This is very complicated. Two things that need to take place. First, if she is not married then the boys BC needs to be corrected. Also, the CENOMAR for the mother needs to mirror the name as it appears on the new BC. Second, when this is completed then she can get him a passport (see requirements for PP for minor).  BTW, when these names are changed/corrected on the new documents then don't forget that when you go to the NBI for the clearance it needs to have all AKA's search and appear on the NBI or USEM will issue a 221(g) for a new NBI with the changes (automatic DELAY? YES!).

 

 If minor is traveling with either parent or alone

  • Personal appearance of the mother is required if minor applicant is an illegitimate child.
  • Affidavit of Support and Consent (ASC) executed by either parent indicating the name of the traveling companion and relationship to the minor. If minor will be traveling alone, ASC must be executed by either parent, stating that his/her child will be traveling alone. If minor is illegitimate, mother should execute the ASC.
  • Original and photocopy of DSWD Clearance
    • There is no need to secure a DSWD Clearance if the minor traveling abroad has parents who are in the Foreign Service or living abroad or are immigrants, provided he / she is holding a valid pass such as a dependent?s visa / pass / identification card or permanent resident visa / pass / identification card which serves as proof that he / she is living with parents abroad.

Does it require for everybody who apply for K1 visa? Yes. It is mandatory that you attend the CFO class and pass. A sticker will be placed in your passport once you complete and are approved for your visa. If you took the CFO class prior to the visa being issued, you will need to return to have the sticker placed inside the passport.  If you take the CFO after the visa, have your CFO sticker applied upon completion of the class. You will need your passport with visa inside.

When does it usually conducted? It is conducted M-F except Philippine and American holidays.

 

Can I complete the seminar while waiting for interview schedule?  You are required to show that you have a interview scheduled prior to taking the CFO. When you register and schedule your interview you are then allowed to attend the CFO seminar.

Some have gotten theirs in 7 to 10 business days. Others 2 to 3 months and more. So, your question is difficult to answer how long yours will take.

The US civil wedding, which is legal, will be the legal date of marriage for any document for now and the future.

 

The "ceremony" in the Philippines is just what it is "a ceremony" that you are sharing with friends and family in celebration of your marriage union that took place in the USA (civil wedding). The "civil wedding" is the one that you report to NSO via the consulate here in the USA that has jurisdiction where your wedding took place. 

 

When you go to the Philippines you cannot get a marriage license (because you will have to declare that you are single, which you are not so you are perpetrating fraud) in the Philippines and re-do what is already been consummated prior in the USA.

 

So plan the "church ceremony" and invite all your guests and have fun.

Here are the instructions for the Los Angles Philippine Consulate on the procedures for shipping remains to the Philippines.  If you have any additional questions, it would be best to contact the nearest Consulate to you.  This is a nice favor your doing for your friend. I won't be applying for I-131. So, it's not in there. Hope you guys can help me out. Also, is it better to send the packet via a courier like UPS or FedEx than USPS? Either of those methods is fine BUT be sure you can track the package. 

 

Why would you not file for the I-131? After all it's at no cost to you. Imagine if something happened at home while you are waiting for the approval of your AOS, and you need to be on a plane heading there, your not going to be able to travel without it.

 

Do either of you have a prior marriage as the Dissolution Decree from a prior marriage needs to be added to this package.

Maybe we are missing something. What exactly is your computer; is it a PC or Laptop? We know the weight but what are the dimensions, how many pieces. This will help us understand just what we are dealing with. Are you traveling alone or can someone help share in carrying a piece or two with their carryon. Pack a piece in your luggage and the main component in your carry on (if it will fit).

 

You got to think outside the box. Check out the airlines website for weight restrictions to determine if it can travel with you.

Going to be there a few day due to Visa Interview next month,  I am not very familiar with any area in and around Manila.  Just looking for some things to do.
 
Last time I took a van to see a natural spring, and they took me to hotel swimming pool and told me the water was from a spring, not what I was looking for.
 
I will be staying in Ermita area the first few days.  I am looking for day trips to check out waterfall, natural springs, or other cool places.
 
Nightlife I am a big fan of Cowboys Grill in Ermita, been to Paddi's Point it was ok.

They sent me a letter stating there were unable to complete my visa process unless i provide nbi with a.k.a something like that. I tracked my case number using the ceac state and it says A/P


You need to act fast so visit NBI with your 221(g) and process a new NBI with all the names you have ever used. Then submit the new NBI to USEM according to the instructions contained in the 221(g).

This is normal to receive a 221(g) on an NBI AKA. For those who are reading this for the first time, the rule of thumb is to have ALL your names that you have EVER been associated with (including but not limited to nicknames, married names, single names or names that have been changed do to misspellings) checked when do your NBI or you will be delayed.

 

Follow the instructions and submit a new NBI ASAP and you will be fine. If they have kept your passport and you submit the requested documents then you will be approved in a few weeks time baring any problems in the AP review. Usually this is just a hiccup.

There is a back log on passports because a major system breakdown. It's back up and they are working hard to get the back log caught up. I answered your other thread with the same answer. Sorry, yes I did get the two mixed up. It is one year and nine months to file for permanent residency (10 year Green Card).

 

"A conditional permanent resident receives a green card valid for 2 years. In order to remain a permanent resident, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The conditions must be removed or you will lose your permanent resident status."

To piggy back on Hanks statement that your GC expires and you need to adjust to permanent 10 year card. The paperwork needs to be submitted 90 days before meeting the residency requirement which is 3 years. So at 2 years and 9 months you would submit your paperwork for the 10 GC.

SLEC has the best update and current equipment to complete the necessary X-rays that the Doctors will be able to ascertain whether there is TB or not and or if the Sputum test is needed. This is the mandated procedure and equipment that SLEC must use as required by USEM. There just is no way of getting around SLEC's procedures.

She went in Nov 2013 and was told to come back, she had to return home because of the plane tickets being unable to be refunded or changed because they were on promo. She returned in Feb 2014 for the sputum, they contacted her to come for the results in Apr  2014. She tested positive for TB, but not her son. We were finally able to get her to Manila so she can go to St Lukes to start the treatment for TB. The time I am refering to is the window for us to get her past this and finish the visa process.
 

 

Based on the whole story I have to agree with Hank. Contact the Embassy to see what your options are.

Who required that treatment to be started? SLEC?

 

When did they examined her and what tests did she fail?

Your interview date will be extended once TB treatment is complete if that is "the treatment". SLEC will inform USEM and make the interview date.

Muslim Divorces are adjudicated per Sharia Law. Most are in the Mindanao area of the Philippines naturally because that is where most of the Muslim communities are. You are correct outside of Sharia Law the Philippines does not have a divorce process. They are the only remaining country who does not have a divorces system.

Yes you can start your I-129f without the NSO copy. You will need the NSO copy for the interview and since it's taking about 90 days for NVC approval you should have no problems. It's what we did for our process and we had no problems.

 

I would like to give you an outline what is needed to complete the registration of your annulment with all Phil governmental agencies to insure you have smooth sailing in getting the proper documents for your interview and avoiding 221(g)'s.

 

Once you attain the divorce/annulment (this procedure is for either or) you will need the decision of the divorce (works also for an annulment), entry of judgment, then the decree of divorce (annulment). Then you?ll need to secure copy of the marriage contract with the divorce (annulment) annotated on it. A total of four documents. You?ll need to wait 20 days from receipt of the Solicitor General of copy of the decision before you can secure the Entry of Judgment. After securing the Entry of Judgment, you will have to register the same to the Local Civil Registrar where the marriage took place or Filipino?s hometown. The said office will transmit the same to the NSO. You will show the Court what date the LCR transmitted the documents to the NSO. With the proof of receipt of the NSO, the Court will then issue the Decree of Divorce (Annulment). After 15 days from receipt of the NSO of your documents, you can now request a copy of the marriage contract with the annotated divorce (annulment) proceedings. You need to request at least 4 certified copies for future use.

A Muslim Divorce is acceptable and is recognized by both the Phil and USEM as long as your paperwork is in order. Muslim laws of the Philippines supersede the Civil Code of the Philippines.

I agree with Hank..... CR1 is the best route to go. If the child is yours, then once born, then you can get a US passport and a Filipino passport and he/she has all the rights as an American and Filipino.

Congratulations and yes, maybe just a little early.

 

MNL # is one of the numbers to try with 2GO for tracking, along with the UID and passport number, never know which one will work with 2GO

USEM will send an official request to NSO for the documents that you need. NSO will comply with the request and USEM will pick them up on Fridays for all the requests from earlier in the week (yours and others). Come Monday they will begin processing and matching the "new" documents to your file. Once that step is completed, then your file is sent onto the CO for their review. If they are satisfied then they will approve your visa. Then the visa is processed. About two weeks you will begin to see updates on ceac for your visa. Once it goes to ISSUED then you should see it in about 5 to 10 business days. Remember, these are normal processing times and process's and your actual experience may be different. By all means don't buy plane tickets till you have the visa in your hands!!!!!!

This is a problem for many others. Some CO's are lenient when it comes to China. They know the hoops you have to jump through. Having said that, It is only my opinion that you should try the following. Document every effort in writing where available and have it for the interview.

 

1. Ask your student go to the police station in person and ask your question. When turned down, ask for a document declaring exactly what they said.

2. Go to the China Embassy there in Manila and inquire about getting the police clearance explaining your difficulty in getting one because you have been told you need to appear in person, at this time you do not have a visa that will allow you to return to china.

3. How about the employer that hired you for your position in China. A lot of the times they can help. Again, document your request to the employer and their response. Keep in mind sometimes if you write, they will need to respond with a return answer and now you have your document. Email works to.  

4. Copies of emails, telephone logs, lists of whom you contacted and their response.... As well as (limited) proof of your residence (e.g. copies of your visas, any local IDs, addresses for residence and employer... etc. would come in handy with the interview.

5. Are there any agencies that do this type of work for China that can help. I think you mentioned one.
