Mike.... Hank answered most of your concerns with references to the information that backs his answers. Take a read, it's about two or three entries back.

 

Yes you can avail yourself of the Balikbayan (See my answer on page 1) because you are married to Filipino. Just follow the instructions as put forth in my earlier reply. Yes you should not stay any longer than 5 months.

 

I'd be real careful about another trip after this one as things start to look "fishy" to USCIS for GC purposes.

 

You can get Gina's passport changed to reflect her new married name, but keep in mind that it will take 4-6 weeks to process.

  • For each child: copy of birth certificate

Philippine Law (R.A. 9174) provides benefits to baikbayans:

We have a question my VJ family may be able to help me with.
I am planning on visiting the Philippines with my Pinay wife for 5 months this Oct-Mar (currently in planning stages)
and need this question answered prior to buying the round trip tickets
 
My question is this
I am looking at round trip tickets for us both: Depart USA in Oct and Return In Mar (5 months) (Cheapo Air) Korean Airlines
We plan on her requesting a Balikbayan visa upon arrival for me to stay up to 1 year free
Will they sell me a plane ticket that does not show I am leaving Philippines before the 30 day allowance?
Or could they sell me the ticket and then deny me to board the plane at departure time?
Will I need a throw away ticket?
 
I figure 5 months will give me a very good idea if i can live there long term and at the same time not mess my wife's 10 yr green card application next year
We can apply for ROC in Aug 2015

PhilippinesGOT MY K1 VISA INTERVIEW APPOINTMENT/SCHEDULE ON AUGUST 11TH! (Schedule made today July 11, 2014)

 

I paid my appointment schedule (240$ or P10,560) thru BPI on July 8th (tuesday) @10am then my payment appeared online(https://cgifederal.secure.force.com) by 6pm of the same day(contrary to the said 4-6 hr clearing time), called US Embassy right away for interview appointment, but no available slots yet. 

 

Started to monitor online for available schedule every chance i get starting tuesday(july8) til yesterday (july10) i got restless and googled topics about k1visa appointment unavailability and got surprised a lot of people are experiencing the same difficulty i have. 

 

Then i read the threads related to my problem, read thru every post i see then ended up downloading the Check4change (my first time to hear about this fancy application) on my macbook. I applied it on the Dashboard page i want to refresh every second to not miss any slots. It was already 4am (july11) and my macbook is on 4% battery plus i got sleepy so decided to just sleep away.

 

When i woke up i talked to my fiancé about this strange stuff im doing (check4change), and somehow i mentioned that ive read threads that they had their medical exam first even w/o appointment schedule. 

We were like is that possible? So to address our curiosity he said go and call the embassy right now (10am,july11,today) to ask if u can get the medical exam w/o appointments.

 

So i called the Embassy (02-982-5555) and talked to an agent (the same person i talked to last july 8th when she said that there was no sched available yet) and before even telling my main concern if i can have a medical first w/o appointment she quickly mentioned the available schedule is on AUGUST 11, 7:30am, i was surprised and i was like oh, okay, im picking that one. :))

 

So she sent me an email right away regarding the appointment page i have to print and bring to St.Luke's 2weeks before my interview date.

 

Then i asked 'Is it possible to have medical exam even w/o appointment?' She answered 'Yes in some cases that's possible but we dont encourage it since the medical exam result has an expiration date and you need to be sure about your interview schedule date'. 

 

So my question was answered with a surprise bonus of Appointment Schedule! :)))

 

I wanted to make the story short however there may be a lot of fellow k1 visa applicants out there being in the same boat. 

 

A very quick shoutout to all who created threads/topics like this one, theres many of you i cant name you all guys but its just so nice to have these people make an effort to help others who are hungry for information that none of some websites can answer. 

 

Conclusion:

Its best to be proactive than to pass time and wait for your chance that other's might have been getting away from you.

Congratulations your doing a good job by being proactive. Read the threads with the topics of interest to you. There is a wealth of information to help in your journey. From the main page of the Philippines Threads you can search for those topics you are interested in. There are guides to help you along the way. One of the best guides out there is the one Hank has on his website. It takes you through the process step by step. Look for Hank's name and snoopy camper, scroll to the bottom of his post and follow the handy dandy world wide famous flashing red arrow.

 

BTW you don't have to call the Embassy as everything you need is online including interview dates, medical, CFO, NSO, NBI etc.

Well this comes down to "a bird in the hand is worth two in the bush"!  Many have outlined your pitfalls so far, luck, two cancels before having to start over, missing a date you wanted but having cancelled the one you had.... on and on. No one can predict what will happen in the future for scheduling. From what we have seen these two past weeks it looks like maybe the "expedites" have gone through the system and things are beginning to return to "what is normal". Too early to tell.

Yes you can start the K1 now but keep in mind you will need the MC annotated and the updated CENOMAR for the interview.  This is exactly how we started our process. The annotated MC took about 30 days from NSO. Good luck.

she can fly through any international destinations including Hong Kong, Japan, China and then onward. Be careful of the layovers as that can add a lot of extra time to her itinerary. I've seen 36+ hours traveling through China to arrive east coast USA when taking a flight through Japan can be 24-26 hours.

Many of us were trying to tell you as well as others, and might I add from our experience, that two weeks is not a long time. And for you, it was "T-14" your measurement not mine.

 

Yes you have a lot going on in your life health wise, and I'm sure having Candy there with you would ease your anxiety.

 

Let me share something with you. I lost my previous wife to breast cancer in 2005. I had three children ages 12 and twin girls at 9 years old to raise and support on one income by myself after she passed. I never took the "whoa is me" attitude. I did what had to be done to raise my children to adulthood. I never complained.  Then in 2009 I had prostate cancer that was around the time that I met my lovely Filipino fiancé and we began our journey. Would having her here during my sickness have helped.... Hell Yes! BUT it was not going to happen. So realistically I did what had to be done to insure that I was well for when she did arrive.

 

The best thing she told me in the beginning of our journey was that I will need more patience then I have ever mustered in my life. You know, she was right. It was those words that got me and "us" through the trials and tribulations for our journey.  There were times that I wanted to throw the towel in. Trips and trips to this agency and to that government agency and not understanding the "culture" of why it couldn't be done the American way. NOW.  Thousands of dollars were spent to ensure in the end she and her children would be next to me and my children. I can tell you that it took 5 years to get her visa and I am proud of her accomplishments, because in the end she was the one who had to endure the 3 hour non air conditioned bus rides, the ferry rides late at night, flights back and forth and the continued disappointment when she needed to return again because it would take "weeks" to complete the documents.

 

Our journey included one K1 and two K2's to the USA. It was hard. But you know, its like eating an elephant; one bite at a time. So two weeks waiting from interview to visa in hand was a cake walk. Many of us who comment on the forums do not paint a panacea for the questioner. We play it straight and sometimes the OP does not want to hear the answer. We know from experience or the experiences of others that that answer is what is going to make their experience easier and will ensure a positive result. 

 

Many of us see others here who are struggling with the visa process. We spend countless hours helping and communicating and encouraging that the path they're on is worth ever step of the way. We research many hours to help those requesting help. What you say will not deter my desire nor theirs to help others reach their goal. I'm sorry but mine is a "Can Do" attitude and therefor it's hard not to comment when I meet a complainer. 

 

If you have seen the many posts that apple21, Sweet Cakes or Hank post, they are there to help. Many times their posts go unappreciated, but there are those times that one will get a thank you or praise. I have the greatest respect for Hank and so do hundreds that he has helped. You can see the outpouring in the "thank you Hank" posts.  There are others that I have not mentioned but believe me they are hard at work to help anyone who ask for help.

 

You didn't go to Candy's interview, if you had, you would have seen your "Country" at it's best. There are thousands there (at the USEM) trying to reach their dream and the people who work there are trying to do the best for our Country and for the individual, it's truly is a thankless job. I wish I could go back in the Embassy and meet with the Filipino CO and the American CO for our case and tell them that I appreciate all that they do.

 

You know, you and I could sit down and have a beer together and we probably see eye to eye on many subjects. But this one we do not.  I hope you see we both have our own road to hoe; but brother, maybe the pain and the journey will become easier if we work together.

Just got ISSUED today.  To answer your original question of how long did it take:  2 weeks.

 

Congratulations.

 

Now tell me, and I believe that most of us told you to stop ranting because the process can take any amount of time but for you it was normal processing of two weeks, just two little measely weeks, and you got yourself so worked up all about nothing.

What good is this information. Everyone is different and no two visa processes are the same. This would be referred to as "flawed data" if you were taking a statistical class.

 

So tell me, why is it so good if in the end the information is not useful to the OP?

Hank, sweet cakes and I went through at a less stressful time so we are not what is the norm now. We have never seen it this slow but Yolanda exipiedites have slow the system to almost a crawl. Like Hank said, no one can say when the visa will be issued. Everyone is unique. That question cannot be answered definitively asking is fruitless excerise. Have patience and your turn will come.

We had a 221(g), in fact we knew that it would happen because of the circumstances to a 10 year old case that we had been working to correct early on before the interview. Two months before the interview my wife visits the NBI in Mindanao with all the supporting documents to correct her NBI. They excepted the documents and stated that the problem would be corrected in Manila. So we go through the interview and lo and behold, the problem was never corrected and the USEM required documentation from NBI, hence the 221(g) after the interview. Next day she goes to Manila NBI and inquires and finds out that her record was never updated to show the new information. On that visit she got the records update but they could not inform USEM of the corrected record till USEM requested a new NBI with explanation. So we has to wait additional two weeks for the matter to clear up. Shortly afterwards the visa was issued.

 

It's a process that can be frustrating. Keep working on clearing up your information and you will soon have your visa.

I can answer your curiosity to why a AKA is such a big deal to the Embassy. Because they want to know who is coming into this country (USA). We want good people to immigrate to the US and assimilate and contribute to this country.  We DO NOT want anyone who wants to do harm to anyone as terrorist did on 9/11. I'm with you on this topic. My wife saw me on our first shopping trip throwing out the plastic bags and said we should keep them "as you never know". Of course me, I don't reuse those bags because they seem to split or tear, always at the wrong time. So, she has saved and now we have "tons" of plastic bags.

 

You know, I thought about why she keeps these things and it goes back to her upbringing. When you have very little you find ways to reuse what you have in new ways. Us Kanos don't think that way because we often times have too much.

 

Along the same lines of this discussion she said you Americans have a gadget for everything and I replied, yes we do because we are lazy and invent things to make our lives easier. She laughed and so did I.
