IR-1 / CR-1 Spouse Visa Process & Proceduresgot our interview date...couple of medicle questions
QUOTE (appleegg @ Jun 9 2009, 05:30 AM) <{POST_SNAPBACK}>
aloha all,

we finally got our interview date (july 13) phnom penh, cambodia.

we were notified of this by email, and advised on what to bring.

instructions for medicle examination; where to go, costs, what to bring, etc. it states "applicants should bring the attached forms..."
but there were not any attached forms provided for us.

should my wife be expecting a packet with the appropriate medicle forms?
should i find a particular medicle examination form on this site or elswhere and download and print it out, and bring it to her examination?
should i expect that the necessary medicle examination forms will be supplied by the hospitals that they refer us to?
could someone provide me the name of the form that we need?

thank you so much!

I am not sure if this specific to each embassy but my husband did not have to bring any forms other then his passport photos, immunization records, NVC interview letter, and his passport. But that was for a CR 1 visa. You might want to ask in the k1 form for more specific info.

IR-1 / CR-1 Spouse Visa Process & ProceduresK3 Vs CR1, want to know by someone who made this decision
QUOTE (Justin143Wendy @ Jun 8 2009, 09:17 PM) <{POST_SNAPBACK}>
I do appologize if this question has posted, i have seen something before but cant find it.

Realistically speaking, how much faster was the CR 1 for you? Are you happy with the decision that you made?

I currently applied for 1130 and the 129 to make it faster, but everyone seems indifferent. I have my approval so let me know asap, and maybe how to cancel the 129 to go the CR 1 route.

In my experience the CR 1 was better all around. I was part of the thread for people who applied for the K3 and the CR1 and so monitored the process for people who started at the same time as me in both visa categories for almost 9 months. I can tell you that the people who applied for the K3 were not approved for their visa until a few months after people who applied for the CR 1.

Overall, I am very glad I choose the CR1. Not only was my husband here faster but we will not have to deal with immigration for another 2 years. He applied for his SSN, Drivers license, and jobs as soon as he got here. So I have no regrets with choosing the CR 1. Ultimately, you have to choose which visa best fits your needs.

Good luck! good.gif

Removing Conditions on Residency General DiscussionTime between NOA1 and biometrics appointment letter?

If you miss your biometrics appointment, your case will be considered abandoned.

Is this true??? We have been having problems getting anything in the mail from them and I believe we have missed or will soon miss the biometrics.

Removing Conditions on Residency General DiscussionReceipt Notice?
Same thing happened to me. I called about about a week ago and still have not recieved an NOA1. I have made an info pass appointment. You might want to try that if you don't receive it. They will stamp your husband's passport.

Removing Conditions on Residency General DiscussionMore Evidence Request....

So i'm going to send everything I sent the first time again, get anyone who has ever seen us together that I can think of to write a letter for me, if I can get like 20 letters from people attesting to the fact that we're legit and that isn't good enough then I guess we'll just move to England

You could always invite them over for tea! hahah I assume they would interview you if they didnt find the evidence as sufficient and I am sure after nine years of marriage they couldn't stump you in an interview!

Removing Conditions on Residency General DiscussionMore Evidence Request....

I filed for removal and the response was that they needed more evidence of 'Significant financial responsibility' for the term of the marriage.

Did you file as divorced or with your wife?

We had joint medical and car insurance, joint phone contracts, joint car loan, files our tav returns together to show all this, and they still want more? So i managed to get copies of our joint bank account statements to send in, will this be enough on top of what i sent before?

It could be that they lost your financial documentation. You may want to send copies of what you sent the first time along with joint bank account statements. Did you have joint credit cards?

I don't get why the immigration service see commitment and a healthy marriage in a financial way - its very annoying! If thats how they view it, anybody could come into the US and just get joint financial responsibilities, and viola! you're in! It sucks!

Well if it's a fraud marriage most people are not willing to comingle their finances. That is why USCIS asks for proof that you are living as a real couple.

Removing Conditions on Residency General DiscussionEarly Biometric Appearance Issue?
My husband did a walk in yesterday in Raleigh, NC and they didn't even look at the date or question him as to why he was trying to do biometrics 2 weeks before his scheduled date. Someone asked the same question about early biometrics in San Francisco and it seems they were able to do it. Click here

I don't think it affects your application negatively. More likely it helps you get your card sooner. Good luck.

Removing Conditions on Residency General Discussioncan personl check be used to file I-751?

Hi,

I am just wondering if a personal check can be used to file I-751? Or do I have to buy a money-order? If money-order, can I get it from say, Western Union or Walmart? Thanks.

I used a check and had no problem. The good thing about use check is you can see when they cash your check and know your NOA 1 is on the way.

Removing Conditions on Residency General DiscussionChange address before removing conditions on residency???

Hi everyone.

Received my 2-year green card last August 12, 2009..
Move to a new house with hubby later that year. Now I am due to remove conditions on my residency. Notice of requirement to file from USCIS was receive in our old address which happened to be my mother in law's house now.

Do I file for I-865 first? I am kind of confused.

Thank you in advanced for your info... Be waiting.

Cloe :help:

Both the permanent green card holder and US spouse must inform USCIS of change of address.

Click here for instructions. This is supposed to be done within 10 days of moving.

Removing Conditions on Residency General DiscussionI-751 troubels !!

hi all;
i need some help plzzzz ! i moved to us on march 2008 on a (k1 visa )...got married and i got my 2 years GC ..i have been in the states for 3 years now ! last january 2011 i filled I-751 for Removing conditions.. to get 10 years GC ..we filled jointly me and my wife i got a letter from uscis to go get biometrics wich i did .and they sent me a notic says that i am allowed to stay and work in usa for another year while i am waiting for my GC ... but last week i found out that my wife wrote a letter to Immigration and went and talked to them about us cause our relationship is not going good and she wanted them to call us for an interview and she wanted it separetly i don't know what she is planning on doing ! but we still married and we just filled taxes together ... but i don't live in the same house with her right now because of my job and we did tell immigration about me not living with her when we filled the i-751 ...i just wanna know if what she did will cause me a problem? and could she get me deported ? and can i get my GC after what she told them about us having problems ? Any answers will be appriciated !thank you !

Yep, thats a big problem. You either have to be in a current marriage or divorced and it seems like your wife is going to tell the immigration officer that your no longer a couple or something worse. It seems like you have problems in the marriage and that wil be a problem for your I-751.

Read this:

If you are still married, but legally separated and/or in pending divorce or annulment proceedings, and:

-You filed a waiver request. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment (if applicable).

-You filed a Form I-751 petition jointly. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment and a statement that you would like to have your joint filing petition treated as a waiver.

Upon receipt of the final divorce decree or annulment within the specified time period, we will amend the petition, to indicate that eligibility has been established for a waiver of the joint filing requirement based on the termination of the marriage.

Really? Charlotte office has always been busy. My husband was there at 7:45am this morning and there were already 10+ people in the line. The lady said they had 121 appointments today.

This is the 2nd experience for me in last 6 months. My mom also had her biometrics done early and they gave us hard-time then too. I am not complaining because I know this office normally is very busy.

I almost didn't even want to try with my husbands bio but he was eager and persistent (so glad :) ).

Next time go to Raleigh. It's dead. You can hear crickets!

Oddly there was never anyone at the Raleigh office when we went.

The stamp they ought to give you is an I-551, which is equivalent to a green card. The DMV should accept that.

The I-551 was accepted for a drivers license in North Carolina. If they give you a hard time ask for a superivisor.

Is there anybody living in Texas?? I'm having a hard time trying to renew my driver's license bc they won't accept the extension letter. How am I supposed to renew my license then?? I'm trying to get an infopass but it's not showing anything on the website. If anybody knows how to renew let me know please.. My green card and drivers license expires on Sunday =( Thanks Juliana

Make an info-pass appointment and have them stamp your passport. You may need to tell them you didn't get your NOA1. They seemed hesitant to stamp my husband until we explained to them that we didn't get NOA1 and have no proof he is in the country legally. The stamped passport was accepted in North Carolina and we were able to renew my husband's drivers license.

They threw it out?!?!? I would've been scared :P

Yea after one year trying to get a green card it was a little upsetting to see them throw it out so haphazardly. Anyway we completed our early biometrics today in Raleigh, NC. They never looked at the date or asked us why we came early. I sat in a waiting area while my husband completed his biometrics. This was our second trip there and again it was empty. It took about 30 mins and only because they had computer problems. I did see a security officer ask a woman with a crying baby to leave, but other then that everyone was very pleasant and helpful.

My husband and I had an infopass appointment today in Durham, NC. We only waited about 5 mins and everyone was very helpful. At first they did not want to stamp his passport, but we explained that he will loose his license in 3 days and has no proof of legal status and finally they stamped it with his I-551 which grants legal presence for one more year. We were able to take his passport to the DMV and get his license renewed, but still no NOA-1. We learned at the infopass appointment they had the right address for me but not the address for him, so they have been sending our paper work to the wrong address.. Not really sure how they did that when they are the same address....
