Hello everyone, I'm brand new here and this is my first post! 

 

I've been reading a few posts, especially the pinned one about visits while waiting for the K1 visa.

I couldn't find the answer to my question, I don't know if the topic's been discussed before. If it has, I apologise in advance!

 

I am binational: Swiss and British, currently residing in Switzerland. When my fiancé and I filled out the I-129 F form, I only had a Swiss passport but in the meantime I've received my UK passport which had expired in 1998.

 

Anyway, I read it was ok to visit your fiancé but that it was a lot of stress and anxiety as they could deny you access and send you home. Obviously, I would prefer to avoid that scenario.

 

Do you think it would be fraud if I tried to enter the US with my UK passport, knowing that I'm applying for a K1 visa with a Swiss passport?

If you think it would be, then at what stage should I inform the USCIS of my dual citizenship? does it matter at all?

You are not applying for K1 visa with any passport yet. YOUR FIANCE just filed I-129F petition on your behalf. Long way to go before YOU wil be applying for a visa at the consulate. 

 

I doubt you will have any problems with entering US on British passport, but the best way to find out is to apply for ESTA.

If you haven't met in 2 years immediately before filing I-129F, your petition will be denied.

You will need to meet with your fiancee after that and then refile. Sorry, but requirements are very clear and you don't meet them.

Okay also to state im not going to get into the rights and wrongs about drug use, but just ways to circumvent the system to get us thru this. If lieing gets my baby here then thats what we will do. I ask if she can take another medical because if so we know what we have to do come question time. If the medical exams arnt electronically sent then no one knows. The only proof that they have of all of this is the packet she has in her hands. Thats what I really want to know. If she could do it over we still have time for another medical but can we do it is the question. Will they know that we did.


You want circumvent the system by lying? Then better prepare yourself for living in Colombia if you want to be with your fiance.
I don't think admission of drug use will cause automatic denial. But if the drugs have in fact been found in her system during recent medical, she will be asked to do another medical... a year from now.

You are an US Citizen, right? Only USCs can petition for fiance.

You don't mention what state you live in. I think some states require some waiting period after divorce before you are free to marry again, but not sure.

You won't be able to choose where your petition is processed. Initially all I-129F should be send to Dallas lockbox. Read I-129F instructions really carefully.

You (USC) won't have to visit any USCIS field office during this process. Petitioners are not routinely interviewed.

Not sure if i should write about employment during the i-129f process, cause on form g-325a sent to USCIS i was unemployed, so i put there unemployed, but during the process i found part time job, but i didnt update that information, so should i write it on form ds-230 for the embassy interview, or just write same as on the form g-325a
About being an aupair - is that considered as job, i wrote that in form ds-230

Warsaw is a very easy consulate for K-1s.The staff is very friendly and they do not ask too many questions - at least in Immigrant Visa Unit where your fiancee wiil have her interview . It was true almost 4 years ago when my wife did K-1 there, it was true 2 years ago according to Gosia&Tito.and I wouldnt expect it to change since. That said, I would definitely try to get papers in order to minimize the possibilty of failure. Update your I-134 and if you're below 125% poverty line, update co-sponsor's I-134. Mail it to your fiancee UPS express, she will get it in 2 days flat.Yes,I know it is a lot of money for shipment like that, but believe me it will be worth every penny you spend on this mail. It will give both you and specially your fiancee a peace of mind. Priceless.

@Tom and Teaw. I cannot believe it. I keep thinking it is about to come to an end, and it gets dragged out longer still. I agree with Kari. It is a good sign that they kept Teaw's passport. Also agree to just have Teaw hang on to the papers you sent. If they grill her again, she should turn in the papers. If it is a visa in her passport, she does not want to turn in those papers.

Thanks. I am more inclined to wait and see what happens. Teaw is a little upset over the interview thinking she did not do well, but from what she told me of the questions and answers, I think she did pretty good. The lady still does not believe that she can write emails and chat in English as well as she does....which is far from perfect but I usually understand what she is saying. And it's much better than we first met. She was asked again who writes the emails for her and made her write on a piece of paper in English a sample email to see how she did. Sometimes I wonder about these people they have doing this stuff. I wish they would have called me so I could give them an ear full of what I think of some of the things they ask about. After all, the prior relationship was over for good in April of 09...although in my mind it was over before the knife incident...and the divorce has been 8 months ago. It would be nice if they would concentrate more on OUR relationship instead of the past one.

Teaw's days off are Thurs and Fri and she is nervous and hoping they call her and tell her to come get her visa. I do too but I feel sorry for how she feels after being grilled again.

Oh, they wanted to know if I had come to see her again since Jan. She told them I was waiting for the visa before I came again since I had to save my vacation time.

But I wonder, should I have Teaw take the document I mailed over Saturday that explains what happened with the ex and what brought about the divorce and why I did not end it in April when I was there and she pulled the knife out and I thought she was going to cut me. That had nothing to do with mentioning a divorce either. But it does explain how I realized it was going to end and that I started caring more for Teaw. Or maybe I should just let it lay and wait and see what happens. She did tell them about the knife incident as best she could as I have told her about a lot that happened.

Hmmmm, sounds like Teaw was the cause of Ying's delay. She was called in at 1pm and grilled for
two hours!!! They asked her everything under the sun about us meeting, the ex, how she writes
English in emails, the works. Then they kept her passport and said they would let her know
later. Just one lady interviewing her. I guess the lady wasn't too bad this time but it would
have been nice to know they were going to interview her before she went there. I had just mailed
a huge packet of chats, a letter explaining what happened with the ex and phone bills for the last
3 months for her to take if they wanted more info. Unfortunately, that won't arrive until around
Thursday. I am tempted to have her take the letter explaining the quick demise of the marriage
and give it to them so they have a better understanding of what happened and how we both decided
we wanted the divorce. Not sure if that's a good idea of just let it lie and hope they call her
back to pick up the visa.

They also asked her for my phone number and she said they may call me. I hope they do!!!! Then
I can straighten them out on a few things.

Well, the embassy called Teaw yesterday, their Monday, while she was at work. They tried several times to get her but her phone is in a locker while she is in the clean room working. She tried to call
back on her afternoon break (she is on 7 to 7 day shift now) but there was no answer. Shortly before she was to go back to work they called again, told her to bring her passport between 1 and 3 Tuesday.
The lady said noting about another interview, but did ask her if she had other papers to bring. She said no and the lady said never mind. Just bring your passport.

So I am hoping that is the "good sign" we have been waiting for that they are going to take the passport and tell her to come back on a certain day to pick up the visa!! I figured since they did not give
her a day specific and a time specific for an interview, that just bringing the passport is great news for us. Anyone have any feedback?

Running off at the mouth can certainly hit you where it hurts:

Two foreigners, a Briton and an Australian, have been indicted in Pathumwan District Court for violating the emergency decree while participating in the United Front for Democracy against Dictatorship (UDD) anti-government protest, which ran from March 14 to May 19.

The Australian, Conor David Purcell, 30, and the Briton, Jeff Savage, 49, each face up to two years in jail if convicted.

The prosecution on Thursday brought two, separate, charges against them. They pleaded not guilty.

Since nobody showed up to seek their release on bail, they were sent to Bangkok Remand Prison.

The court is expected to schedule hearings of the cases between August and September.

I think the 2 K-1s in quick succession might be the problem in your case. Not saying it's right, but I bet it raised some flags.


I am sure it did, but if they had a concern or question, why didn't they just ask me to explain what happened? That would make the most sense to me.
I would have been happy to explain it. I left it open for them to ask when I emailed them after her interview and told them if they had any questions
I'd be happy to respond. Far be it for them to act sensibly and just ASK instead of play this AP game for months on end.

I read the review. It's unfortunate that we didn't have more info like that sooner. I could have prepared Teaw better for the onslought of attitude the 3 people interviewing her had. While the reasons for a divorce in the past or whatever should not be their concern, it's unfortunate they put people on the spot and try to break them down. I know Teaw was very nervous not knowing what really to expect. Of course, your man being an attorney I am sure helped greatly in being able to hold up against them. For most of the women I am sure they feel very belittled at the interviews. Oh, well. Still waiting. Wrote the embassy for an update 3 days ago and have heard nothing back yet.

So when is he coming over here, Kare?

Mike, you don't need a PIN but she does need to pay the new $350 fee at the post office and provide the receipt. Make sure she makes at least one copy of the receipt in case the original gets lost.

I am not clear on which form you need to submit. You could email the embassy and ask them to clarify it. I am sure they will tell you.

Well, Anya, Teaw needs XS in some lingerie and I now it's hard to find some clothes here that fit well. I told her we'd go shopping so she could buy a couple pairs of jeans and stuff like that to bring here
until we had time to scout it out more. We have TJ Maxx and all that here, of course, since you are right up the road from me. Just finished an appeal where a guy was going around TJ Maxx, filling his cart
with stuff and then using old receipts to return the items and get money back. Was his first felony but he had some prior cases that never got past being charged for the same stuff at other stores. When they
searched his car he had about 18 bottles of wine, bunches of empty bags from Marshall's and TJ Maxx, Target, lots of new clothes with tags on them and tons of receipts laying around...his BMW no less!! Now you
know why some prices just go up and not down. Hope all goes well with the baby. Your life will be much different. I am assuming this is your first one.

Kang Lang, I am writing the embassy again to see what kind of answer I get. Usually the standard you are in AP and we will notify you but I think this time I will put that I know we are in AP and could you
give me some kind of time frame on when to expect an answer. Maybe they will be a little more specific or they might look at our case sooner. Worth a shot at least.
