IR-1 / CR-1 Spouse Visa Process & ProceduresI 129 F
QUOTE (Rings @ Jan 3 2009, 12:41 PM) <{POST_SNAPBACK}>
It was the best choice for us because we didn't want to wait, but it does cost more and it means more paperwork. If you can wait a couple months longer then it may not be the best choice for you financially. It may or may not be a faster way to be processed either. Sometimes the I 129F is not processed BEFORE the I 130.

It seems that people who have filled the I 129F with the I-130 are taking longer to process (especially at Vermont). It used to be that the CR1/IR-1 was slower then the K3. I would recommend the CR1/IR-1 because it is cheaper in the long run, faster, and a better Visa. Good luck with your process. good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresAnother I-130 Question.... Affidavits for Bona Fides marriage
QUOTE (222Andy @ Jan 9 2009, 08:10 PM) <{POST_SNAPBACK}>
My wife and I obtained two affidavits to show bona fides of our marital union. However, on these affidavits, some one decided to hyphenate my wife's middle and last names!!!

I'll use the initials for the sake of protecting our information... S and K are her middle and last names respectively. So then on the affidavits, her name is listed as Kimberly S-K (actually full names are on the papers so don't forget!) which, in my mind would make them both her last name... all the other paperwork shows her middle and last name separate....

Is this going to be a problem????

Thanks,
Andy

I think that you will be ok. We had 3 affidavits to show our marriage is bona fide. My husband's legal name is Piter, they misspelled his name when he was born. wacko.gif Two of our affidavits had his name as Piter but the third had his name as Peter, which is what his name really is. We had no problems with this and didn't get any RFEs for our I-130. However, I do recall putting Peter as one of the names he goes by on some of the forms ( I can't remember which one). Hope this info helps.

QUOTE (222Andy @ Jan 9 2009, 07:58 PM) <{POST_SNAPBACK}>
Hi, it's me again... before I submit my I-130 (appx two weeks away from doing this) I had a couple questions about the photos that are required...

How strict is the processing center about these photos... my wife sent me some passport sized photos, but they have a blue background. She also sent me some slightly larger sized photos with white background. The standards say it must be a white background and that from the top of the hair to the chin must be 1 inch. These that I have are 1.25 inch.

So my dilemma is this: I have two sets of photos. One set is the right size but the wrong color. The other set is the right color but the wrong size...

Any advice?

Thanks in advance,
Andy

My husband's photos where smaller then our standard American pass port photos and were accepted.

Local: caserio Jaldar

On his passport it says he was born in Loreto. (a department)

On his DS-230 I put: Caserio Jaldar Loreto Peru

We had no problems with this and did not include an explanation of anything.

On his birth certificate it has Chiclayo as his city of birth, however, on his passport they put place of birth as Lambayeque. For people who have been through the NVC, do you think that this will cause an RFE? I am planning on including an explanation of the differences and a map of the area. Does anyone have any suggestions or advice? I am afraid this will cause a delay in our process.

Thanks!!

IR-1 / CR-1 Spouse Visa Process & ProceduresAlbania Consulate- Interview 1/29/09
QUOTE (Lindsay G @ Jan 15 2009, 06:59 PM) <{POST_SNAPBACK}>
We finally have my husband's interview on 1/29/09! We're both extremely excited to almost be together again, but I am worrying so much that we'll have a problem or they will give him AP or worse. Our case is pretty straight-forward, no concerns, but you never know! My husband spoke with a lawyer who has translated our documents for us, and told her about our interview date. She told my husband that "there's a 90% chance they wont give you your visa right away because you are a man- they wont believe you"...!!!!!!. (there are no problems with our petition or any red flags in my opinion!)....... then told my husband that I really should be present for the interview (at least waiting outside as I can't enter), as they look very favorably on that (which isn't a suprise after spending time on this forum)...

I'm freaking out. I don't have time off of work (If they gave me time off, which I think my boss would, I'd probably have to use unpaid). I've been living at home for the last 8 months to save money so we can buy a home sometime in the near future, and am not kean on spending $1000 for a few days.

Do you think it is worth it to send an email to the consulate, expressing my desire to be there, but outlining the reasons why I can't? I have sent so much information to my husband, ridiculously organized, with pictures and ticket reciepts... do you think it could really just depend on my being in Albania at his interview time? Silly! I wish I could be there, but my husband can handle this on his own too.

Any advice?

I plan on going to my husband's interview in Lima. I know my husband can handle the interview on his own, but I want to be there to support him. You said you are freaking out about the process think how he will feel when the people in the embassy are grilling him. Just knowing you are outside waiting for him will give him more confidence and will look better to the embassy.

I also do not have any paid time off, but for me the cost is well worth it, because I will be there to help my husband with his embassy, to help celebrate our visa, help him pack, see his family, etc.

Ultimately it is your decision though. Good Luck good.gif

Thinking that we had better start getting together evidence of our relationship, we have a lot of emails both to and from my yahoo.com email address and also my google gmail account. I would like to just print off the recipient subject and date and would be grateful if anyone has done this before and the best way of going about it. My thoughts being that should there be a requirement for the actual email contents then it would be easy to access the email account and view whatever email was required, or else there will be a lot of paper being printed.

Many thanks smile.gif

Arthur and Roberta

Create a folder for both of your email accounts and put all the messages to your wife and from your wife in these folders. This gives a list of all the emails sent back and forth the dates and the subjects. Print that page. This will show a long string of emails between the two of you. You will probably have to print several pages. I plan on doing that and taking a few emails with me to the interview. Hope that helps! good.gif

I guess it depends on the embassy because we asked at the Embassy and they said that it would be in our packet that we took to POE. However, when we got there they wouldn't give them to us. In the end we never got our originals back. So it's best just to have extra copies.

Original Document Requirements
The applicant and each family member who will accompany the applicant to the United States will need to submit original documents or certified copies of the documents listed in this section from an appropriate authority (the issuing entity).

In addition to sending the original documents or certified copies of the documents to the NVC, the applicant and each accompanying family member must submit a photocopy of the original documents or certified copies of the documents.

I have a quick question.

I noticed that most people who are in this particular post have IR-1/CR-1 visa. Is that a better way to go? I am curious I am a novice in this Visa world. blink.gif Are they basically the same in regards to waiting time? Does one have precedence over the other?

Does that make it easier or faster having that type of visa?

I read the pros and cons...but lists are just lists until someone walks out the process.

What I have read about the visa process and what I have walked through have been different.

They are the same visa the only difference is that the CR-1 is for people who who are married less then two years before the foreign spouse enters the USA. They will get a conditional green card and will have to apply for the permanent green card after 2 years. An IR-1 is for people who have been married 2 years or more at the time the foreign spouse enters the USA. The foreign spouse will receive a ten year green card. The processing time and procedure is the same for the CR-1 and IR-1.

I did the same thing and my papers got to the right place with out a problem. I am sure this is a fairly common mistake there.

National Visa Center (Dept of State)TWO LOTS OF PAPERWORK FOR NVC AND CONSULATE?
QUOTE (LadyYang @ Sep 5 2009, 08:55 PM) <{POST_SNAPBACK}>
I am confused. It says that NVC requires DS230 I & II plus police clearance plus originals of court documents etc. My US Consulate in Sydney says that I need exactly the same forms submitted for Package 3? Do I need to duplicate everything - that is: one complete set of documents for NVC and one set complete documents for US Consulate?

Isn't this being a bit redundant or is it bureaucracy gone mad? Not to mention the cost to self for getting properly certified documents!!!!! Any help would be greatly appreciated.

The NVC forwards all of your documents to your embassy so they will get them that way. I never got any packages for my husband's interview in Lima, Peru, however, we brought copies of all our forms to be on the safe side. We had no problems.

National Visa Center (Dept of State)PERU (LIMA) NVC Documents Request
QUOTE (Carito @ Sep 28 2009, 10:51 AM) <{POST_SNAPBACK}>
Hello everyone. I hope someone can give me some help. My wife and I had mailed in the I130 with all the required documents as outlined on the state dept website.

A couple of days ago I get 2 emails (Checklist Letter Response IR5) documents about both cases saying that they need additional info or docs were missing. They basically wanted almost everything I already sent including the photos. The duplicate photos I still had I checked against the requirements and they were exact size and everything. Anyways... I called NVC and was told they never recieved any photos even though they were paper clipped to the top of the packet contents.

Is that normal???

Can someone please give me some info on exactly what I need to send for Lima Peru.

They are saying that I need the following which I already sent:

1) Peru Certificado De Antecedentes Penales (previously sent)
2) Peru Antecedentes Judiciales A Nivel Nacionel (INPE- National Penetentiary Institute) (previously sent)
3) Liberta Electoral (L.E.) or "Documento Nacional De Identidad (DNI) (previously sent)
4) Wife's Birth Cert (previously sent)
5) Petitioners Marriage Cert (FORGOT this)

I already sent all these and her parents went to the addresses specified and got the certified documents. Can someone please give me some advice or any additional input?

I also need to send a copy of OUR Marriage Certificate which of course is in English. Will I need to have this translated to Spanish since everything will eventually be sent to Lima for their interview?

Thanks so much!
Carito

I am confused because you said you sent the I-130 and then called the NVC. What exactly are you applying for and where are you in your process.

Regarding the AOS Package:
I already paid the 70 dollar fee, and I have all the AOS package documents completed, do I send them along with the cover sheet, or do I have to wait for the NVC to tell me to send in the AOS package?

No you don't need to wait. Go ahead and send all of the documents and the coversheet to the NVC.
