Best thing to do so that your future with your family will not be jeopardized. It is better to wait 6-12 months for the visa than to do what the lawyer suggests and be banned from US entry for 3-10 years for fraud. Did you say you were married? If you are your wife will have to file for you as a family based immigrant. Read all the guides here on VJ and try to figure out your status. You can ask all the questions you want and will get straight forward answers.

Jamaicans who are petitioned for relatives in the US have to provide a Certificate of No Impediment to Marriage, even if they were previously married and has a copy of their divorce decree. This has to be obtained from the Registrar General's Office, a government agency.

Packet #3 is the request for the DS-230 and beneficiary's personal documents and what and where to send depending on if your consulate is appointment or standard processing post. Packet #4 is the interview appointment letter which also gives you instructions on completing the medical. Tell your SO to apply for the police certificate (which I believe is good for 6 months) and start gathering his documents. He must have original, certified copies of his birth certificate, divorce documents (if ever been married before), military records (if ever been in the military), any court records if applicable.

Someone else might be able to confirm what I stated above.

Hey Dayna, welcome to VJ and good luck on your journey. Just read the guides up top and post in the regional forum "latin America and the Caribbean" and you will find people there who have gone and are going throiugh the process. In general you will get tons of information.

You need to start by getting an original marriage certificate and download the I-130 form and instructions and start there. Post your questions as you go along and they will be answered. This is the best place for you to be right now

Ok.. I haven't had much rest yet..but here's how it went. (Im sure my husband will share more as soon as he's rested)

Ahmads appt was set for 7:30am...but as usual we knew it was all about arriving early and then wait..but most important be on time and prepared. So there he is looking like he's ready to move into one of their offices with all his required docs and "supporting evidence". There were a few others there..but they had only a folder or two. This made some of them a little nervous thinking maybe they were supposed to bring more..but for some it just depended on what their exact purpose was for being there.

His first interview was with a woman. She asked him only a few questions. For starters she asked "how did you meet?". He told her how and what circumstances led to our meeting online. This brought up my son marrying an arabic woman..which in turn brought up the age questions -My sons, Ahmads and mine. This question gave [u]Ahmad opportunity to share more about our sincere love and the building up of our relationship[/u]. She asked what his parents thought of me (and our relationship). With these questions he offered to show pictures, emails, phone records etc..(which was located in his "luggage" file- 1 large/2 small) She said no..don't need to ..just show some pics. Ahmad said he had so many here due to 3 celebrations/2 visits to Jordan. She said just a few is fine. He brought out a few pix of us together and also me with his parents and family. She asked "When did you see her last?" . He answered with exact dates and time periods She seemed very interested and pleased with the photos..in which her tone and reaction changed greatly when she who I was and how the pics showed my relationship with him & his family (very close/ the pix don't lie). She did ask if he had a copy of the visa stamp in my passport of my visit.. he said he didn't have it but had my boarding pass/luggage tags etc as proof and offered it. She said no..its ok..don't need it. Then she said ok.. I believe you. Now the only thing that would need to be done is to wait outside and the next interviewer would call him..then they would need to get one last security check..after this his passport would be stamped. She was very pleasant and Ahmad felt that if she felt something was wrong or missing that she would tell him.

The next interview took place a few minutes after he left her. He met with a man. As he walked in with his "mini" file suitcase ensemble... The man said "Whoa!!.. ok ok..I believe you!! (smiling and jesting with him as he looked at all of what Ahmad carried). Ahmad smiled... remained calm and ready. He was asked to show all docs I-134 and supporting docs. I had this set up in a presentation folder. Ahmad had one- Sponsor "me"..and another folder- Co-sponsor "my dad". The interviewer was impressed bc I also included 2007 tax papers (W-2s/Form 1040- no 2007 transcript). Also I included 2004-2006 transcripts/W-2's. Other documents to support information given on I-134 (employee verif/recent paystubs ....). He took mostly everything from those folders and viewed his screen and said that Ahmad had everythign they asked for and more and this was good. He said this was the end of process..All was completed and acceptable..but they had to follow thru with sending it for one more check. Ahmad questioned "What should I tell my wife about this interview?" He was then told " all is good and completed..just would need to wait for last check (if all is clear), then request for him to send in passport..then it would be stamped with visa. Ahmad continued to ask about how long bc this has been so hard on us..the waiting and being apart..and this is why I had to come back to visit again. The man said that it says up to 3 months..but it could be much much faster and not to worry because everything looked good and it was just a procedure that had to do now.

Your case has to be processed and completed before you get an interview. By your signature, it seems as if your case was just approved. You have a bit to go before you get to the case completed and interview stage. Please read the guides and the NVC flowsheet to see what other steps need to be taken before you get to the interview at your consulate.

How could you also be approved for a K-1 visa if you are already married? Can you explain exactly what you mean. K-1 is a fiance visa and K-3 is a spousal visa. The same form is used to apply for both (I-129F) but you get the Spousal visa after you submit and get approval for the I-130.

To answer your question, I think the K-3 is a multi-entry visa, which means you should be able to leave and re-enter the US without any problems. If I am not correct someone is sure to come along and correct me. laughing.gif laughing.gif

If your wife is in the Phillipines, all your paperwork should be directed there after NVC completes your case. If your wife has a Manilla #, your case was probably forwarded to that embassy from Jamaica.

The NVC usually collects the documents and process them then schedules the interview then forward the completed case to the embassy in the country of your wife's residence. That is where the interview will take place.

Are you a USC or a LPR? You should probably explain your situation a little so we can better understand and try to help you. The petition you filed usually starts with the USCIS who issues the NOAs, then it goes to the NVC after approval.

Where overseas are you?

Are you Jamaican national or USC or LPR?

How long have you been married?

Is your wife Jamaican or Phillipino?

I am sure when you present your situation more clearly, you will get the answers that best suit your case.

I am in the same situation with my tax transcripts as far as married filing joint. However my income was always OK. But it states that only the last years tax transcript is needed. the other two are voluntary. So if your income on the last years taxes was good enough, I would just send in the one. You also include your current paystubs and letter from your employer to prove current income. It is your current income that is important.

Disclosing your past conviction is going to depend on if you are the petitioner or the beneficiary. The USC petitioner does not have to disclose any prior convictions to the USCIS/NVC.


They do if they must answer yes to the specific IMBRA related criminal past question on the new I-129F.

The $400 is the actual visa application fee that has to be sent in before she can send in the visa application (DS-230) itself,

I was in the same situation where my boyfriend's parents filed for him in 2000 years before I met him, and I was his co-sponsor and I paid the visa application fee because his parents had previously sponsored other family members.

Good luck and go ahead and help them as you are on the lucky end. If you had to filed for her you would have had to pay waaaay more than $400 in fees before she gets here. She is also going to incur more expenses before the visa interview also. She has to complete a medical exams and might even have to pay for vaccinations if her records are not available and if she needs additional shots.

You can also read the guides about family immigration and the steps one has to go through before the visa is granted.

Hey K, I think because it is a K-visa you only need to fill out and submit the I-134 and include her son on the same form in the section that asks for others accompanying the beneficiary. good.gif
