The only issue that throws a monkey wrench into people's plans is the TB testing. TB is pretty common in the PI so naturally it's going to have a large effect on those from the PI who are doing their medical. If you are physically healthy and no issues then you will pass without a problem. The majority of the individuals will pass their SLEC medical you included possibly.

There is not much you can do when a system blows up in your face as this one has done to you. I'm always amazed at a system that adds days and days of extra expense to the applicant, when all of the procedures can and should be done on one visit which I think is shown clearly by your situation.

 

We had a problem with the NBI and it could have been resolved the day after the interview when my wife visited NBI with the necessary documents to clear the issue, but they said they couldn't do anything till they receive the 221(g) letter from USEM. A week later she has to get back on a plane and return in person with the documents to clear her name, the same documents she tried to present previously. $$$$$$!  To add insult to injury, she had traveled to a NBI office in Mindanao just two months prior to her interview to have this resolved and after presenting the same documents, was told they will forward to Manila NBI for inclusion into her file. Case closed we thought. Haaaa. 

 

Having said that, from your experience, this should be a lesson learned for others to do their medical at least 2-3 weeks if you have K2's because you can never predict what will happen during their medical processing. K1`s one to two weeks should be fine. Remember, like Hank said, they batch the cases up and send over to the embassy for matching with your other records prior to the interview which can add time and miss your interview causing yet another delay.

If you miss that opportunity and show up for the interview and your SLEC results are not available then you will be delayed. Your timeline of 2-3 weeks prior is a good plan, hence plenty of time for your SLEC results to reach USEM.

Again, we must speak up or things will never change.

The medical is used for two milestones. The visa uses the medical exam date as the starting point to your six months validity of the visa which marks the time that you need to land in USA. That same medical date is used also for the AOS and therefor, the AOS needs to be completed in one year from date of the exam. One exam for two different processes.

You have to enter the US with 6 months remaining on your passport. This is simple. Count back from July 26, 2015 and you will have your last day to enter the US on a valid passport.  Here, I did the math for you. January 24, 2015 is the last day.

Yes. If they kept your passport and didn't say that you were disapproved then yes you are approved and you should start checking the CEAC website and see Hanks red arrow and follow his instructions. Don't don't make any plans as far as airlines until you get your visa in your hands . It could take you 5 to 10 business days to get your visa.

When you have your interview with the psychologist and CO/USEM, IMHO you should tell them the truth. Be honest and forthright with your information. Show them your confidence and your truthfulness, and what you did was just a one time event, which has never been repeated. Having "experimented" in college some 10 years ago should not have a large baring on your case. I would think they would look at this for what it is, a young girl (you could be a male also, but your profile does not state your gender) "trying" something through curiosity and that she is not a drug seller or drug mule looking for a visa to substantiate her "habit".

 

Be honest in all your answers. Be sure to look the interviewer in the eyes when you answer as that will have a great baring on the outcome of the interview.

Please stop telling people to "lie" about their drug use as it could have more consequences then following the normal path as laid out by USEM/US State Dept. in their requirements to legally attain immigration.

PhilippinesRecent Passport Renewals in Tacloban....time to receive?

Dear Fellow VJ members,

 

Has anyone renewed their visa in Tacloban recently?  They state that it will take 35 days to receive it, as there is no expedited delivery service available at this time.  We are (thankfully) one of the very fortunate ones experiencing very rapid approval and processing at USCIS and NVC.  We never expected that waiting for the passport would be the thing keeping us from moving forward!  Not a major worry, but we would be interested in knowing how long it has taken others to receive their passports from Tacloban.

No one can give you a definitive answer as each case is different. If you were told it takes approx. 35 days, then that would be your starting timeline goal. This is a process and getting documents together as earliest as possible will help smooth the bumps in the road toward your visa.

The marriage of a Filipino should be reported to and registered with the Philippine National Statistics Office through the Embassy/Consulate General having jurisdiction over the locality where the marriage event took place.  Please check the Consulate Finder or the Consulates Link for the states covered by the Embassy/Consulates General in the U.S.

If do the ROM then you can change her passport then you're eligible for the Balikbayan Visa. Those issued a Balikbayan Visa are given a one year stay in the Philippines.  There are no charges or extensions necessary to stay up to one year.  Should you wish to stay longer than one year in the Philippines and are issued a Balikbayan Visa upon entry, you may stay on the Balikbayan Visa for a full year, then report to the Bureau of Immigration (BI) and convert your Balikbayan Visa to a Tourist Visa, at which time you can stay up to a maximum of 24 additional months following the rules and regulations imposed on a tourist visa holder in the Philippines.

It's really not an interview. All they will do is collect your fingerprints and take your photo. That's it. I went with my wife and children to their bio and was asked to sit in another room. When they finished, about 30 min. later, we left the building and I had no conversation with any authority except the guard at the entrance. So your husband would have no interview or conversation other than with the guard when he enters the building.

Hi every one! I just got married last month gladly with my fiancée. I am from Philippines and was approved to come visit my fiancée in US as K1 visa. So after getting married we filed my I-485 and I-131 and EAD. Now our problem is my Philippine passport will expire this October 2014. And we're clueless if I need to renew it in my country? We'll we are still looking on what the next move should we do.

We are going through the same thing now. We are changing my Wife's passport to her married name. Since there is an outreach in North Carolina toward the middle of the month we decided to go ahead and do a ROM (report of marriage) and name change on the passport. This saves a trip to the Embassy as that is the closes and serves our area.

Thank you for the responses.Sorry for getting back to this thread so late. My fiancee did get a CENOMAR. She has not been married. The explanation given was that her sisters put a month, year and city of marriage  on the birth certificate because the son would not have been able to have the father's surname otherwise. 

 

The child is in his last  year of high school and will be going to collage next year , he will not be coming to the US with her anytime soon. Maybe never.

 

 

 

The child will age out at 21 years old so if the mother wants him to join her then she should be sure he is in the USA before then otherwise it will take many years of waiting in line for a slot to become available for him to immigrate.

This is very complicated. Two things that need to take place. First, if she is not married then the boys BC needs to be corrected. Also, the CENOMAR for the mother needs to mirror the name as it appears on the new BC. Second, when this is completed then she can get him a passport (see requirements for PP for minor).  BTW, when these names are changed/corrected on the new documents then don't forget that when you go to the NBI for the clearance it needs to have all AKA's search and appear on the NBI or USEM will issue a 221(g) for a new NBI with the changes (automatic DELAY? YES!).

 

 If minor is traveling with either parent or alone

  • Personal appearance of the mother is required if minor applicant is an illegitimate child.
  • Affidavit of Support and Consent (ASC) executed by either parent indicating the name of the traveling companion and relationship to the minor. If minor will be traveling alone, ASC must be executed by either parent, stating that his/her child will be traveling alone. If minor is illegitimate, mother should execute the ASC.
  • Original and photocopy of DSWD Clearance
    • There is no need to secure a DSWD Clearance if the minor traveling abroad has parents who are in the Foreign Service or living abroad or are immigrants, provided he / she is holding a valid pass such as a dependent?s visa / pass / identification card or permanent resident visa / pass / identification card which serves as proof that he / she is living with parents abroad.
