·         Mother?s passport or valid government ID

·         Drinking water for child if 3 years old and below

·         Two pieces 2x2 photos each with white background, if you have not yet submitted photos at the embassy at the time of your application

 

On 5 December 2013 we proceeded to the US Embassy for our second appointment.  The actual DNA collection took place at the US Embassy, 2nd floor Cubicle 13 or 14 at our appointment time at 12:30PM but we had to be there 15 minutes prior by 12:15PM.  Once we were there the lady that will do the DNA testing gave all three of us a plastic cup and told us to go to the CR and gaggle five times before the test.  It took us 45 minutes to complete the DNA Testing.

 

Now just waiting for the final results.

 

This was their experience. IMHO, I would start with USEM and determine the cause for declining your application. If you determine that it was the lack of proof that she is your biological daughter then I would request the DNA test be conducted and if USEM would be satisfied with the results to continue your application processing.

Have you tried calling the call center? They can schedule appointments.

 

The call center sees the same schedule as the website that the OP is looking at. So, they are not going to be able to help. They're going to need to have more patience.

We all can understand your frustration, but the Embassy is processing thousands of applications and doing their best. With the added burden of the "fast track" Yolanda applicants it has set the system in a tizzy. This is where you will have to dig deep into your patience as things will not change till most of the Yolanda applicants are processed.

Yes, your right by going in person if you have the time and money. You will be able to get answers "straight from the horses mouth" and respond accordingly. Should cut down your turn around time to receive the COC.

From what I have read she would be able to get a police clearance. You can email any inquiries you may have to the Singapore Police at SPF_CID_COC@spf.gov.sg. Plan on allowing 60 to 90 days for your request to be processed. I have heard less time but be on the safe side and start early.

The one place I don't want to see Candy wait in line is at the medical.  Since they only take cash, each lady has at least $225 in her pocket.  A robber going up and down the line can get a year's salary for the average Filipino in one morning.

 

It escapes any sensible reasoning why they don't take credit cards online for that.  I would have paid it by now with my credit card if that were the case.  They get paid sooner, our fiances are safer, and I sleep better.  Everyone wins except the robbers.

And what if it takes 2 months to get an appointment, whereas you can now get your CFO the day after your visa is issued as long as you are willing to stand in line?  How is that an improvement?

 

:o Oh, who says you won't get an appointment after the visa is issued?  There is no guarantee under either system you will be able to get and appointment after your visa is issued on "the next day".  If you see in my post I said that "it can hinder some individuals" meaning exactly what you said. But I go on to say that there are more positives then negatives. I like my cup to be half full.

 

I can only deduct from the experience with the new system that some things will change and others will stay the same.

 

No more waiting outside at all hours of the morning to get what little seat inventory is available. I like the fact from a safety standpoint that our fiancé's will not be out in the early morning hours putting them possibly in harms way.

 

Requiring the issuance of a valid visa will eliminate those who are denied and had attended the CFO from taking an appt. that someone else who did get approved.

 

I can only imagine that if appointments on line are made and there are "no shows" that inventory of seats goes unused. To prevent that from happening, they are only going to take those with approved visas.

 

I see this as a step in the right direction but I can see how having your visa in hand before taking the CFO can hinder some individuals but the enhancement of the new systems has more positives then negatives.

Yup. Stood there proud to see my fiancé and kids passing their interview. BTW, I was able to witness the Filipino interview but when it came time for the US CO's interview, I was greeted warmly. Asked if I was the petitioner (yes in response), he said that "it is always nice to have the petitioner here, but for now would you take a seat and if needed I will call you back up. I replied yes, and less than 5 min later they were walking toward me with a grin on their face.

 

Go, and be there, you will enjoy the experience.
