Good morning all.

I was just hoping to have some questions cleared up about the CR1 visa. I know i might sounds like a might of a newbie in here, but we (my fiance and I) know USCIS very well, as my timeline kinda points out. Sadly we are at the point of so much frustration with the system that we are looking at alternative arrangements.

A bit of background first.

I (Australian citizen) am currently staying with Chris (US Citizen) in the USA, we applied for our fiance visa (K1) 13months ago. It has been screwed around by USCIS, expedited, lost twice, into court twice and frankly going nowhere. So we were considering getting married in the next couple of weeks and applying for a spouse visa, before you get all excited yes I will be exiting the USA on the 27th of October no matter what as that is when my visa expires. If we were to marry and I stay, they would have us for visa fraud in AoS, even though all we want is to get on with our lives....

Onto my questions.

Application of the K3 and CR1 visa are one in the same, and thus require the same forms, and checks right? However I can drop the K3 during the process as lately the CR1 has been faster, and more appropriate (come in with work rights extra)? Applying for the K3 requires you to send another form in after you receive confirmation of receipt of the I-130. I don't know the entire process for the K3 however I do know that you can drop either the K3 or CR-1.

From what I have been seeing looking around at the moment the time from NOA1 - NOA2 seems to be around the 3 month mark, how long should i expect that the process will take? This depends on where your petition is sent, California or Vermont. There is no guarantees and your petition can be approved in a few days or up to one year. There are many people who have been waiting many months for an approval

Is this one done mostly through USCIS like a K1?

And if i choose this route over K3, am I making a better choice for my situation? (i know that seems like a dumb question but any insight would be wonderful). I think only your lawyer can tell you that.

My husband came on the Cr-1 Visa path about 6 months ago. I highly recommend that you do it. Overall it is cheaper then the K-3, takes about the same time as the K-3, but the Cr-1 has more benefits. Basically what happens when you apply for a CR-1 is that you fill out an I-130 and all requested documents and send them to the USCIS. They take their sweet time and then when they approve you they send your case to the NVC. The NVC can take any where from 2 weeks to months depending on your situation and if you have your documents ready. Once it has been approved it will go to your embassy where you will have an interview. Juding from your case you might be able to apply for an expedite of the case.

Once you are in the United States you can work, go to school, get a license and you will not need to deal with the USCIS for two years when you apply for your 10 year green card. From my understanding with the K3 you can not work, go to school, or get a license until you have ajusted status which takes months and costs over $1000. Personally if I were you I would pick the CR-1 just so I wouldn't have to deal with the USCIS for another 2 years. You have been through a lot and it says alot about a relationship when two people can endure such troubles and an extended period seperated. Good luck in your process. good.gif

I would call once a week to find out if you have an interview. That's what I did and I found out that my interview was scheduled after the 2nd week of the month. So they actually do schedule interviews at other times but just tell everyone they schedule on the 2nd. However, this may be due to the embassy in Lima, Peru having less demand. Anyway it couldn't hurt to call and ask.

You should read the NVC short cut guides which tell you how to get through the NVC the quickest. Your wife should fill out and mail the DS-3032 and DS-230 with all the supporting documents to you when you receive your NOA 2. If you wait for the NVC it will take much longer to get through the NVC. It is possible to get a case complete in the NVC in a matter of weeks if you have all your papers ready. Do you know all the documents you need?

I went to an IRS office last year to try to get an ITIN number before doing my taxes and was told you can't do that anymore and can only get it when filing your taxes. This makes it so you are unable to E-File. Just FYI.

I filled with an ITIN and the process was a complete nightmare. I filed as soon as I got my takes in February with the help of Jackson Hewitt. Basically I got someone who had been trained two weeks prior on how to do tax returns and as a result I had major problems with my taxes and it took about 5 months to my refunds. Moral of the story is to go to a very good tax accountant if you want to go this route. Also, I had my interview on April 2nd which is before the due date for taxes and the embassy still wanted a copy of my taxes so everyone should make sure to do them early if you have an interview date around the time taxes are due.

I had the same thing happen to me. I debated giving all three years because one year was under the 125% requirement but ultimately I did include that information. I didn't have any RFEs due to this and at the embassy they didn't care. As long as you can prove over 125% for the current year with pay stubs then you will be fine.

Engo, the USCIS does not need the foreign spouse's birth certificate in the I-130 packet. They do need a photocopy of the US citizens birth certificate (both sides) or passport (copy of all pages). You will send the orginal or certified copy of the foreign spouse's birth certificate to the NVC. How did you send it to the USCIS before? Did you use tracking or just place a stamp on it? I used Epress overnight mailing from USPS and had no problems. Note that the USPS is the only one who delievers overnight to post office boxes.

Now that you have payed the fee you need to wait until the payment clears and then you can print the coversheet. Once you have the coversheet you need to collect the documents for the AOS packet. These documents include the I-864, letters from employers, paystubs, tax returns and or tax transcripts, and any co sponsor info if applicable. Once you have all the documents you can mail them to the NVC.

You will soon receive your IV bill and you will do the same thing. Pay the bill, print out the coversheet and mail in the supporting documents.

As I posted please read LingChe's Shortcuts. It completely explains how to get through the NVC process. You will need to call the NVC to find out your NVC Number and you can also give them your email address. I hear that now they email everything as apposed to sending everything snail mail. However, if you decide to do this without a lawyer you will have to be very proactive if you want to clear the NVC by the time you go to see your wife. I know it may seem difficult or confusing but read the guides then come back to the forum and ask questions. The process is simple and relatively quick once you read it.

First congrats on the approval!! If I was in your shoes I would send the documents to the NVC. You have more than enough time to get through the NVC. If everything works out your wife will get her interview while you are there. That way you can go with her to the interview and fly with her and the baby to the USA.

The process is very easy. Read the guides and prepare everything. Have your wife begin to collect the documents now and then send them to you through UPS.

Well seems you are already half way through the NVC. As long as you have the required documents to send to the NVC such as your birth certificate, tax information, and proof of income than you should be fine. The rest of the documents come from the foreign spouse. Mail them into the NVC when they are due and drop the K3 and avoid the headache of dealing with immigration when your spouse gets into the US.

We choose the CR1 and have not regretted it. My husband was able to get his social security number, his drivers license, and a job shortly after coming to the United States. If you go K3 then you will be waiting a long time until your spouse can work, drive, or go to school. You really need to read the guides and understand the process completely. It is cheaper in the long run as well. Also, when I was applying for my husband's visa I kept track of others who started the process at the same time as me. Those who applied for the K3 actually ended up receiving an interview about 1 month behind the IR1. In my opinion it is not faster then the CR1.

From your timeline I can see you are at the NVC. I did not sumbit anything to the NVC to prove a bonafide relationship. I did submit somethings to the USCIS but nothing when I got to the NVC. However, I don't think it is really necessary to provide these things at the time you submit the I-130 especially if you are in a new marriage. I did bring all of the things you mentioned to my husband's interview. They asked for nothing and wouldn't look at letters from family members I tried to give them. I personally think those items are most important at the time of the interview because during the interview you really must convince the officer that the marriage is real. I say calm down and provide the items to your husband when he goes to the interview. Good Luck! good.gif

We are filing our affidavit of support with a joint sponsor. I am currently filing my 2008 return to submit with the joint´s sposnors taxes. I have sent my Colombian income information to an accountant in the US and he claims I must state Single status on my 1040 because my husband doesn´t have a US social security number. Is this true? Will this cause problems with immigration, since we are married and are applying for a spousal visa?

I agree with Darnell this accountant is very stupid. The ITIN is specifically for non US citizens who have a taxpayer obligation. I went this route with my husband and obtained an ITIN and filled jointly. In my experience it was a nightmare but my accountant turned out to be stupid as well. The IRS doesn't make it easy for us!

I agree with k.loveh. The directions on page 3 of the I-864 state: "A joint sponsor does not have to be related to the petitioning sponsor or the intending immigrant." The co-signer's relationship to the beneficiary and petitioner does not matter. The only thing that matters is that make over 125% or over 100% if they are in the military.

Some are not getting a read receipt for a few days and then an acceptance of the DS-3032 after about a week or even longer.

I sent mine late on the 29th and have not heard anything back yet. I am just going to wait. I did mail in the hard copy on the 30th.


I emailed mine the day I got my case number and once more a few days later. On the day the DS-3032 and AOS bill was generated they also accepted my email DS-3032. It took about a week but I did receive two emails from the NVC acknowledging receipt. Give it some time good.gif

First congratulations!! Take a look at my profile for an idea of how long it takes form NOA2 to interview. It took us a little over 2 months from NOA2 to interview. Although we did wait 1 month for an interview. Your own time will depend on your own case. REad the short cuts and you should be through the NVC in a flash.

USCIS cashed the check but I haven't recieved the NOA1 by snail mail or Email. Curious.



Nope it's not unusual. If your worried and want your case number now its possible. If you have online banking and they show you the cleared check then look at the back of the check the numbers ofr your case are on there. I accidently put the wrong address on my I-130 and had to get my case number off the check. My case number was one number off but I was able to call the NVC and they gave me the right number.

In North Carolina they actually put on my husband's license that he is in the country legally. I wonder if he needs to keep his green card on him? Does any other state do this?

What is your experience? I'm briefly looking through a number of time lines here and I'm seeing an average of 6 months from the time of sending off the I130. I will be filing mine as soon as I return back to California in a month. Assuming I'm on the ball with everything and filing with California centers, is it safe to say that visa approval may happen in 6 months??? Has it been shorter for anyone? I'm in the UK and for their spouse visa we had an option to use a expediter which quickened the process by months. Is there a similar option here? Thanks guys!



See my timeline below. This process is very difficult and alot is left to chance so no one can really say how long your petition will take. If your case is straightforward and you don't make any mistakes and they don't make any mistakes (example loosing your petition) then it should be 6-9 months.

Thanks guys. I am planning on getting fresh birth cert (certified copy from municipality - my wife was born in Ayabaca but it was registered in Siicha... luckily much of her family is still up in Sullana, so we will be able to get these) and fresh marriage cert (from Jesus Maria). Regardless of what the embassy is telling us, I will provide RENIEC certification of both (we spent all day in RENIEC registering the marriage cert, so might as well use it), especially since we will have to go and get the cert for her birth certificate anyway. My step-son's birth certificate (Miraflores) says RENIEC right on it, so I assume that it is good to go, but since we have to go wait all day at the RENIEC anyway, might as well take it along for the trip. I have plenty of "originals" (i.e. certified copies from the entity where they are registered), so if they don't give 'em back, no biggie. I have most of the stuff translated into English now, and can get fresh "originals" from the translator on short notice (agency is just up in Seattle), but I don't think I need translations for that stage (everything is either in Spanish or English).

Small world indeed I have a brother in law who works in Seremsa. Our marriage was the first between an American and Peruvian in Agustino. It was kinda funny because they brought in photographers to take pictures of the wedding for their records.

We got married in El Agustino and had RENIEC legalize our marriage and his birth certificates (birth certificate from Chiclayo) and yes it was a nightmare. We had to go there 3 times to get everything right!! They kept making mistakes on our documents. We got everything translated into english for a small fee. Let me give you a heads up. When you get to the NVC send copies of your wife's birth certificate and marriage certificate. If you send originals then the embassy will keep them!! I sent originals because I heard that you could get them back if you asked. It's not the case and now we don't have an original birth or marriage certificate! Let me know if you have any more Peru specific problems!

Use the shortcuts and get everything ready before you go. The only thing you need from the NVC is your barcode sheet after you pay them. But if your mom is fairly decent with a computer she can print that out and put it with your package. If I was in your shoes and wanted to save time and money, then I would just have all the package ready to go and leave my mom very detailed instructions.

If you designate the spouse in Egypt as the agent of choice then be prepared to wait a long time at the NVC. It could take up to one month to receive the letter with the information (IIN) you need to pay them with.

:dance: So...this probably means nothing but I talked to my case worker today. Not because of anything really. They had messed up some of the names on my form and so I had to call them and have them fix it. Well she had a question about it so she called me today. I asked if she was the person assigned to my case and she said yes. She then (on her own) said she would look to see if everything was ok, since (in her words) "she could" ( :blush: ). She gave it a quick glance and told me that she saw my marriage license then asked if I had an English translation and I said yes. She said that it wasn't attached (but it was) and then she saw that too (no need to argue when you get a chance to talk to the person in charge of your case). She then saw a birth certificate and thought that it was my husband's but I told her it was for our daughter. She asked if she (our daughter) was born here and I said no. She then asked if I had a petition for her and I said no (b/c she is a US citizen) so we went around about that for a second and then she said that is good that I got her registered at the Embassy or I would've had to file a petition for her. She then said it all looked ok and then told me she would send the new NOA1 in the mail soon.

I know that doesn't mean much nor does it guarantee a quick NOA2 but it was awesome for those few minutes to talk to the person reviewing my case. Hopefully she "likes" me and will be nice and give us a shot for an interview in the next coming 6 months.

Yes, we scheduled my husband's medical exam with the interview letter. You need to take the letter, your passport, picture, and shot records. Be prepared to pay above the set fee for any extra shots you may need. Sounds like you better hurry up and schedule that exam.

I took a ton of proofs of our marriage and was asked for none at the interview, but I am still glad I took it, even if just for peace of mind. Make sure you have your 2009 taxes ready. I had my interview on April 2 and was asked for my taxes (even though they were not due). Luckily I had done them and had a copy. That was the only thing they wanted from me.
