IR-1 / CR-1 Spouse Visa Process & ProceduresI receive the I-797C Notice of Action today

iT SAYS: THE I-130, PETITION FOR ALIEN RELATIVE HAS BEEN RECEIVED BY OUR OFFICE FOR THE FOLLOWING BENEFICIARIES AND IS IN PROCESS.

WHAT DO I NEED TO SEND BACK OR DO I JUST WAIT FOR THE NOA2?

THEY DIDN'T APPLY MY WIFE'S MAIDEN NAME IS THIS OK OR DO I NEED TO CALL USCIS?

Just sit back and wait for NOA2 or RFE. Is your wife legal name using her maiden name? If not just call them and they will fix it in their system. They mispelled my husbands name on a few documents.

IR-1 / CR-1 Spouse Visa Process & ProceduresWife Port Of Entry (POE) with Husband???

I am just thinking ahead for our honeymoon.

Once my wife gets the visa, we plan on stopping over for our honeymoon and then continuing to the US.

Can I be with her at the time of POE or do I have to show that I am already in the US waiting outside the airport?

Thanks!

I entered with my husband. We were in line at the POE together and I was allowed to go with him as he handed his paper work over to the immigration officer in the side room. So it will be no problem for you two to go together.

IR-1 / CR-1 Spouse Visa Process & ProceduresMy I-130 is out in the mail today! What now?

Hi All,

My husband mailed our I-130 today to start the process for me to immigrate to the US.

Thanks so much for all the help and resources on this website. I don't think we would have
gotten this done properly if it wasn't for this website!

I'm sooo nervous now.

What should I get ready in the meantime while we wait for the NOA2?

Not much you can do now but wait. You can start reading about the the process when you get to the NVC and embassy. That will better prepare you for what you need and what you need to do. Good luck!

I brought 3 or 4 large backs into the embassy and interview. it was no problem and no one questioned me. They did request an orginal of my tax return.

Not necessarily true. I requested my husbands origianl birth certificate and we were denied. So make sure you have extra orginial copies of all documents for your own records.

I still do not understand why the tracking package is necessary. Who can ensure that the packages sent to the embassy are really contained your case file?

Please elaborate a little bit. I am still confusing on the methods, advantages and validity. Thanks.

From my understanding there is no real need to track it. I just like knowing where my package is. I also want to know when it arrives in Lima so I can tell my husband to call the embassy if we do not receive the information packets.

IR-1 / CR-1 Spouse Visa Process & ProceduresTracking Package from NVC to Embassy
QUOTE (SankuNiku @ Feb 12 2009, 08:59 AM) <{POST_SNAPBACK}>
The NVC uses DHL to ship their packages. Once you confirm the date that the I-130 was sent, you can go on the DHL website to approximately track your case. There are forums here talking about it but I'll sum it up below.

1. Go to: http://track.dhl-usa...?nav=TrackByRef
2. In Reference, enter the info as follows:
EXP DD MMM YYYYA
EXP is constant
DD is the date before the day the NVC said they shipped the case.
MMM is the three letters representing the month the NVC shipped the case
YYYY is the year the NVC shipped the case
A is constant
For example, if the NVC says they shipped the case on February 12 2009, this would be entered as "EXP 11 FEB 2009A"
3. Date range for shipment - From: Enter the date of the day NVC said they sent the case
4. Date range for shipment - To: Enter todays date
5. Keep the rest of the fields blank
7. Once you enter the info, press "Track"
8. After a while you will see a list of all of the packages that left the NVC today. You need to search for the specific consulate, in your case Lima?
9. When you find the shipment the corresponds to your consulate, you will see the tracking number that you can record.
10. You can then track the shipment from the NVC to your specific Consulate

It says no shipment found on that date.

Has anyone been able to track their NVC case as it is transferred to the embassy? Is this only done once they have scheduled you an interview? There is some information on Ling Che's short cuts, but wanted to know if anyone has successfully done this.

IR-1 / CR-1 Spouse Visa Process & ProceduresBonafide Evidence docs with I-130

As WrightFamily said, "front loading" seems to be the trend. If you can, try to send some evidence from before & since the wedding as well. Keep in mind that you are basically proving that you did not go into marriage for the purpose of immigration. I know with some religions it isn't customary to have a courtship before marriage, but proof you met and spent time together before the actual wedding day would be helpful for your petition. Best of luck..

I sent a small book went I sent in my I-130. I couldn't believe how big it was when I saw it again at the interview. When I submit paper work now I just send the basics (tax returns, bank statements, car notes etc) but nothing in excess.

No, I haven't come across such a form. I know how frustrating it can get. The only thing I can think of is type your answers to each question in a word document, that way you can save your answers and not have to type them over, and when it comes time to print the form, just copy paste all the answers into the appropriate slot. They really should have made the DS230 saveable.

My husband was able to save it. I think he used Adobe professional but I will ask him.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion on DS-230
QUOTE (jm&mcs @ Aug 12 2008, 08:47 PM) <{POST_SNAPBACK}>
My husband is also from Peru and was also in the military. Here is what you have to do. Besides the 3 police certificates, you need an additional police certificate. It is called Certificado de Antecedentes Judiciales y/o Penales issued by Consejo Supremo de Justicia Militar. This information is on the Lima Embassy information page accessed through the NVC information pages. Although if you are doing a K-3, then you may not have an issue with the NVC. If you are doing the CR-1, which in my opinion is a far superior visa and cost a lot less, you will have to deal with the NVC.
We had a problem because the NVC said the military records were not sent. Well, they were. It took an unnecessary RFE, many phone calls, and a letter but was resolved. I would include in your packet a letter explaining that military records are not available for Peru. And according to the Lima Embassy information you have included the above certificate for a total of 4 police certificates.
My husband would like to know where you husband lives. My husband is from Iquitos.
Good luck with the rest of your journey.
Joanne

We are working on the CR-1. You said you sent military records. What did you send just the military card? How long are the police certificates good for? I am currently stuck at VSC and am preparing for the NVC. So wondering if it is too early to get these documents.

My husband is from Lima and was born in Chiclayo. Any other tips for me in the process as pertaining to Peru?

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion on DS-230
I am preparing for the NVC. I have a question about the DS-230. My husband was in the military but eventually left for medical reasons. He says that there are no military records just military cards. The department of state's website states that military records are unavailable for Peru.

QUOTE
Military Records

Unavailable. A military carnet (Libreta Militar) is available and required to be held by all male citizens, as well as all female citizens born after 1955. At best, it is an item of identification rather than a record of service.

So should I just send a copy of his old military card and an explanation as to why there are no military records or will they know that records are unavailable for Peru?

I know in the case of Peru that these documents are only valid for about 3 months. I think it depends on the country.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about I-864

I took some time of this year to travel to Peru and get married. I just started two new part time jobs. I have done some calculations and it seems that at the end of the year I will be right at the 125% poverty line or just under it. My question is should I secure a cosponsor? IR-1 / CR-1 Spouse Visa Process & Proceduresjust confused, need help
My husband and I are pursuing the IR-1/CR-1 path because it is cheaper in the long run and will allow him to work, drive, and go to school sooner then the K-3. I was very tempted to apply for the K3 if it got my husband here even one month faster. I miss him so much, but I thought about it and realized that while it would reunite us quicker it would prolong the visa process and would delay him going to work or school when he comes here. So I decided to suck it up and apply for the IR-1/CR-1. Overall, it is the better visa. When we submitted our I-130 packet we included the following:

Cover letter stating what we were applying for
I-130 form
His and my G-325a
passport photos of us both
Copy of my birth certificate and passport (only one is necessary though)
3 affidavits from people who have seen us both together
Translated copy of our marriage certificate
affidavit from me stating we did not marry for immigration purposes
copies of some emails, phone records, chat records, plane tickets from my trip to peru
Pictures of us together
some western union receipts

Most people would say you only need to send the I-130, G-325a, passport photos, the US citizens birth certificate, and marriage certificate, but personally I prefer to send to much then to send to little whistling.gif I recommend that you triple check everything and not rush to send the paper work out as well as to keep records of everything. Overall, try to remain patient this is a long and very difficult process. If you are unfortunate enough to have to send your paperwork to Vermont prepare yourself for a long wait, there are some VJers who have been waiting at Vermont for over 6 months.

Best of luck to you. good.gif If you have enough more questions you can send me a message. I am stuck in Vermont so I am not that much farther ahead in this process, but will try to help in any way possible.

Hello everybody! I have a silly question. I am debating now with my fiancee whether we should change her name or keep her maiden name when we get married. My only concern is the government workers that see fraud in any marriage. We want to keep her maiden name because it will save us tons of time and effort. But I want the hole process to go smoothly so I am kind of paranoid. So what do you think?
Thank you all!

From your info it says you are going after a CR1/IR1 so I assume you are already married? I am the US citizen and when I married my husband I kept my maiden name just to keep everything simple during the process. When he comes to the USA I will change my name to his. Hope this info helps. I am not sure if this is possible or how it works if your wife is not the USA citizen.

A loan is something that you pay back, therefore is not considered "Income". Income is something that you get and keep.

Your student loans are NOT listed on your IRS returns as income.

A cash grant that does not need to be paid back, that is used to pay for school expenses could be considered income.

I would be looking for a Joint sponsor, if current income falls below 125% poverty line.

Yes, I have anticipated that and have a co-sponsor set up. My co-sponsor is self employed and I do not live with the co-sponsor. Which form should I have the co-sponsor fill out? It also states on the USCIS website that "Proof of current employment or self employment". Are they referring to tax transcripts?

It was the best choice for us because we didn't want to wait, but it does cost more and it means more paperwork. If you can wait a couple months longer then it may not be the best choice for you financially. It may or may not be a faster way to be processed either. Sometimes the I 129F is not processed BEFORE the I 130.

It seems that people who have filled the I 129F with the I-130 are taking longer to process (especially at Vermont). It used to be that the CR1/IR-1 was slower then the K3. I would recommend the CR1/IR-1 because it is cheaper in the long run, faster, and a better Visa. Good luck with your process. good.gif
