Hi, my fiance is getting stationed in the UK next year and we plan on getting married there. I'm currently finishing my studies in Poland and I intend to join him there. After we get married, can I apply for CR-1 in case we'd like to visit his family in the USA? He will be stationed there for at least 3 years, I'm afraid that before he gets the chance to travel my CR-1 would expire. Is there some other document I can apply for living abroad that would allow me to travel to the USA freely? I didn't see any topic that would cover the case of marrying a military member stationed outside the USA. I really need some help and advice on how to obtain all possibly needed documents from the polish side while I'm still here. Help, anyone? helpsmilie.gif

 

CR-1 is not for a purpose of visiting family in the US, it is to enter and stay as a permanent resident. You will need B2 tourist visa and I don't think you will have any problems with getting it in London as a wife of USAF serviceman.

Mike, if she has B2, she always can attempt to enter US. They will most likely scrutinize her more at POE when they see she has an immigrant visa application in process, and there is not any guaratee she will be admitted... That said, if she is able to convince CBP that she's only visiting and going back to Poland to wait out CR1 process, she'll get 6-months I-94.

You need recent paystubs to show the current income. Show gross income.

and just petition for a K-3 visa? It's good for 2 years, and you can easily apply for an extension.

Send in your I-130 package...when you get NOA1, send in I-129f.

No offense taken about your comment. Just wanted to make it clear we are not trying to do anything illegal. I am not sure how many times I could get her to come over here...maybe once a year?? But I'll check further and then decide which way we should try to go. The idea of her being able to come and go whenever she wants is certainly more appealing than the tourist visa.

Our intent is not to circumvent the immigrations laws, but if I can get her a visa so she can come and go freely over 2 years, that would ease the strain of me flying there 3 times a year and allow her to meet my family. I'd hate to have to apply for a tourist visa every 6 months or so to get her over here. That can get just as expensive as getting the K-3 or maybe more. We went through the I-129 process all the way up to having an interview date this last August and then she said she didn't want to be away from her daughter for up to 6 months waiting for the AP so she could go back and forth after that. So we just got married while I was there since that was our plan anyway.

But do you really think the notarized letters would work? They are real hard on tourist visas in Thailand and although the wait may be longer, I am thinking the K-3 or CR-1 would be the best route to follow for now. By the time she got it and came over and the 2 years expired I would be about ready to retire again and move over there. I do appreciate all the advice as it will help me decide which route I want to take next. So keep it coming!!!

I found the answer to what the CR-1 visa was but now I have a question about if you file the I-130 how do you designate it as a CR-1 instead of the K-3? I did not find an answer to that in the guides.

A question for you learned people. When last I wrote I was headed to Thailand to see my fiancee who had decided she did not want to follow through with the K-1 visa. While there I extended my trip an extra week and after a few hassles with papers at the Amphur's office wanted we got married. I know how difficult it is to get a tourist visa and probably even harder now that we are married as the will probably think she will come here to stay illegally on that visa. But I do want her to come here and meet my parents, grandkids, my kids, etc.

So any suggestions on any other kind of visa I can get to get her here for 30 days or so other than a K-3 now? I'd hate to go through all that process just to get her here for about a month only and then go back to Thailand. I still plan to move there in 2-3 years when I retire again. And yes, I wish she would have agreed to finish the fiancee visa, come here for 4-5 months and then she could have gone back to Thailand. But that's not an option now that we are married.

I kept the originals and sent copies and I have all the original translated papers from Thailand. I sent in the K-1 late January to Vermont and she got the packet from the embassy I think Saturday...at least it got to Korat which is the address she uses but is in BKK still studying yoga and her sister, who brought it down with her, forgot to give it to her. I am not too worried about establishing the relationship as I have almost 3 years of emails, phone bills, text messages and pictures from 8 trips and going back on June 18th. So I don't think that's going to be a problem. But thanks for the info. This is my first experience with anything of this kind and it's good to have "experts" to look to for info.

I'll do a timeline if I get time. I work a lot...bring home stuff to do almost every night and weekend and I am still feeling my way through this site.

I did not find the info searching but if I provided all birth certificates, divorce papers for both of us in English and Thai when I mailed in the K-1 application, will I need to supply all that stuff again at the interview in Thailand (which I plan on attending)? I provided pictures of all of my visits that included my fiancee and family members, dated them on the back, copies of my passport stamps. But I am wondering if I have to provide copies of all of the divorce and birth cert. stuff again for her interview. Thanks!!

What about a situation where the fiancee also filed for the child at the same time as the 129-F is being processed so she gets a visa at the same time as the fiancee BUT the child will only be brought here for a visit of about a month about six months later. She will be 11 and does not want to live here in the USA...although that could change but I don't think it will. Will the daugter have any trouble leaving the US after the visit on that visa?

This may be old news since I have not checked the board for awhile now. I have a friend that just got back from Bangkok as he went for his fiancee's visa interview. He said he was barred from going into the interview with her and had to wait outside the embassy. When he was able to talk to a State Department employee, he said they had had some trouble with petitioners arguing with the interviewers when the visa was denied and about two weeks ago some guy not only started to argue with the interviewer, but jumped over and punched the guy out. So now all petitioners are not allowed into the embassy to accompany their fiancee for the interview.

The fact that she didn't go to the medical exam is a concern, only because I knew of someone else I know who refused to go for a medical exam, and there was a definite reason behind it. For a Thai person not wanting to leave Thailand is not unusual, because most Thai people I know there love their country, love their culture, and love their King. Unlike other countries where a lot of the women are looking for a plane ticket out... Thailand is not one of those countries, in my humble opinion.

Sorry Tom, but no townhouses in Bkk! I do have an old Navy buddie of mine who has lived there in BKK for 20 years... maybe he may know of something?

I am not worried about anything being wrong with her and it being a concern not going to the med exam. She is healthy as all get out. Works out, exercises, does yoga. I know about her minor ailments and all. In fact, she is more broad shouldered than most Thai women, walks very straight and many times people think she is a katoy. She does not look like those weight lifting women but she is strong as an ox and could probably whip my butt good if we got in a fight. But I can vouch for the fact she is NOT a katoy..lol..and also has her daughter and had her by Caesarian and has the scar to prove it, although thankfully not real noticeable.

Ya, I think the interview is definitely off, unfortunately. But maybe it will work out best this way. I'll just have to wait and see how she is when I get there.

We've been to Chiang Mai, Koh Chang, Samui, Pattaya (Jomtien) but that's about it. The last 18 months about she has been doing her yoga first in Pattaya and then up in BKK for over a year. So since she is at yoga pretty much every day we don't stray far. I found out tonight talking to her on the phone she never went to the medical exam. The money I gave her for it she said she will use for my belated birthday present. I only wonder what other surprises she has for me when I get there. YIKES!! Since she seems so adamant not to go to the interview I am debating whether to add the weight to my carry-on with all the papers I was going to take for the interview. She insists she won't go now so I don't see me convincing her otherwise.

Her family had money too. Dad had a construction business and they built houses for farangs and Thais up in Korat. He gave it to the oldest son a few years ago and he has ruined it to the point they had to sell it. The house is on the property with the yard for the business and the bottom floor is partly a hardware type store. But I won't support any of the other family. If mom wants to live with us when I move there, that's fine with me, but that's the limit. Long story, but mom and dad are not together and she is not real close to her dad. Still married cause they both owned the business.

Oh, well, life goes on. I'll just go with the flow and see what happens.

Mostly stayed in BKK due to her yoga courses but eventually I will be able to move around the country and see a lot more. Got a townhouse for rent in BKK for a good price?? She is looking for a new place since we were giving up the apartment we have now at the end of August. Will spend about a week up in Korat before I leave to come back. I always hate coming home but but the time I leave I miss my house here.

Well, I am pretty pissed, more at the money part of it and the fact that her daughter came down last weekend and they went and did the medical exams which I paid for....so why didn't she tell me before I gave her the money for that??? I can survive the money part of it, although I'd rather still have it. But I guess I am at the point in my life where nothing surprises me and honestly, I kind of know what she means about not wanting to leave her daughter. If I had had to leave my girls when they were small I am sure I would have gone pretty nuts. Does not excuse the fact that if she was thinking seriously about it not telling me sooner.

As far as long distance, we talk so much on the phone, internet, email that we don't really miss each other that much other than the physical company sometimes. And I have been over there 8 times the past almost 3 years to see her.

She was here for 90 days in 2005 and got introduced to Christian religion and read the Bible and stuff so she has sort of moved that way. But there are actually more Thai women there that are Christian than you would think. One day on the skytrain I ran into two Mormon missionaries which surprised me. And I am past the point of EVER paying a sinsod or dowry since I have supported her totally for over a year and paid for he yoga training, etc. and paid for her daughter's private school and a few other things. So I don't feel I owe anyone in the family one friggin cent!!! Of course, whenever we go out with her cousin and half-sister...who live together...I am the one who always pays, the rich farang, you know?

Thanks for all your kind words and help but I don't think any amount of talking is going to get her to change her mind, unfortunately. Trying to get her and her daughter over in Oct. would not work out I am sure if she went ahead with the interview. And her daughter would have to be back for the start of school and the AP would not come fast enough. Although I do believe they can be out of the country and use the AP to return. I know about the marriage part and she has already said we'd go sign the papers and it would be registered, etc. No Buddhist ceremony for her as she considers herself Christian. I'll just have to wait and see what she says tonight. I think she is already looking for work and working on a new place to live so her daughter can come down from Korat. True, we might be able to get the visa extended so her daughter could finish the school year. I'll talk to her about that and see if that might help so they can at least come over for a visit. The other bright thing is I will save money on airfare!!!! My biggest gripe is the money I have spent on a new passport for her daughter, photos, filing, etc etc that I can't get back now. Would rather be spending it on this trip.

I think her going to the interview is out of the question now since she also told me on the phone she opened her x-ray from the medical exam!! So that screws that up. I think she has made up her mind and there is not changing it so I don't think I have any options except maybe email the embassy after I get there and tell them to cancel the interview. Mom has decided she does not want to come her period!! We were doing a visa for her daughter also to bring her over later. But after her mom brought her daughter to BKK for 4 days last weekend and she talked to her mom and had some more good time with her daughter, she does not want to come here, just get married and stay there. She was here for 90 days the first 3 months of 2005 and was homesick, missed her daughter and had a few bad experiences and I think that is part of the problem. She just called the airline and returned home after her daughter told her on the phone she missed her and wanted her to come home. She said she won't even go to the interview to get the visa to use later if she changes her mind as she says she won't change it. Her daughter is 11 on the 20th and goes to private school in Korat and this morning on the phone she talked about bringing her to live with her in BKK now. So I am sure this will be an interesting trip when I get there late Sunday night. Guess I can leave all the papers home now.

Well, she told me last night while we were chatting that now she does not want to finish the fiancee visa, that she will not leave her daughter even to come here for 4-5 months, which was the plan. Here is the embassy's reply I got tonight: If you and the visa beneficiary get married before she travels to the U.S. on her K-1 visa, her K-1 visa will be invalid. And you have to file an I-130 and I-129F for her again to apply for a K-3 visa. By law, we cannot change from K-1 to K-3. You have to begin the whole application process again.
