When you are married, you can't apply for the Fiance Visa.
I don't know if it really takes that long for Visa processes in the Philippines but I personally never heard of 2 years yet.
Good luck when you apply for your CR-1!

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-129 F got approved after 241 days! I SURVIVED @VSC

I just want to share my whole experience regarding my petition especially to those who are still patiently waiting for the approval of their petition. First, of all I want to thank my VJ family especially my friends here who have shared their insights, advice and informative ideas on how to go about the I-129F petition. I am extremely happy that finally after almost 8 months of waiting for the approval of our petition, just today our case got approved!!! I have no experience about paperwork since the very beginning we started our paperwork. But thanks to my VJ family, a lot of good people here have helped us go about the whole process of K1 petition, without these good people it would be very impossible to complete our whole packet. My fiance and I never hired an attorney coz it is expensive. We did everything by ourselves with the guidance of my VJ friends. I really want to thank all of you. MILLION THANKS.

To those who are still waiting, let me share to you my experience. We all know that VSC is really slower than CSC right? So the waiting game is really so tough. Ive been through a lot of pains, struggles, frustrations and depression. I cried everyday after we passed the normal processing time which is 5.5 to 6 months as shown on the USCIS website. I almost gave up and I even argued and fought with my fiance, coz I always pushed him to call the USCIS to find out the case and he got tired too hearing different answers from customer reps and even tier2. We tried several times to file for a service request to tier 2, but unfortunately they didnt allow for some reasons. I think it depends on the tier 2 you speak with. So be patient enough to call the USCIS and be on hold for like 40-50 minutes to finally talk to a tier 2. Finally, after we passed the 7th month, my fiance called again the USCIS and was able to talk to a kind tier2. He put us on a service request after he asked few questions from my fiance and noted them down. Then he told him, that a letter will be sent to my fiance in a week or 2. On Dec. 30 my fiance got the hard copy of the letter from the USCIS, but I was surprised that the letter stated that our case is still under review and we have to wait for another 60 days! We were really shocked! What??? I asked some of friends' experience who also had their case put on service request, I was relieved when they told me that 60 days is just a generic answer. They added that hopefully this first week of January I will get an approval. To my surprise today, INDEED I GOT APPROVED!!!! Whoaaaaaaaaaaaaaahh!!!!!!!!!!!!! I was screaming and jumping lol coz I was extremely happy. I realized then that if we just leave everything to God, then it will come the least we expect!!! Good things come to those who wait patiently. So GOOD LUCK TO ALL THOSE WHO ARE STILL WAITING FOR THEIR APPROVAL. NEVER GIVE UP!!! INCREASE YOUR FAITH IN GOD and most of all DONT FORGET TO PRAY. GOD will always grant our desires because HE knows what our heart's desires are.

K-1 Fiance(e) Visa Case Filing and Progress Reportsmy timeline jumped forward

I know I'm not suppose to put much stock in the vj timeline and for a while it said there weren't enough approvals to make an estimate. Today however it says my petition could be adjudicated between Dec 23 and Feb 1. It use to say around April. My noa1 is Nov 20. Anyone else have a BIG change in theirs?

We both file around the same time (nov both i-130 & i-129f) my i-130 was approved in jan , i was happy til i seen my petitions is going through Vermont VCS.:( from what i been seen on this site they take a long long time

IR-1 / CR-1 Spouse Visa Process & Proceduresdid i make a big mistake by filing the I-129f

Correct, however, everything we have been saying about the joint processing of I-130 and I-129F since late 2006 may well be out the window, now that the I-130 petitions are going to NVC for assignment to local field offices for adjudication. We really don't know yet what is happening to I-129F petitions now.

Please let us know what happens to yours.

Probably the overstay is not important.

She will find Divorce in the US much easier to do, but from what I gather not recognised in PI anyway.

To leave she just needs a Passport and a Ticket.

You are half right. If she leaves and he files a divorce and if she can get the divorce paperwork she can run it through the Phil government which will make her free and clear to remarry whether she did a ROM or not. If she does the divorce against her hubby and returns to PI, her divorce will not be recognized, but at some time she can clear the marriage with an annulment. Long and costly to say the least.

She needs to have a conversation with her hubby and ask him to file the divorce, give her a final copy, and then put her on a plane and she is out of his life and she has her life back and can remarry with no problems as long as she has filed everything in the PI properly.

She doesn't need to be present but does need the final copy of the divorce. He can't remarry unless he is divorced so I think he is motivated. If she leaves without a divorce and he refuses to give her a copy of the final decree she just needs to know where the divorce took place and contact the county court house to receive a copy. Might be hard to do from the Philippines so if she has a friend that can help it would be beneficial to her.

No need to trouble yourself with the burden of applying case numbers to your documents. Waste of time.

True certified copies will suffice for your visa application and for other uses like AOS. Be sure to get extra copies because you will need them each step of the way.

That's the burr in my south end. Why can't a country, in this case Philippines, have the same rules and level playing field for all. And to insure it is that way through out all their Embassy's? Seems to me that would only be fair to their citizens.2014.gif

On a side note: So I enlist in these United States of America and it's Naval branch. I go through boot camp and all. I learn that it gets folded this way, and lays that way and it has to be this far apart and it can't be more than this in the pile on and on and on but when it comes to our Government the rules are all so different depending what state you live in, what county your from and what street you live on. It drives me !@#$%% bonkers. 2013.gif

Hank and OP.... it depends on the Embassy she is using. We use Wash D.C. and they require the ROM to be finished and presented at the time of the Passport name change at the outreach. Don't know if that is true if you are in the "building" of the Embassy you are using.

I recommend to the OP to email the Embassy with her questions and see if there is a response from a "live" person.

Pay your fee. Go online and schedule your interview here is the link: https://cgifederal.secure.force.com/. You will see all the dates available for September and beyond if the October schedule is open. You will need to be patient after you pay your fee. The posting of your payment to USEM will take 4-8 hours. You can try after 4 hours.

did anybody here who just went into this situation ..... i don't want anymore delays...and if ever atleast i can rush to NSO pasay tomorrow to give whatever shoul be attached to the forms....

pls anyone....

Please post this in only one thread.

I will answer your question just as I have from your other thread.

USEM will send an official request to NSO for the documents that you need. NSO will comply with the request and USEM will pick them up on Fridays for all the requests from earlier in the week (yours and others). Come Monday they will begin processing and matching the "new" documents to your file. Once that step is completed, then your file is sent onto the CO for their review. If they are satisfied then they will approve your visa. Then the visa is processed. About two weeks you will begin to see updates on ceac for your visa. Once it goes to ISSUED then you should see it in about 5 to 10 business days. Remember, these are normal processing times and process's and your actual experience may be different. By all means don't buy plane tickets till you have the visa in your hands!!!!!!

This is from personal experience

PhilippinesNVC we got mnl number

Don't be discouraged if ustraveldocs says no appointments available.  Lately they have been getting pretty overwhelmed.  If you see that, just go back the next day and every day thereafter untl you see an open slot and then take it.

Medical can be done as late as one week before interview, but if you are already in Manila, two to three weeks and maybe even 4 weeks would be a better choice.  If the applicant is a lady make sure to not do the medical during your period.  One of the advantages of allowing more than 1 week is if your period takes you by surprise, you can simply wait until it is over and then go.

Plenty of dates still available for September. They have now gotten through those who were fast tracked so for now no problem.

I will arrive Manila around October 20th and have a tenative return flight on November 15th

I have not booked yet, looking for suggestions.

I plan on flying Delta since I can stay on the same Airline from Dallas to Manila.

I wanted my fiancé to fly back to USA with me, but I don't want to book her and she gets delayed getting her visa, she lives in Bicol area not close to Manila.

Suggestions

USEM states:

Do not finalize arrangements for travel to the United States, dispose of properties, or resign from your

job until a visa has been issued and delivered to you.

Simple? We all have been in your shoes so just have some patience and she will be with you in the US soon. Patience...Patience.

You can get your CFO sticker at any of the three locations; CEBU CFO, Manila CFO or NAIA CFO desk (see instructions below)

You can get your CFO sticker (be sure to bring your certificate with you if you are going to get the sticker at the airport for that matter all locations require your certificate for processing) at Manila NIAI Term 1. NIAI office request that you call ahead 2-3 days to make an appointment. The airport location is open from 5am till 12 midnight - CFO NAIA desk is at terminal 1 (one)... beside TIEZA travel tax desk... between the entrance doors with the x-ray / conveyor machines... Hi everyone! I just have a few questions with regards to filing the K1 visa.

I am the petitioner and I'm currently in the Philippines after giving birth 3 mos ago. My questions are:

A. Can I provide an income tax return from the Philippines? If your asking about a US income tax return the answer is yes. Just go online and request your transcript for 2013 at the IRS website. The only problem is it will be mailed to a US address but if you have a friend that can retrieve it and scan and email it to you... you are good to go.
B. i am currently staying at home since I just gave birth and my fiance is the one working. He earns a little above what is in the poverty line, would that be valid? If your the petitioner you must be the one who is earning and supporting him above the poverty line.
C. Even i I am the woman would I still need to be the one to provide support?   Yes because you are the petitioner. Even in my fiance's earnings are okay? Does matter he is the beneficiary and the beneficiary is supported by the petitioner. If your income is greater than the poverty level for the number in your family, you have no concerns.
D. Can the beneficiary be the one to support himself?  No.

Thank you very much in advance!

PhilippinesSome questions related to documents to bring for Interview
Yanyan, on 29 Aug 2014 - 11:59 PM, said:

Hello,

On our status online it says that Petition already shipped on August 25, 2014 Department of State for visa processing.

I have not yet got the MNL# and my fiancé will start to call NVC this coming Wednesday (September 3, 2014, it is 7 working days after shipping the petition).

So now while waiting to get the MNL#, We are preparing our documents to bring for my interview.

He will send the documents on September 4, 2014,

He will send these two (2) documents through DHL or FedEx 1I-134 form with ink signed and date

                                                                                               2. Intent to Marry Letter (dated with August 31, 2014)

And email me these documents: 1. Federal Tax (ITR-2013 "1040 form") all pages

                                                    2. W2 (Year 2013)

                                                    3. Paystubs (3 paystubs),

My fiancé receives his salary every week so the paystubs that he will email me are the weekly stubs. Is it okay?

I read other threads that they sent 6 months stubs, Just need more clarification here...

And another question is about Employment Certificate? Is it necessary to get bring that?

My fiancé is above the poverty guidelines. He is earning 35, 000 dollars yearly so for the two persons I think it is okay.

Thank you to everyone.

Your fiancée will need an employment letter from his employer. Yes, 35k is enough for two people.

Follow the directions in the Embassy letter. It outlines everything you will need for the visa process. Use it as a check list. Begin to read other posts here on VJ where most of your questions will have been answered.

PhilippinesCFO at the Airport

Oh sorry. My passport is now with the courier just waiting for it to be delivered. They said they will tomorrow. I know booking the ticket was a mistake when I dont have my passport with visa yet. But once I have it tomorrow morning I can still go to cfo office in Quirino. But if I get it late tomorrow then I can do it at the airport tomorrow if there's office there. I can just show them my certificate. If there's none then I'll just rebook my ticket.

So my only question is... is there a cfo office at the airport?

IMHO, You should make SURE that you visit the CFO office in Quirino (Manila) and have your sticker affixed to your passport prior to going to the airport. DO NOT rely on the airport as you have not made prior arrangements, your flight leaves at 6 am (CFO does not open till 5 am but who knows if they are on Filipino time) and you need 2-3 hours to get from the front door to the gate as you will need to check luggage, get your boarding passes, pay your fees and taxes, go through customs, immigration and purchase a Krispy Kreme donut.

You might have dodged a bullet with not waiting till you had all documents completed and in hand before purchasing your ticket. cray5ol.gif

Good luck!! smile.png

Don?t be surprised if you happen to have a Pinay sweetheart who cares for you passionately, who will lack at times a sense of security, and is on the alert; watchful. Instead be kind, forgiving and thankful. In the dictionary of the Filipino, jealousy is the most twisted ? and perhaps truest ? form of flattery.

Sometimes it's best to turn the other way and not try and figure "what is wrong" when she is jealous. Just move on. Or in the words of ZZ Top, "buy some cheap sunglasses the ones that no one will know your name". 2079.gif

If you are clear when seen at SLEC you'll pass but if they find anything then further tests are needed. If they find anything concerning TB you'll be delayed until your cured. Nothing you can do to change your results. Relax, let the system work.

By the way, if you have additional questions you should start your own thread and not hijack someone else's.

I dont know if this is the right part to post this soif not, feel free to move it.

My visa is taking too long to deliver, im waiting for i think 2weeks now. Aug12 they told me to just deliver the nbi clearance via 2go cause i dont have it. Aug 18 i sent my nbi via 2go to the embassy (2go branch is near the embassy) so probably 1-2days they already received it. I know ill be delayed cus of this so im expecting i will receive it within 2weeks.

Im still waiting, i want to sched a flight this month. I dont want to wait till october

What should i do? Should i wait a few more days or weeks? Should i call the embassy?

I badly need to sched my flight this month.

Unfortunately it's difficult to predict when your visa will be issued. We have seen issued status from 10 business days to some waiting 3-4 weeks if not more. Need a lot more patience. Calling the Embassy this early will probably not get the visa a quicker.

Also from what I have seen from the other K1 fillers from the same time as me the medical can really delay things for those from the Philippines.

The only issue that throws a monkey wrench into people's plans is the TB testing. TB is pretty common in the PI so naturally it's going to have a large effect on those from the PI who are doing their medical. If you are physically healthy and no issues then you will pass without a problem. The majority of the individuals will pass their SLEC medical you included possibly.
