You have gotten some good information from others here. The MAIN thing you need to remember is be truthful in all your answers. As milimelo stated, you will have to state the facts when filling out the DS-160 form as you have known them to be. If asked at the interview, then answer the question with the facts as you know them. If you don't know the answer to the question, it's ok to say to the CO "I do not know".

 

This is a tuff situation you find yourself in. You're trying to do the right thing to get your visa and your father has made a mistake in overstaying his visa which puts you in a situation that you may need to divulge information against him. The right thing for your father to do is to get an immigration attorney, and get his status rectified. Of course, it will look more favorable on the two of you, if the process where actually moving through the adjudication stage when you have your interview. That would be a positive thing that the CO would consider. Just my two centavos.

I haven't heard of such in postings here in last 10 months...unless I missed it. 




For the medical in the Philippines you are required not to schedule an appointment if you are having your menstrual cycle.

I guess after 10 months you may want to brush up on what the requirements are that need to be followed.

Your just starting your process and up pops the question about "how long will". A bit of advice. Nothing through this process is going to be like anyone else. Yours is unique. It will take what it takes. This is where we all started practicing patience.

 

Having said that, if you sent it with a receipt then you will probably know that they received it before you actually get the NOA 1. If you didn't send it with a receipt requirement then you are at their mercy to when they will notify you.

 

It's still early. Patience.

We can only conclude that they will ask anything and it maybe for a document or some far fetch hair brain question as you have witness recently. Just when you think you got them figured out.....

 

Anyways, you are done with CFO. I think getting the parental advice notarized was still a good move even not needed. Now onto the next land mind. Good luck.

This is for the CFO, we already completed the interview a few months ago.  I hope they don't ask for the parental consent.  We just want to have it encase they do.  She won't give it unless they ask.  We had a lot of stuff for her interview that we didn't need, but it was better to be safe than sorry.  It's been a long process for us, so we don't want some small detail to mess things up now.  She has an appointment for the CFO next week and I will be going there in a few weeks and bring her back with me.  Exciting times.

 

Here is my suggestion. Don't volunteer information that is NOT asked for. Have your documentation prepared and with you BUT wait till the interviewer ask for the document. I am not advocating lying, cheating or withholding information but be truthful with your answers but don't offer items not asked for as this can open a new discussion and possibly denials or delays.

A sworn statement by the contracting parties (you) to the effect that such advice has been sought, together with the written advice given (you say this maybe her mother if found), if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice or cannot be located, this fact shall be stated in the sworn statement.

 

Take the statement to a reputable lawyer for notarizing. Present the documents when asked for from CFO to CO at USEM. My recommendation is don't present something of your free will till asked. If never asked, don't show. It can only open a can of worms possibly.

What consulate? Your expectation should be that you will have your papers returned and a ROM complete. It will take about 10 to 15 business days to receive your endorsed and filed documents. Yes you can walk in the door and deliver your ROM form with backup documents.

The best way to find a lawyer for doing your annulment is through friends, family or befriend someone at the courthouse and ask; Is there a lawyer that does annulments that you would recommend. Does he or she have a good success rate? How much can I expect to pay for the processing and lawyer fees? Typically what can I expect as far as processing time?

The report of marriage form asks for an original or certified copy of Candy's passport and my driver's license (my passport is expired so I can't use it).  How are we supposed to get certified copies of this stuff?  What did the rest of you do for this requirement when you filed your report of marriage?
 


We didn't have to submit a DL. We filed through Wash. DC and never had to do that requirement. If it were me I'd make a copy and have it notorized.

Yes the CFO can deny a sticker. If you don't know your fiancée very well, if you don't have confidence to answer the questions. Age gaps can be a problem which will require additional questioning.  She needs to answer the questions with confidence. If she is shy they will eat her up. Look the interviewer in the eye and answer the questions straight away.  Be sure she knows your "landline" phone number (yes they ask that but how stupid as most people have given up their land lines).  Be sure she knows your mothers "maiden name". Of course she needs to know where you work, what you do etc. etc.

Is Manila the only place where the CFO seminar can be done? Not offered in other major cities? And don't you get the sticker upon completion?

 

CFO is given in Cebu and Manila only. You can get your sticker at Cebu, Manila or at NAIA Airport.

 

If you have completed your interview and you have your visa with you when you take the CFO class you can get your sticker placed in your passport on that day.

Do you medical about 1-3 weeks before your interview. The medical takes about one day, maybe two at best. We have seen the "early bird" get finished in one day but this can only be accomplished if all "your ducks are in a row". Don't schedule your exam during your menstrual cycle as you will need to return to complete the medical exam.

It is not that I shouldn't start the journey, it is more a matter of being on the hook for 10 years.  Correct me if I am wrong, I am a total newbie, but if she runs off on you, you are responsible to support her for 125% of the poverty limit.  If you get divorced, you are paying.  If she sleeps with your best friend, you are paying.  The only way you can get off the hook is when she becomes a citizen, dies, goes back to her country or gets 10 years of work credit.  That is a huge liabilty and risk.  It might not be something you have contemplated Derrick, but it exists.  You bring a foreign national to this country and sign the I 864, you have signed a contract with the federal government to support that person.  I am not talking about supporting her in terms of marriage, schooling etc.  Your fiance/wife as loving, wonderful, sexy etc.  etc. as she may be can leave you high and dry and you will be paying if she avails herself of government benefits. 
 
Now, I may be putting the cart before the horse.  I am at the very beginning stages of getting to know the filipina and planning a trip to the phils to be with her for a couple of weeks to determine our compatibilty in person.  Depending on how the visit goes will determine if I proceed with the k1 visa.  I don't care about gold digging or green card or any of that other nonsense.  If she gets a green card and works and wants a divorce, no problem.  If she runs off with another guy who has more money than me, fine.  As long as i am not paying to "drive the car" without being able to drive the car".
 
 




There is an old saying that he who has the gold makes the rules. USCIS HAS the gold. You have only one choice here, find someone and be committed to each other for better or for worse or make a different choice and do nothing.

Many here are happy with their choice.

With today's technology and most PI cities have internet cafe's, you should be able to get through this whole process without any problems. I'd suggest the following to ease that process.

 

Get a dropbox account and this will allow you to complete, provide scanned copies of official documents or update forms as you go along to your fiancée. She can go to a net café and access the DP account and print the documents you have dropped into the box from the net computer.

 

Another handy item, we used a folder with many pockets to store the documents and to keep everything organized and available if asked by government officials. You will have so many documents that thumbing through them the traditional, with them all in a stack with no rhyme or reason, will only slow you down, it adds undo pressure and of course everyone's BP goes up.

 

As Hank said, going through the interview at USEM is priceless. I accompanied my family and was thrilled to see the process. I now have a better understanding of what the employees of USEM go through from day to day which only added to my knowledge, and caused me to be more patient.

I am now going to AOS in 2 weeks after , kindly give me an idea about my question.

My K2 is still in the Philippines, she has not been interviewed nor had her medical exam, and as per the consul I have 1 year to get her. When does one year start? Is it on the day of the application or when I was approved by the consul ? Also is it ok to adjust right away without my K2? Thank you for those who will give an input and it is greatly appreciated.

Processing time of 5 months is about the average.

 

Take the time to get all you documents and to be sure they are correct; spelling, missing names, dates, places etc. Go to all the government offices and begin filing for those documents; NBI clearance, CENOMAR, birth certificate, passport etc.

 

Do it now while you have the time. Believe me when I say this.... the time will go by fast and it will be over and she will be with you here in these United States.

We stayed at the Hotel Soriente. It's not a GREAT hotel but it's also not a shabby run down place. It's clean and the people there are friendly. We enjoyed our stay because it is in walking distance to most places you need, SLEC, Embassy, shopping and dining.  We met a couple of pinays there that were going through the interview and we're able to help some to have the right documents before their next day interview. Saved them from getting 221g's.

Being and "old dog that I am" and wanting to sleep on this I agree with you Hank. Do what she needs to do here in the states to clear her name and go back home and begin her life a new. Simple solution.

Yes your right, we don't know both sides of the story. But we have no way of knowing his side so, do you just ignore the OP's question because you need both sides of the story? This forum is not a court. It's a blog of ideas and the OP asked for our "ideas" on what would be her options. That's all it is.
