Hello!

I'd like to clear up some questions specifically for sponsorship for k-1 visas.

My fiancé and I are trying to sponsor ourselves, I don't have an income, and his income just became above poverty line this January. We don't really have anyone we could ask to be our co sponsor. Also note, his income would be able to come to the US with him because he runs his own business selling apps, its not tied to a specific job in the UK.

1. To self sponsor do you need to show 3 years of tax returns? K-1 cannot sponsor themselves

2. Can a co-sponsor be retired? Yes

3. I've never paid taxes because I've never reached the yearly income required to do so, do I need send off for some sort of paper to prove that? Statement will be sufficient

4. What are our options if we can't get a co-sponsor and have to sponsor ourselves (I don't make an income so he would have to sponsor himself). None

We're kind of panicking because we don't have the 3 years of a steady income but this year we've reached beyond the government poverty line and the year is only halfway through. Any help would be greatly appreciated! Thank you so much for your help!

VSC's I-129F official processing time is 5 months, where are your 6 months coming from?

Congressional inquiry may help or not, but definitely won't hurt.

my fiance in Poland is confused about the DS-160, on the web-site it says he needs to fill it out but it's not for K visas.
He is trying to schedule an interview but doesn't really know how to do it or what he needs to turn in.

Visa applicants must submit a completed DS-160, Online Nonimmigrant Visa Application for all nonimmigrant visa categories, except for applicants applying for K visas.
K visa applicants must use Form DS-156, Nonimmigrant Visa Application.


Has your fiance received Packet 3 from Warsaw yet? It explains the whole process and lists needed documentation.
Your fiance does not schedule his interview himself, IV Unit at Warsaw Embassy will do that and let your fiance know of the date and time.

Not true. Translations don't need to be notarized unless explicitly requested by USCIS.
All the translator needs to do is to state that he/she is fluent in both languages and translated the document.

I know a thread has already been put up regarding this, but I asked my question on there and most people wasn't sure of the answer.

I know i'm ahead of myself, but I like to be prepared in advance.

When filling out the DS-230 form part I, it says you need to fill a separate form for each family member going with you, regardless of age.
Well I have a 7 month old son who will be coming with me but he already has a US passport and Social Security Number as he has dual citizenship, do I need to fill out a form still on behalf of him eventhough the K-1 Visa is just for myself.

Confused on this, any answers would be appreciated.

You don't need to apply for a visa for your son, so no DS-230 for him.

Hi all, im originally from Poland, living in United Kingdom. My fiancé is on work assignment and lives in the same city as I do, thats how me met. We applied for K1 knowing he will have to go back to US in 2013. We are living together since September just after sending petition.
So... we are nearly 3 months after NOA1 and it struck me that we might have not provided enough proof that we met in last 2 years. I mean we sent couple of pics (not date stamped) and travel itenaries for our trips to Poland and France. For both trips we have only had printable versions of tickets, which i am reading now are not accepted. I know know we should have send my fiancés passport stamps etc... but it was so obvious for us we are together everyday, we didn't think we are kind of guilty until proven innocent if it makes sense. Will it be enough that my fiancés current address he put on the form is in the same city as mine?
Then going forward any kind person could suggest what sort of evidence we can provide as proof of ongoing and genuine relationship. We don't do video chats and we don't have to pass borders to meet so no stamps.. we do text and call on a mobile (mine is on my name but his is pay as you go - so not registered to his name). All i can think of is to make some pictures with a stamps on them going forward and keep boarding passes from our vacation in January and have my engagement ring/receipt and my fiancé with me for interview. Any other suggestions? :-)


I think you have more than enough... stop worrying. In case you get an RFE, you can always add the CC receipts (or statements) suggested in earlier post.

I'm pretty sure USCIS expects U.S. citizen to use Roman alphabet on G-325A, no matter what their native alphabet was.
Your fiancee should write her name in Cyrillic alphabet in that field on her G-325A.

Your fiance's petition will be denied by USCIS and your case won't even be forwarded to the embassy.

That's odd, because when she came a few weeks ago, they asked her about it because there were no return stamps in her passport. Maybe she just got a rookie agent that day. Odd though because that was also the only time she was actually pulled aside and asked secondary questions. You'd think they'd have more experienced agents in the secondary area.


Stamped or not, all passports are swiped on both entry and exit. CBP has this information in the system.

in the guide it says to attach 2 to 5 pictures of us together. but i have about 25 pictures and as im holding them it feels like a bit much. should i limit the amount of pictures or is front loading this a good thing. i have been reading that at the warsaw embassy its pretty relaxed on all that considering the EU has stronger currency than even the US. sny help is greatly appreciated. thanks


Please enlighten me what strength or weakness of currency has to do with it.
Not to mention, exchange rate doesn't say anything about currency strength either.

25 pictures is too many, IMHO. I would use 10 max and staple them 2 to the page (5 pages total).

The interview wait time in Brazil is one of the fastest at the moment, the average wait time once your petition gets to the consulate is 2 days for an interview. You will be able to bring her here in the adequate amount of time ithout the visa expiring. You are now in a waiting game if you look at my timeline you will see how long it took for my approval but on average right now its around 8-9 months wait for a approval.

We just phoned uscis and the national visa center, and when we spoke to the woman at the visa center she said that because our NOA2 said it was being forwarded to the consulate listed that it wasn't even going to go through them, it was just going to be sent straight to Canada......does this happen? 60 days is nothing! In normal circumstances, the processing time for noa 2 is 5 month but this years the processing time reached the 7 and 9 month. Most of the august, sept, oct, november and december are still waiting for noa 2. And after the NOA2 you need to wait at least 2 month (after noa 2, the nvc receive your package, they check it again and then they send it to her embassy) so the normal processing time for an entire k1 process is not less than 7 month. I guess you are new member so you need to check the processing time chart for each stage of the process, so you have an idea how much time you need to wait


OP responded to RFE almost 60 days ago. His question was about RFE processing, not entire K1 process length.

It's my understanding that the employment letter is a must-have.  I could be wrong, and I'm sure SOME people have gotten through without it, but since so much depends upon your income and being able to prove that your income is ongoing (not just your past income), the employer letter should state that you are currently employed, thus giving proof that your income will continue.  Paystubs don't provide any proof of future income.

 

As for the bank letter, you need that ONLY if your income is below the poverty level.  I am including it, because my income is so variable and although it's good right now, it's been shaky in the past, so I'm using investment/bank accounts as a safeguard.  It took literally 5 minutes at a desk in the bank, and they printed it right out for me -- well worth the time, in my opinion.  But if you are comfortably and reliably above the poverty line on income, then you don't need the bank letter OR bank statements at all.

 

How the employment letter will prove that your income will continue? It will prove that you're currently employed and how much you make, but I seriously doubt that any employer will include prediction about your future with the company and guarantee future earnings.

Hello everyone, I'm brand new here and this is my first post! 

 

I've been reading a few posts, especially the pinned one about visits while waiting for the K1 visa.

I couldn't find the answer to my question, I don't know if the topic's been discussed before. If it has, I apologise in advance!

 

I am binational: Swiss and British, currently residing in Switzerland. When my fiancé and I filled out the I-129 F form, I only had a Swiss passport but in the meantime I've received my UK passport which had expired in 1998.

 

Anyway, I read it was ok to visit your fiancé but that it was a lot of stress and anxiety as they could deny you access and send you home. Obviously, I would prefer to avoid that scenario.

 

Do you think it would be fraud if I tried to enter the US with my UK passport, knowing that I'm applying for a K1 visa with a Swiss passport?

If you think it would be, then at what stage should I inform the USCIS of my dual citizenship? does it matter at all?

You are not applying for K1 visa with any passport yet. YOUR FIANCE just filed I-129F petition on your behalf. Long way to go before YOU wil be applying for a visa at the consulate. 

 

I doubt you will have any problems with entering US on British passport, but the best way to find out is to apply for ESTA.
