Sorry for Confusion

First, W-7 (ITIN) is a temporary number for Social Security Number. When your wife gets here, she will automatically eligible to get SSN.
It is not "MUST" thing you have to have during NVC process. The only consideration is; if you file your tax jointly, it's one more evident of your relation. So, if you want to get ITIN number the option you have is: Ask your wife to send her original passport and notarized here and send it to Austin, TX office for the process

But in your situation, one important thing plays in role. Your Petition is already approved. If things go smoothly then within next 15 -20 days, you will have your case number and then you have to submit AOS package to things keep rolling. At this point, if you try to get ITIN, it might take up to 2 months ( some gets within less than 3 weeks, they are simply lucky), which delay your process at NVC.

There is nothing wrong to file tax returned as "Married filing Single" as there are a lot of cases where Petitions are approved. If there are other red flags, then it's totally different game. But Married filing Single vs Married filing jointly should not effect on Outcome of the CASE DECISION, at least, I believe so.

So, it's your call what you want next. Whether you want to wait to get ITIN and file your tax return or be ready for AOS (file Married Single and do amend when she gets her)

I dont see either way is wrong, its only matter of "DURATION" to complete your PETITION.


There is no such thing as 'Married Filing Single'. What you had in mind, I guess, is 'Married Filing Separately'.

I think what he means is that as long as you aren't having problems proving that you are married, then you shouldn't have to go through the extra work involved with filing Married Filing Jointly. Maybe you can just amend the return and file as Single. That is what I did (We got married in 2011, but I just filed as Single) and I also think that should be okay.

Maybe some other members who have experience in this area could give us some input on this?


Since the spouse was overseas for all of 2011, he should have filed as Married Filing Separately.
If filing as Married Filing Jointly, the overseas income would have to be included.
Should not file as Single since he is not single.

You're fine. If you have it already signed, no need to redo and send it back and forth again.
According to USCIS website the latest edition is 08/08/11 (expiring on 08/31/12), but previous editions are accepted.

I'm slightly confused by this, (which is an easy feat, I promise you) I am currently living with my parents (rent free, Bill free while I save up money)However, once my wife arrives here, It will be just me and her. The confusion lies here, Do I declare that my household is size 2 or size 4?

Maybe I'm not using my brain, and the obvious choice is 2, because we intend to be living in our house, with just the two of us. Argh, help.


If you make enough to support 2, that's what needs to be reported.
If you use your parents as a cosponsor, they will have to show 4.

Hello, does anyone know if the beneficiary can travel while there is a CR1 pending?

My husband lives in Mexico and we were recently married there. We are thinking in going on our honeymoon in December to Costa Rica. The flight is nonstop from Mexico City to Costa Rica. We would NOT be connecting anywhere in USA. Would we be able to travel without interfering with the petitioning?

I will begin the petitioning process pretty soon but wanted get some opinions before i begin the process. Your opinions are apreciated.

for the visa application your husband needs to send an original copy of his birth certificate. for the 1-130 a copy of his birth certificate.

The above is simply wrong. The foreign spouse's birth certificate is not needed at the petition stage at all, unless filing the petition abroad. Since the petition is not being filed abroad, the Consulate's filing instructions are not applicable. Use the I-130 filing instructions and the VJ Guides.

If he gets a job, no need to wait a year; as long as his new employer/ hospital gives him a letter stating he is a permanent employee, and he has a couple of pay stubs to show, you are good for the affidavit of support.

There is nothing wrong with taking good care of your mom, it is an honourable thing to do, but it doesn't mean being her servant 24 hours a day. If he gets a job as a doctor, he could afford home help during the day and still take care of his mom when he is home overnight/ at weekends.


Penguin_ie's is definitely the best advise you can get.

If your husband is in fact MD with valid medical license, he should man up and get a job. He will be able to support you and take care of his mother at the same time.

Need help please. I went today to add my husband to my bank account. I was told last week all i needed was to have him sign a form and supply copy of his passport photo/info page to add him... today I take it to the bank, and now am informed he cant be added because he has no tax id number. I have read where others have added their foreign spouses, so I know its possible to do. Can someone please tell me what I need in order to add him, as the lady I spoke with at my bank (state employees credit union), admitted, she had never dealt with adding a non US citizen before, and after several phone calls to her supervisor, still didnt know, (nor did her supervisor!) but if I could find out for sure, so she would know what the process is, she will then confirm what I tell her, and help me add him. Seems I will be the first to do this at this location. My husband and I are at the "awaiting our NOA2 now". Thank you for any help anyone can give us in advance :)



Is your husband in the U.S.?
If not it may be impossible even if he had ITIN or SSN, since the bank will need his original signature on the signature card.

You may or may not make it...
Your wife (she is an USC as I understand) can return to US anytime, you will have to wait for your CR-1 visa.

Thanks I was gonna go with that. Now if u dont mind me asking, my wife didnt change her last name (too much paper work to change passport, etc) we both agreed is better to avoid headaches. I have 2 last names, and she also has 2 last names, in the FIRST question where it says FAMILY NAME, we write down BOTH LAST NAMES in CAPS correct??


I don't really have an experience with multiple last names. Maybe members from Latino community will answer this one.

I married my wife in the US and she will soon return to Brazil (she was on a valid tourist visa and there will be no overstay) We have added her to my bank account and obtained credit cards (authorized user on my accounts) We added her to those accounts with her new married name so our proof of a bonafide marriage will be in her married name. She has not yet changed her name on her Brazilian passport which contains a 5 year tourist visa to the US.. It is our intention to show her married name on the I-30 with her maiden name as a prior name used. That ok?

If your wedding plans aren't already locked in and paid for, you could look into the fiance visa (K-1) it works in a similar fashion to the spousal visa, but you don't get married until you come over here.  It is considered a non immigrant visa and may get you an interview closer to where you live and be a little less hassle.  

 

I have no idea if this is even feasible for your personal situation, but thought I'd mention it in case you hadn't considered it yet

 

K visas, although considered non-immigrant, are handled by IV (Immigrant Visa) Units at US consulates.

She will have to interview in Stockholm, no matter CR-1 or K-1.
