it breaks my heart sometimes to read some of the stories and situations posted here on VJ. I myself am just starting the procss of waiting and have already begun experincing the emotions that can debilitate and sap your strength as we stumble through this process. Father I pray that their defered hope would not make their heart sick, but that you would grant them a special reprive, in some special way, a break from the stress and frustration of waiting. I ask that you would use this process for the good of their relationship and not for harm, and that you would intervene where the immigration process has treated them unfarely or where mistakes have been made. Pease father bring those people who are waiting too long for their loved ones together soon, bless and strengthen their love for each other and guard their hearts from despiar. Please make their homecommings a sweet sweet moment and watch over them as they build thier new lives together in America.

It is good to get a notorized letter from the children's mom authorising them to move to the US. Is his name on their birth certificate?

About him working here, I think he needs employment authorization and SS# to do so. After you get married and file for adustment of status, you apply for EAD, SS# and advance parole (so he can travel outside the US before his green card is approved) Since you will be married less than 2 years, you will get a conditional green cared which will expire in 2 years. You apply to remove conditions during the 90 day period before the 2-yr GC expires. The GC is work authorized, so that will expire also. When the 10-yr GC is received, it is work authorized.

Hope that helps and maybe someone else will come along and verify or correct me if I am wrong.

Yes Lawny, you age out at 21. Mike's dad had put his children on his initial application and one has aged out and the other will age out in October. When he went to the embassy last month, he was told that she is protected under the child life act and he is to fill out a DS-230 for her ans have me and his dad send in AOS for her and she is go to get her medical done and come with him on the 26th whe he returns. We are now rushing around to get al her documents together and her medical done in time for the interview date.

When things happen (like what happened to Mike at his interview) we should always put our trust in God beacuse only he know why!!!

Hey Mrsladyd, welcome to visa journey. Like Lawny said, come on over to the Yardie thread in the regional forum and you will find tons of people that have gone or are going through the K-1 visa process. Lawny just finished last month and she is great with advice. A couple more are almost at the interview stage and they have gotten great advice and guidance there. Not saying the people who have responded to you so far have not given you good advice, but the yardie thread is specific to Jamaica and all consulates and countries does things diferently and has different requirements.

Good luck with this process and like Lawny said you have to be prepared to exercise tons of patience as you take this journey to being with your loved one. good.gif

Hi Guys!

I am loving this forum smile.gif I'm still confused beyond reason, but at least I know I'm not the only one!
My boyfriend and I are trying to figure out the wisest way to get me down there. He's in North Carolina and I'm here freezing my ####### off in New Brunswick. Even with all the reading we have been doing, we're still not sure what is the best route to take.
Any thoughts on which Visa to apply for? he's planning on proposing on my next trip down, so we could either start applying for our K-1 or we wait till July and get married and apply for our K3. Either way it will be a small wedding...whether it's here with my family, or down there if I go through the K-1 route. We're going to save up and have our dream wedding when i get settled. Any suggestions either way?
Also, I have been planning on going back to school to do my Masters. Does anyone know if I get a J1 study visa, if either K visa can be processed at the same time? These may seem like moronic questions to those of you who know this process, but it's still taking some time for us..so I apoligize! smile.gif

All I know is I love this man, and he loves me and leaving him after our last visit was the hardest thing I've had to do. As long as we can be together, I think we'll go through anything!

So we're now officially engaged! He proposed on March 28th, at my place, as he is here visiting Canada and meeting my family. So we are almost ready to start putting our package and I'm so excited!!
My question is, I know that our first wedding will be down in North Carolina, but I am going to plan a wedding back here in New Brunswick for my family and friends and so we have time to save up some money. I was looking at the requirements for Advance Parole while you wait for your AOS, but does anyone know if a wedding would count as a reason to get advance parole?

Hi everyone!

I just got home from spending a week with my fiance in NC - I miss him sad.gif
Anyway, while I was down there, we got our paperwork and evidence all sorted and labelled. I brought it home to look over it one more time and include a few pictures I had forgotten and I will send it back to him to mail to Vermont. Here are my questions

#1) How should the paperwork be bound? Do I staple or put in a folder or what? I dont want to do anything that will comprimise the validity of the package

#2) My fiance is in a house with a roomate, but is thinking about moving into an apartment soon so we will have our own place as soon as I get there. Should we hold off on sending the paperwork until his address has changed? ( it would be in the next few weeks), or is it an easy process to change the address through the service centre? I was figuring it would be less time and hassle if we just waited, although I hate the thought of holding off any longer tongue.gif I just want to get the ball rolling so we can be together smile.gif

Any imput would be wonderful! thanks!

Hi all!

I think I may just get an ulcer by the end of this process from worrying so much, but what can you do eh? smile.gif

So Bo sent off our package on May 5th by overnight courier and it arrived and was signed for on May 6th. Here is where the worry sets in: We have still not received anything through email about our NOA1 and the check has not been cashed yet. It's 10 days and I see from most people's timelines that they had electronic confirmation between 2-5 days after the paperwork was received.

Is this long of a wait normal? If we don't get it today, then it won't be until next tuesday that they would get to it, making it two full weeks. I haven't seen any timelines so far that have had to wait that long sad.gif

Any ideas? or at least some general words of encouragement LOL smile.gif

Just a quick word in here smile.gif

You don't need a passport to drive across the border until next year or to travel by water ( The Cat ferry from Maine to Nova Scotia is an example). I live in New Brunswick and when Bo came up in March, I drove across to Maine (Houlton/Woodstock) to get him from the Portland airport and they don't ask for a passport, just government issued ID.

LOL it was so funny the difference between the US customs people and Canadian...US asked for my ID (I have a passport because I fly down to NC), they checked the car, the trunk real fast. Going back across to NB with Bo, they didnt ask for ID at all, didn't look in the car...just said to have a safe drive smile.gif

Once you have the K-1 issued, it would come up when you went through customs and they scanned your passport, and since it is only a one-time use, that's all you would get out of it.

I'm the Canadian and my fiance is the American, and we had the same questions. Read everything you can on here, and I would suggest the K-1 Route. It takes between 6-9 months for everything to get done. Where in Canada is she? Interview times for Montreal are a bit of a wait, but I've heard good things about the Consulate itself.

If she decides to travel, make sure she has proof that she lives in Canada (bills, lease, pay stubs, letter from Emplyer etc). I have talked to a few CDN's who have been denied entry, but I've been lucky so far - 3 trips since filing. And make sure to tell her not to lie to the Customs' people when she does travel. It will be more trouble than good!

If you or her have any questions, people on here are fantastic, and you can msg me as well to know how our process has been going as well!

J ust to let the other Canadian filers know, if you are going through Vancouver, it will be a bit faster than Montreal, but Montreal handles the bulk of the interviews and unfortunately they are slow as all get out blink.gif . There are people that received their NOA2's in July that still have not received their interview dates. We got approved on the 1st of September, but I don't expect to get my interview before January at the rate they are going. They seemed to have backloged themselves, but from what I read, I shouldn't complain - last year it could take up to 6 months for Montreal to give an interview.

For us Canucks there is still a wait ahead I'm afraid sad.gif But I just keep telling myself it's worth it smile.gif

give them a couple days and then call or email the embassy Gordon...They should be able to tell you when it arrives. I received my packet 3 already, and I'm sure yours will be on its way soon. Use the LDN number they gave you when you call the embassy.

Hey Hun,
Welcome to VJ first off...I know it seems like SO much info, but if you have the time to look through it, you'll find what you need

hmm, seems you may have missed a few things...there is a whole package you have to send with the initial I-129F form...you can look at the guides tab to see what all should be in it. If you have already gotten your NOA1, then you will most likely be getting an RFE - request for additional evidence, when they go to process your file...which, if you sent in May probably won't be until August at least. The process is likely to take at least 6 months from the time you received the first notice. Do you know which service centre your fiance sent it to? California or Vermont?

You won't have to worry about your medical and things until you recieve your 2nd notice, which will be August at the earliest (longer maybe with the RFE)

Honestly, the best thing to do is go to the "guides" tab, and read everything about the K-1 visa, and see what you may have missed and what you can expect. This site helped my fiance and I out tons when preping our paperwork! Don't be afraid to ask more questions if there is something you don't understand. People on here are very knowledgeable and super nice!

Once the file is forwarded to NVC, it's a short wait there then it's forwarded to the Consulate in the Beneficiary's home country. All consulates are different, therefore the interview wait varies by which consulate it is going to. Look up the consulate and see if there is a processing time there, or consult other VJers who have filed through the same consulate to get an estimate of interview timelines.

I made my medical appointment yesterday for October 16th, and the Doctor said NOT to get my shots until after he's done his exam and told me which I need. I can then come home and get them, and send back my card within a week and they will add it to my medical report. So I think it really depends on the country I think smile.gif

All the originals that you sent with your original petition have to be sent to the CDN (in this case), such as all your original forms, birth certificates, evidence such as pictures, boarding passes etc.

In my case I had kept all the originals anyway, and brought them back to Canada with me after we had filed. The only thing he needs to send is his Birth Certificate up to me from the original I129F petition. The Embassy may not ask to see everything, but it's always better to be safe than sorry!

Hmmm...

I've gone through pre-clearance in Halifax most of my trips (save one) and I've always said I was going to see my fiance. I had ties to home, but all they were really worried about was a return ticket. I pretty much have to mention it when I travel in January, as one of my major ties will be my K-1 Interview in Montreal *lol*. I don't think it's a bad thing to say they're are visiting family and friends either. Just depends on personal preference smile.gif

I'm assuming you started a new profile as your fiancee has your main profile. For people who are wondering, I think that they are going through Montreal, and I am one of the others they are referring to. My papers were sent back 2 weeks after these lovely people sent back their P3 to Montreal, and my interview is Jan 15th, while theirs is at the end of Feb.

Like I posted in the other thread, the only thing I can think is maybe there is more to check into your background then other people. Not that it is bad things, but maybe you had lived in more places, held more jobs etc.

The latest MTL dates are complelety backwards though. Seems the people that sent back their P3's earlier got feb dates, I have the 15th, and someone that sent theirs a week after me has theirs on the 13th of Jan.

I am sorry that you have extra time to wait hun, but at least the uncertainty of knowing when you'll be together is over.

Montreal keeps your passport and mails their visas out, so they say it can take from 5-7 business days to get it back in the mail. Hope this helps

Just to put a side-note on all the things that Kim has mentioned:

When I got my Packet 3, the instructions for the I-134 were that they needed to see:
Letter from Employer
Letter from bank
and/ or pay stubs and bank statements.


They do not ask for tax transcripts from us. You can take them as backup, but they are not a required item, as it is for other countries.

It is taking about 3-4 months for montreal to do the interviews after they receive the P3...but you can call the Department of State with your MTL case number, and they will actually know your interview date before you get the letter from Montreal. I think I received my letter about a month before my interview.

Here are the instructions for DoS:

Actually, our bank would NOT add my married name to the bank account - it had to be in my maiden name, as my two forms of ID were in my maiden name (SSN and Passport)- Even with my marriage certificate. They have to see my greencard in my married name to change it over.

But it would vary by bank I would assume....

Each state is different to what is required to get your marriage license. Look up the register of deeds in your area to see what is needed.
A lot of the time, the bank and the DMV will require your SSN to process applications, so if you are waiting a while into your 90 days to get married, you may want to apply before hand. If so, you cannot change the name on your SSN to your married name until you recieve your EAD..they're just picky like that.

Are you sure you have the right form?
DS 160 is intended for nonimmigrant visas such as B2.

On that form, in box 26 "How long do you intend to stay in the US?" we entered "Permanently"



Yeah, Canada has been using the DS-160 since putting out P3's late last fall. I put 75 years or something on mine, I think it is more of just something to fill in.

Actually, if you look up the definition of a K-1, it is considered a "non-immigrant" visa, as you apply for your AOS after the terms of the K-1 have been met. So the DS-160 actually works in this case smile.gif

I logged on to the OSCIS website today and noticed that the last update for my case changed from 5/21 to yesterday (6/30) I have recieved no e-mail or text about anything, so what does this mean (If anything)?
